Sata dismisses HH demands to remove acting Chief Justice Lombe Chibesakunda.

PRESIDENT Michael Sata dismissed opposition United Party for National Development (UPND) leader Hakainde Hichilema’s demands to remove acting Chief Justice Lombe Chibesakunda.

And President Sata has questioned the legitimacy of Mr Hichilema’s holding on to the UPND party presidency saying he has never been elected.

This is contained a letter, in which Mr Sata was responding to Mr Hichilema’s letter of July 9, 2013, where the opposition leader queried why Justice Chibesakunda had continued to occupy her current Constitutional office without Parliament ratification.

The President said this in a letter dated July 12, 2013 obtained by the media in Lusaka yesterday.

“I will only respond to your letter when you tell me who elected you as President of the UPND, because as far as we know, you have never been elected to the section, branch, ward, constituency, district, province and let alone to the Presidency of your party,” the letter read.

Mr Hichilema in his letter charged that President Sata had abandoned plans to lead the judiciary on the path of reform.

He said the current status of the acting chief justice would erode people’s confidence in an important arm of government and would in turn threaten stability in the country.

“It is a temporary administrative measure. What is obtaining now in the judiciary is tantamount to making a permanent decision in temporary circumstances. This is a breach of the Constitution and is unacceptable. We demand that you live up to the oath you swore to uphold by correcting the constitutional and statutory violation, through the appointment of a substantive Chief Justice,” he said.

But President Sata dismissed Mr Hichilema’s allegations and questioned the legitimacy of the opposition leader’s continued stay at the helm of the party saying he had never been elected.

    How on earth can he compare UPND and Zambia? HH is a president of a political party (a club) so the President should never behind the fact or perception that HH was never elected UPND president when he was queried as to why an un-qualified person has been acting as CJ for more than a year! And has he forgotten that Chibesakunda was rejected by the National Assembly?
    Sata must for once become serious and realistic. Disgusting and nauseating President!

    • It just goes to show the thinking and reasoning calibre of our head of state and his cabinet ministers. (I include cabinet following Kambwili’s public naming of the Lusaka stadium)The whole of the Office of the President to respond with fingers (and also you) to a very pertinent issue of national concern is shameful to say the list.
      My Wonder is, why in the face of all any flagrant breaches of the constitution, is the opposition parties failing to raise a motion of impeachment? Are there loopholes within the process that can backfire or holt this if thrown in?

  5. To the best of my mind, would I be wrong that all the years Sata led PF while in opposition, he too was never elected at any convention as President of the party. Now that the shoe is on someone elses foot he has the audacity to raise that up. Sata may be president but he shouldn’t forget that he is a minority president and so the majority of Zambians didn’t wish he was their president. That was a cheap answer to give to a serious issue. From that answer, Mr President, do you honestly expect serious minded Zambians to be comfortable with the thought that as a nation we have a fair minded person for a president. There is a time for politicking and a time for statesmanship.

  8. The president responds deliberately to HH like that because he knows that ,there is nothing he can say or do to please him as long as he remains president of this country. HH keeps on criticizing PF government whether they do good or bad.

      Rise above it just get on with the business of governing (and developing!) the country as best you can. Cheap and divisive comments don’t help…. especially when you pretend to be a “listening government”.

    • Can you cite some incidents while Sata was in opposition when he supported any government that was in power? Of course it would be admirable for HH and any opposition leader to give credit where it’s due but these instances are few. Take the naming of the national stadium. After being forced into a u-turn do you expect the government to be praised when they could have avoided the debacle in the first place?

As a result, he is constantly booed at home and abroad whenever he opens his mouth. Zambia is heading into a ditch. Matthew 15:14.

Aspire for more! As a nation we can do better. We are being short changed.     For example why should HH be first elected section chairman to have the right to question things that affect him as a citizen?

    It is this low life discourse that just put a lot of us off. It is a shame really that Zambians gave power to such low life souls.

    For example just how do 20 people who are supposed to be the best team to lead the country, sit round a table and come up with a name called Garbon Disaster Stadium? This is jaw dropping, what did Zambia do to deserve this?

      The fact is that Zambia has no alternative party to the PF that can lead the country in the way must people would love. To me this is the biggest issue and a dilemma. All our young leaders are completely useless and as long as we continue like this it will be PF for 20 years, mark my words

    So now when HH is “legitimately” elected, then the Chief Justice will step down?

    Last time our State President came again with another “clincher” to the commonwealth: Unless HH discloses his source of wealth, the commonwealth shouldn’t come to investigate allegations of Human rights abuses by Government.

    The Head of State subsequently brandished HH’s personal Bank accounts and revealed he had 1million beef cattle and was a major supplier to ZAMBEEF.

    Now my question would be, what’s that got to do with allegations of torture and restricting of freedom of expression and assembly?

To assert that HH was not elected, never been section or ward member before became UPND should not concern mr Sata and his PF. This can not be the basis to subject the entire nation to acting Chief Justice Lombe Chibesakunda continue occupy her office illegally without parliament approval. This attitude by Sata reflect the poor and incompetent leadership he has ever since displayed to Zambians. I hope his stint as national leader will help Zambians to critically future would be president of our country. Education is paramount from what Zambians have seen so far.

    It is not mandatory that one heads a political party but it makes it even more pertinent when one does.

    • Good one. When did PF go for a convention? Who challenged SATA if at all there was a convention? SATA should remove the plunk from his eye before removing that dust particle from HH’s eye. We expected the president to address the nation on the legality of justice Kunda’s stay in office and not this childish response.

He is living in the past by suggesting that you have to start from branch level in order to reach the top. Zambia has moved on and yet we still have a president with a colonial / UNIP era mentality. Mark my words, this guy will not relinquish that post without putting up a fight as long as he is still alive.

  38. Sata will be remembered for having brought such high mediocrity to the state house of Zambia. All the previous leaders, though not loved by all (a natural thing) had great integrity and honour. Hence the title “His Excellency” was appropriately used by these previous leaders. For Sata he has to command his minions to accord him that title.
    His response to HH request concerning the embattled Chief Justice is a clear testimony as to the man we at plot 1. I do not recall when Sata was elected for PF position other than the fact that he broke away from MMD when he could not be appointed as the next president of the part. HH has a degree obtained genuinely not by correspondence from a non-accredited. Sata needed to go through all Kaponya positions because that was and still is his level.

He must respond with civility and intelligence to all queries. And at 75+ years he is supposed to be wise. But alas that appears to be something he will never achieve.
    Its really a shame that we have a President who cannot even hold a press conference?, a President who calls AU OAU.
    Back to the issue at hand, its surprising and shocking that a person who swore to uphold and respect the constitution is allowing an unqualified person to act as CJ for more than a year and he is arrogant about it! This must be a ground for impeachment.
