Brigadier General Godfrey Miyanda has said that the current PF Government is not predictable and does not respect and observe the rule of law.

In a statement released to the media this evening, Brig.Gen Miyanda said that until the current Government confesses and tells Zambians the truth about the health of our President, it should be described as a “Government of Lies, for Liars and by Liars”.

In the statement, Brig Gen Miyanda also questioned the 14 days duration of President Sata’s medical checkup, asking whether it was normal a healthy person to undergo a 14-days medical check up.

Below is the full statement

GOLDEN JUBILEE 1: “GOVERNMENT OF LIES, FOR LIARS AND BY LIARS”?

It is said that democracy is the Government of the People, for the people and by the People. The characteristic of such a government is that it is predictable as those in power respect and observe the Rule of Law, especially the Constitution. I regret that the current regime does not meet this description of democracy but should instead be called a “Government of Lies, for Liars and by Liars” until it confesses and tells Zambians the truth about the health of our President.

Although the Government has now indirectly admitted what we already know, it devoid of details and hence the matter must not be allowed to rest until the truth, the whole truth, has been unveiled. There are very serious implications in having in office a President who is completely incapacitated but alleged to be working.

Is it normal for a healthy person to undergo a 14-days medical check up? Further what medical check up must a healthy public servant undertake at public expense outside the country? Surely in Zambia the University Teaching Hospital (UTH) is capable of undertaking this routine task; in fact even our private hospitals and clinics are equal to this task.

The point of this statement is to demand of our Government full disclosure about our President’s health. The Cabinet is either hiding the truth or is completely incompetent to carry out its constitutional obligations. As public servants Cabinet Ministers are answerable and accountable to the employers, the people themselves. The Cabinet, led by Vice President Guy Scott, stand charged of lying, abuse of office, negligence of duty, even a possible conspiracy to subvert or disregard the Republican Constitution.

It is a lie by the Vice President and other ministers to have been persistently declaring that the President is well and performing his duties. It is also more revealing for Dr Scott to state that he is not President Sata’s wife to know whether he is suffering from anything. By these words Dr Scott has denied President Sata more than three times! Unfortunately Dr Scott is President Sata’s “political wife”. The Cabinet Handbook describes the VP as the President’s “Principal Assistant”. In the National Assembly he is the Leader of Government Business, essentially making him the President in the House when the President is not attending. The way out is for him is to file for a divorce and get out of this marriage of convenience. But before we grant him the divorce he and his Cabinet have a lot of questions to answer now or in the immediate future.

If the President has been sick and has been travelling all over on medical grounds at public expense, we need a full disclosure of the medical itinerary and expenses involved as well as the list of accompanying personnel, government or otherwise. The VP, the Leader of Government Business in Parliament, must surely have this information at his fingertips!

I have had a second look at Article 36 as read with other provisions and I have strong reasons to revise my position and contend that the article should be deemed mandatory. This Article states as follows “36(1) if it is resolved by the majority of all the members of the Cabinet that the question of the physical or mental capacity of the President to discharge the functions of his office ought to be investigated, and they so inform the Chief Justice, then the Chief Justice shall appoint a board consisting of not less than three persons selected from among persons who are qualified as medical practitioners under the law of Zambia or under the law of any other country in the Commonwealth, and the board shall inquire into the matter and report to the Chief Justice on whether or not the President is, by reason of any infirmity of body or mind, incapable of discharging the functions of his office”. I contend that the foregoing provision impliedly suggests that the Constitution bars any person who is not of sound physical or mental capacity from continuing to perform duties as President until this state is resolved.

I humbly submit that by beginning the Article with the words “IF IT IS resolved by a majority of all members of the Cabinet…” the framers of the Constitution intended for the Cabinet to view seriously the health of the President who is Head of State and Commander-in-Chief. The implication is that the office holder must at all times be physically fit and of sound mind to be able to personally discharge his duties and be able to coherently give directions to all government institutions as well as to be able to represent the country intelligently in foreign undertakings. You could have a president of unsound mind declaring war without realising what he is up to. Additionally the danger of other persons taking advantage of the office holder’s incapacity is ever present in this period of uncertainty. Cabinet should have carried out its duty without fear or favour, unless those in Cabinet are up to some mischief or are part of a conspiracy. It would be ridiculous to have a provision requiring the verification of the President’s state of health to be left at the discretion of those with narrow loyalties to their benefactor.

I thus assert that the Zambian Cabinet has reneged on one of their most important duties, that is the observance, application, protection and defence of the Constitution. The President has been incapacitated for a very long time, and the Cabinet has been aware of this. Zambians must now demand that Cabinet gives a full account of his condition. The account must state, inter alia, the President’s state of health, full disclosure of his itinerary to various parts of the world including India, South Africa, Israel, UK and USA, the list of those in the President’s entourage (government or otherwise), a bill of costs of each trip, and also the help or attention given by our own UTH.

Let us continue to pray for our President, his family as well as for the peace of our young nation, but let us not use the Jubilee season to refuse to observe the Constitution.

    • The General is right to question the period of this so called Medical Check up. A lot of us do medical checkups. All my medical checkups have lasted less than an hour, even the results don’t take 14 days. This is another lie by the ignorant people handling the presidency, who perharps have no clue about what a medical checkup is and it is even more shameful that the first lady, who understands these things could not even give counsel to the people handling her husband’s PR machine.

    • Brig. Ge. Miyanda is very correct. The PF government does not observe the rule of law. It’s like the run the country with an “I don’t care attitude”. Like they have nothing to lose. Thats why the PF lies in the morning, lies in the afternoon, lies in the evening and lies at night. In short, the PF lies all the time.

    • When it comes to Zambians with analytical minds, General Miyanda stands tall among them. Granted every human being has their own flaws, General Miyanda is one Zambian I would listen to when he talks, save for the one time I disagreed with him when he likened the gross abuse of public funds by the then FTJ (through the so-called slush fund) to a father distributing sweets to his own kids.
      If you read his articles with an open mind you will have no option but to give it to him for his incisive mind and pull-no-punch style or analyzing issues to the chagrin of many a PF cadre and sycophant.

    • The cabinet is paralysed. Anyone found to be an independent thinker will by lynched and set among the cadres. There is fear among those in government as to how they can continue enjoying the benefits of incumbecy.

      They say “once bitten, twice shy” but in Zambia we never learn. Levy Mwanawasa was clearly sick and struggling to finish interviews (way before he died) but we persisted and played hide and seek. We were bitten then but we are not “twice shy” because we put somebody in power who was sick and we are hiding the truth again. I think, after our experience in such things, we need to place a compulsory annual medical on the president once he/she reaches the age of 65.

      Otherwise, let’s put in place a budget figure for State funerals.

    • This is what I expect from an opposition leader. This is a powerful article from an astute leader. Good job comrade Miyanda. Its been a long time since I commended you for something. This is what I expect from the likes of Hakainde Hichilema. This is not the time to be silent and scared that people will misinterpret my demands. PF cabinet has been lying on this issue and they need to be held accountable. They are yet to acknowledge that Sata is sick. We all know he is sick, but no official statement has been made to the effect. Wake up UPND. MP’s in Parliament need to lineup and ask Guy Scott, the cost of the president’s trips to these medical institutions across the globe.

    • If I was Winter Kabimba, I would challenge the expulsion from govt portfolios. It may be that Kabimba was not fired by Sata but someone took advantage of the mental state of Sata and manipulated him to do this against Kabimba. Now I hate Kabimba’s guts to the core, but I am suspicious of the way he was hounded out. Sata is just too close to Kabimba to shame him like that. Kabimba and Sata are really the same person. Somebody is using Sata to do crazy things.

    • So as it is, every Cabinet Minister stands guilty of contravening or failing to effect -Article36(1) of the constitution effectively rendering this cabinet null and void. They are abusing their office by deceiving the nation on this matter, just to protect their jobs, salaries and access to the proceeds of institution aliased CORRUPTION!!! Their day is not so distant. Zambians after 50 years of independence can’t we take leaf from what freedom fighters did? I fail to see a solution that does not involve evoking the paranoia of my elders while motivating the youth to know they can do better… That innate cultural respect is tantamount to political apathy… we need a generational change and that is the best gift Zambia can give itself!

  6. Who said that if your marriage partner was a medic or health pro, you would be spared the indignity of what MCS is now going through? Christine Kaseba will be one of the biggest casualties of this episode … as she has repeatedly failed to rise to the occasion and tell her husband what is good for them and country. I think Kaseba’s position is a direct result of why she married Sata in the first place. Wealth and influence counted more than self respect and dignity.

    This would be a betrayal to the memory of one, late Dr. Chipili Kaoma, who in the early years of the Kaseba Sata union acted some sort of ‘pimp’ for lack of a better word. The 80’s were electric and King Cobra’s impact on late Chipili was real. It is not too late for Kaseba to redeem herself and country.

She stands to gain should Sata die in office..ie motive. At this point, Sata is not in charge of his faculties and as a medical doctor I would expect her to do everything in the interest of her husbands health. How do you explain her performing state house duties including delegating some to Chikwanda? She would like to be another Maureen Mwanawasa. She should have advised her husband to give it up and resign to go and take care of his health, but she is busy global trotting with a man who is as good as dead! One word, Greed!

  8. Dr Kasonde should resign on moral ground, all our senior Doctors must be walking around with their faces down with embarrassment. The term ‘medical check up’ or clinical examination is certainly no big deal for any Zambian be it the president to have it done abroad. Did Chella mean to say ‘medical review’…?…or used ‘check up’ to avoid questions like when was the president sick if he used the word ‘review’..?..Well whatever, whether ‘check up’ or ‘review’, it could have been done after the 24th October..
    The old man is under a medical ‘eye’ 25 hours a day since the madam is a qualified medical doctor, If the so called medical check up was done in November, March or July and anywhere, it couldn’t have raised any fuss..now Jubilee week..?

Gen Miyanda raises a critical point of cost to Zambia in taking this man all over the world at what ever cost, while a team of foreign doctors continue to be paid by poor Zambian tax payers. Lies without dignity to the rest of Zambia, secrecy and arrogance of taking Zambians as docile people to be stepped upon all over without any reaction. Lawyers and judiciary is quiet in a nation to provide national direction, all because Sata has taken to be a law in himself and no one dares to speak and remind him of upholding constitutional law.       Mpombo declared the President as fit as a fiddle, I ddnt. Wrong comparison, wrong topic and wrong accused. Article 51 says “the Cabinet and Deputy Ministers SHALL be accountable collectively to the National Assembly”. Scott as Leader of Government in Parly MUST issue a truthful Ministerial Statement and make full disclosure but not hide behind not being Sata’s wife!!!

In reply I quote from my statement of 1st July published by lusakatimes on 5th July “This sad scenario must make all of us be concerned for President SATA and his close ones and treat it as an emergency regardless of political views….Each one of us has an appointment with death…I appeal to our conscience in this unpredictable situation to come together, pray for the President and his family and nation to avoid lawlessness…” That was July, it is now October, lies have continued. Worse still you were accused of harming Dr Kaunda and Dr R. Chongwe in Kabwe. A soccer commentator sees more chances than the participating players.     • Can I believe that Miyanda and Hichilema are wishing Sata any good, or they think every Zambian is dumb? Is this about crocodile’s tears for the president? I believe it is only Sata who can speak for himself, not the cabinet. He is the president, and if he thinks he needs to resign or whatever decision he wants, no one will speak for him.   18. General Miyanda has spoken very well, the challenge we have in Zambia we do not have men and women made of steel in Cabinet who can raise to the occasion and challenge the status call. That what is happening is illegal President sata lost the call to lead this country a long time ago. Its not his fault , its illness but the fault of those people in Cabinet who have been given the responsibility to rule this country. its very simple what does the law say as General has rightly put it. I started calling for President SATA to address the nation in October 2012; but this is NOT a competition, all who have something to say are free to do. But for the record I first called for prayers for him on 1st July (LT 5th July) when UPND were daily teasing him though your statements hav now changed to prayers.See @ Godfrey Miyanda says at 24 above. It is also good if people repeat an important message over and over in the hope that the PF Cabinet listens and takes action and stops their lying that President is well and working!

  20. Brig Gen MIYANDA is such a necessarily citizen. His statement is a well researched one. His questions are very rational. He is against lies and not against the person of the president. He is against those who have the privilege to do what is needful on behave of the nation but have chosen to bury their heads in the sand. Loving your president does not mean you have to tell lies but the truth so that realism is applied by the people. Already some blockers tend to condemn the General and even insinuate that him does not get sick, why thinking like that when you are not told that the president is sick? Some say let pray for the presido for a quick recovery: I ask why quick recovry when we are not told that he is sick? This is the confusion any sane Zambian lik MIYANDA want avoided.

    Gen Miyanda has a lot more to offer to Zambia but it is a little selfish to come up with a statement every other month and sit back and admire oneself,

    This is not a criticism but merely a request on him to find a channel of offering more if this statement is anything to go by.

    It is like playing a sport where you show flashes of brilliance in spats but not consistent enough.
    It is a subtle way of me saying he is selfish and we are hungry for his knowledge. As it easy people tend to forget what he has to offer.

  22. my heart feels sorry for President Sata, he really fought hard to get to presidency now things seem not to work out for him-wish someone would allow him to rest from public office, he has the heart for zambia but alas it seems to be too heavy for him now

  24. I concur with the generals’s expose on this mediocre party of incompetents. They lied their way into government and gone and made a mess of the economy by spending money that they don’t have. The reason the economy has gone pear shaped is embarking on projects that were never planned for. (Evidence of this will yet manifest in full in the not too distant future). They threw the Sixth Development Plan out of the window, which document is a blueprint for development. Decisions with far reaching ramifications were made on mere whim. Future generations has been committed to ridiculous debt through eurobonds when monies could have have secured from prudent and creative tax regime from the mining companies. This cabinet is just a pack of docile men who have no point of view on governance…

  26. This is a prize moron. This is a democratically elected party in power. We already know Sata is unwell. What difference will it make if the details of his illness are revealed to us.

    Yes probably we are paying his medical bills, but that is in order.

    I Concur that we chase to establish if we are paying for other family members other than First Lady. I feel President Sata and his family should want members of the family to pay for themselves. Family members should not take seats on presidential plane but must pay their own fares on commercial airlines, they are all doing well and must show duty to the country.

    However we must draw a line under the need for disclosure on the nature of the illness. 2016 is near and we can change our votes in the alternative.

    • Zambia needs to concentrate on keep afloat our economy not political skirmishes. We need to work together, ‘tiyende pamodzi’, as has always been our motto. Now at Jubilee, we must reinstate that and kill off political skirmishes.

      To add, family members other than the First Lady must pay for ALL their costs of travelling with President Sata. President Sata must pay for the little kiddies!!

  27. Sir, you can talk but real action is not that easy. You were in government yourself and you were accused of the same things you are accusing the present government. Worse still you were accused of harming Dr Kaunda and Dr R. Chongwe in Kabwe. A soccer commentator sees more chances than the participating players. I pray that one day God allows you to rule Zambia and hope that you run an ideal government.

Dr Kaunda assigned his son Col Kaunda to deal with the matter who had apologized for not acting but promised to deal with the issue. He has never acted. Dr Kaunda and others published a false documents which alleged that I “was personally in Kabwe supervising the assassination”. They promised to sue me; they have never done so but I hear they have been paid.

  32. I don’t know why every opposition leader is so bent on coercing cabinet to reveal whatever is said and aspire in cabinet meetings. Even the most democratic countries like the USA will not tell everyone whatever they are doing just to please the disgruntled opposition. Any government has to consider security issues. I think it irresponsibility that is driving you to undermine Zambia.

    You were in the army: would reveal your plans and what you do just because you want to be transparent to Zambians?

      1. You need help. The health of the President is definitely NOT a secret. Cabinet meetings ARE secret but you know that President SATA started allowing ZNBC and other cameras in the meetings! This has NEVER happened before. However the Medical Report on the health status of the President is NOT secret as it has to be submitted to Parliament for debate and a resolution thereon.
      2. I would not reveal secrets, but verifying the health status is NOT a plan as such, Article 36 directs it. Besides the Budget is not secret so we can be told how much money was spent on the trip to USA and what he went to do there and whether there was a budgetary allocation or support. But am not asking for Cab secrets.
