Supreme Court today ruled that the attempts by Miles Sampa to reopen the consent judgement that sealed the fate of Edgar Lungu as PF Presidential Candidate comes up tomorrow before the Supreme Court Full bench.
In this case, Miles Sampa is attempting to contest the Consent Judgement that was issued by High Court Judge Mungeni Mulenga.
Sampa is represented by Sebastaian Zulu, Sakwiba Sikota and Makebi Zulu. Lungu is represented by Mosho and Chashi.
Lungu’s lawyers have contested that Sampa has no locus standi and is abusing the court process.
Lungu stated that Miles Sampa is relying upon illegal decisions made by a General Conference that was barred by the courts of law, is also relying upon the decision of a dismissed officer Bridget Attanga.
In settling the matter, new Secretary General Davies Chama resolved the matter with PF National Chairperson Inonge Wina and entered into the Consent Judgement that was approved and issued by the Lusaka High Court.
In the event that Sampa wins the case tomorrow, it will be referred back to the High Court. the High Court can consider Sampa’s argument to re-open the Consent Judgement.
In the event that the case is dismissed, Mr Sampa’s fate will be sealed.

Tomorrow will be the end of Miles Sampa’s political career. In effect, Sampa must know that the injunction against that second conference means that any decisions from it were null and void. Sampa has been out-maneuvred by Lungu such that all his supporters are staying away from him like he has skin disease!

Lets wait and see tomorrows judgement with the full bench means all intellectuals will be present judging the case. Who will be there anyway? Is it all supreme court judges or who?

Full bench is also an indication that should he fail to win the case then he cannot go to supreme court again through a different judge with the same case. It would mean the entire supreme court has decided.. So we wait and hear the outcome tomorrow. If he wins then another high court process… Hope PF will have a sealed candidate before 20th December.
