Siliya won’t be suspended says Kunda

VICE-President George Kunda has said that President Banda will not suspend Minister of Communications and Transport Dora Siliya pending investigations of the tribunal into allegations leveled against her as no law warranted such an action.

And former Minister of Communications and Transport, William Harrington has asked President Banda to suspend Ms Siliya to facilitate investigations into allegations of abuse of authority and corruption.
At media briefing in Lusaka yesterday, Mr Kunda said the President would only act upon the report of the tribunal.

“There is no law or precedent which compels the Minister in question to go on leave or her suspension pending the conclusion of such an inquiry,”
Mr Kunda said.

He said that the tribunal to be set up by the Acting Chief Justice Ireen Mambimilima would conduct an inquiry not a criminal trial as Ms Siliya has not been charged with a criminal offence.

The Vice-President said there had been two of such tribunals set up to investigate ministers and it was on record that these ministers never went on leave nor were they suspended.

He said at the end of it’s work, the tribunal may make recommendations to the President in accordance with Section 14 of the Parliamentary and Ministerial Code of Conduct Act Cap 16 as regards to actions, criminal prosecution or other further actions as it thinks fit.

“The President will only act upon the report of the tribunal after it is rendered. This is the position of the appointing authority,” Mr Kunda said.

He said it was Government’s understanding that the tribunal to be set up was as good as a commission of inquiry under the Inquiries Act, Chapter 41, from which the Parliamentary and Ministerial Code of Conduct Act borrows some of its provisions in Section 15 (10).

And in a letter to President Banda, Mr Harrington commended him for the support he has rendered to the decision by Justice Mambilima to appoint a tribunal to probe Ms Siliya.

He said President Banda’s directive to the Secretary to the Treasury Likolo Ndalamei to fund the tribunal that would be set up under the Ministerial and Parliamentary Code of Conduct was testimony of his personal commitment to fight corruption at all levels.
Mr Harrington however asked the President to suspend Ms Siliya from official duties in order to allow for a free and fair investigation against her.

Ms Siliya is alleged to have awarded contracts for evaluating Zamtel’s assests and supply of a radar system at the Lusaka and Livingstone International Airports.

“I am requesting you to consider exercising your prerogative as provided in the Constitution of the Republic of Zambia to suspend, in public interest, Ms Siliya from her official duties pending the outcome of the tribunal,” Mr Harrington said in a letter to President Banda.

He said that this was necessary and expedient to allow for a free, fair, transparent and unhindered investigative process by the tribunal.

Mr Harrington said thorough investigations may not be conducted if Ms Siliya was allowed to continue discharging her duties as officials at her ministry and outside may wish to testify or could be summoned by the tribunal.

He said such persons and witnesses may naturally feel inhibited to do so if Ms Siliya continued heading the ministry.

President Banda has welcomed Justice Mambilima’s decision to create a tribunal to probe the Minister and hopes that all those that were involved in this debate would allow the tribunal to do its work in a professional manner.

  1. Who is the current chief govt spokesman? Is it Kunda or, Shika? Out of politness Dora must just resign or, wait to be suspended. The problem pa Zed is people work when there is pressure and cannot just make a decision. The international community is watching and they would like to see whether we are interested in development or, failure. No one is indespensable suspend Dora and someone must act as minister, period.

  3. Lets learn to respect the law and avoid immature complaints even when things are done within the preceipts of the law. There is really nothing wrong in Dora working. The law does not stop her from working. Let her continue.

    What is suscipicious though is the continued involvement of Kunda in the case. It would be better if Kunda could keep queite for now and watch from the terraces.

    • This why Zambia cannot develop. Dora should step aside and allow the tribunal to investigate the allegations without interference. The are people who are supposed to give evidence in her ministry,with her continued stay there she can interfear with the witnesses. Any our learned laywer George is an embarrassment to the legal profession. We have not forgetten the Kashiwa Bulaya saga. Goerge was in the forefront suggest their is no evidence to convict Bulaya. Where is Bulaya today? Goerge has no credibility has a lawyer.

  5. Those of us who have studied a bit of law know that once a precedence has been set, it’s only appropriate, in the interest of justice to continue with the trend. What’s wrong with Dora continuing when in the past ministers under investigations still held on to their offices. Is it because she’s a woman? Step aside guys, let Dora continue until the case is closed.

    • I think every law student and even those practicing now should go through a proper course in Ethics (not the simple professional ethics that you do). This will help you to understand issues better. Not everything that is legal is ethical!

  7. The other side of the argument is ;Precedents are not legal yardsticks as they have been known to have been overturned when there is good reason to do so.In this case there is some alledged criminal elements involved.

  8. Everything has an end. A precedent also has an end. Strong regimes have ended so we cannot just fold our arms because someone set a standard. They say a standard you walk past is the standard you accept. We cannot just allow a wrong standard to prevail. We will apply the same pressure squarely. This case is interesting and we want it closed as soon as possible. If found guilty, too bad and if found inocent then we will congratulate her.

    • Mulyata was found without a case to answer by the courts and innocent. So the man lost his job and reputation based on a story from the Post. So mulyata is not a good case to use for precendent by the Post. Further Mulyata did not face a tribunal. He was arrested and charged by the ACC for criminal misconduct. Tribunal is a more of an inquiry.

  12. Patriotic Front must realise that their time to rule will probably come in future – if they win elections. For now they have to let RBB run the country. We know that PF is a sizeable party and has support in some regional areas, but the MMD is much bigger both in parliament and by recent presidential vote. So we cannot have 2 parties running the country. Harrington should chill. We don’t want confusion or anarchy. I’m a swing voter who doesn’t support any party in particular, but it seems to me that PF might be over-rating themselves. Let RBB rule, it’s his time!

  16. I have always likened George Kunda to Jonathan Moyo of Zimbabwe. The latter used his knowledge of the law to help Mugabe pass draconian legislation that lead to the banning of independent newspapers and generally undermining democracy in Zimbabwe. Unfortunately for Moyo, Mugabe fired him and he (Moyo) is now critisizing the same laws he help create. Goerge Kunda is a dark malignant force in government. He avoids standing for eletions but he is always in government. Such people are contemptuous of the electorate. His only job, it seems, is to use his knowledge to find loopholes in the laws and therefore justify wrong-doing.

Kunda lacks the brain nowdays.I can’t see why he’s protecting Dora.Even if u’re innocent when u’ve a case to answer u need to step down.Now it’s the V.president protecting Dora.He’s a lawyer without knowing anything.I agree with people who say the big man is sick coz v.predo can’t say like that.look to what happened to Illinois governor!!The boy was forced to step down even if he’s not guilty.Dora should also step down without a problem.If kunda continues he should too resign.we don’t want sick people in govt who can offer nothing accept corruption.It seems something is lacking in V.presdo nowday Rb chose him to be easly manupulated coz he’s sick.

If it were some Minister in some Govt. in the west they would have stepped down. You can not perform your duties and at the same time be taken serious when you are being investigated

He is giving press conference to who please sto wasting time what we want Kabwalala ni kabwalala so Kunda is protecting the boss yama soya is the one. So as at now if you are sent to insult a chief first you punish the one who has been sent and in this case dora was sent to steal so let us punish her and them come to Nyamasoya himself.

There is no moral, ethical, legal or constitutional reason to suspend Hon.Siliya over mere allegations without facts from the tribunal legally to prove allegations. Doing so by the Head of state would be curving in to the whims of self seeking anarchical fanatics inimical to our national stability and enduring peace. It would be a bad precedence of emboldening hatred to cook, sponsor and spin more allegation with impunity with intent to impeding peace, stability ruin those they deem at variance with in interest.

As a country I think we ought to learn from the two mistakes of President Mwanawasa who blundered by taking orders from the post newspapers on the allegations against Southern province minister Mulyata.The man was dropped even before the enquiry. After investigations, the president carried the embarrassment when the enquiry found the framed Mulyata innocent yet the same post newspapers unethically chose deafening silence as if they didn’t frame him publicly. It has taken President Banda to reappoint the man against a public still…

As a result of that blunder, President Mwanawasa learnt a hard lesson never to Govern through editorials. When a call for him to suspend Jonas Siakafuswa came over the Parliament Motel report, the President refused to suspend or fire him without an investigation report on his desk proving the Post allegations. The day Government is run on editorial of tabloids, that the day anarchic reigns.

Where wrong damages have been proven, apologies and retractions suffice which is all missing in the agenda of the Post newspaper. Look at the malice they loaded on KK about the Sindamisale arms cache they claimed, the allegation of KK starching US $7 billion offshore and late Saddam being at State lodge with his white plane at the airport to evacuate KK. All dangerous insinuations when hostility over the Gulf war was at the ceiling. They saw nothing in risking the country with US bombs just like they see nothing in apologizing to Dr.Kaunda for all their hype.

    The tribunal will be centred on the activities at the ministry and the minister Siliya. The fact that the A/CJ has agreed to convene a tribunal means she is satisfied that a prima facie has been established by Harrington. These are no longer ‘mere’ allegations and the minister should step aside to negate an appearance of interferance of the alleged ‘crime’ scene (her office), witnesses and the suspect (herself).

    • The minister has no way of influencing the tribunal and she cannot interfere with witnesses as she will not know which witness has been called until the hearing. There is no need for a prima facie case to be made for a tribunal to be called. The Act establishing this system was enacted as a way for the public to keep public servants in check. So once a petition is received a tribunal must be set up. There is no presumption of guilt or innocence. All the Chief Justice is doing is making an enquiry, i.e. what has happened in this whole saga, who did what and when. Then finally recommend either prosecution, reprimand or withdrawal. If it is founf that the Post lied then the post will face libel

    My brother don’t compromise your competence with emotions many are trapped in.I expect you to be solid at least in constitutional matters as a future leader.PROGRESS on logical arguments and practical law theory than emotinal traps.Constituting a tribunal is not a verdict of wrong but hearing in common law-three Precedences exists.FYI,a Tribunal can even take 5 years.

  42. There is really something fishy about Kunda s move. He is the one who should advise Dora to do something positive by stepping down.
    The fact that Kunda has put down his word is in some way a hinderance for the tribunal. He should not have come up with this move at all. Dora is the one to act now . I mean now and not later!! It will spare her a big embarrassment !!

  43. Senior Citizen, thanks for your advice to the un-initiated on the practicalities of our society. The tabloids may dig deep and have their merits, they also have their de-merits. We must not have blind faith in their rhetoric, otherwise we will be allowing ourselves to be ruled by editors and not the leaders that we elected. Do not be swayed by high sounding references to or comments by supposedly high profile NGOs, ZICA, Surveyors Institute etc etc. There are good people in these institutions but the tabloids select the comments of those who sympathise with them, those who have bones to chew with the establishment. Note that Kabeta Hapenga is not even the president of ZICA, but an employee.

    • The tabloid, POST NEWSPAPER or Undereducate’s Imagebuilders, always write their editorials to sell and make money with an aim to manipulate ill-read or illiterate Zambians. Their whole aim is to run editorials on the Undereducate, Michael Chilufya Sata, to show a pciture that the old man, a 72 year old recycled politician, spaeks for the Zambians people on anything that has to do with the governing of Zambia.
      Unfortunately, Zambian characters who are emotional or deceived because of not reading widely fall for such useless rhetoric aimed to cheat the nation. By God’s grace, we as a Nation still have sober minds who analyse issues beyond trying to get Sata to be our President at all costs.

Mwaanga was was fired by late former President LP Mwanawasa out of pressure from the POST NEWSPAPER which insinuated anarchy in dull Zambians who added more pressure on the then President to drop Mwaanga over the GRZ’s debt to Mr Moses Katumbi of Congo.
    We also so anarchy at play in causing Ministers to be dropped from office when Undereducate Sata was in the MMD government and allowed cadres like Nakawala to harrass and use MMD cadre mobs to stage demonstrations.
    The Undereducate Sata has now started using his Imagebuilders the POST to cause unsuspecting Nationals to force President RB Banda to do things…

  47. I believe the president has the right not to fire Dora while the investigation is going on. However, I believe that Dora has been telling the truth and because of that I expect her to step down based on moral conviction in paving way for the investigation. If she is cleared by the investigation. She can be brought back to her position. That how democracy should work. I believe Dora has no problem with that, but its only the fact that people are speaking for her.

    • Obviously he, Mr G. Kunda, is speaking as Minister of Justice simply to override the knowhow of the Attorny and Solicitor Generals.
      However, I still believe that President RB Banda has greatly made a mistake in overworking Mr George Kunda with two almost equivalent POSITIONS. This too me is failure to lead or manage human resources to efficiently run an entity.

    • kunda has always had two positions from the time levy appointed him as AG and Minister of Justice. People have short memories. It is the same levy who kept two ministers in one ministry, kapita and susan as agriculture ministers. it is this same levy who instructed dora not to get the debt from ZA and it is the same levy who started the partial privatisation of ZATEL quietly with the chinese. so dont talk about levy as if he was an angel. this is the same man who kept 4 billion kwacha in his personal account at finance bank saying it was party funds. he was the only signatory so where is that money today?

    • Well both the Govt and Civil Societies should review the case so that there are checks and balances. The Govt people reviewing the case need also to review the Minister and Transports case too together with all the other cases that the Auditor General has been raising in her report. Infact they need to also review and investigate all cases similar to Zambian Airways ,what we are trying to avoid is discrimination which is arising as pay back because certain sectors are a pain to the Govt.   53. Bank of Zambia (BoZ) has queried DBZ for giving loans to Zambian Airways when the company was insolvent, contrary to bank regulations on large exposures.

Thus far, there has been only two such tribunals set up in accordance with Section 14 of the Parliamentary and Ministerial Code of Conduct Act Cap 16. one for one Mr. Ephrain Chibwe and the other for one Remmy Mushota. We all know that in both cases, the thieves never survived the chop and whether by shear coincidence or not, both stinkers kicked the bucked with two years of their ouster. Dora is thus damaged goods, she is radioactive and if I were Kunda, I will keeb a distance.

  57. Morality is not enshrined in Law, it arise from ones inner sense of justice & respect for the people they hold dear near & far, i.e. their family & the people they purport to serve.

  65. The battle between RB and The Post will eventually bring untold misery on the masses. RB must be careful. Donors especially embassies that are in Lusaka are following the Dora saga with keen interest and believe me, The Post has been vindicated over their fears with RB’s style of leadership. Donors are viewing it this way. I have friends in five western embassies stationed in Zed and this is what they are telling! When you see The Post being defiant like this they know that they several have embassies behind them. RB must be careful because very soon donors will start suspending projects they are funding and before we know it we will be Zim 2.

    Mines Air Services, Zambian Airways to pay National Airports over K12.6 bn

    THE Lusaka High Court has ordered Mine Air Services Limited and Zambian Airways to pay over K12.6 billion to the National Airports Corporation Limited (NACL) in passenger service charges, rentals and other services.
    High Court Judge, Prisca Nyambe entered the judgement in default of appearance and defence.

Judge Nyambe ordered Mine Air Services Limited and Zambian Airways to pay US$1,020,788.95 (about K5, 614,334,000) being passenger service charges collected by the companies on behalf of the NACL from passengers in Lusaka, Livingstone, Mfuwe and Ndola International Airport.This was as at October 29, 2008.Judge Nyambe also ordered Zambian Airways to pay US$1,033,823.08 (about K5, 686,026,500) to NACL in respect of aeroplane parking, ground handling, air navigation, landing and aeronautical services provided by NACL as at December 29, 2008.

She said this debt had continued to increase in respect of these services and now amounted to US$1,154,371.13 (about K6, 349,040,500) as at January 9, 2009.Judge Nyambe also ordered Zambian Airways to pay K31, 635,120.00 for office rentals, water and electricity charges which had arisen and accumulated through the company’s operations at the NACL premises in Lusaka, Livingstone, Mfuwe and Ndola International Airports.
    This was as at October 29, 2008

She said this debt had continued to increase and now stood at K47, 291,700.00.The court also ordered Zambian Airways to pay interest at the average of the short-term bank deposit rate from the date of the writ of summons to the date of the judgement and, thereafter, interest at the lending rate as determined by the Bank of Zambia (BOZ) until payment.

    Judge Nyambe also ordered costs to be agreed between the parties in default to be taxed.

The govt is right,The Post as a tabloid will always cook up something against the ruling govt & its leaders so if Siliya is suspended,a precedence will be set where every leader shall be suspended whenever similar allegations against them are made.In my opinion,it’s up to Siliya to show some morality by seeking leave to pave way for investigations,the worst the govt can do is order Siliya to go on leave with full pay not a suspension,she’s not been found guilty yet & am sure the govt investigated the matter before the Veep could issue a statement on the status quo.

    • I doubt but it should be individual conscience that should compel people to make their decisions whether to resign or stay put,in this instance,Dora has been defended by the Veep who is the leader of govt so no one can force her to resign,it’s either she asks for leave coz she cannot resign if it’s not been proved whether the allegations made by The Post, a notorious tabloid.We all don’t want corruption of any sort but it’s up to Siliya to consult her mind.

  75. The rule of law demands that the law, as currently established, be followed without bending it either for “good” or for “bad”. So if allowing Siliya to continue in office while the Tribunal does its work be consistent with the law, so be even if some of you people are displeased. Otherwise, we will have Rule of emotions and anarchy will follow. If this law is not satisfactory, lets urge our constituency representatives (MP’s) to have the law changed. It will be unlawful to force Dora to step down and yet on the other hand insist that she is innocent until proven guilty.

  76. The Tribunal is conducting an inquiry and not a criminal trial. Besides, the tribunal will require her to tender her side of the story as Minister of Communications and Transport, hence she has to remain in office.

    • Dora will be asked to make submissions concerning the RP issue no because she is still Minister of C & T. Even if she goes on leave, she will still be asked to make submissions on the matter. It is for this reason that it would only be much more transparent if she (Dora) stays away from office (on leave and return if found with no case). This would give much confidence in the tribunal in that there will not be room for doubting whether or not Dora had interfered with the submissions from other parties (especially those under her ministry) when she is still in office. This is the best way she can make her position of innocence in the matter be proven.

    • We do not want our relatives in Zamtel to lose their jobs. Neither do we want them to remain employed while at the same time some newsreader steals what rightly belongs to us Zedians. Transparency is what we need.

  79. If you have noticed Kunda from the very begining has not commented on Dora. He only said let the judiary(law people) do there work and that he wouldnt comment. In other word that already showed that he is in her favour and he will definately defend her, banda is in support for her. One thing you should know is she will not be found with a case to answer.What they will do is delay things they will adjourn then adjourn then listen to the case the set her free.I can alost asure you on that. LPM had suspended Gladsy Nyirongo pending investigation why cant that apply to Dora, as Harrington said, using the presidents perogative.If its not in the law as Kunda said it means the LPM abused authority

    • You may wish to recall that Nyirongo’s saga was reported to ACC and ACC opened investigations against her and charged her while Dora’s case was taken to the Chief Justice’s office who has opened the way for a Tribunal. Besides Levy fired Nyirongo for defying his directive to have Sichone appointed as Acting PS at the time. Harrington has tied himself by going the way of an inquiry as opposed to the Courts!

  80. Lets hope the tribunal won’t be composed of MMD hencemen or job seekers otherwise it fail. And that Dora give the platform for more underworld activities which has become her trademark.
    Chiluba used defend offenders from Luapula,and RB is defending a fellow Easterner which they will be another one waiting if RB doesn’t handle this issue openly.
    Failures of MMD: 1-Fertilizer there’s no fertilizer for K50,000 not K250,000 and NCZ has already collapsed. 2-The budget is not in favour of the working class. 3-Mushrooming of corruption means limited DONOR support made worse with credit crunch.4-Massive unemploment from the mines,NCZ etc

  81. Let me warn President Banda and Dora Siliya that Vice-President George Kunda is not to be trusted with his advice. I ma sure you are all aware that the same George Kunda misled Mwanawasa into entering a nolle prosequi in a case in which former ministry of health permanent secretary, Kashiwa Bulaya defrauded the ministry of billions of kwacha. Where is Kashiwa Bulaya today? Prison. Now Dora should wake up to reality and step aside to facilitate for unfettered investigations in her dealings. Obviously will bounce back if found with no case to anwer, unless there is something that she is hiding.

  87. A DEFENCE witness yesterday told the Lusaka magistrates’ court that former President Frederick Chiluba had more than one source of funds that went into the Zamtrop account.

    The witness, Doris Nambeya, a Supreme Court master, said this was according to submissions made by then Attorney General George Kunda in the Anderson Mazoka and others versus Levy Mwanawasa presidential election petition. She said Mr Kunda submitted that the petitioners had not shown how public funds went into the 2001 general elections and ‘it would appear that Dr Chiluba had more than one source of funds.’

    SO WHERE IS THE SO CALLED CORRUPTION????

  90. the truth of the matter is that zamtel owes US$125million, governement paid US$16 last year on behalf of zamtel, moral of employees is low hence the constant problems therei. the post has deliberately ignored the cause of the problem, just because Dora took the right decision on ZA. even if Dora is fired, a partial privatisation of zamtel still has to be done and ZA still has to explain where the money went and why they were given three years not to pay NACL. we are getting tired of his petty politics and constant selective reporting by the post.
