FODEP Executive Director MacDonald Chipenzi and two others have pleaded not guilty in the Lusaka Magistrate court for publication of false information with intent to cause fear and alarm to the public contrary to section 67(1) of the penal code cap 87 of the Laws of Zambia.

This is in a matter in which MacDonald Chipenzi and his co-accused the Daily Nation Newspaper Proprietor Richard Sakala and his Editor Simon Mwanza have been jointly charged for publication of a false article in the Daily Nation Newspaper on December 10, 2013 believed to cause fear and alarm to the nation.

When the matter came up for plea before Magistrate Lameck Mwale, the prosecution objected to the defence’s application for bail stating that if the accused persons were granted bail they would continue with publication of articles of the same nature and that may also interfere with the witnesses.

The defence submitted that the court should exercise it’s discretion and grant the accused persons bail became they had committed a bailable offence and that the article had already been printed hence they cannot interfere with anything.

The magistrate said he had considered the submissions from both parties and grated the accused K10 000 cash bail each with two working sureties from government and quasi institutions who are both residents of Lusaka.

The matter has since been adjourned to December 26, 2013 for mention and January 10, 2014 for commencement of trial.

    Really I dont understand why these parties are allowed to form as parties, waste of ink they are printed on, even here on LT, they are terrible no hopers as parties, whose manifesto is best understood by no one

    • There you go again. Misguided. Firstly, FODEP is not a political party, but a Civil Society Organisation. Secondly, though you calim to be in the diaspora you use of English ans sentence construction is rather embarrassing! I’m sure you meant “there are” and not they are. Please get off your high horse!

  2. @1 Shut up!Ukusabaila. let Chipenzi test the jail.l think Richard has become a hard core criminal so he is just missing what has become his second home.Mwanza ,alefwile incito.The day fake journalists at zwd are cornered i’ll celebrate.

  3. That’ s the Zambian government style, what they preach about is not what they do. There is no freedom of press and expression in Zambian and every action has a 100% pointer to dictatorship/ police state. My doubt goes to the normality or thinking base of those who support such actions. I consider it worthwhile for them to be taken to Chainama for mental examination. The peaceful Zambia we knew years back has now swiftly lost direction with empty tins manning the show – very sad indeed. One can wonder why those who publish the fake Post Newspaper are spared – useless.

  4. It’s disappointing hurting distressing demoralising to hear some pipo praising the most useless regime zambia has ever had. More than 2years now poverty in every corner of zambia takes its toll unabated no one cares at all look at the compounds and the rural arears poverty poverty poverty and disease all over, and the so called govt officials/zealots busy praising an individual a failure, liar visionless leadership.
