The Law Association of Zambia (LAZ) has said that  there is nothing wrong with Parliament resuming sittings before a new cabinet is appointed.

The clarification by LAZ follows Tuesday’s walk out of the House by some Patriotic Front Members of Parliament.

PF members claimed the house was sitting illegally because President Banda has not yet appointed his cabinet.

He told ZNBC News that the ruling made by Speaker of the National Assembly Amusa Mwanamwambwa was correct and constitutional.

Mr Banda said all Ministers were appointed by a sitting President and oath, from the Presidency and not to an individual occupying that office.

He said the fact that parliament and cabinet were not dissolved before the October 30 presidential election means that all appointments by President Mwanawasa hold until the new President makes changes.

PF Lusaka Central MP, Guy Scott raised a point of order on Tuesday questioning the rationale behind the house sitting before cabinet is sworn in.

Dr Scott argued that it was unconstitutional for the House to resume business before cabinet is sworn in.

But the speaker Mr. Mwanamwambwa in his ruling told the house that the resumption of business was legal as parliament had not been dissolved before the polls.

And in another development the Law Association of Zambia -LAZ- said the election of President, Rupiah Banda, is a reflection of the confidence Zambians have in his leadership.

LAZ president, Elijah Banda, is confident that President Banda will not fail Zambians.

In an interview with ZNBC news in Lusaka on Wednesday Mr. Banda wished President Banda well in his new task.

And Mr. Banda said the association is happy that President Banda has shown committiment to continue with the fight against corruption.

He said the association is delighted to note that the new President has pledged to continue with the fight against the scourge.

Where as Mr Sata won in Lusaka, Northern, Luapula and urban CB, Mr Banda did won some constituances in Luapula and Northern as well. Even where he lost other than some areas in Lusaka and CB, the magins were small. Mr Sata lost by large magins in some areas getting less than 100 votes while mr Banda was getting in 1000s. Mr Banda won Central, CB rural, NW, Western and Eastern by a landslide. Mr Sata did not win a single constituancy in theses areas. Where as rural areas may have fewer people, the voters turned out in numbers. I also doubted but

    after I took time and made a spread sheet from the raw results Mr Banda actually won. In a class situation for example, one can be top of the class by becoming second with an average 70% in all the subjects and beat some body who gets on average 98% in only 4 subjects and 20% in the other 5 subjects. Clearly Mr Sata whom I admire with his vision at times and complete idiocy at other times is very unpopular in many areas in Zambia. Anyone out there who wants the complete constituency results for their own scrutiny can post their email address and I can forward them. I hope this puts to rest the issue of rigging.

    This is welcome, but I feel something is missing here and this is the fact that we need a Vice president to run the affairs of parliament. So, can LAZ clarify with this problem instead of doing ‘hide and seek’ games.The appointment of Defense Minister Mpombo to act as Government Veep is what is tricky here. In this regard, I support the PF MPs who walked out.Let President RB banda appoint a Vice President instead of leaving us in suspense the same way late LPM left the MMD party without one. This is a National and Country matter and not pol. party.

There is nothing special about the VEEP being leader of the house, the truth is Mpombo whether you like him or not a senior cabinet minister has been provided by Cabinet to be the leader of Parliamentary business in the house. Let these MPs go back and the President shall appoint at VEEP at his pleasure

One thing PF supporters should be reminded is that Sata will never rule Zambia because the Army will never allow him to do so even if he won the elections already in Chisamba there were fliers that were being distributed that if Sata would win they would take over. The army also realise that Sata is a disaster and they would not allow a peaceful nation like Zambia get into the hands of Sata. The only way to remove MMD is to vote UPND. The point as far as the Army is concerned is not to remove MMD from power but to prevent Sata from going to plot 1 and if in the process MMD remain in power then it is okay. This is nonsense from PF, Even under normal elections Parliament can resume without first appointing the Cabinet, The President may first appoint a VP as Leader of Government business, then later start appointing other members of Cabinet while parliament is open. Moreover this was a by election with an already functioning Cabinet. By the RP could have remained VP assuming Sata won, Sata could not have appointed a new cabinet but fired existing or replaced ministers if he wished. I am not MMD but am beginning to think its a blessing PF lost.

  59. #78 What is the reason behind that decision.What most of you are failing to understand is that even though cabinet Ministers are considered to be equal,The Defence,Finance,Foreign & Home Ministers are ranked slightly higher. Even in most companies,when the MD is not available,it is rare that A Director of Marketing or Humana Resources will be asked to act as MD,it is usually the Director of Finance,Corporate Affairs etc infact they even earn slightly higher so Mpombo is highly respected as Defence Minister,it’s a big post that’s why initially Levy was President & Defence Minister at the same time,Mpombo deserves to act he’s 3rd or 4th from the President basically.

  65. Latest on news was that PF concillors walked out of the chamber in kitwe where they were attending a workshop by an NGO about the issue of AIDS. They expected to recieve a sitting & transport allowance from the NGO. I think we are in trouble in Zambia putting wrong people as councillors who do not understand civic matters. They think it was council function which attracts sitting and transpot allowances. More confusion, MPS and Counillors from same Party we love so much Pabwato fye.

  67. Bear in mind that the voting pattern in #98 is that from Northwestern Province where people voted on a non-tribal manner.
    Analysis:
    1. UPND President Hakainde Hichilema was clearly the best candidate
    2. Zambian President RB Banda was the next best because the MMD has party structures there and new mines gave people jobs.
    3. HP Leader Miyanda was a fairly good alternative to president HH
    4. Undereducated unelected PF Self-apponted Leader … was the worst candidate to consider for Zambian President.
    This is proper voting without tribal lines or affiliations taking into consideration some comments by most Bemba Zambians that Tongas in Southern Province vote on tribal lines instead of intellectu.

  77. RB needs to start afresh picking credible people from the boot lickers and job seekers we saw during the elections. there is far too many opportunity seekers surrounding RB some we never even saw when Mwanawasa was there eg Nevers Mumba,even Chiluba is jumping on the band wagon.

    We need serious people who will not be looking at felling their own stomach, but to serve the Zambian people first. i hope RB is strong enough to withstand and punish these thieves.

  81. Once upon a time, we were told that speed kills. RB is a steady driver – no panicking in picking his best Cabinet. Study the Ministries, evaluate the many job seekers and decide which Minsitries need revamping and appoint a Cabinet that closely mirrirs your vision after this exercise. Do not forget, it is only three (3) years and whoever he appoints must deliver within this time as there will be little or no room for abrupt reshuffles once he swears in his Cabinet.   87. PF may have a point, we just came out of a constitutional crisis due to the death of LPM. Now imagine if RB was to drop dead now,we would have no VP, no cabinet and basically no direction. A cabinet lays out a plan of action with the president so that they all think as one. But now RB has not done that. God forbid should the worst happen Zambia will be lucky to come out unscathed.

  92. When you are elected as an MP you represent the people in the consitituence regardless of who voted for you. PF MPs just like any MPs are sent to debate intellegently in parliament and not walk outs. Walking out is failure to debate intelligently and this is sad development from PF members. Once u stay in there and put your views inteeligently u may even win some to your side. But alas PF has no iota of critical analysis. LAZ exists as a result of an act of parliament and in the act such authority to come in on matters of law is enshrined in the act. Even the president of LAZ has some powers under the ACT to speak out but i believe he consulted the committee on such matters of interpreting such. This to me is very clear that PF can not lead this country constitutionally . I think guys it is time to go thecitizensdemocraticparty.com way. There is freshness and direction for Zambia and the future.
