Culprits to pay heavily for public nuisance offences

Government has today unveiled new penalties for public nuisance acts under the street vending and nuisance amendment regulation of 2007.

Launching the statutory instrument in Lusaka today, Local Government and Housing Minister, Sylvia Masebo said the instrument was in line with the “Keep Zambian Clean Campaign which President Levy Mwanawasa launched last week.

Mrs. Masebo said the penalty fees for various public nuisance offences have been
increased from the range of between K300 and K1, 000 to the range of between K90,
000 and K450, 000.

She said the old penalty fees were too minimal to deter offenders from committing
the offence.

In the new instrument, throwing litter in undesignated places would attract the
penalty fee of K90, 000 while passing urine in unauthorised places would attract
K200, 000.

She said trading in an unauthorised areas and operating unlicenced taxis would
attract K450, 000.

The minister has since called on Zambians to support government measures in order to
achieve a clean and disease free environment.

She further said Zambians should be vigilant and exercise their powers of citizens’
arrest by apprehending perpetrators of such nuisance acts.

  1. #1 She has nothing to say,its either that speech was written by Maureen Mwanawasa or Levy.Its common for these Ministers to say anything without reading it first.Sata left such frames all what was required was cabinet support to enforce these penalties.

  4. Zambia has been on the downward trend for many years, as far as cleanliness is concerned. Cholera is a direct result of the dirty environment. Malaria can also be reduced by taking care of the environment. It is depressing to see that a lot of Zambians do not care where they throw rubbish. The situation is made worse by the fact that local councils have all but colapsed. Our praise for Ms. Masebo should be tempered with caution. All these tariffs could be window dressing in the absence of enforcement. Who is going to enforce these bye laws if there are no police officers around? As long as everything is centralised in the hands of central government, enforcing council bye laws is near impossible. Government needs to be serious about sorting out local councils first. They need to be funded and audited properly.

  5. #1 EASY.I know it`s difficult to achieve a disease free enviroment but as citizens ,we need to try and maintain a clean surrounding.We need to support good initiatives even if we don`t politically support the initiator.Before long,if we`re hit by preventable diseases such as Cholera,the same people against such iniatives will condem Masebo for doing nothing.I hope that this isn`t a temperal thing but will be enforced all the time.People tend to grasp things quickly when it directly affects their pockets.if someone can`t afford to pay the fine,then I`m affraid it should jail time.Therefore,I applaud Masebo for trying to infuse some sanity.

  6. Bwana Minister of Local Govt. How many toilets and bins have you installed in these public places. If you have any bins, how many times does your local govt empty these bins. I don’t stay in a city. I live in a small town where most gazetted markets aint got any toilet facility. The move is good, it has to start with local govt putting these facilities in place.

  7. Apart from lack of funding for councils, another thing that has been neglected by the government is mobilisation of local communities. People at local level should be involved in maintaining their environment. In the dim and distant past, there used be social and welfare centres where mostly women were taught all sorts of things, including hygiene. The idea was to cultivate a sense of community and belonging. When people are made to take ownership of their envinroment they become responsible for and proud of it. Unfortunately, all people see these days are councils which are keen to collect taxes but are not so keen on providing services. The meager amounts they collect just go on salaries for workers who do not even have tools to do their work.

  8. In my small, long long time ago. I can still remember, we used to have dumping sites where all the garbage was dumped. Nowadays, garbage is dumped in potholes in our roads. Shame on us. I propose every household should have a rubbish pit where possible.

  9. Chapi, what you are saying is what I expected the minister to say. This is why I agree with Kuku #2 that these ministers dont even read thru their speeches. I have no problems with Masebo as a minister. Infact I like her no nonses stance on a number of issues relating to the cleanliness of the city.

    However, solutions like hiking the penalty fees leave a lot to be desired. There must be systems in place first of all to ensure that these culprits are noticed. Moreso, the people need to be sensitizes that its wrong to throw litter or pass water in undesignated places. You and me may know this but think of an ordinary trader or bus conductor at city market.

    A clean environment is a must yes but let us look at attainable ways of ensuring people adhere not theoretical ones.

Make these partnership and cooperation with the local communities and authorities in order to make the good suggestions effective. You just woke up and this not allowed you be punished. This reminds of the one deputy finance Minister who was the first Mechnaniker to Zambia Railways she used to read speeches. She tooked of chitemene systems, environmentatl dangers because of climate change. Please reporters interview this woman and find out about her CVs she seems to be fit to take over the Environment ministries. For me these could be very big..

On the hand our leaders have a problem of sleeping in hotels and watching TV when they are in developed countries instead of going around and see how people live. All the solutions are at your dispose if you want to know how have managed thier environments we have embassies representives in the country go and ask them how their nation solve these problems. Embassies are just their to hel enforcing thier country´s foreign policies but to exchange ideas and issuing visas.     Coming to the beef, building toilets and putting-up bins is one side, the other side of the coin is educating people to stop/reduce on nuisance dumping and thats exactly what i understand from the story above.

Its a batch of well educated Zambians, that is why things fail in Zambia because we like talking about peoples ideas hence the difficult to implement. Please go Kanyama or Msisi and see yourself because of lack of Town planing it is impossible to build a dusty bin or toilet because there is no plan. Mwana our cities they just copied village life and brought it in town whereas in rural people live spacely. Can you tell now if you are in LUsaka and you go to city market where you can build dusty bin. I think you have a problems of understanding and reasoning Hey that why we fail in Zambia to perform because we inherit and change is doesnt have a meaning to us. The problem we have in Zambia is politicking,If the local authority is left to work on its own, all these issues can easily be implemented,right now that Minister does not even what goes on the Waste Management area.Give autonomy to councils and build in systems that can prevent corruption.We have Car Park attendants on cairo road who most of the time just pocket the money.The guy gets peanuts but collects quite a bit for the council, do you expect him not to be corrupt and charge half the fee for his pockets? Reigning Women International Boxing Federation (WIBF) Champion Esther Phiri has become the new Global Boxing Union (GBU) Super Featherweight champion after defeating Bulgarian Challenger Rodostina Valcheva in the second round. Fighting before a packed crowd at Woodlands Staduim this evening , Rodostina could not accomodate the reigning WIBF Superfeather weight champion jabs and uppercuts. The outspoken Bugarian failed to respond to Esther’s jabs especially in the close of of the second round which made the referee Richard Phiri to step in to stop the fight. Rodostina who was rushed to her change room reportedly sustained a sprained on her right arm. Over 400 boxing fans braved the cold to watch the thrilling match. Give them, and let people take the responsibilities of keeping their places clean. let people know that they are the government and that they should participate in cleaning their areas. Let people know that they are ruling in every aspect of their lives. There is no government anywhere else apart from where the people are. ‘If you see anyone throwing papers around, ask him/her to pick them’. The government should show a good example by facilitating the desposing of gabbage in right place and, in time.

Zambia needs leader such as herself. Leaders who are prepared to make tough and unpopular decisions in the best interest of our welfare. Understandably, culprits are not very amused with her stance towards the right direction. My advise to you opposers/offenders is that refreshen youselves well before going into town, or carry enough money to pay at public loos if you know your bowels are so active or got a small bladder. And if you dont have money and you got nothing to do in town please stay at home -start blogging like EASY-until you get yourself a job. Greetings fellow blogers I’ve observed that most of the comments raised on this issue and many other in Zed we always have to blame goverment for and indeed as our leaders they will always recieve critism over many issues but I believe that to a greater degree Zambians need to accept the blame as well. I was tought that cleaness is as much my responsibility as is is anyone else.All things begin with implimenting rules I ensure that my family understands the importance of cleanliness in the home and on thier person e.g in the neibourhoods I’ve leaved I ensure that I have no cockroaches and no rats and it is somthing we have managed to achieve with reasonably degree of success but some of my neighbours do not make any effort at all hence roaches tend to come into my home from the outside homes. What I’am saying is if we all make an effort we can make a change but you can not blame always blame Govt even my grand mother fm the village wud never pee in public areas or throw Litter around

  38. I believe for us to see a change in our country Zambia, it has to take each and every person to be responsible for what we do. No amount of blame on the government will help. As much as the government can put up laws to deter this, still the general publich has to bear their part also and that is to ensure they do all they can to make the environment clean.
    I see something that disturbs me, when such things as bins are put up, people will take them for whatever they use them and that does not help the situation.
    Its our country and we have to take responsibity and until that is borne is every Zambian, we will not see much progress.

Those excuses such as shortage of public toilets can’t hold because this is not about toilets but atitude especially us men.   43. I do not think this is the best solution to the problem. They talk abaout throwing litter when they have not put a single bin in the country. This is just increasing the cops’ take home bribes from the would be offenders, especially for throwing litter and urinating in public places.

  54. I have a suggestion on how this issue of public nuisance can be handled. The Council should demploy Town Centre Wardens who should be given the authority to issue fixed penalty tickets. The Wardens should start by encouraging and educating the populace who go to the town centre to take pride and not to drop litter. Businesses in the towns should also fully support the council’s action as it helps attract people to the towns if the areas are clear of litter. There was once pride in the town of Chingola when the council was presenting the message to all residents and visitors to help keep the town clean and clear of litter. It is also encouraging the careful disposal of cigarette ends as these amount to litter. People should be issued with fixed penalty tickets for littering when they have refused to pick their rubbish up upon request and this includes refusing to pick up a cigarette end.

They are being too practical on separation of powers, and independence of the judiciary. Comparatively, at national level no opposition party could have beaten MMD considering its approach to a confused plural system obtaining over the years in our country. With exception of the same ruling MMD, all in the opposition regrettably sold and are still selling themselves out on regional lines which majority Zambians never buy. With the UPND Tonga stigma for Presidency, HH will never rule Zambia unless integrated in some nationally visionally party while Sata is a comedian we should count on to keep our politics lives with his ramble. He will never rule this country come what may. If not careful, the same MMD advocates and strategists will offer this country a version 3 of MMD after the version 2 is over. Ever wondered why they steadily protect MMD, demonize any opposition but never enter mainstream political roles except marshaling themselves economic powers for now? Politics has become too expensive in Zambia. Those with bottomless pockets will have unquestionable roles. Strategists know the inside out of the obtaining politics across this country.I rest with my independence.

    Its because a God fearing practical Democrat is reigning as head of state.Did you hear KK 2 weeks ago saying in his time they acted with precision and determination every time opposition and tribal politics tried to emerge.Do you know what that means? Gibson Chigaga, Nalumino Mundia then Wezi Kaunda and Edward Shamwana. Levy doesn’t believe in that parochial politics.Hence all these nonsense from every jim and jack.He is the like of Kenya’s Kibaki of ideal based politicking without state machinery reprisal on opponents. Under Levy we will never hear of clandestine ends of opponents.

Zambia is on the right track,this government needs the peoples support regardless of your political affiliation,it’s time we started thinking straight and put our act together as one Zambia one nation,and for our beloved leaders in the opposition,don’t just oppose just sake of the word in front of your title,if we put our heads together there is nothing impossible,this Great country is at the verge of an economical explossion and mother Zambia needs us all where ever you are.
