Petition to remove chief Justice Ernest Sakala thrown out

Headlines Petition to remove chief Justice Ernest Sakala thrown out

Chief Justice Ernest Sakala
Chief Justice Ernest Sakala

The Lusaka high court has dismissed a petition to remove chief Justice Ernest Sakala and Supreme Court Judge Peter Chitengi from their offices.

High Court Judge Munalula Lisimba dismissed the petition by Lusaka lawyer John Sangwa after a two hour judgement on Thursday.

The Judge dismissed the petition on grounds that article 98 of the Zambian constitution does not provide for ratification of re-appointed judges.

He told the court that this is not with-standing that article 93 of the Zambian constitution requires judges appointed for the first time to be ratified by parliament.

Judge Lisimba said relying on article 98 of the constitution, a Supreme Court judge can be re-appointed under the president’s pleasure, without parliamentary ratification.

He further contended that Supreme Court judges cannot be subjected to the judicial service commission for scrutiny, before being re-appointed because they are members of the commission.

Judge Lisimba rejected the petitioners’ submission and contended that the petition was calculated to embarrass Justice Sakala and Judge Chitengi.

Recently Lusaka Lawyer John Sangwa petitioned Chief Justice Sakala and Judge Chitengi to vacate their offices.

Mr. Sangwa submitted that the two have attained retirement age and have not been ratified by parliament.

  1. We would be crazy to expect otherwise with this judiciary. Going after the head when his own head is in the pocket of HERB. Wafya.

I WANT THIS HOMO CHAP INSIDE . EVEN FOR A WEEK!

  3. Zambia seem to be a nation full of nothing, no people, no direction but politics only. Every decision made in the nation has an element of politics attached to it. When will Zambians be a who can change things according to the way they feel and they way they want? How come only the few that are in certain positions make every decision even with regard to who you associate and talk to? So, what next now that even judgments are politically induced?

  4. Anyway it had to be otherwise what type of country can that be where you allow such nonsense please slap them with huge legal costs…….good for nothing homos st upid f ools

  5. #9 Kalos2020. The answer is African presidents are more powerful than all citizens out together. See how the man is always enjoying ama none. Mailo ku States then ku Cuba. From there he will be in Malawi, then Zimbabwe. Who can talk?

  6. Please Membe I want you to lodge an appeal immediately……You should now dedicate the whole POST especially Editoria and your letters to editor ( written by editor) for the next one month for this case to go all the way to the Supreme Court and demand for a full bench to consider the case …… i can even hire a mob for you to protest from Post offices to Supreme Court and demand for something eeeeh maybe rights for those who like yakumboyo……..am mau less!

  7. I hear reliably that RB picks the phone to call judges or politically appointed people to instruct them on what to do immediately he hears some news. This man thinks he will be president forever? Zoona the more you grow old the more dumb you become.

  8. 2 many sick pipo kaponyas!. You wanted FTJ jailed, Supreme court Justices humiliated. What a sick nation without morals. NEVER will it be. hhhhahahahahahahah

  9. Why do African men, just want to hold to power? Look at Mugabe, Look at Kaunda( I am surprised some people think he is a hero), look at Chiluba to name but a few. These are some greedy African men, who think when they are in a ‘hot seat’ they will die it. How disgraceful and ill advised is that?. This man has to go, He is got to retire for all i can, where the hell, is his moneyhe made? what is he scared of. Its people like this Sakala that make a bad name for a humble zambian man. Its one of these reason, i have chosen to marry a whiteguy. Just astonishing and backwards. Somepone back me here please, iam so upset !!

  10. The Judiciary risks becoming useless in this country, the courts have become too predictable in Nyama Soya’s Government. MAy Almighty God help us.

  11. The ruling sounded as if it has a legal basis up until the point where the judge accused Sangwa of being out to embarrass the two judges. On what basis does he make this assertion? We all know that beyond a certain age one once’s mental faculties begin to diminish. In the case of Zambia the law as set this age at 65 years. Sangwa did not write this law!

  12. It is not about EMBARRASSING the judiciary, it is about following the LAW. Zambia, Twasebana. Munalula Lisimba was a struggling lawyer not to long ago. It is a case of having both sides of his bread buttered batata.

  13. #18 Sobongo. “The Judiciary risks becoming useless in this country.
” I want to disagree with you. Our judiciary became useless a long time ago. I always quote the Kenyan saying: “Why hire a lawyer if you can buy a judge?”

  14. The Judiciary is already useless.. Most pipo would prefer not to appear before these Megistrates & Judges. They are so predictable, corrupt and low Caliber. A few expections are not being assigned sensible cases

  15. Here are the beans Rev Lungu failed to spill….Henry Banda was Prince Makhosetive’s classmate at Waterford Kamhlaba School in Swaziland. Henry’s family through his mother, the late Hope Makulu Banda got to know the Prince’s family very well, particularly the mother, the Indhlovukazi. Makhosetive later became King Mswati and in the process RP Capital did some work for him. When Rupiah became president, Mswati introduced RP Capital to his friend and the rest , as they say, is history. Never in the history of Zambia has a Swazi king gone beyond the confines of Lusaka attending a SADC, COMESA or NAM meeting. Mswati going to Solwezi is something else. Icalo bashitisha.

  17. Ba Sangwa, making a name out of mischief. When you lose a case the Chief Justice and Judge must go; but when you win (e.g. FJT’s acquittal) all is well.

  18. “Zambia has an independent judiciary which is not subject to the discretion of the President or indeed any member of the executive”, read the letter.

This is falsehood of the highest order. The Minister of Justice, just so happens to be a very senior memeber of the Executive…George Kunda. I cannot believe how Zambians are duped everyday. When will we awake if ever? Ignorance is killing us. The saddest thing is the people tricking us are also “mentally challenged, but we continue to fall for their tricks. Jah save us!

  19. Who was forming the law of Zamba? It seems the guys were so mad or power hungry as to put so many contradicting closes. There are so many contradicting closes and this renders the law/constitution of Zambia useless. Very uzeless indeed.

  20. John Sangwa is a full time PF cadre known for taking useless unresearched orders from a bitter life time sole loser Michael Sata.He is a very disingenuous and mischievous PF cadre like Bonaventure Mutale in the legal fraternity. It was him who advisedly was behind the fallacy of impeachment as flawed as it were and this failed petition in acts of aberration.Sata in his Utopian thinking, he has promised him the CJ slot which Winter Kabimba a lenje is also fiercely fighting for despite knowing that this is wishful thinking as Sata will never ever rule.On the other Hand, HH also wants no other person but his tribesman Jack Mwimbu for CJ in the imaginary UPND or so called PACT administration.

  21. HH wants no other person but his tribesman Jack Mwimbu for CJ in the imaginary UPND or so called PACT administration.

    Sata want John Sangwa

But Winter Kabimba a lenje is fighting on his own for the same position despite all knowing that they will never defeat MMD in 2011 while 2016 it will be a Generational change political outcome obliterating their dreams.

  22. 18. MUSHOTA……………….EVERY COMMENT ON THIS BLOG YOU ALWAYS TALK ABOUT YOUR WHITECHAP; I THINK U ARE SUCKING THE POORMAN BIGTIME. EVERYTHING WASHOOOTAAAA IN YOUR LIFETIME HAS BECOME A REALITY. TALK ABOUT YOUR ACHIEVEMENTS. I DONT THINK MARRYING A WHITE MAN OR MARRYING A WHITE WOMAN IS AN ACHIEVEMENT. COMING TO THIS 1.D.1.0.T SAKALA. AT LEAST FOR ONCE I AGREE WITH U HE SHUD NOT HANG ON TO POWER UNTIL HE IS PRONOUNCED DEAD BY THE MEDICAL STAFF OF INCAPACITATED. THERE ARE A LOT OF YOUNG JUDGES BELOW THE AGE OF 70 WHO CAN DO THE SAME JOB BETTER THAN HIM. HE SHUD RETIRE AND TRY TO REST. ALREADY HE IS A COMMITTED CATHOLIC AT ST. MARYS CATHDERAL IN KALUNDU AND HIS HOUSE IS JUST NEXT DOOR. HAVING BELT A GLOTTO AS A PRESENT FOR THE PARISH USING THIS ABOVE RETIREMENT INCOME IS ENOUGH.

  23. Senior Nonsense #33 & #34, Who can you tell anything? You are such an ignorant sycophant of party poltics which you do not even understand. John Sangwa was simply trying to protect his criminal clients and wanted a loop hole for their escape. It has absolutely nothing to do with Sata or HH.You wallow in gossip as if you are God sent. He told you that the rumours you hear are gospel truth you illiterate sycophant, brainless party cadre? John Sangwa represents all criminals including Chiluba and other plunders simply for his monetary gain. I know the young men John & Robert are simply doing all this for money. They are never as dull and as manipulable by liars as you are. How much has Mulongoti paid this time Senior Nonsense? Are you another Rev Lungu? Stand and be counted if you are a man

  24. The Realist,
You kids never stops amuzing me with your protruding ignorance.I forgive you for ignorantly laboring but in vain to litter me with the rubbish heavy in your head. By Grace and all dimensions I’m far above your Utopian world.I sympathize with most of you futureless and disillusioned kids filled with envy and pull him down demons. These street and blog rhetoric you learn in the wilderness have really confused and ruined you off the radar of self actualization. So you think everyone you bump into in blogs is of humble education unsecured social security like you? If i may ask you one question, at what level of Political thought and MODERN CRITICS OF SOCIETY AND POLITICS are you competent to engage me?Does the street teach such?

  25. please can we have a new breed of people pliz..thats why there is no new development or different ways of deciding cases. black people!

  26. I can’t connect most of the comments to the story. Is it my reasoning which is failing or the comments that are misplaced?

#39,40 stop masquerading as a whitey when it is quite obvious that you’re as black as a Zambezi cod Umulonge).

  27. Just when you could not think it possible, Mushota found a white dude on LT lol. Anyway more education for all, African students are the overall high achieving and attaining college students we have. So I ask what are you based in the UKand around the world doing? At the least we of the nation called Nacirema are making it more powerful. Reason being our own leaders did not appreciate our sharp and wise intellect. Rest easy though we do send money andreading

  28. Okay can the govt give this man his pension and let him retire.? We can still use him as a consultant if we think he is so brilliant. Now we have some judges out there who are due for promotion and these are young intelligent lawyers, How can one seek audience with RB? Who advises RB? My services are pro bono. Actaully as soon as dual citizenship is law I am coming to run for office.

  29. I have to admit that I’m no lawyer and I don’t have full details of the judgement for me to form an informed analysis. Nevertheless, I believe that this judge erred in his judgement. It was expected anyway – what with all the political pressure from the appointing authority and the fact he had to rule on his own Supreme CJ, he had to do what he had to do.
I did read the analysis by LAZ’s consultant in yesterday’s The Post by a lady called Eva Jhala (I suspect she is Indian descent by her name) – it was a very intelligent piece that even a layman like me could see facts in it. You have to give it Sangwa for standing up against all the bureaucracy. He has earned by respect despite he defends criminals. As for the CJ, he has lost people’s confidence in him and he should resign!

  30. How can we as Zambians let these madalas in their 65-70+ run our country into the ground? What use are they to the 21st century? They have tried and failed, and it’s high time that they handed over to our generation. You mean to tell us that, out of all the educated jurists in Zambia, none of them are worthy to ascend to Chief Justice? Give me a break. What signals are they sending to our generation, that we are not good enough? Well, fellow Zambians, how long of this nonsense do we have to endure? The only thing that RB is good at is jetting around the world at our dime. He needs to retire and spend time with his young children and grand kids. How can we possibly progress as a nation without vision? As the Good book states, “without vision, the people perish.”

  31. #38-senior whatever- try to come down from your high horse and see things differently, you are indeed high above the UTOPIAN world because to you everything the MMD and Rupiah does is perfectly normal and rightly so because UTOPIA by definition is a society possessing a seemingly perfect socio-politico-legal system. You ask “at what level of Political thought and MODERN CRITICS OF SOCIETY AND POLITICS are you competent to engage me?Does the street teach such?” in zambian politics yes the street teaches you everything, from bootlicking to propaganda which is influencing the attitude of a community toward some cause or position. As opposed to impartially providing information.what political thought are you going to engage in in a society like zambia with people like you who are blinded…

  32. What other outcome could we really have expected from this? This was an academic exercise and personally, even for people I do not like, I am not a big fun of cases that set a bad precedence. Case in point, was unhappy with Chiluba’s gift to ZAMBIA (Levy) but after he was sworn in, I was not for the idea of removing him using the courts. These are definitely political problems that need political resolution. It looks like the constitution is pretty unambiguous on these kinds of appointment and as much as I dislike RB’s direction, this only gives him ammo. Abash RB. Abash George Kunda, Abash HH, Abash Sata(n). Abash FTJ. Abash the entire political establishment.

  33. Senile Citizen

Who were the people who brought these topics to a head?

Is it not Kabwe abd chungu and CHILUBA?

These are the reports in the papers over the last month.
Now you try to SPIN the truth around by blaming the opposition.

you are mentally challenged and backed into a corner on this one.
Now BLAME someone else this time.

  34. Modern criticim of society and politics is all about asking questions as to why a government would consider buying a Hearse instead of an ambulance, its about maturity, its about asking questions about the city, government, politics, liberty, justice, property, rights, law, and the enforcement of a legal code by authority: what they are, why (or even if) they are needed, what makes a government legitimate, what rights and freedoms it should protect and why, what form it should take and why, what the law is, and what duties citizens owe to a legitimate government, if any, its about engaging in debates, making the government accountable for all the decisions they make, its about letting the govmnt and leaders accountable for pronouncements they make, today the president says 10months,VP says 4m

  35. THERE IS TOO MUCH POWER VESTED IN THE REPUBLICAN PRESIDENT. THIS IS WHY THERE IS INCONSISTENCY IN THE RUNNING OF THE ECONOMY. WHY SHOULD WE ALLOW ONE PERSON OUT OF 10 MILLION PEOPLE TO MAKE DECISION AS THOUGH IS THE MOST INTELLIGENT OF ALL. THAT IS WHY PEOPLE TEND TO PRAISE THIS MAN LIKE god.
WE NEED ALL THE ORGANS OF THE GOVERNMENT TO RUN INDEPENDENT. THIS WAY IT WILL BE EASY TO PROSECUTE OFFENDERS WITHOUT ANY INFLUENCE OF THE PRESIDENT. PRESIDENT OF ZAMBIA IS IN CHARGE OF JUDICIARY, PARLIAMENT, AND EXECUTIVE.TOO MUCH FOR ONE PERSON……..

  36. 39, 40 THAT IS TRUE MWANDI WE BLACKS HAVE A PROBLEM…….GIVE US EDUCATION NO HANDS ON RESULTS BUT GIVE US A HUMMER TO DESTROY YOU WILL SEE. TOO MUCH UBUFONTINI AMA LEADERS…….AMA BLACKS OR AMA NIGGERS BWAFYA MWANDINI……………WE THROW DIRT EVERYWHERE ON THE STREETS, CHOLERA, NO WATER FROM TAPS, BLOCKED SEWER, NO FOOD AND YET GOD HAS GIVEN US EVERYTHING WE SEEK…….STUPID PEOPLE

  37. Mr Justice Lisimba is also looking forward to continue until death. So how can you people expect to do otherwise(Ukushinka uko bulesumina)?

  38. The Judges know that they will be the next. They are therefore creating a precedent to protect their future positions. Apparently the issue involves their boss. Pa Zed ili bad.

  39. Senior Citizen can lick feces if promised anything. I cannot imagine an adult with full fucntioning faculties defend this corrupt to to the core party of his.

  40. #51Smoothcriminal: Maybe you have heard this but I would like to share it wit you and others-NATURE of man: The Story- In one village an old man died and as she was going back to heaven she men a baby boy who was coming to be born. The baby asked the old woman about the world and the nature of man. The woman explained that the only way the boy was going to understand this was to be born death and dumb. Indeed the boy did exactly that. As he grew he started noticing that he was being accused for every wrong that took place. Then one day a prince drowned and every boy said ati nichibulu ewa chimusunkila mumumana(It is the deaf mute who had pushed the prince in the water). At this moment the boy decided to talk in order to defend himself. Even now we the voiceless are being mistreated. Cont.

  41. “LIARS IN CHURCH”
A preacher finished the service one morning by saying, ‘Next Sunday, I
am going to preach on the subject of liars.
As a preparation for my sermon, I would like you all to read Mark 17.’
On the following Sunday, the preacher rose to begin.

Looking out at the congregation he said, ‘
Last week I asked you all to read Mark 17.
If you have read the chapter, please raise your hand.’

Nearly every hand in the congregation went up.
Smiling, the preacher said, ‘You are the very people I want to talk
    to today.
    Mark has only 16 chapters.’

  42. 7, 53 and 54
Communication is based on a gradually evolving consensus, not what some “geekoid” decides. You should have a look at linguistics, the science of language, to learn more about how language works. For what it’s worth, capital letters have been taken to mean shouting for a very long time, long before the internet. We have developed a means for common courtesy when we write online in emails or blogs. We use the dreadful exclamation point too often, but we want to show enthusiasm in our comments and compliments for each others’ work, so I can forgive that. But common courtesy dictates that we not use all caps. when writing. Not only is it rude and difficult to read, not only do we feel that we are being attacked or even insulted, but it also is simply uncouth, in the same way…

  43. If the Sakala and Chitengi have reached their retirement age why cant they just step down on moral grounds why is it that old people still want to work ndalama sizipaka iyo…….

  44. I think with all senses this judgment is very legal and professional. It should be noted that Sangwa and his minions accepted to have their cases by the same judges they are trying to embarrass until they lost their case. Should lawyers only seek that which favors them? This I believe defeats the very purpose upon which justice is sought. Anyway I am disgusted also by LAZ by being double tongued and now they find themselves in a very embarrassing position.

If the law is silent on something, then the principles of justice remain that the verdict shall be passed in favor of a defendant period. The law does not expressly talk about ratification by parliament of reappointed judges and thats it.

Sangwa and Membe stop embarrassing the judicially.

When a winner was announced the others protested that they were uglier than the winner therefore they were entitled to the U$200,000 prize money. I tell if there was no money involved these people would not accepted to called ugly.

  46. Where is Justice Kabaza Chanda?? I miss this man very much. All this rubbish taking palce in the Judiciary reminds me of him. He was an independent Judicial officer un matched in the country. No wonder Chanda Beu Kafupi could not stomach the Judge’s stay.

  47. Hello, we still waiting here. Can we have the Senior Citizen respond to the defenses/corrections put up by Smoothcriminal and The Realist, Or may be he’s run out of his self proclaimed HIGH IQ b4 we conclude the man is in actual sense from UTOPIA?

  50. Hey Mushota-Linguistic has got nothing to do with the use of CAPS,thats how as an individual you percieve it,an opinion-Linguistics encompasses a number of sub-fields. An important topical division is between the study of language structure (grammar) and the study of meaning (semantics and pragmatics). Grammar encompasses morphology (the formation and composition of words), syntax (the rules that determine how words combine into phrases and sentences) and phonology (the study of sound systems and abstract sound units). that is linguistic in simple terms, nowhere in the study of languages does it state the use of caps means shouting,i beg to be corrected, please dont come on here with unresearched opinions about the use of linguistic and capital letters, get your facts right dear

  51. white man supporter, thank you very much for the support mate. as for mushota babes, holla at you boy init? are you shy?

  52. I read Lisimba’s full judgement and it makes sense, a lot of it! I hate to be on the same side as Kanitundila but this ruling, unlike Phllip Musonda’s masalamusi over Dora and Chinyama’s excrement over Chiluba seem to be backed by facts in law that all seem to be logical. I wonder where Sangwa’s two convicted criminals are going from here, Chimbokaila! As for Banda, we shall see how he will have Chiluba’s immunity reinstated.

  53. 73
What a load of drivel. ! Why are you putting definitions in your ‘comments’ What a retard you are. Another of my many reasons why making an acquaintance with a zambian man is a mistake I will refrain from. Communicating with you is hard enough, let alone you trying to explain something that you should really forgo. You are much unsaved if you know what i mean. Pathetic. What a retard

  54. I’m failing to understand you pipo: Judge acquits Chiluba (Rupiah pushed Judge). Chiluba wants Judge to go, Judge defends himself (it’s still Rupiah who intervenes). Don’t u think this is being contradictory? Are u saying everything in Zambia hinges on Rupiah?
You guys think RB is a god. He is not omniscient! He’s not all-knowing.. He may have spies but they can’t manage to make him intervene in all things. Besides, you r the same pipo blaming him of being a world traveller, wat time wud he (RB) have to read all thing and know all things without being a god ? You the citizens r the ones that are creating these monsters we call African presidents. RB didnt make the constitution. We did.

  55. What next the petition has been dismissed? Let us accept the ruling. That was the best way do deal with serious matters by going to courts. But I need to read the full context of the ruling.

  56. Now who is a retard LMFAO!!!,you come out here with lies about linguistics and capital letters, without any facts, like i said i beg to be corrected….tell us whats the connection between linguistics-the science of language as you rightly put it and capital letters.do a bit of research before you expose your ignorance—–now you are a retard coz you tried to lie and the lie has caught up with you-cretin

  57. Is there anything that any ordinary zambian can do or say without the interferance of the president. Do we even have any say in what we as citizens want and dont want. These laws where definately not meant for Zambians but for the president. No HOPE for the country if this never gets fixed

  58. Well, I think all those who have delt with Justice Sakala will tell you that he has bollocks made of steal. In the Chiluba partenity case, he was the only judge who ruled that to meet the requirements of that constitutional requirement for all candidates there ought to be a paternity test in a case where paternity is contested like was the case with Chiluba and Kafupi. All the other judges tucked their tails clean over their dirty prats. I for one doubt Sakala would curl to anyone, worse still Kanitundila. It is Sangwa and his thieves afraid of this gallant judge registering our London verdict against Kafupi whence this embarrassing charade. To me, he should stay on the bench intil Chiluba is on the cross. Halleluiah!

  59. Its characters like Sobongo Kibanda waba Kabwa who not predicatable. Let us not forget that these judges are just human beings who have attained their status through training, studies and practical experience over the years and are not perfect in their judgements. Sometimes they may make mistakes but one may not question their actions other than thru an appeal. We dont live in a country where there is jungle laws. Survival of the Fittest. Let us not try to digrace the judicial, lets not loose confidence in it let us build the delivery capacity of all our governing institutions. For as long as we dont actively participate in public affairs we keep on crying like children over unfulfiled promised gifts. To attain anything on earth we must put up a fight.

  60. #46 Jigga: Eva Jhala is a former PS in the Ministry of Justice. She is a Zambian coloured.
As for her legal opinion in the Post it’s just one in the many opinions that you can expect from the many lawyers in this country. What you must know is that you can have as many legal opinions as you have lawyers. That is the reason why society has created the institution of courts where we have reposited the responsibility to interpret laws for us. It is not perfect but that’s the best that human society can do until the Lord returns, not when the Post says so.

  61. PEOPLE LIKE NUMBER 7 ARE THE ONES WHO HAVE BROUGHT ZAMBIA TO WHERE IT IS BECAUSE OF THERE FOOLISHNESS AND SHORT SIGHTEDNESS. YOU CANT SEE THAT THE JUDICIARY IN ZAMBIA IS A SHAME!!!!!!!!!!!!

  62. President Rupiah Banda is one of the first Western educated Zambians in the Diaspora so he the best man to appreciate our community. Not surprising that President Banda has opened a liaison office at State House to deal with issues concerning Zambians in the diaspora.President Banda said he had decided to set up a liaison office at State House to deal with issues related to Zambians based in the diaspora.“In addition, I have directed the minister of finance to work with the diaspora to facilitate their participation in growing the economy through investment in projects of their choice,” President Banda said.

On the media, President Banda said the government was considering privatizing some government run and controlled media organisastions.

“I wish to inform this House that my…

  63. Senior nonsense #38. Read your English and read mine and you tell me who a street kid is between you and me? You live off Mulongoti’s stolen cash, do you deny it? You live off stolen money and I can tell you who your connections are and what you rexpectations are you brainless party cadre. Challenge me if any of the things I have said are false. Tell me what you do if at all you are a professional because I know you are not one. But you keep lying to people that you are a lawyer, which lawyer can write such nonsense like you? It is people like you that are a danger to society and shall be responsible for its underdevelopment. Watch it you brainless party cadre, you are only digging a grave for your own kids.

  64. Number 38, it’s clear to me that you’re lost in this forest of free speech, in a century where I can read your mind from ten thousand miles away. The good thing is, you’re entited to your opinion, and so are we. So, feel free to respond in your mist of foggy lines and abused words. We love The Motherland, and that’s why we take our precious time to blog. Siala sinde, mune.

  65. #92 why did you wait so long to jump on board? Thank you for your comment hope it is not taken in the wrong context. We need to keep open minds but at the same time we all know what time it is! What time is it again?

  66. Na\talie ~
#87 you are the best, it is amazing how biased the bulk of bloggers are. The only time they agree with any judgement is when it is against the state. While i may not agree with certain judgement, I do appreciate that there is always two sides to things and the role of the courts is to interpret. Trully and really I welcome Sangwa’s action on behalf oh hisconvict clients because it provides a chance to interpret the law. And if it is felt that the constitutiion if faulty in the topic at hand then we can talk of amending it. However my view is when someone is ratified by parliament my take is ant extension is administrative since he passed the first stage and this fits in well with the permanent nature of Judicial offices. I however note that Eva Jhala argument also makes…

  67. # 94 POSITIVIST PA ZED, I agree. We expect divergent views among 10 million+ citizens, but we can disagree intelligently and constructively.
