PF’s Mwansabombwe seat nullified

The Supreme court has nullified the election of Samuel Chitonge as Patriotic Front Member of parliament for Mwansabombwe in Luapula Province, on the border with the Democratic Republic of Congo.

The court said this is because the poll was not free and fair.

The supreme court judgement set aside a High court ruling in favour Mr. Chitonge.

Chief Justice Ernest Sakala sitting with supreme court justice, Denis Chirwa,Peter Chitengi and Christopher Mushabati said the trial judge had erred in law and fact when it ruled in favour of Chitonge.

The court observed that there were a lot of anomalies that characterised the poll in Mwansabombwe.

This was an appeal against the high court judgement of July 17 this year in an election petition in which Chitonge was declared duly elected.

In the apeeal the losing candidate, Maybin Mubanga said there were a number of malpractices during the election campaign.

  1. Look at these chief justices, they have the courage when it comes to making decisions over insignificant elections.

    When Mazoka won the election in 2006 the let the MMD get away with rigging…double standards.

    They are also able to nullify the resuls because the winning candidate was from the opposition party… Shame on them all!!

  2. What a political circus!!!. Hoping Sata will forgive chitonge for joining NCC. On the other camp MMD should cast their net wider in search for a candidate

What does it mean when they say the lower court erred in law and fact,i thought these lawyers does the same law. but why has it taken centuries 2 conclude plunderers case’s. this man appealed on 17th july and just less than a month they av passed a judgement. i don’t trust Zambian judges. Waste of time.anyway PF will will reclaim that seat.it’s PF Zone.

  4. # 1 I agree with you . The question is how many seats won by MMD have been nullified in the courts of law ? The ruling part is using this tool of nullifing the results to weaken the oppositions . Can someone give me the answer .

  5. We are tired of these costly by-elections and why would Maybin shed taers and wished LPM was here?this is so retrogressive people!nothing to be happy about!maybe the hefty slaries they shall get are what made Mubanga weep!

  6. Interesting indeed. The judge erred in LAW and FACT when it ruled in favour of Chitonge. Who was the trial judge ? Iam sure he could be some PF cadre……

THE MWATA WAS WEAPING AND BEATING ALL HIS SUBJECTS WHO WERE NOT SUPPORTING PF.ALL THE VILLAGERS WERE TO SUPPORT AND VOTE FOR PF.ALL THE GUYS WHO WERE SUPPORTING MMD OR UDA WERE BEATEN AND THRETENDED TO BE EXPELLED FROM THE VILLAGE.SINCE THE CHIEF HAS INFLUENCE ON HIS SUBJECTS AND HE WAS WEAPING HIS SUBJECT,THE ELECTIONS WERE NOT HELD IN A FREE AND FAIR MANNER.THE HIGH COURT HAS ALSO NULLIFIED B4 MMD’S ELECTION AFTER 2006 ELECTIONS.IF I CAN REMMEBER VERY WELL, CHISANGA(FORMER UPND) AND SATA THAT IT SHOWS THAT THERE WAS RIGGING.

  9. i dont support either parties but i should just point out that a fair game should be played in unseating anyone from his position. Life is hard and campaining is expensive.

  10. One wonders why in the case of an MMD MP, the case is always in their favor while those in opposition, they easily nullify. I bet when a non lawyer president comes in the first to whip are these crooked lawyers who sentene the innocent while aquiting the guilty. GOD IS KEENLY WATCHING YOU FELLAS AND WHEN HE DESCENDS ON YOU, YOU WILL REGRET THE REST OF YOUR LIVES

  11. Ba Maybin Chisanga, you literally did nothing for your area as an MP during your time. Why don’t you allow others also to enjoy the fruits of their labour. The truth is, Maybin, I have known you since the early 70’s. I know what you can and you can’t do. You cannot hide yourself behind your finger.
