KK ordered to pay K2.6 bn.

THE Lusaka High Court has ordered companies and banks that hold money on behalf of former President Kenneth Kaunda to transfer it to a consortium of lawyers’ account to service the debt he owes in legal fees.

This is in a case in which lawyers from law firms are owed legal fees amounting to US$645,526.26 by Dr Kaunda.

The law firms include Central Chambers, Andrea Masiye and Company, Dove Chambers, Lukona Chambers and Mvunga and Associates.

Deputy High Court Registrar Jones Chinyama directed that the cited companies should appear before him on June 19, and show cause why they should not give the money to a consortium of lawyers.

The companies include Zambia National Commercial Bank, Barclays Bank, Standard Chartered Bank, Stanbic Bank, Indo-Zambia Bank and Investments Bank. Others are Zambia National Holdings Limited, United Quarries Limited, Dora Tamane School and E.W Tarry’s.

The order was made following an application by the lawyers that the named companies and banks pay them the debts, dividends, profits, rentals due or any money accruing to Dr Kaunda and UNIP, which they were holding.

The legal fees accrued when the lawyers represented Dr Kaunda in cases, which included the misprision of treason, which attracted a fee of US$171,726.25, citizenship case with a cost of US$150,000, and the black mamba case with a cost of US$90,475.

Other cases in which they represented Dr Kaunda were the alleged Kabwe assassination attempt and illegal assembly with a cost of US$ 45,825 and the 1996 presidential petition case.

The legal fees which the lawyers are demanding were agreed upon in a consent order on April 27,1999 after Dr Kaunda disputed the initial fees.

It is alleged that the former President and UNIP undertook to settle the fees but to date they have not done so.

Can someone please come forward and pay these bills for the old man.let us not drag even the first president through the mud.Most zambians have forgiven him for his many mistakes but i can assure you these lawyers will stop at nothing to get their money (they probably are entitled to it anyway).

  2. #1 Lawyers never forgive, example is Chuchu who has failed to forgive his good friend (according to him) FJT, VJ and others. The old man have a lot money, he can afford to pay for himself or his many sons, grandsons who are well to do can pay on his behalf.

    Alas !!! these lawyers are all the same. There interest is always to make money. Same in Chiluba’s cases only the Nchito brothers, Sangwa and Simeza will be the winners.

    We will mobilise to contribute towards these bills for Kaunda. His cases were genuine.

  4. Well, there is a national under Lawyers for you. All the Lawyers in Zambia are now wealthy. They drive the best cars, go to the best places, live in the best houses, have the best property in the most sought after areas and have the best farms in the best areas..what more can you ask for. Even my landlord who owns a block of flats of a liquidated company is a lawyer. When did getting a law degree guarantee such wealth in such a short time. Hopefully we can have a Doctor in State house and liberate us poor Doctors, twachula pa fula.

  8. It is not just that the State should pay. What kind of judgement did these lawyers get for KK? If the judgement (obtained by the lwayers) was with costs, then the State has to pay and the suckers must approach LPM for payment. If the lawyers were negeliegent and did not Seek costs, they should not embarrass KK. KK has argued in the past that these lawyers took the case pro bono. Zambian lawyers are the most greedy and unethical world over. They will keep taking momey even when the case is not ‘moving’ – I have experienced this. LAZ must step in and stop this. When you take a case pro bono, you do it out of principle and cannot turn around to demand payment after the case is won.

  9. KK should pay his bills. The man has the capacity to do so. The lawyers are asking for what is due to them. The old man and his advisers knew what they were getting into when they approached the lawyers for thier services. I totaly disagree with Chimwemwe (john shoes), the state is already paying the mans pension for life, why should they pay the mans legal bill. KK is a humanist so he should pay his own bill so that the state can concentrate on delivering services to the poor.   10. Lawyers make money because they work for it.Period. You can not compare a lawyer to a politician. Why do people get coned by Nigerians through just sending an email? This is because they want to make money without working for it. Us The Elite know that one of the laws of Physics says ‘Energy can not be created or destroyed’.Period.     If you must Know KK’s was withheld for more than five years by the Chiluba Government. The retirement due to UNIP Government officials were repealed by the first parliuament under MMD.Those who had received their pension were persued and the money recovered from them.One of the the surving freedom fighters who have still not recieved their freedom are people like Grey Zulu.

He falsely accused people in UNIP in order to destroy the party. These cases must be added to Chiluba’s mischief. Chiluba should also be charged for negligence which caused the death of our entire national team in 1993. He was the one who ordered the pilots to fly that defective buffalo plane against expert advice. He must be jailed for that.

Let him just pay the lawyers, after role he is not giving them as a token of appreciation, they worked for it. If you go and ask for service be it from a plumber, garden boy or a lawyer you should be prepaired to pay the dues. KK can afford to pay his bills he doesnt just feel like paying. Millions of dollars used was not for KK but for Zambians, it explains why we are in this depth of poverty. Unfortunately you pipo honour one person instead of a country.   41. If the state does not want to foot KK’s bill then he should sue the Government for all the cases they brought against him and the never convicted him. It is only fair.He will probably get more money from all those fake charges they brought against him when he sues than when the state pays his 2.6 billion Kwacha.

  47. Consortium of lawyers! Hmmmmmmm. Was a ‘gang’ really necessary looking at the nature of theses cases. I mean, just at face value, even a fly could tell they were winnable! So why so many? I bet everyone of them wanted a piece of the old man’s well known goodwill on their CVs/profiles. And that’s precisely my point. KK should charge them for that.What needs to be done now is to price that goodwill and then offset the fees from their dues. Valuers, where are you? KK needs you most at this hour. Your payment?   48. Our ‘learned’ colleagues are involved in practically every agreement that Zambia contracts. Yet more often than not, things are skewed against GRZ. Need I mention the Donegal Inter’n vulture fund case, for instance…it came as a total surprise to Zambia. If the contracting lawyer at the time had agitated for a clause against purchase/redemption of the loan by a vulture fund, we would be $15m richer today. But sure as the sun, the lawyer got his fees paid. Shouldn’t they be made to account also?
