A Kasama housewife has been convicted by a Kasama High court for causing the death of a baby that was strapped to the back a woman she was fighting with.Presiding judge Petronella Ngulube sentenced Alice Namusukuma, 28, of Musenga Townhsip in Kasama her to five years imprisonment.Namusukuma was initially charged with murder but the charge was later amended to manslaughter.

Particulars of the case were that Namusukuma on March 27, 2013 murdered baby Patience Chilufya as she fought a suspected rival for her husband’s affections only known as Thelma.

The chitenge with which baby Patience was strapped to Thelma’s back in became loose as the two women scuffled leading to the baby falling to the ground head fist.

Soon after, the baby’s condition deteriorated quickly as she developed a high temperature and swollen head.

She was then rushed to Kasama General Hospital where she later died. A postmortem indicated the cause of death as brain hemorrhage secondary to a head injury.

Namusukuma was convicted after her unequivocal plea of guilty but pleaded for leniency through her lawyer Keith Katazo as she was a first offender who had readily pleaded guilty.Mr Katazo said his client was also remorseful and deeply regretted her actions.

Mrs Justice Ngulube however, chided Namuskuma for her lack of wisdom and impulsiveness.

“The convict due to her lack of wisdom and impulsiveness attacked a person who was carrying a baby on her back and this resulted in the baby falling to the ground and her untimely death.I therefore, sentence you to five years imprisonment with effect from the May 3, 2013,” she said.

  1. Babies should be carried in the pram not at the back of anyone

Which normal person carries a baby at their back? You must be joking, the mother should be charged herself with negligence

    #unbelievable

    Thanks

    • when you were carried on the back of your mother and you have just learnt of prams in Europe then you want to boast . ifya kumonena kubukulu na fyena awe sure

    • The mother of the baby should be imprisoned for child endangerment! She should not have been in a fight with a baby on her back. Bush Court justice!

    • @Mushota, so why are baby back carriers being sold for if not for people to carry babies on their backs? One may use citenje or a harness but all are achieving the same result. Mushota, your levels of primitivity are shocking!

    • Actually, even the western countries have researched and found that there are positive social and psychological developments in babies who are carried on the mothers’ backs as compared to babies carried in prams. For this reason, most moms and Dads prefer to carry their babies on their backs or front. Hence the introduction of kangaroo wards in maternity wards in hospitals especially for pre-mature babies.
Therefore, the tradition of carrying the baby on mom’s back is superior to prams.

  2. Physically attacking a lady who has a baby on her back was wrong…. Very unfortunate that the baby had to die under this unfortunate circumstance. May Baby’s soul rest in peace.

  3. @ Mushota the with some Zambian when they go out of the country they reject there tradition as if they were born from Europe or uk, why are you not proud with your culture? muzungu will never and can’t behave like you, you claim to be educated but very backwards.

    • This same ka Mushota with her big mouth who hates everything Zambian but is always follwing Zambian news? Rather confusing if you ask me. Can you please restrict yourself to European blogs and let us wallow happily in our backwardness…Mushota mxxm

  4. Nsanje mai gurui! By the time you come of prison, you will find mai nini has already taken over your marriage and will have three children with your former husband. May the Soul of the Baby Rest in piece

  5. Imwe mwebena Kamotole, you still have old manners of fighting over men! Infact the man you were fighting for is just a drunkard! Why waste your energies over a man who is not sincere! Remember, AIDS is real through such characters of men who are not sincere you can get it. It is long gone when men used to count how many women the man has known!!!
