RB warned and cautioned, questioning continues on Friday

Former President Rupiah Banda has been warned and cautioned on three counts bordering on corruption. Spokesperson for the Joint Government Investigative Team Namukolo Kasumpa confirmed the development in an interview with Journalists in Lusaka this afternoon.

Ms. Kasumpa said Mr. Banda has been warned and cautioned for his role in the oil supply deal with unnamed Nigerian oil firm.

She said Mr. Banda has also been warned and cautioned over the campaign materials for the 2011 elections and the Mpundu Trust Development Project.

This was after Mr. Banda was questioned for the second time this week on allegations of corruption during his three year reign as Head of State.

Ms. Kasumpa told journalists that the former President cooperated and was remained calm during the questioning.

She however stated that Mr. Banda is still expected to return to DEC Headquarters on Friday for continued questioning.

And Mr. Banda’s lawyer Sakwiba Sikota has accused the Joint Government Investigative Team of lacking sufficient evidence against his client.

Mr. Sikota told journalists in Lusaka that the investigations team had not done their work properly when there is already an impression created that the team had concluded its work.

He added that it was unfortunate that the joint investigative wings were trying to fish for information from Mr. Banda.

And Mr. Sikota has charged that the joint investigative wings are being pressured to finding a specific offence for the former President.

Mr Sikota added that the investigation is being motivated by those that want Mr. Banda to be found with a case to answer even when there is no such case.

“The mood in the room from our side is one of frustration. After being told that investigations had been completed, very very clearly investigations have not been completed and they are still trying to find evidence to fit the crime.”

“They are going about things in the opposite way, one would have expected they already had their facts together and now they are trying to get facts from our client in order to fit their perceived crime.”

“Unfortunately it’s a waste of tax payer’s money and time that we can be going about this issue in the manner they are doing,” Mr. Sikota said.

Mr. Sikota said the investigators are dead set on finding something to charge Mr. Banda with.

“They are dead set on prosecuting Mr. Banda and unfortunately there is nothing to charge him with. The Minister of Justice has stated that they going to prosecute, he has clearly stated that there is a case to answer which case we are yet to find out.”

And Mr Banda says it is unfortunate that his alleged persecution might satisfy certain individuals.

“I was your President and I didn’t do this to anybody. I tried very hard to bury the past so that we can all come together and concentrate on what really bothers the people of Zambia, the difficulty that the poor people are facing, the shortages of everything that we do, that is what I think was my responsibility,” Mr. Banda said.

He continued, “but anyhow, perhaps my persecution, my prosecution will satisfy your needs.”

  16. The only lasting solution to this abuse of power and authority by Zambian presidents is to clip their wings by withdrawing the limitless powers they command and also do away with this beast called immunity. These things make them get detached from the people.

  18. This is an excellent opportunity for you Sir to prove your innocence or otherwise. This chance may probably restore some confidence in MMD party if RB is proved innocent. Currently whenever one mentions MMD party what comes to mind next is a corruption tag. The close association of UPND (The party that appears next to rule on day) to MMD may or may not reflect well on them depending on the outcome of the allegations levelled againt RB. This is just my perception. I do not support any party am just neutral. Anyway accord Mr Banda the fairest trial (so to say) and respect he deserves . He did the best he could during his rule.   22. The problem with Sakwiba is that he is playing double role, that of a politician and that of a lawyer but his tone and analyzing of issues is that of a politican and that of an opposition. He is quick to give a cover up comment. Professional lawyers would not rush to comment.

It so clear that RB stole money. This case shouldn’t drag on for too long, it’s an open and shut case. Sikota wants to score on two fronts, political and legal.     • He has not been tried and our legal system says he is innocent until Kabimba and Co prove he is guilty in court. You can not say he is as guilty as hell unless you are relying on the Bwinjimfumu judgement which is only recognised in Hell and by Satan’s followers.

  42. Mr Sikota, let me get this straight; You wanted them to have all the facts without getting any input from the suspect. If investigations were meant to present facts to suspects then what would be their use. I think the investigation wings did a good job by not considering Mr. Banda guilty before they would hear his side of the story. By them asking him about issues they were just trying to get his side of the story as an innocent man. Then they will tarry what he said with what they have. If things do not add up, the continue probing untile they exhaust everything. Then they analyse the data and see if they can prosecute him or not. I think Mr. Sikota stay in your turf as a lawyer and do not try to be smart in procedures you do not understand.

He used to say the same when defending Fred M’membe years ago and managed to secure Fred’s freedom. Expect scincilating cross examination like in the Black Maamba and Zero Option.   47. @ 26.1 Dracular, the article is not objective just like the ZWD which when you read you “see” emotion and bitterness, judgement is supposed to be left to the reader. The writer claims that the current president will be remembered as the wosrt preisdent,what about Ala Bee
    1. He lost elections inspite the extravagant expenditure on the campaign
    2. He ordered the arresting of a journalist for speaking the truth and was later acquitted by courts
    3. Had some people in Western Province shot dead
    Peoples memories are not short.

    • Good comment. the problem with some bloggers here is what ever the PF does is wrong, the do not look at the issue in depth, but the tend to look at issues with a political inclination. the issue is did RB stole or not , the court of law determine that.

  51. We Zambians have very short memories. There is no doubt that RB abused his presidency.

    The kind of expenditure we saw in the 2011 elections, the Stand up for Zambia nonsense by Chanda Chimbwi, the Use of Zambia National broadcasting to denounce the opponents, the lavish expenditure by RB’s children, the endless trips abroad ( Kamwendo munjila.) etc

    Hakainde should not say that RB handed over power to Sata. It was the Zambian people who removed him from office. He should not speak as if RB did Sata a favour. RB was forced out of office by Zambians and the record are there to see.

    Why is this RB’s criminal offences such an issue when there are so many Zambians facing similar cases.?

    Let us wait and see what RB will do.
