Zambian confidence will be restored if Sata deals with Mmembe/ Nchito before dealing with Judges

I read with dismay at the style of leadership that President Sata is exhibiting especially with regard to the suspension of the 3 judges.We have no problem investigating the 3 judges and the judiciary as a whole, but the manner in which Sata is doing it, leaves so much to be desired.

Firstly the suspension of the Judges came as a result of the judgement that was given in the K14 billion issue that his friends Nchito and Mmembe are involved in. Suppose the judgement was in favor of his friends, would he have gone ahead to suspend them and set up a tribunal? I don’t think so.

If he wants to show the general public that he is allergic to corruption and he is in there for the overhaul,why can’t he first suspend Nchito and then investigate the issue with the K14 billion and tell the nation that he will recover the money from the duo. It does not make sense to us to investigate the judges when his partners are refusing to pay back tax payers money.

Let him deal with Mmembe and Nchito before dealing with the judges and that will give us confidence that he is in there for the job and for the
poor ordinary Zambian. He should not even lie to us that he wants to clean the Judiciary, he wants to hammer them because they gave judgement not in favor of his buddies.

Look at the number of tribunals, if they make submissions not in his favor he hammers them and tells them that they don’t know what they are doing. Sata is ruling Zambia with preconceived ideas and if you challenge his authority then you are in trouble.No wonder those in his camp are so afraid of him and its only online papers who can provide checks and balances and report on real issues without government pollution.

I used to follow other news medias a lot because they used to be objective in their style of reporting and now it looks like only online forums can provide us with that objective role of alliance for what’s going on in Zambia.

Secondly the setting up of so many tribunals is a waste of tax payers money at the expense of the poor ordinary Zambian. The fight against corruption is so selective such that people like Nchito and Mmembe are free to do what they want because they are untouchable now. The
mounting pressure to have the Chief Justice resign is an indication that they want people to shift the attention from the K14 billion to
issues that are not at hand.

If we want to have the Chief Justice resign, lets call for the resignation of Nchito and believe me Nchito will never resign on moral grounds and Sata should be made aware that if he does not do the right thing with the issue of the K14 billion,he is putting himself in jeopardy and one day these mistakes will visit him because no government stays in power forever.

Even the single sourcing and awarding of contract to Chikwanda’s company to renovate state house is an issue that will visit him one day. I wonder why Guy Scott has even tolerated the PF this long with the mistakes they have made so far, I thought he was a gentleman who would address
those issues with the PF or even resign to protect his name. The mistakes, intimidation and shortfalls we have seen so far in the present government is a clear indication that the government has no idea what they are doing and they have lost direction which they did not have in the first place.

Political campaigns are different from reality and it is very easy to say that will perform outside of realism and when given the reality of platform, performance is deterred by conceptualism of the fact that it takes a different position to comprehend what we promise. We do not appreciate the new concepts of intimidation and selective fight against corruption being brought in the political arena and into he country by the PF government, we need to enhance the livelihood of our people for a better tomorrow and know that what we do today will come to haunt us tomorrow and that is something that the government of the day need to be made aware of by the media.

    • You PF cadre you honestly think that moeny will be given back? We all know Chiluba stole and was guilty but was he ever found guilty? This is government my friend. Sata and his goons are not giving anything back. After he is gone we will be saying he was a thief too but will he ever be found guilty and pay back whatever he could have stolen?   3. Well spoken Banda, Its time to call a spade a spade and not a big spoon. These issues are very clear and straight forward as Banda has pointed out, let us not protect the criminals and victimize the innoncent judges. I feel the K14 billion should be paid back and there is no need for a tribunal, its just a waste of tax payers money.

My understanding of this issue is not that Sata is against Mmembe and Nchito paying back the K14Billion of public money they owe DBZ, but the conduct of these judges in the process of dispensing justice. The complaints against these judges also came from LAZ, a professional regulatory body among others. Its therefore prudent that judiciary is cleaned in order to restore confidence.
    I am interested in seeing that the K14Billion is recovered in full
    D Banda’s article has mischaracterized what necessitated the formation of the tribunal. He does not understand how judges’ misconduct and incompetence can be a source of anarchy in the country and it had to be truncated forthwith.

    • LAZ has been complaining about other Judges and not these three for corruption, late or non delivery of judgments, laziness and sheer incompetence for a long time now and nothing happens. Two people complain and boom we have a tribunal.

  5. This article sounds like its one from the opposition, merely trying to oppose Sata. In the first place, investigating the ills of a former regime is something everybody does to clean their house, if the MMD was not corrupt, all these tribunals wouldnt have been set up. Even Mwanawasa had to set up the task force which consumed a lot of tax payers money but indeed certain things changed and some funds were recovered. The tribunals are even a cheaper method than Mwanawasa’s task force which never utulised the already established govt structures to fight white collar crimes! Lets learn to criticise constructively, and not just because you are not the one in the drivers sit.

  6. D. Banda has hit the nail squarely on the head. Debtors refuse to pay, they appeal to the supreme court and before the case is heard they run to the president to complain. There is something fishy here. The day of reckoning will certainly come.

  9. # 13 well said, Sata has never said he does not want the 14 billion to be paid but rather the misconduct of the judges regarding the judgement of the 14 billion. i wish Banda could enlight us more on the tribunals which have not achieved the intended purpose. The problem with Zambians we intend to be ahead of ourselves without reading carefully and understanding situations. All tribunals go through to cabinet and its up to cabinet to make recommendations. we need to understand that Sata as an appointing authority could have easily just fired the 3 judges without a tribunal if he really wanted to protect his friends

    • The tribunal makes recommendations and it is then up to the appointing authority (which can be cabinet or in this case Sata) to implement.

The author of this article has even forgoten that this country lost K200bn plus through the failed George Kunda(MHSRIP) led NCC which gobbled billions of tax payers money due to a corrupt judiciary! Majority of the NCC participants were from the legal fratenity – Judiciary! So why not sort out this ailing judiciary and let Nchito/Meembe be liable for what they owe DBZ as a purely business trancastion they entered into? Lets move away from personalities like Nchito and concentrate on sorting the Judicial dispensation in this country which all poor Zambians depend on! Shame on you haters!

    We all want the K14Billion owed paid back in full with interest but it has to be done within the provisions of the law.
    In fact what is at issue is not the judgment handed down but the exploitation and perversion of the judicial process by the suspended judges.

    If your judges are innocent lets wait for the outcome from the set tribunal which is not as costly as you claim compared to the set commissions during your regime and if the two guys you are disrespecting have something to answer prove it since this issue started in your MMD regime.

  16. This is an bjective truth. We are concerned with the manner in which this government is running the affairs of all of us. In one way or the other watever the head of the state says or declares it affects us whether positively or negatively. And for this one, it really affects us negatively. Fight corruption has now been seen as a mere talk or witch hunt no difference with the MMD. At least with the MMD RB had to lose the case certain cases ie Kabwele of which we thought she was going to be jailed for that report now with this govt any case against it or its allies when its not in favour that means trouble in the judiciary.May the govt do this with the right attitude and mind.   18. Comments raised in the article are of profound importance if PF government is going not only to be HEARD, but to be SEEN to be effective in its governance of national affairs. Currently, there is fear created by the president in his administration to effect administrative procedures in implementing tasks for the nation. Almost every move has to be cleared by head of state. The cleaning of the judiciary is a welcome move as the fight against any corruption. However, the modus operanda is ineffective. It does not convey seriousness on the part of Mr Sata for two reasons: 1- Institutional tools exist for him to make use of but has picked wrong personnel to do the job.     I do not see any unfair judgment which has been passed. Nchito and Mmembe stood surety for the debt. They need to pay up. Thats how business are run. If they did not stand surety DBSA would have never given them the loan.

Openness and transparency demand that this would have been his bench mark on how he was going to proceed with every similar case. Even Vice president Guy Scott made a scarnty comment in form of a promise to the house..end of story. He too is afraid like all civil servants. Suspension of judges on allegations of corruption is good move for fair delivery of justice in a nation. The question is when was this move to be made? Certainly not after delivery of judgement that seem to be against Sata or his friends. Last, Mr Sata’s silence over K14billion owed to DBZ that came out of that judgement betrays his very belief of being allegic to corruption. How does he dismiss judges on allegations of corruption who presided on a case that boarders on corruption or failure by his own officers to repay the loan to Zambians? His silence over Nchito, Mmembe on how and when they will pay K14 Billion to Zambians has amazed many in the country. We hear efforts are/were being made for DBZ to write it off as bad debt. Surely, does this convice Zambians Mr Sata can fight corruption? The big issue is stuck with Mr Sata. An elephant in the Zambian’s living room. Get rid of it or keep it?

  26. I find articles like these intriguing. It is amazing how much time Zambians waste on discussing irrelevancies. The issue of Zambian Airways and their lenders has to be dealt with according to the Laws related to the Companies Act. If that Act is inadequate, it surely cannot be the fault of Mmeembe and co. The current government played no role in lending monies to Mmeembe and co. I would also like to point out that companies collapsing and being unable to repay lenders, is commonplace in Zambia. Look at CEEC and you can clearly the trends and culture pertaining in Zambia. It is sad that people can ignore facts and continue to mislead. On the issue of the judges, I agree with MCS. People in the judiciary, or any other arm of government, cannot continue to be as corrupt as they are.

  30. What pisses people off is the way Mmembe and Nchito flashes their ‘wealth’ around.

    Nchito meets this known car dealer with the latest of his brand in the car park of a known hotel. Nchito falls in love with the guys’ vehicle and writes a cheque for it there and then…a cheque of around K300m. Mmembe imports over 100 vans for his paper…he is charged duty in billions and pays it without any qualms. Then people hear these two jointly owe the government K14b which they’re refusing to pay…and they are there mapping the route for the country….

  33. Someone needs to help us here.What exactly did the judges do that amounts to misconduct to attract the wrath of the President?Is it issues to do with their execution of the profesional duties? Who deals with and how should issues of any professional misconduct of judicial officers be dealt with?

    • The are allegations of Corruption which the three Judges have to answer before the Tribunal of Lovemore Chikopa.The other allegations is that the Two Judges jumped on the case which was being handled by Judge Wood.The Judicial procedure is that since Judge Wood had recessed himself from passing Judgement,the case must have started afresh instead for going straight into Judgement.The Judges did not follow the procedure which is laid down in the Judiciary.

All these issues you are talking about including the 14bn will come out in the tribunal and more. Why not wait?   42. Here we are not talking about the 14 billion that Inchito and Membe or the 200 Billion that UPND stole through the NCC, but the rotten judicial system in Zambia which must be cleansed. The judiciary in Zambia must be cleansed period.

  47. #61… your view on the administration of justice is unavailing. When these issues of corruption and other cases are taken to court, we all want them to be handled judiciously and in accordance with the law and not because the head of state is calling the shots in the background.
    Corruption cases are all decided in courts of law and not by the president. No one must be allowed to usurp the judiciary and use it to fix others, it’s a recipe for despondency and anarchy in the country.
    Therefore the judiciary has to be put in good order ab-initio
    Come on don’t be a retard and just shout we want our K14Billion… Yes we do… but there are laid down legal procedures to be followed even by judges.

We need change in totality with things which defines us, such us our constitution,our beliefs,school syllabus,their is need for our elector board to look on how political parties source their revenue, because this is the genesis of all corruption, if we regulate the source of funding of political parties will lessen corruption, because most of our politicians are the biggest culprit,they don’t have proceeds out side politics,they have never governed any private firm apart from being in government or awaiting to be in government so that they plunder our resources.
