Major Richard Kachingwe booed at Court for ‘betraying’ RB

Former MMD National Secretry Major Kachingwe was yesterday booed by former Republican President Rupiah Banda’s sympathisers who called him a traitor for allegedly deciding to testify against Banda in a matter in which he is charged with one count of concealing gratification involving nine trucks all valued at K471, 000 contrary to the Anti-Corruption Commission (ACC) Act No.38 of 2010.

The supporters who waited for Maj Kachingwe outside the court premises told him that it was a pity that he was “eating with both hands and that his time would come when others would also betray him like he had also betrayed Mr Banda.”

They started shouting thief, thief.thief behind the court premises bringing panic to police officers and other people waiting to see off their relatives in the prison vehicle commonly as ‘Kasalanga’ and was only saved when he was whisked away by a vehicle from the State.

The symphathisers warned Maj Kachingwe not to align himself to any political party and reminded him of the 2016 general elections.

Major Kachingwe yesterdays produced seven documents as evidence against the republican president. Particulars of the offence are that Banda on dates unknown but between January 1, 2011 and August 30, 2011, received nine motor vehicles valued at K471, 000, which were allegedly obtained as gratification from Sogecao Zambia Limited, a subsidiary of Anui Foreign Economic Construction Company which was contracted to construct the Levy Mwanawasa Stadium in Ndola.

Mr Banda through his lawyers Sakwiba Sikota, Steven Lungu, Lubinda Linyama, Mackebie Zulu, Patrick Mvunga and Ireen Kunda submitted that they needed time to study all the seven documents that had been produced by the witness.

The lawyers contended that they needed ample time to study the said documents looking at the volumes and that giving them hours to do so was going to be unfair on their part.

In response, Director of Public Prosecutions (DPP) Mutembo Nchito said he did not object to the application for adjournment but called for both parties to make progress in the matter as two days had now been lost without any progress.

“I would have loved that we meet in the afternoon because we have lost two days, Monday and yesterday. My prayer is that we make progress in the matter,” he said.

But Chief Resident Magistrate Joshua Banda in his ruling said it would not be possible for the court to resume in the afternoon because he was unwell and needed to have his last injection.

Earlier Maj Kachingwe had submitted documents among them letters from former Minister of Energy, Kenneth Konga to Nigeria requesting for Oil, appointing Maj Kachingwe to be the attorney as well as a reminder or follow up on the request.

Others were the oil deal contract, the remittance of the US$500,000 from Access Bank of Abuja in Nigeria to Barclays Bank in Singapore by Sarb Energy Managing Director in Nigeria Akpan Ekpan. The matter comes up today for continued trial.

    • Major Kachingwe is extremely unreliable,a trickster and above all a con man.He obtained his MMD membership by false pretenses.Michael Sata knows this chap so well as well and so does RB’S private secretary.The defence should first establish Kachingwe litany of deceits.

      There is absolutely nothing admirable or inspiring that Rupiah did for the country during his time as president

    • Did I hear correctly? Model president? Which man are you referring to , Enka? Are you from Mars or Neptune to refer to RB as a model president? May be a model in some weird sense, but certainly not in any normal person’s frame of reference!

    • There are plenty DRs from UTH or private hospitals around the country who can attend to his knee and if the leg needs amputation, that can easily be done in Zambia.

      His knee doe not require any specialized treatment outside the country

      He will not be allowed to continue abusing public resources any more

RB SHOULD FIRE HIS LAWYERS SAKI AND MVUNGA FOR ADVISING HIM WRONGLY OVER HIS IMMUNITY. THE MAN COULD HAVE APPEARED BEFORE THE INVESTIGATIVE WINGS WITH HIS IMMUNITY INTACT.     • Just hold your fire of premature conclusions.Kachingwe will face defense lawyers’ cross examination on the documents he has produced in court.It is at this point that the direction of the case will be seen.

  10. Lets wait and see if these documents stand the scrutiny of the courts of law before we make any conclusions. If Zambia was buying the oil how come then that Nigeria was paying for the oil? It does not show how Zambia lost out. It will be interesting how this case turns out but from a layman’s point the state case looks very weak.

    • What happens in such deals is that the Seller puts his mark up and also puts buyers
      commission. So price is inflated with buyer’s commission. When buyer pays he will pay plus his own commission. The added commission is then paid to the buyer by seller at Buyer’s selected bank. In this case Gvt loses out because it is paying more than it is supposed to pay because of the commission added for buyer. This is what happens in most of these Big deals you witness arround.

  14. RB is being ill advised. He should humble himself and stop tantrums from his lawyers , most especially Amsterdam. When things go wrong, you certainly apologize to the people and live On. Kachingwe is doing what every patriot citizen of a country is supposed to do. Zambia is for all of us, and when we see someone destroying the country, we shouldn’t just say ‘palibe kanthu’.

    • I don’t agree that an apology would suffice. It has to be investigated and if and only if the guy has a case to answer, convict him. If not, let him go and stop harassing him.

      All civil servants that have plundered should be treated thus.

  15. @ Maxwell, its taxpayer’s money that will be used to pay as the govt will bear the cost of his prosecution. Watch this space in months or even years to come. Remember FTJ’s cases took nearly 10 years and nothing came out of it. Meanwhile Nchito went to the bank smiling. The same will happen this time.

  17. i dont think people should take Major Kachingwe seriously, to me he is more like a comedian, i always feel sorry for him though, you know that face you look at and feel sorry for? thats what i see in major Kaching, especially that image when he was manhandled by those kaponyas, iye ubulanda, i wonder why they even give him a serious hearing am sure he just jokes!

  19. Sympathizers of RB are a let down to the Nation when they want Major Kachingwe or any other person not to testify the truth against Banda. All they care is about RB not about people living in poverty. To them corruption by RB is right just like RB defended and rescued the late Chiluba from corruption. To sympathizers of RB and Chiluba regarding corruption are enemies of the nation who promote poverty by encouraging the head of state to still. Sympathizing of RB when the government is mistreating and stepping on RB’s rights is right. Yes it wrong for the government to mistreat RB because is neither guilty or not guilty. Even a person who is guilty does not deserve to be mistreated but punished.

    • While I’m not an RB sympathizer per se, I am alive to the fact that jailing RB will NOT eliminate poverty, will not reduce unemployment, will not put medicine in hospitals.

      You and I want the same thing – and that is justice. In order to get justice, we need transparancy. Do you know that even HEMCS will face the same seat as RB over the endless COIs, bye-elections and witch-hunts in 2016? It is only a matter of time.

      What does that tell you? It tells you that even well-meaning people can seem corrupt when put in a system that has no checks or balances. We will continue to hunt down former presidents until we have a means of making the president in power accountable.

      A new constitution that spreads out the president’s power.

    While all this makes for interesting reading, we are still hungry, broke, unemployed, sick and dying. We chased Chiluba till his death and not one of us has seen a single ngwee from his persecution.

    The solution is not in trying to get nshima from people who have already eaten it; the solution is in making sure no one else can steal our nshima from this day forward. Even if you could get back the eaten nshima, it will be chimbala or feces.

    I would like to see an administrattion that can rule transparently and openly.

    Do you know that the next president in 2016 will question the COIs, the extened Constitution making process, the ACC witch hunts, the unnecessary bi-elections.

    Do you need 90 days to think about all of this?

  22. France is doing a good job of confiscating property worthy millions of dollars belonging to the president of equatorial guinea. Yesterdays auction of his luxury cars confiscated in France raised $4.8 million! If it was in Zambia, some organisations will be crying selective prosecution. We should stop praising and defending thieves!

  23. Booing Kachingwe is neither here nor there. If he has taken the oath and is telling the truth, then it’s fine. All part of establishing charges brought against RB.

    As long as things are done correctly according to the law in EVERY case for EVERY person, I have no problem.
