Mutembo Nchito Tribunal reconvenes today

THE tribunal constituted to investigate the alleged professional misconduct of suspended Director of Public Prosecutions (DPP) Mutembo Nchito reconvenes today.

Tribunal secretary Mathew Zulu said the sittings will start at 09:00 hours at the Mulungushi International Conference Centre.

Mr Zulu said yesterday that today’s proceedings will be open to the public.
“The decision as to whether future sittings will be open to the public will be determined based on arguments in today’s proceedings,” Mr Zulu said.

The tribunal chaired by former chief justice Annel Silungwe was appointed on March 10 by President Lungu to enquire into the alleged misconduct and acts of impropriety by Mr Nchito, as provided for under Article 58, sub-article (2) and (3) of the Constitution of Zambia.

Other members of the tribunal are former chief justices Mathew Ngulube and Ernest Sakala.

The tribunal has been given eight terms of reference that include the probing of the alleged acts of impropriety by the DPP as alleged by members of the public.

They also include investigations that Mr Nchito allegedly repeatedly abused his authority by indiscriminately entering a nolle prosequi in cases in which he is alleged to have interest of his own to serve.

The tribunal has also been tasked to investigate alleged misconduct or misbehaviour of Mr Nchito, whereby on February 20, 2015, he purportedly took over prosecution of a matter before senior resident magistrate Lameck Mwale.

It has also been tasked to probe alleged misbehaviour of Mr Nchito on or about May 8, 2013, when he purportedly took over the prosecution of his known business allies Mr Fred M’membe and the Post Newspapers Limited without declaring conflict of interest.

Another term of reference will be to investigate allegations that Mr Nchito took over matters in which he has a conflict of interest relating to his business partners (Mr M’membe and the Post Newspapers Limited), Rajan Mahtani (creditor), thereby going against his statement made before the Parliamentary Select Committee of the National Assembly of Zambia.

The tribunal will recommend to the President whether Mr Nchito ought to be removed from office for the allegations.

    • One thing for sure, Mutembo will be better prepared for this tribunal than those that have constituted it. let the the due process of the law take its course

    • I hope Mutembo can finally face what he put me through when he was the high and mighty levy’s boy. My crime? Was to have servd as a civil servant surrounded by people who where stealing. In his view I knew something about them so I needed to report them…so I lost my job my family disintegrated and I became a near destitute…years let I met this selfish boy instead of apologizing he said he was just doing a job..so unlike you I didn’t have the Post behind me to make my case I didn’t have the privilege of the source of income of CJs I just my bible and the truth…..I wish you the best as the web you spun chokes you…

  1. Sort out the criminals hiding in constitutional offices. No way out…it will b good riddance. Fred can fill his Post with hate! Who cares. Thanks el

  2. I am sure, he is itching to clear his name and its is about time; but the way the tribunal came about is what considered pawned.

  3. So far, Brebnar Changala’s accusations have been shown for what they are – LIES. The two charges withdrawn are that he planted drugs on Brebnar & that he forged a High Court judgement. That is why they have been withdrawn. This tribunal is a scheme to hound out Mutembo from the DPP’s office so that Rupiah can go scott free. The two chief Justices Ngukube & Sakala are discredited and cannot give a fair hearing. They have both an axe to grind with him after he exposed their corruption.
    Mutembo is a clean tough guy. The evidence will expose EL and all the other crooks. LET US HAVE THE TRIBUNAL IN THE OPEN SO THAT WE CAN ALL SEE WHO IS TELLING LIES. WHY DO YOU WANT A SECRET PRE-DETERMINED TRIBUNAL IF YOU HAVE NOTHING TO HIDE?
    LET THE GAMES BEGIN!! MAYBE YOU WANT ANOTHER ADJOURNMENT?

    • The reason Brebner’s charges have been withdrawn is that they have not been proved before a court of law and would amount to just allegations at this stage.
      The reason they have withdrawn the forgery of a High Court judgement is because it was already dealt with by the presiding Judge who reprimanded Nchito therefore he cannot pay twice for the same offence.
      The remaining charges are serious enough and Nchito has to answer for them. The evidence is clear and any moron who dismisses them is doing so for ulterior motives or plain ignorance.

  4. With the old Zambian constitution still in place, Nchito will have no case to answer because everytime, he had used his constitutional powers allowed for by an outdated Zambian Constitution.

  5. Ricky Bobby? @ 4.1 thinks that “The evidence is clear..”. Well, that is what EL thought when framing the terms of reference or did he not think when setting up the tribunal in the first place? In court Mutembo said about these same charges, “Go and report them to the police…”. No one listened then, but now you tell us they were not investigated! Iam a layman but the charge that he entered a ‘nolle’ for himself; what did the court say about it? Did not the court rule that he was “in order”? That he did not break the law? Whic part of that judgement do you not understand? Zambians are not blind. We know what is going on. EL does not say anything about RB’s thefts! That tells us a lot. There is a prescribed procedure for removing a DPP. No short-cuts to please your political…

I shudder to read some of the rants on this forum… I can not believe that any rational and sane citizen would support an individual who showed an apparent and absolute disregard for reason and the rule of law… Ncito dug his own grave when he started associating with the likes of Fred M’membe… No one should get away with such impunity. Not the President nor the Director of Public Prosecutions.

  10. Only those who have failed to read through Mmembe’s hate principle will agree with all his manipulations. Mmembe is a primer and primes people to hate innocent individuals especially those who he thinks have derailed his ambitions to control power of the presidency. FTJ became sworn enemy to Mmembe immediately his uncle Arthur Wina was defeated in the 1991 MMD presidential race. RB became an enemy when he defeated Magande in 2008. EL has become a sworn enemy after Sata sacked Kabimba in preference for EL. This is the basis of Mmembe’s hate. He says EL has discarded Sata’s vision yet we all know that it is not true. RB and Sata just like with VJ were very close friends but Mmembe says otherwise.

  12. MUTEMBO AND HIS BROTHER HAVE RUN A VERY SUCCESSFUL LAW FIRM WITH INTEGRITY. BUT THERE IS A LOT OF JEALOUSY FROM FELLOW LAWYERS AND SOME PEOPLE WHO BELIEVE IN “PULL HIM DOWN”. THEY CANNOT JUST SEE ANYONE SUCCESSFUL. SOME PEOPLE ALSO THINK THAT WHO EVER IS SUCCESSFUL, IS A THIEF, A SATANIST OR CORRUPT. I FEEL FOR MUTEMBO. THE GANGS HAVE GATHERED TO CLAMP HIM DOWN AT ALL COSTS. SOME OF THE CHARGES BROUGHT ON HIM HAVE ALREADY STARTED TO CRUMBLE. BUT AM SURE THEY WILL STILL COOK-UP SOMETHING TO ENSURE THAT MUTEMBO IS CLAMPED DOWN. THEY USED HIM, NOW THEY HAVE DAMPED HIM. THATS WHAT POLITICIANS ARE. I HOPE MUTEMBO WILL NEVER ACCEPT ANY POLITICAL APPOINTMENTS IN FUTURE. THIS IS A LESSON.

  13. The action by camrade Chagwa to institute the tribunal was founded on hatred and to free his colleague RB.
    All those charges are fake because some of the remaining charges out of the two dropped are connected.
    Why not disband the tribunal and in the spirit of togetherness you look at other issues that will bring food on the table of the common man.

    • Mapalo. I hope you are old enough to recall that Mmembe and Mutembo framed the late DPP Mukelebai with a number of allegations through the headlines in the Post newspaper. A Tribunal that was set up and held in camera found the allegations baseless and cleared Mukelebai. However as the two had wished Mukelebai was still removed as DPP. Mutembo then without opposition took full control of the Chiluba case. Mukelebai was seen as a stumbling block to their scheme. Mutembo first said it was free legal services then later starting earning huge sums from the case as legal fees. Mwanawasa cried foul about the fees but was told off in one of the Post editorials not to question the payments to Mutembo. There is a lot of self interest in how Mmembe and Mutembo act. Its rarely for national interest

  14. Nchito and Mumembe built PF as a safe heaven, it is good that the same safe heaven is becoming a grilling hell for them. Please Mumembe and team pay back the ZMK14billion with interest.
