Changala calls for tribunal against DPP Nchito

A Civil Rights Activist BRENBAR CHANGALA has written to President EDGAR LUNGU asking him to set up a tribunal to probe Director of Public Prosecution MUTEMBO NCHITO.

Mr. CHANGALA alledges that Mr. NCHITO’s appointment to the office of the DPP has been a dividing and controversial subject for the last three years.

Mr. CHANGALA becomes the third person after Lawyers MAKEBI ZULU and KEITH MWEEMBA to petition the president to establish a tribunal for the DPP.

He further alleges that MR. NCHITO is seen as a hired gun to fix real or imaginary political fall-outs.

This is according to a a copy of the letter to the President made available to ZNBC news in Lusaka today.

Mr. CHENGALA has told President LUNGU that, in order for the country to put the matter of the current DPP to rest once and for all, there is need to constitute a tribunal for MR. NCHITO.

He further appealed to the President to release the MUKELEBAI MUKELEBAI tribunal report for Zambians to make an informed opinion on how the then DPP was hounded out of office and by whom.

Meanwhile, Former Deputy Minister of Finance NEWTON NGUNI has recommenced fresh charges against Mr. NCHITO in the Lusaka magistrate court.

The matter has been allocated to Magistrate LAMECK MWALE.

MR. NGUNI has dragged the DPP to court over nine counts of abuse of authority of office among other various offences.

On February 11, 2015 Chongwe Magistrate Court issued a warrant of arrest against Director of Public Prosecutions MUTEMBO NCHITO for 9 offences.

However the warrant of arrest was short lived following the Lusaka High Court’s order to quash the warrant.

    • Changala is now talking a lot of sense. A tribunal is the best way to remove Nchito for the office.

      He will be fired by the president while the tribunal in progress.

    • We should never willfully opt to overlook some moral and constitutional platitudes for political bias, Nchito has to prove himself credible before the jury. We better be thoughtful in our public comments. Defending the indefensible makes some actions repugnant to the Constitution. DPP found with criminal issues must not be insulated from facing a recall at the hand of citizens. It’s beyond dispute that Mutembo’s time has had some clear violations of the spirit of the law.

      Surely, we can learn from the USA where the former Attorney General John Ashcroft was made to leave his office early for failing the constitution due to many oversights. Some comments are only promoting criminality which if tolerated can lead Zambia to some ignominious chapters of our national history.

    • @1.0 ZWD for sure Lungu will be fired even before 2016. Iliko bad mu PF they wont survive second round Muhabi has become a chola boy for Kachasu man.

      I foresee PF in a fiasco promulgated by Lungu & RB marriage of convinience, they stole the Votes frm UPND and this will haunt them,we are yet to see confusion after confusion.

  2. The most sensible thing for the DPP to do right now is to step down. His continued stay in office amid all these damaging accusations is what tells me that he may not be clean after all.

  4. Problems come in multiple numbers.

    DPP could make it easy for himself by paying off ZDA, and confessing where he thinks his accusers are correct. No need to fend off wrong doing when it catches up with you.

    God bless Nchito and may he correctly discern his position in these matters and take the chance to be purified here on earth by facing his wrongs and giving respite to those he harmed. Surely he will be blessed for that.

  5. Mr Lungu is currently by far making great and deadly mistakes. For those who had been at the centre of making PF to be a ruling party over a period of 10 yrs are asking questions as to whether he Lungu is PF and fit to stand the heat and painful experience that Sata endured in opposition, gassed, demonised, arrested and put in prison to fight for what was right to an ordinary man. Henry Banda was in a mfuwe with Moses katumbi, Mfuwe is known for corruption and back door deals. Mr Lungu was not part of those who fought hard battles with Levy or Ruphia .He was spared after getting involved in spending clients money by Sata not adopting him to stand . In whatsoever Lungu is doing are not Sata liking or stood for . 2016 is very near even working with MMD will not hold much . People are watchin

  6. Lungu has offended many even those PF cadres in Northern, Luapula , Muchinga , CB and Lusaka . What Lungu is doing is exactly what Ruphia did after the demise of Levy and the end marked his fall from Grace. The displacing Sata’s disciples with impunity has long term implication especially Kabimba having a better understanding of PF structures and how to reach out using Sata’s approach and language then it’s a very different battle to fight for Lungu. Ruphia is not adding meaningful gains but detrimental to the future of PF . Rain all party is going to be a pain to PF. Wait for last few months of Lungu rule many will start designing and the marks wil be that of Ruphia. Is Lungu the cheating himself for claiming he is the disciple of Sata by mere words and not deeds? Lungu has failed Sata

    • @Pafwenamwine,Rainbow Party died the day it was launched….google rainbow party and see how unattractive the definition is. We will use the two upcoming parliamentary by elections as a litmus test on the popularity of Kabimba and his party.

  7. People are saying the honourable thing for DPP is step are aside. In African setup and Zambia in particular, leaders would rather get hounded out of office or get fired if fireable than do the wise thing. Remember what happened to Kabimba and GBM when they were being investigated by ACC, Masebo when tribunal was on did she resign, Dora Siliya did she resign? If we want to yield different results from our systems, office bearers should not just be honourable but also should have morals. This is what is lacking in our systems. People should not just say president do this and that…..no no no…..question the systems and follow the constitution

  8. Some of the statements from Lungu at times appeared as if he so drunk and lacking capacity. Zambia standing on the international in three years has been damaged just because Sata did not want to global trotted? To start helping Mugabe to sell blood diamond through Angola on the expense of Zambians will make Zambia in the eyes of donor and cooperating partners as Zambia promoting abuse of human rights

    • If the will is there on the international diamond market to cut off diamonds from Zimbabwe, even using Angola as a conduit wouldn´t work as all these minerals have a unique spectral signature that once subjected to spectral analysis at point of sale can be identified as having come from a specific region. Angola should know this and wouldn´t dare want to black list themselves as this could lead into the Angolan source also being black listed.

  9. This is the best decision ever made by Edgar Lungu to prosecute Mr Nchito. If Lungu had lost this election, he and his colleagues would have been in court facing treason charges and locked up in chibokaila prison with people like Scott drinking champagne while supporting such nonsense. PF must now dismantle this cartel of hatred piece by piece. So far they are doing well. This cartel is responsible for the tangled web of crime, intrigue, corruption and cover-up never witnessed in any third world country.

DPP should not step down,let him face the tribunal,and tha tribunal will sweat.Yes,Nchito is no saint like all of us but he is not a criminal.The criminals and corrupt elements in this country have regrouped and they are bent on bringing down Nchito.If they succeed it will be for a short time.Justice will eventually prevail and the hired assassins will have their day.To Mutembo I say walk with your head high,you worked hard,a thankless job indeed,you will soon be hailed.Those characters who are working tirelessly to arnish your name will be roasted it is.   11. Great. Whilst I fully agree with setting-up of Tribunal to deal with DPP issue, how come no body is asking for Public Commission of Inquiry to investigate R(obber) Banda?

  12. Nchito please do not step down. These criminals are back. Henry Banda and Mose Katumbi at Mfuwe are at work. When I read the so called charges I do not see any crime in them. You have fought hard and send many of them to jail. Now they have regrouped.

    The debt from DBZ is just a debt like any other debt. Why can’t they follow the normal procedure of recovering the debt than this criminal procedure.? How much debts has Chikwanda that dead plank going to leave for us and our children to repay compared to what you got from DBZ.

    Why can’t Nguni leave DBZ to deal with the debt? This is a civil matter between Nchito and DBZ. If there was any criminality in obtaining it let DBZ prove that not this povert stricken Nguni being used.

    Lungu 2016 you are fired.
