Nevers Mumba condemns RB summoning, threatens to impeach Sata

MMD President Nevers Mumba has strongly condemned the decision by the Anti-Corruption Commission to summon Former Republican President Rupiah Banda over allegations of corruption and other criminal activities.

Dr Mumba said the MMD is appalled at the abuse of both office and constitution by President Michael Sata and the PF government.

He said President Sata’s instruction to the ACC to demand that Mr. Banda be summoned is a major breach of the constitution which has provided immunity to the former Head of State.

Dr. Mumba told a media briefing in Lusaka this afternoon that Mr. Banda enjoys immunity and that the demand for him to face the law enforcement agencies in an illegality that must be stopped.

“As a party, we do not seek to defend any wrong doing by anyone of us. If there is something wrong done while Mr. Banda was President, that can only be pursued by following constitutional provisions,” Dr. Mumba said.

He said the MMD considers the action by the ACC as part of the ongoing harassment of MMD leaders with the hope of destabilizing the party.

“We have not reacted to President Sata in his unreasonable assault on the opposition. His total disregard for the Law and the constitution he had sworn to defend. Today’s action is a step too far.”

Dr. Mumba said the action comes at a time when the PF wishes to sidetrack the population which is demanding to know the whereabouts of the President and his condition.

“The action also seeks to divert people’s attention from the failed policies of the PF administration,” Dr. Mumba stated.

He warned that the blatant disregard for the law and constitution continues to provide necessary material for the impeachment of the President.

Dr. Mumba alleged that President Sata wants to freeze the constitution so that he can govern by decree.

“The MMD is ready to stop the PF from fatally injuring the democratic gains made under the MMD leadership. We shall fight using all constitution avenues available to us including impeachment which now remains a strong alternative to stop this President from ruling by decree.”

He also condemned the action by the ACC to release the letter to all state media even before Mr. Banda could be served with the letter.

    • Ba Nevers will Never be our president because apart from running away from the pulpit u cannot understand the basics of Law. Our former president Mr. Rupiah is not being prosecuted but being interviewed for what he has always been suspected to have done: he has immunity against prosecution and no Zambian will allow that to happen without his immunity being lifted. Finally let the man clear the air, thats democracy.

    • Just follow the constitutional procedure as outlined.Nobody is saying RB CANNOT BE QUESTIONED about any criminal act.Lift his immunity first.If one enters a house through a window when the door has no impediment for you to use,if it is your house,people will think you are getting mad and yet if it is not your house you surely risk being arrested.There is nothing that stops PF from lifting RB’S immunity, but to parade him before the so called task force is madness at its worst.RB SHOULD JUST IGNORE THE FOOLISH SUMMON FROM WANDI.

      When immunity was lifted from one Kafupi, some people cried foul saying he had not been given chance to be heard. Now one RB is being given a chance to be heard before immunity lifting procedures can be implemented, some big-mouthed people are crying foul!

    • @ Stephen. When people have been telling you to read the Zambian constitution you have decided to ignore them and oppose everything from a point of ignorance. If you pick up the current draft constitution (as a guide) you will see that on page 66, clause 96 clearly explains this matter.

After questioning Rupiah Bwezani Banda for wrongs done against the Zambian people (looting with his cohorts – a mere peasant farmer turned millionaire in 3 yaers) while he was in office and prima facie case is established, Parliament will decide whether to list his immunity or not. In the event that his immunity is lifted, let him dance to the music like one Kafupi Wa Bufi danced to the tune. Useless and senseless Pastor.

  2. The Question is: does a former president’s immunity cover being questioned by law enforcement agencies or it covers prosecution only? It it covers prosecution only, then the ACC has the right to question RB. I think that interpreters of our laws have given the GRZ advice on this.

    • That is one thing I wonder about these so called prayer warriors, they don’t pray for substantive thing like, “let’s pray to stop crime in Chibolya, or poverty in Misisi.” If indeed prayers worked, some of the major battles Mumba is involving himself in, assuming they are legitimate, would be solved by a prayer. But even he know, prayer does not work!

  7. Although I am a Barotseland national, i find this very provocative and unconstitutional, i read the letter in its entirety and there are only threats without substantiated facts. This is a scheme by the top leadership to have ba Bwezani imprisoned. Ba Bwezani you are only paying for your current international recognition. The President (SATA) knows too well that he will never achieve what you did for your Country in three years even if he be given a third term (15 years)

    What are his latest successes? Is it the rebased Kwacha which is now trading at 5,500 to the dollar? the rampant Mealie-Meal Shortages, formation of one party state and creation of a PF police or appointment of maids, secretaries, relatives as Ambassadors???

    But let me say this: This whole exercise is a total waste of time and cover up of how useless this government is being seen in the eyes of Zambians.

    Lets face it, Zambia has divided parliament and you need two thirds to pass anything sensible. In short Sata can’t be impeached and RB immunity can’t be lifted.,neither side of the camp has the numbers .

    It is sad for PF to start creating these time wasting debates. Can we develop this country please? Can Prof Chirwa hold another public lecture to stimulate us to debate about something sensible please? Am tired of so much trivial day in day out

  10. Nevers is a joker who obviously knows that if RB is also under investigations for the over adulterated corruption, the funding for clueless campaign comes to a halt. There is no doubt that alot of corruption happened under RB’s watch and rightfully so the whole MMD was a bunch of plunderers. PF is definitely on drive to consolidate its hold on power but Nevers should not misinterpret his flawed pollitical campaign as the focus of Zambia’s greatest politician President Sata who undoubtebly remains the country’s most inspirational and visionary leaders. Questioning with intent to prosecute and convict a third party, or to question the summoned party who might implicate himself/herself in a matter before court/under investigations, and prosecuting the summoned party is one and the same. The immunity acts as a membrane which can easily be punctured by a formidable team of prosecutors. The very same constitution which provides the shield for the former head of state against prosecution, it smultaneously creates cracks in that immunity. Dr. Mumba is correct to protest against the issuance of the summon in which Mr.Banda has been subpoenaed to appear before the investigation team.
    The other option/root which the MMD must consider is to immediately assemble an experienced of team of criminal defence attorneys who can advise Mr. Banda.

Unless he knows he doesn’t have many years to live, which is likely. May be Zambia would be better off. We did not vote for dictatorship. If he doesn’t like it, let him leave State House. If he wants to deal with RB, Sata should ask Parliament to lift his immunity. The stup.dity of illterate presidents is that they forget that they will be treated exactly the same when they live office. Nobody is saying RB should not be investigated, but the law must be followed. We are getting really tired with this very sick man….honestly.

      What should guide the decisions of any worthy government official or the President is the national interest and not self interest. All your reasoning and complaints are based only on the consideration of self interest. The President and all well-meaning government officials must never act solely on the basis of self interest, but must consider the benefit for the country. If Mr. Sata does wrong while serving as President and is prosecuted after his tenure, should that be a major consideration whether or not to visit other current or past wrong doers with the law?
      Let us think more dispationately and argue more intelligently!

  18. How do you gather evidence without questioning somebody? How do you remove someones immunity before you establish if whatever allegations levelled are true or false? How do you conclude from hearsay and present the allegations to parliament before the alleged person is question and given a chance to clear himself? What if we remove RB’s immunity and then find out that the allegations are not true are you going to restore his immunity?
    Let us be objective let the man clear himself and if its not true then he continues to enjoy his immunity.
    Do you have to remove his immunity before you establish the truth?
    you will only go to parliament when the evidence is proved and ready to prosecute, its not like you are prosecuting the man its questioning.

    The point is ACC has lost the moral authority to champion fight against corruption. The ACC should stop playing double standards and ensure fairness before the law.

    Why is she in a hurry? Why not present the allegations to the house for consideration; It’s only the National Assembly that can open up a former Head of State for probing by stripping off his/her immunity.

Irrespective of our differences with the Sata’s camp, if the law was breached and there is enough evidence against suspected parties then the attorney general must compile a dossier and place it before a jugde president at a high court level. Witnesses willing to testify against the prime evil accused persons must be placed under a Witness Protection Programme. Only after the witnesses tender wholistic evidence in which they also implicate themselves in the commissions of crimes, then the presiding judge president upon satisfactory reflection of the state tendered evidence he/she can grant amnesty to the witnesses.
    Therefore, Sata should not unnecessarily be condemned before the would be marathrone prosecutions are concluded. Let legal minds argue and cross-examine witnesses.

    • Mutomoto, you must also look at the expanded version of Article 43. This is how the law is applied, it requires you and I to expand the taken for granted. Simply put, the cream of the matter is not what it seems. It is not give and take. The law provides other loop holes for the prosecutors to build a formidable against the former head of state. It is the duty of the defense attorneys to identify those flaws and to develop a defense strategy so as to puncture the state case against their client/s.

They hate being challenged, get offended when questioned. Personally I feel RB was Zambia’s worst leader but I don’t feel he should be persecuted but let him be answerable to any crimes and abuses he may have allegedly committed.   33. Educated or not SATA remains President of the Sovereign State of Zambia. Imagine, he defeated all the learned Pundits of this Mother Zambia in September, 2011. Hesh it is sad that people are still choking with envy over SATA’s Presidency under the pretext of opposition harassment. Truth be told; How many Zambian Professors, Fellows, Engineers have done anything tangible for mother Zambia from time immemorial? Sata should be given credit in his seemingly humble education, he has managed to ascend to the presidency the highest office in the land. It takes God almighty to select a leader for his people at a given time. David and Goliath story in the Bible speaks volumes as to what God does.

  34. For FJT, there was a dossier called the Matrix of Plunder of National Resources as perpetrated by FJT and his people. The same dossier was presented in Parliament to lift FJT’s immunity by the then sitting president, LPM. Why can’t the same be done for RB, so that his immunity is lifted and prosecutions can start and then we can all move on. Where is the problem? We are now beginnig to use technicalities of ‘it is questioning and not prosecution’. Why use shortcuts. If data is readily available as it is purported, please present it to Parliament through HE MCS and get the man in the dock to answer for his ‘sins’. Zambians seem to enjoy such gymnastics that do not add value to anyone.

  37. There is no court above parliament in Zambia that can begin to question RB allegations of corruption. To begin with PF govt should have moved a motion to remove immunity of former president Banda. There after motion successfuly goes through parliament, then spineless ACC controlled by PF Sata should have the ball to play around. At it stands now it just demonstrates how ignorant the entire PF group is ( may be aware but choose to trangrace the law deliberately, however this leads to bad and crookedness as character of PF governance in the eyes of Zambians). This wont reap any positive results until PF govt is schooled in governance. Zambians await further action, in the same vein we do not shield corruption where proven law has to take its course as was the case with late Mwanawasa reign.

  38. The likelihood of prosecuting a case in which Mr. Banda is likely to stand trial or testify has nothing to do with the Sata’s victory in 2011 presidential elections. And there is no proof that God favoured Sata over other presidential candidates. If the work of hand picked investigators is to enjoy the respect of legal minds and that of the citizenry, ‘activities’ associated with Sata must not be connected with this investigation.
    Sata is not immortal and he cannot remain in power indefinitely. The same sovereignty which Zambia exercises can compromise the powers and limits of a president if abused. So beating drums of ignorance is as good as jumping the gun or shooting oneself in his/her foot.
    One has to define the powers enjoyed by the rulers in to proportion to the ruled.

    • @ OGA – First of all, there is no English word called “prisidential”. You have been looking in the wrong dictionary, no wonder you are confused and your reasoning definitely sounds weird! When you find the correct spelling, you will understand the point that everybody else is making. Try and look for the correct spelling in The Concise Oxford English Dictionary…at the British Council Library in Lusaka. After consulting the COE Dictionary, PLEASE go to Wynter Kabimba and warn him about the dangers of getting rid of English in our schools. Just imagine the damage that will happen to you or your children 5 years after learning in your mother-tongue – you won’t even be able to consult Google or comment on Lusaka Times. Problem is, you PF chaps can’t think beyond your noses!!!

  46. TIMELY ADVICE FOR ACC’s Rosewin Wandi.
    If the ACC Director-General got her degree at UNZA she must have known of an important humanity course based on the “African Studies”. However Rosewin must first glance at our constitutional calender to realise that PF has only 3 years of its rule in govt. Rosewin must be extra careful if she has to sustain her job in Zambia. Rosewin is embarking on dangerous errands. She must know that: yes Sata has his supporters; but leaders such as Milupi, Sakwiba Sikota, HH, Nevers Mumba, including the former Presidents Chiluba, Mwanawasa and RB, also have numerous supporters too. Rosewin’s assignment to harass RB will infuriate the people of Eastern Province and the rest of Zambia. She is fueling explosives that will soon blow-up in her own face.

  47. I wish to advise the Movement for Multiparty Democracy (MMD) to make use of its legal minds before making statements that have the potential to further embarrass the former ruling party. Article 43 (3) of the Constitution of Zambia does not bar a person enjoying immunity such as the former Head of State Rupiah Banda from being interviewed by investigative wings. Former President Banda is only insulated against being charged and that is not ACC’s jurisdiction. It is therefore an exercise in futility for the Opposition MMD to attempt to make Mr. Banda’s summon as an illegality.

  60. MMD cannot impeach President Sata because:
    a) The full house has not sat in parliament as some members are not fully serving a mandate ie. their elections are still being petitioned.
    b) A 2/3 majority is needed to impeach a President and both UPND & MMD do not form that number.
    c) There are no grounds for impeachment, the issue of nominating Chibesakunda is not impeachable since she has not been appointed yet, Obama made unconstitutional appointments last week and all that is done is such instances is to invalidate the appointments and not impeach a President.
