Amnesty International has demanded for the immediate release of James Mwape and Philip Mubiana the two men of Kapiri accused of having sex “against the order of nature” under Section 155 of Zambia’s Penal Code.

Amnesty International Zambia Researcher Simeon Mwanza says the continued incarceration of the two men is an abuse of human rights and reflects badly on the country’s justice system to the international world.

Mr. Mwanza said his organization considers the continued incarceration of the duo who deny the accusations is an affront to all who believe in fundamental human rights, equality and non-discrimination hence the two should be released immediately.

He said the duo have already spent over a year in jail after their application for bail was denied in may last year something he said reflects badly on the country’s justice system.
Mr. Mwanza also said people should not be locked up on the basis of their sexual orientation as it is a clear breach of international law and justice.

“These men have already spent over a year in prison having been denied bail in a case where they are accused of something that should not be a crime. Locking up people on the basis of their real or perceived sexual orientation is reprehensible and a clear breach of international law and justice”

And Amnesty international has called on government to fulfill its obligation in protecting all human rights respect and protect all human rights and end the persecution of individuals on the basis of their real or perceived sexual orientation or gender identity.

“Amid a growing climate of fear in Zambia, Amnesty International is calling on the authorities to fulfill their obligations to respect and protect all human rights and end the persecution of individuals on the basis of their real or perceived sexual orientation or gender identity.

We are worried about the shrinking space for human rights in Zambia under the current administration. Fundamental freedoms have increasingly come under attack with political opponents, civil society and sexual minorities being systematically suppressed,” said Mr. Mwanza.

The duo who face up to 14 years in prison if found guilty were first arrested on 25th April 2013 before being released on bail on 2nd May but re-arrested 6th May 2013 and have been in jail ever since.

The international human rights organization has also condemned the examinations done on the two men describing them as forms of torture.

“They were arrested again on 6 May and subjected to forcible anal examinations by government doctors to “prove” their involvement in sexual activity. These examinations are tantamount to torture,” added Mr. Mwanza.

    • If the law says, for their crime, they should go to jail, then jail it is. it does not matter what jesus would do. Ask the so called jews about jesus.     • The Bible mentions homosexual behavior and it clearly condemns it. The issue is precisely whether that Biblical judgment is correct. The Bible sanctioned slavery as well, and nowhere attacked it as unjust. Are we prepared to argue today that slavery is biblically justified?

  3. There are other important issues touching many lives of Zambians this Mwanza should be taliking about. But I’m not suprised because he has a salary to earn by issuing such statements. I do not imagine that one day my son or grand son should bring another man that they are getting married.

    We have told chaps like Mwanza several times that this is against our culture and beliefs just like having more than one wife is an offence in your American sponsors. Go to America or UK and marry two wives and see how you will be locked up and see if your Armnest will protect you.     • Amnesty are not quiet over the Meriam Ibrahim issue – do your research and don’t display your ignorance on public platforms. Go to their page and you will see. Further, most of you uneducated morons keep on saying its the law, but the law is clear that individuals should be released on bail until they are convicted by a Competent Court unless in cases of murder, treason and the stupid Chiluba introduced ‘motor vehicle’ theft etc. These men have not yet been convicted and yet they have been detained for over a year in a maximum remand facility!     However, at the same time, I woulnd’t put it past ‘Amnesty International’ that they are paying attention all of a sudden, because people are talking about the Windfall Tax.

    When the New Labour government wanted to throw President Mugabe out of office in 1997 (Soni Rajan, ‘Dinner With Mugabe’ by Heidi Holland), two years later President Mugabe was accosted by Peter Thatchell, the boyfriend of Minister Peter Hain. It was only after that, that legally speaking the constitution was rather clumsily adjusted to ban homosexuality.

    Amnesty International itself has been populated by US State Department hawks like David Januzzi and Suzanne Nossel.

All of a sudden, The Family/The Fellowship (see “C-Street” by Jeff Sharlet) introduced draconian anti-gay laws, the same way they did in Uganda (David Bahati is the Chairman of the Uganda Parliamentary Fellowship, and has frequent contact with Jim Inhofe, John Ashcroft, Scott Lively) and Kansas (the Religious Freedom Program wrote the language, and had former Watergate Burglar Chuck Colson on it’s board of advisers).

    All I am saying, is – don’t dismiss the possibility that this is all politics.

    The laws against gay acts are the same in all former British colonies, and have been on the books since at least the 1950s. So why all the publicity now?
