LAZ to hear Mutembo Nchito’s alleged professional misconduct in his absentia

The Law Association of Zambia (LAZ) says it will proceed with its scheduled July 16 hearing on a matter Director of Public Prosecutions (DPP) Mutembo Nchito is facing allegations of professional misconduct.

LAZ president James Banda says the matter will be heard by the association’s Legal Practitioners’ Committee whether Mr. Nchito appears before the committee or not as the case is still active.

Mr. Nchito has already written to LAZ explaining that he is above such committees and as such can’t appear before them for disciplinary charges.

Mr. Banda has however affirmed that the Legal Practitioners’ Committee is not stopped from hearing such cases as the DPP is facing, if Mr. Nchito does not exercise any other options as provided for under the LAZ regulations.

The second summoning of the DPP is a follow up on a complaint to LAZ by Movement for Multiparty Democracy (MMD) Solwezi Central Member of Parliament Lucky Mulusa who complained to the association that Mr. Nchito allegedly lied to the parliamentary select committee when he was being screened for his current job by the parliamentary select committee.

The latest summons dated 30th May 2013 also indicate that LAZ has changed venue from Lusaka to Ndola City Council Chamber where he is expected to appear before a five man committee.

  1. You are chaps degrees are nothing but useless,,, you even boast UNZA this and UNZA that,,,all useless and stu.pid!!! look at this mutembo guy,, and all these LAZ chaps failing big time yet they called themselves learnt fellows….
    These people are supposed to guide the nation properly with those papers they have!!!

    I have NO respect for shi.t degree holders who cant back their qualifications with good works,, respect and integrity

    • Ba Ndobo don’t drink Turbog “elephant” on Sunday. Apapena you missed abit. There are some UNZA products who did something: Mwanawasa, Kunda and one more..
      And probably I may agree with you, non-UNZA graduates are even better such as:
      – KK
      – Munkombwe
      – Scott
      – Fr. Bwalya
      – HH
      – Prof. Chirwa
      I can’t even make a list of great Zambian politicians. Now I agree, Zambia has shortage of educated LEADERS. Thats why we are ending up with Ponyax Sata.

    • Mr you can’t go thru life hating higher education simply because you don’t have it. Regardless of age, you have the chance to have it in this day and age. On the other hand, at least accommodate it for your children’s sake. Learn to debate the issue at hand.

      yes these UNZA lawyers should tell us what they learnt at school..

      what does the law say about the overage CJ chibesakunda??
      what does the law say on a DPP if accused of abuse of office? and a case has be established?
      What is the position of LAZ in relation to the DPP`s office??
      The answers shouldnot only be stated but pratically demostrated

      I personally have a problem with UNZA paper holders,, i look at LAZ, these guys should be learnt fellows, who should know what to say and do… Look a the Economics association of zambia,,they can see there is something wrong with the national budget they are quite.. no professional comment or advise!!!

    • Can LAZ spare us their empty barking.Why is it so difficult to withdraw the practicing certificate of Mutembo Nchito as he seems to have overgrown the capacity of LAZ TO DISPLINE HIM!!!!!!!!!!!

    • INTERESTING SUBJECT: The shortcomings lie in the statutes that govern and regulate most professions in Zambia, and NOT really in the quality of our UNZA degrees. LAZ for lawyers, EIZ for Engineers and most other professional bodies are very toothless and merely enjoy the status of PROFESSIONAL CLUBS. The existence of these bodies should be provided for in the Republican constitution as statutory bodies with whom any professional should be in good standing to qualify for any Senior Public or Private office related to the practise of such profession. A violation of this requirement should automatically translate into a violation of the Republican constitution.

    • That Mutomba Nchito is another waste of humus. A peace of scavenger, who survives on rotten cases. He delays case, so the files can decay. We knew him time of Chiluba, now he has even stolen RB’s passport. Stinking hyena, look at his pose, chimbwi umutuntulu.

  2. Going by my status I am well above the cops but I still cooperate with them. Mutembo sits above LAZ and feels they cannot summon him. It’s a jungle now… Zambia for sale!!!!!!!!!!!!!!!

  3. All the corrupt since our PF Government supports no corruption should be arrested. Let him prove himself right. We are tired of this against that and that against this. We want the same Rule of law in Zambia to apply to all Zambians for No One is Above The Law for its One Zambia One Nation to all irrespective of who you related to or know.

  4. A lot of the President’s appointments have bad checkered past. now we have thieves, forgers,unqualified retirees , failures, no wonder we going backwards
    with a bunch of losers in control, with their wrong thinking like the law don’t apply
    to them, not forgetting Nchito still owe the country a lot of money with his associates

  5. Trying to discredit or undermine LAZ is the only option left for Mutembo and what a shame. Mutembo, Sakeni and Kabimba were very quick to suggest that “If RB had nothing to hide, he should have appreared before the ACC even without lifting his immunity”, well if the DPP has nothing to hide he should appear before LAZ nada not hide behind his office. At least RB was relying on the constitution while (I do not think) the DPP is just blowing empty air.
    It will be interesting to see what happens if the revoke his practising licence for profession misconduct.

    • We are NOT children we know the connection between Banda in LAZ and Rupiya Banda. It’s not surprising that LAZ Banda comes out so strong on PF.

  8. It is sad that we now have individuals becoming much powerful than bodies or institutions. This must be contained if we are to continue having order in the country. Now DPP is above LAZ the body which register him to practice. Does he imply this country can have a DPP who is not on the LAZ register? Where is the professionalism here? Last year we saw how Winter was above ACC. Who will be next other than the majority poor? Remember order is above DPP.

  9. If a Legal Practitioner is found to have misconducted himself or herself unprofessionally, the Committee may suspend the Legal Practitioner and refer the matter to the LAZ Disciplinary Committee at the Ministry of Justice. The Disciplinary Committee consists of the following members: –

    VICE CHAIRMAN – Mr. Musa Juma Mwenye, S.C., Solicitor General
    SECRETARY – Mr. Andrew Nkunika

    Upon the LAZ Disciplinary Committee establishing a prima-facie case against a known Legal Practitioner, the Committee may impose sanctions they may deem fit such as admonish, censure, suspend and/or recommend to the Chief…

    • No wonder Mutembo Nchito is arrogant towards LAZ.The composition of the displinary committee is user friendly as far as Mutembo Nchito is concerned.Mumba Malila and Musa Mwenye are all Mutembo Nchito’s recommended appointees backed by Fred M’membe.The two cannot bite the hand that feeds them.What a Circus!!!!!!!!!!!!!!!!!!

  10. LAZ is overstepping its boundaries, it has no power to summon Nchito in his capacity as DPP, a position appointed by the republican president. Maybe as a practicing lawyer but that’s clearly not the issue here.
