Zambia has a functional constitution in place, Lungu tells Parliament

Parliament heard yesterday that the Minister of Justice and Attorney General will advise on the roadmap and steps to be undertaken on the draft constitution once the document is tabled before Cabinet.

Government has maintained that there is a functional constitution in place. Acting Leader of Government Business in parliament Edgar Lungu says government would depend on the learned counsel of Justice Minister Wynter Kabimba and acting Attorney General Musa Mwenye on the roadmap to enacting a people driven Constitution.

Mr. Lungu who is the Minister of Defence said the PF Government is keen to follow the legal framework without ‘injuring’ the Zambian people.

He said this when he presented a ministerial statement in Parliament today that government is fully alive to the time-frame and will give Zambians a people driven constitution.

Last week, United Party for National Development (UPND) Mazabuka Central MP Garry Nkombo raised a point of order to find out an update on the draft constitution and which level the document was at.

Mr. Lungu reiterated that the issues of the constitutional making process is not a dead-one as government was addressing a lot of issues among them education, health, roads and others.

He added that the PF Government is determined to implement and fulfill its 2011 campaign promises as others have already been fulfilled.

He denied that the PF Government is changing goal posts on the draft constitution document but that the Zambian people would judge for themselves.

Mr Lungu said Zambia still has a functional constitution that can be used at the moment untill the draft was ready .

“The current constitution is still functioning and we can use it until the new constitution is out,” Mr. Lungu said.

Meanwhile, Deputy Speaker of the National Assembly Mkhondo Lungu yesterday afternoon threatened to send the entire members of the executive bench out for allegedly making noise in the House.

Mr. Lungu in guiding the House observed that the front bench had made noise for the second time translating that it had breached the parliamentary procedures.

“Please, order, order…..You risk the whole bench on my right being sent away from the House. This is the second time l’m saying observe order in the House,” the Deputy Speaker warned.

Meanwhile, the House also heard that Government would consider increasing the Constituency Development Fund (CDF) allocation to rural-based constituencies.

Finance Minister Alexander Chikwanda informed Parliament he was concerned that rural-based constituencies were receiving the same amount as those based in urban locations.

Mr Chikwanda said Cabinet would seek the guidance of parliamentary committee on the matter to enhance an all-inclusive governance approach.

“Allocating CDF equally to all constituencies is not fair, as rural constituencies face serious challenges compared to urban-based constituencies. We hope the relevant parliamentary committee will guide us on this issue and how we can go about it to ensure there is fair distribution of resources,” Mr Chikanda said in response to a concern raised by Chadiza MMD MP, Allan Mbewe.

And Deputy Speaker of the National Assembly Mkhondo Lungu advised MPs not to be derailed by comments from members of the public on calls for their increased emoluments.

Mr Lungu said this when he made a ruling on a point of order raised by MMD Mafinga MP Catherine Namugala who expressed concern over reactions from the public indicating outrage on the issue of increasing emoluments for MPs.

“Don’t get derailed by comments coming from outside, I have also heard them but if you concentrate on them, we will not function as a House,” Mr Lungu said. “We know the challenges we face in the constituencies and so we should not be deterred by attacks.”

Parliament would resume sittings in September ahead of the presentation of the 2015 national Budget.

Winter kabimba is the most learned lawyer in the PF regime and they depend on him on the road map for the new constitution and at one time Kabimba was heard saying Sata is the most intelligent person in the PF cabinet. this PF cabinet is a joke to say the least, we need to vote people who are coordinated and know what they are doing than these retards who only wanted to taste the coridos of power then after that they go black out, shame to mother zambia.

  2. Zambia has a dysfunctional constitution in place- one that is open to abuse and interpretation to fit narrow selfish ends.Rewrite a new progressive one with objectivity asap.

      PF are a problem, they have been yapping from without for almost 3 years now.
      Tired of the debate which is being held “hostage” by the PFs piglet cadre party.
      They failed in 90 days and have continued to fail in their 3 years tenure of govt.

    The cabinet is truly a joke! Imagine the deputy speaker being on pains telling them to be quiet as if he was a class monitor in grade 7. Mr Lungu we know there’s a functional constitution but is it functioning well? A “sunka mlamu” can take you places, but if you have put in some investment for a new car, you’d be painting a wrong picture of yourself if you don’t go ahead and purchase a new car.

There is no healing massage coming out from these weirdoes, every statement made is comical and Zambians should be swift in removing them from high office.   9. lungu does not inspire in his talk. the difference between lungu and kambwili is that one is fatter than the other but their brain capacity is similar. I expected lungu to be more articulate and subtle with his utterances reflecting someone who attended full time education at UNZA but oh boy I was wrong. even when pf were campaigning in 2011 they new that there was an existing constitution. it is its weakness that zambians demanded for a new one but lungu sees nothing wrong. oh boy

    For how long is this situation going to continue? The only thing that is happening is the ministers lining up to visit Kazimu.

    • How can you be confused by such a simple issue? Lungu is acting leader of government business in Parliament as Guy Scott is here in the UK. NOT acting President!

  13. Is Lungu the acting president. I thought Guy Scott will act as president since he corrected himself last week. He further said that the constitution was misapplied by his boss by not allowing him to act. ‘big brain’ Kabimba should help out.

  15. A number of issues:
    1. Our current constitution is old and is based on the old British constitution we inherited 50 years ago; one that did not benefit Zambians, but heavily favored the president/prime minister/governor.
    2. The British government has encouraged us to NOT follow the old British ways and to chart our own course.
    3. PF was elected into power because of the promise of the new constitution.
    4. We will only see development if we can hold our leaders accountable — something the current constitution neglects.
    5. We have used the old constitution for 50 years and it has not brought development, maybe we should try a new one.

    We will forever remain poor.

  18. As I have stated before, Sata has mad dementia. To make matters worse, a week before he was secretly evacuated to Israel via South Africa, he suffered a stroke that has left him speechless! The man cannot talk any longer and they have brought in a speech therapist to help abena Charlie Kays Mwango to regain their vocalizing ability. Though the problem remains that even if he regains his speech, mad dementia will still proof hard because all he has been saying from those who can read lips is that, and quote: “Teine wa mwipele nomba finshi aipaila Kazimu wandi?” In the house of Satan****, it is agony sure. I beg to be corrected is it true that Kabimba has never ever won a case since he became a lawyer if that is true i feel for zambians when Government depends on him for legal advice please correct me if i am wrong, and what happened to the same Kabimba when PF was campaigning that they just needed 90 days to have a new constitution he never advised them that it is impossible that’s politicians for you only when it suits them.

Dear Mr Lungu, it’s interesting that the PF party have advised you of their ability to deliver on Education, Health etc. Currently Mr Scott is releasing press details of his money laundering schemes with his Scottish mates. Apparently, Scotland is offered our hospital services without any formal selection process. A chap called Bennett has already lifted £6Million from our educational system for an under-researched e gadget he has built out cheap plastic. Over the weekend we tried posting a critic on this e learning project, on this website, but our comments were blocked, (I am doing my MA in digital Media and just completed research and created a digital artefact proto-type for Blended Learning). Take control of money launderers please!

  24. Come on you guys be realistic. What do you expect the guy to do? The guy is walking, has not eaten and has just been promised a bag of mealie meal from STATE HOUSE what do you expect him to do? And in his head he thinks he’ll be going to STATE HOUSE all THE time. The guy will at least eat for a few days.
