Former Zambia Railways Limited (ZRL) Chief executive officer,Professor Clive Chirwa yesterday closed his defence
in case in which he is charged with his former director of finance Regina Mwale, an accountant of High Ridge in Kabwe with abuse of authority of office, after the duo allegedly authorised payment of K72,282,210 to Fallsway Apartments for Chirwa’s accommodation.

Prof Chirwa told the court that he lowered his standards to zero by staying at Falls Way apartments instead of a five star hotel.He said that according to the job he was doing ,he was entitled to be stay at a five star hotel.He said it was for this reason that he wrote back to the former ZRL board chaired by Mark Chona telling it that he could not afford to further lower his standards when he was charged for lodging at FallsWay.

Prof Chirwa said that he told the board that he was not asking for too much to continue staying at Fallsway until his house was renovated adding that the K200 extra which was paid compared to the accommodation he was
entitled to was not worth disturbing his peace.

” I lowered my standards when staying at Falls Way apartment because my required accommodation according to the job I was doing was a five star accommodation but I went to zero-at this zero star accommodation per month.It was K44, 000 les than a five star hotel” Prof Chirwa said.

Prof Chirwa said that he also told the board that ministers, permanent secretaries and other government officials had lived at the apartments and one of the ministers was even his neighbor and wondered why it was
an issue with him.

He said that the amount he was paying at Falls Way was less than what he was paying at Intercontinental hotel where he had earlier stayed,as he would have been paying K275, 000 per month for three rooms to accommodate his family.He said that he had no idea who was paying for his accommodation until he went to find out from the ministry of communication where the minister told him that it was ZRL.

Prof Chirwa further told the court that he only became CEO of the ZRL on January 11, 2013 after he signed a contract which means that he could not be found wanting for recommending Clavel to train ZRL employees
because he was CEO in waiting.He said that at the time he recommended Clavel, he had just been given
an offer to be CEO and he was not yet appointed.

This is in a matter in which Chirwa 58 of Ibex Hill is jointly charged with his former director of finance Regina Mwale 50 for abuse of authority and failure to disclose that Clavel Incorporated Limited, a company he had recommended training ZRL staff was his company.

Prof Chirwa who gave evidence on oath but did not call any witnesses.

Chirwa’s co-accused Mwale is however, expected to open her defence today and will call one witness apart from her evidence.Trial continues today.

  1. Leave Clive alone. We wasted money on Chikopo from Malawi for doing nothing and staying at a 5 star hotel which is even more expensive than Fallsway. Yes, Clive lowered his standands. Let him go. You are wasting tax payers money judging him. Chikwanda’s company renovated state house and he is not judged for conflict of interest.

      If Clive broke the law, he then committed an offense and has accordingly been charged. There is nothing personal here

      Only the courts of law can clear him whether he lowered or exceeded his standards

    • It puzzles me how the state is wasting time prosecuting someone over rent at some shabby looking place. People are dying on our roads everyday and we are more worried about recovering rent money than the railway network this man came to design.Are we so dull! Indeed how much did Chikopa accumulate during his stay at a 5 star hotel over some silly tribunal. Who paid for that ministers who was chirwa’s neighbours.As long as we waste time and resources on such triviality we shall always remain poor and underdeveloped.

    • Although I have no proof that Professor Chirwa’s parents came from Malawi, there were a lot of Malawians in Mufulira working on the mines as clerks, which were well paying jobs by the standards of those days, because there better educated than Zambians. I had a Malawian neighbour in section 5 drinking tea with bread every day of the month when my family drank tea with bread at the month end on paydays. Since Professor Chirwa had presidential ambitions the infamous presidential clause would have come to haunt him as allegations as above of being a Malawian began to surface.

    • This man should not slag Zambian hospitality like that when here in the UK I doubt if he even completed paying for his mortgage for his house valued at less than £500,000.

      Its being ungrateful on his part for him to say over £8 million spend for his accommodation is nothing. With that amount of money, he would be a property millionaire here in the UK.

      More over what Prof was being paid in Zed is far more than a salary of at most £65,000 per year for lecturer with a PHD and slightly more by £2000 for a professor.

      My advice to Prof, Chirwa, is , he should humble himself for the Zambians to help him out this sticky situation he caused himself.

      From his rant Prof Chirwa does not mean well for Zambia. Its really a shame because he is tarnishing our image as qualified…

    • Prof ‘s problems started when he wanted to eat alone and deny other PF hyenas lucrative deals. What he did not know is that PF is full of minions who live and breath corruption starting with Sata their leader himself.”There is just no honour amongst thieves”so goes the saying.

      What has the whole $750 million meant for the railways been spent on? There are no new trains , no new rail tracks, and Tazara is bankrupt.

      By the time PF leaves power, there will be no railway operating in Zambia. Roads will be full of boreholes. People will be dying like flies due to lack proper health care.

    • @Cindy. Indeed whether Chirwa’s parents came from Malawi or Scotland for that matter should not be an issue. But you have a constitution that does not allow the VP to act even for a day as President because his parents came from Scotland. You have heard or read some people suggesting that Chirwa should take over from HH but how does he become president of the country in the event that UPND wins the presidential elections because the constitution does not allow him to become president. That is the issue.

    • UPND does not condone such characters at all. Once Prof realised how serious HH is he ran away to join PF a party which attracts mafias like him.

      Its actually PF who want Prof Chirwa to stand as vice president to Mulenga Sata.

      UPND has no time for such characters. Thats why he could not fit in.

  4. Prof. Chirwa’s point is in total conflict with logic. One would assumes that he lowered his standards by jumping on the plane to travel to Zambia in the first place. I hate to comment on a matter that is in court but note that my comment is on the matter above and not the one in court.
    I want to believe that when Clive got onto the plane to Zambia he would have imagined that was the start of ‘lowering the his standards’ and anything that was to follow was part of the same package. All this would have been in the spirit of sacrifice for his country, a process he would have embarked on after making a well researched and informed decision as a Professor, Sic!

Didn’t he pause in front of Henshaw Hotel and claimed it was his bangalore and even leaning against a Toyota Anvesis in such a manner that he meant to hide the car’s logo! We want people from the diaspora coming to ZED with a heart of patriotism and not one of ripping even the little that has remained of our resources! Surely, if his conditions required that he gets accommodated in a 5 star hotel, and he goes to a “0” or no start lodge, doesn’t that symbolise lowering his approved standards under his contract? What amazes me is how we, as Zambians, can support the mistreatment of our own under the “Zambian sun”. Its unacceptable this kind of behaviour.

    • Life in itself is a struggle and the dimensions of our struggles vary depending on the choices we make. MAN we serve remains our greatest enemy. If we choose to serve MAN with humility we normally leave a good legacy. Mandela chose to serve Man not knowing how long and hard his journey was to be (A long walk to freedom). Dr. Martin Luther King never arrived, he paid the ultimate price and others have reap from where he sowed. Mandela (Prof. Chirwa’s hero) lived on Robben Island during his service for his country later arrived in The Union Building for The Presidency, TWO VERY CONTRASTING STANDARDS. Clive has shown interest in becoming President of Zambia but cannot live in FallsWay apartments while he serves his country as ZRL CEO. It beggars belief that he failed this simple test.

      Please learn to think objectively and stop this blind support for a conman. Do you really think Clive with his overrated ego would have stayed anywhere with a “zero rating” of standards? Not having been rated yet, is very different to being rated “zero”. Do you really think Clive would have stayed at Fallsway if Ministers and others he wanted to rub shoulders with were not staying there? Do you really think he would have hesitated to move to Intercontinental if his contract said so and Fallsway didnt meet his standards? Read his defence, in one line he says “my contract didnt start until January” so there was nothing illegal recommending Clavel without declaring an interest. Should we also say he should pay his bills at Fallsway until he signed his contract?

      I beg to differ! You are the one who dont get his point mind you this interpretation should be taken into leagal context thats why most of you are able to simply miss his analysis!
      His decision to offer his service to mother Zambia are purely personal and emotional which can never be likened to standards and configurations!

    • @It’s a Worry: I do not blindly follow people, and am a very objective person. But what is happening to Chirwa disgusts me. Day in and day out millions of dollars are leaving Zambia through undeclared taxes; many foreign workers are paid loads and their pay does not even pass through ZRA. Chirwa could have been treated differently; and if his contract said what he said, I am inclined to accept his way of reasoning. We can blame the person who drafted his contract or the then conditions of service. Concerning is levels of patriotism, that is subject to debate. Patriotism is implemented differently by each citizen; and its between each individual and their God. I could not judge him on that.

      I really do not see why you have to be disgusted about what is happening to Chirwa. He had no intentions to serve Zambia but to serve his pockets and personal ambitions. It is not a coincidence that he overstayed at Fallsway or indeed in Lusaka. An honest man of Clives academic backgorund and status (especially the one he wants us to believe) would be guided by strong, or at the very least, good principles. What principles where at play when he tried to use his defunt company clavel? What principles were at play when he as CEO wanted to sit on the procurement panels? Clive has never been anywhere near CEO level in a company of any standing. He had no clue about corporate management but was prepared to use his “UK status” and shoot anyone (board) in his way in order to get it

    • Am sure it’s everyone’s right to express their opinion which might be different from other’s. In your other posting Cindy you are in defence of Chirwa’s heritage and all that. I can appreciate if Clive is your friend but I was just looking at this issue from an objective point of view (the way I see it). Am not a legal person but I looked up the definition of service (the action of helping or doing work for someone-in this case the Zambian public) which should not have been linked to ‘lowering of one’s standards’. I think Clive has a lot to give to Zambia but there was/is a ‘missing link’. Note that although his decision to serve was personal, it lends itself to public scrutiny.

    • @Its a Worry: my disgust does not relate to the “principles” that Chirwa did or did not follow. He may have made a mistake, and the court will judge that. My disgust relates to the way his own country has been treating him. This issue of accommodation could have been resolved by now; and he could have been asked to repay if that was necessary. But not to drag the case for the sake of it. We, as Zambians, do not treat each other well, in our own country, this is what disgusts me. I am not supporting his misdeeds; but surely, the man is our own son; he could be treated better for his mistakes.

    • @Rigoe Sanchez: Spare your utter disgust at the way Clive Chirwa is being treatment by his own countrymen. First I take the premise that all must be treated as equal before the law, Clive Chirwa included. Now there is a law in Zambia against corruption under the ACC. Clive Chirwa’s behavior and activities during the brief time he served as CEO of ZRL have been interpreted as abuse of authority, which is corruption.

      Therefore, Clive Chirwa is not being treated any differently from the way any other Zambian would have been treated. Let him face the music. Otherwise the ACC will be creating a precedence that some, the likes of Clive Chirwa, are more equal before the law. The ACC cannot afford to apply double standards just because the person involved is a Clive Chirwa.

      Am not attacking you or challenging you in anyway just trying to make a point from a more different practical angle, otherwise, your other contribution on this topic are were versed!
      Lets see Clive as a victim here, ever tried to look at the dossiers of those accusing him? What is their motive? Could there be any personal comflicting factors? Has there been any similar incidences in the past? How were they handled and by whom? What has made Clive’s interesting? How many more CEOs have “squandard” Grz’s funds and the gong sounded this loud?
      Until all these questions and many more are soundly answered….. Am afraid I will find him innocent and will never, never blog over personal issues not that you have, but just saying.

    • Yes Cindy I understand your arguement that there is a wider/bigger problem than just confining to Clive but what makes the Chirwa case of interest to me is its effect on the diaspora-local Zambians relationship which as I understand is unhealthy at the moment. HMCS went to Botswana and did not help this situation, was in the UK and damaged it further, a meeting I attended. Clive will have not helped. Am sure HMCS benefited from having lived in the UK and our exposure in whatever way makes us valuable to our country as nurses, engineers, lecturers, teachers, doctors, carers, factory workers, cleaners. We are a collective valuable human resource Zambia would use. What a force we could make to all go back and sacrifice for Zambia.

  6. Clive Chirwa is a mental case. The standard he claims to have lowered was his own standard, not that of the ZRL BOARD. The man created his own standards; caring less how those standards were viewed by the BOARD. At issue is that he was the beneficiary of the standards he had created for himself which were at variance with the BOARD.

    The fact is even though he wrote a letter to complain to the chairman of the BOARD, he cannot be said to have been loyal to either the BOARD or to its chair. By definition, that is abuse of authority. The fact that other people, probably in comparable capacities, were staying at Fallsway is no mitigation.

    His argument for sub-contracting Clavel is shamefully cleverly and absurd. Please save us the agony.

  7. This lumpen cannot say his standards were lowered. We all know that in Mufulira where he grew up, his father was a cook pa musungu and he grew up in a servant’s quarter. He was just another poor boy!!
    his aged parents live in a shack in Kabanana….more poverty!!!
    His children are above 21 and would not be counted as dependents by any sane organisation.
    The madam is old and infirm and has never been to Zambia. Why would she come now? So he is a liar and a cheat.
    By the way, we are still waiting for him to renounce his citizenship?

    • His past and what his father did is irrelevant to the argument. Chirwa is a Zambian, and if his own people can despise him as you have in your comments, then this country does not need to develop. How can lodging issues be so pertinent to the freedom of a Zambian? You wanted him to be staying in a shanty compound for him to demonstrate that he is patriotic? I blame Mpezeni and Gawa Undi; your own son being messed up like this and you are quiet!!

I just want to counter Mwalas ranting over Prof .Chirwas parents.The father worked as a personel officer and was highly respected for being man of the people.Infact my parents named me after his father as he was a father to all miners families especially when you go to changanga in Kantanshi near Shinde.Section 9 in kantanshi had no servant quarters that our brother is ranting about.

  11. Please people do not blame Mr chirwa about the accommodation he was provided, government was aware where he was lodging and how much was being paid. Every position has a job description and conditions of services. What the government or ZRL should have done was to provide alternative accommodation before he (Mr Chirwa) took up his position whilst waiting for the Kabwe house been renovated. What happened is that after some board members were prevented from having unnecessary meetings they started working against him and they then brought up the issue of his accommodation and other issues which they should raised in the first place. I am not justifying that he should having lodging at the fallsways apartment. So we should not entirely blame mr chirwa, we should also blame the system.

    • Am sure most Zambians know what a 5 star hotel is and Zambia’s development is moving at a fast pace now, a process the developed world might have gone through. The problem the Chirwa factor has created is widening the ever increasing ‘distance’ between the Zambians in the diaspora and the fox at home. Suspicion is getting even bigger. I am in the diaspora and intend to get back home to be a part of something one day therefore this issue affects me. My belief is that we have left home to learn with a view take back the knowledge and adapt it. Professor Chirwa’s behaviour does not represent this.

    • Really the issue is not about one Clive Chirwa’s perceived personal standards. It is about the terms and conditions of a Zambia Railways CEO. If the place Chirwa was living in was not in his terms and conditions of service and not approved by the board, then he has got it all wrong to think because he is a man of very high standards he can live wherever he wants irrespective of what the terms and conditions of a ZRL CEO say on accommodation.

    • @the doc: Exactly the point. If Prof. Chirwa had been in compliant with the terms and conditions of his service, he would have no case to answer, especially before a court of law. That alone should have sufficed as his defense. Unfortunately, he allowed himself to live large and at variance with his terms of reference; which is why he is being perceived as having abused his authority.

Well let’s look at the bright side. ZRL raised his standards from a Toyota Avensis to some expensive 4×4.   18. So let me get this right, the most esteemed internationally renowned expert, Prof. Clive Chirwa’s defense is that:

    1) He as CEO (for God’s sake!) had “no idea” who was paying for his accommodation and was surprised to find out the company HE WAS HIRED TO MANAGE was footing the bill? Some CEO.

    2) He “suffered” in what most Zambians would consider a mansion because Fallsway was K44,000 less than a five star hotel. Sure, Clive it’s always possible to SPEND MORE on yourself, but that’s not what the CEO of a LOSS-MAKING public company is meant to do!

    3) Other GRZ officials lived at Fallsway and one of the ministers was even his neighbor. Really? Now the most esteemed sounds just like a drunk schoolboy who tells his parents “everybody does it”.

  19. In Zambia we have a situation where inferiority complex towards those that have lived out side Zambia and return to work in Zambia. The first syndrome is pull him/her down because they left Zambia but have now come back( as if its an offence to return). Worse still is for us who have lived in more civilised countries to point out short falls of the govt of the day is seen as enmity with the state. In many cases we really lower ourselves as we return to our home nation (not that we demand spercial treatment), but deserve to be treated as equals we those at home. The casev of prof. Chirwa is typical of treatment we get which begins at the air port as we arrive, bags searched as if suspects of peddlers illegal contrabands. We are still uncivilsed towards each other.

  20. Prof Clive Chirwa is the dullest professor I have seen in my life. He does not understand politics. Firstly he put himself in the firing line by declaring that he wanted to run for Zambian presidence. PF realised that he was a political novice and they enticed him with ZRL highest position with the intention of finishing him. He foolishly accepted this. When he got into the seat and he started enjoying the fruits, he started manipulating the system thinking because he is a professor everyone will say igweee. As though this was not enough he goes to say he lowered his standards by staying at that hotel. This is an insult to Zambian tax payers. Hope you reap what you sowed prof.

    • The doc, Chirwa says he lowered his standards! Not, Zambians or ZRL lowered his standards. So he decided to do so. The question is, why are those low standards so costly?

      In a sentence, EXPENSIVE LOW STANDARDS is what Chirwa settled for.

It is indeed hard to establish weaknesses or faults in one Clive Chirwa given that the public is not 100% privy to the contract he was offered as he purports….Most of these so called MDs are entitled to certain conditions which they expect to be honoured by their employers. On the other hand, we don’t know exactly what Chirwa’s contract stipulates if he was to be in a place where there are no 5 star hotels… I guess the issue here is more to do with the way Chirwa has responded to the allegations which obviously has made most of the people including myself, wonder if he has any amount of respect by stating that there was nothing wrong for him to lower his so called standards…. I expected Chirwa to be more culturally sensitive in the manner he responded to the allegations..

    Freedom of Speech at its best- We also thank you for the opportunity to comment on your articles. However, you should definitely do better in editing, managing or curtain certain bloggers ( repeated offenders) whose comments are always deemed to be offensive, intimidating, insulting for a certain race, colour or ethnic origin.

    Mushota should be categorised as a Repeated Offender, blocked from commenting, period !!
