Fred Mmembe with wife Mutinta and Joseph Mwenda sit outside Bwinjimfumu road after they were arrested

Police in Lusaka last night arrested Post News Editor Fred M’membe and his wife Mutinta including Deputy News Editor Joseph Mwenda.

This was after the trio gained entry to the Post Newspapers Head Office on Bwimjimfumu road around 01 Hours this morning following a stay that restrained Zambia Revenue Authority from seizing the newspaper’s property.

Armed Police officers also brutally beat up Mr M’membe, his wife Mutinta and Mr Mwenda before bundling them in a police van which drove off to Lusaka Central Police where they have been locked up.

Post Newspapers Lawyer Nchima Nchito was also beaten when he tried to reason with police when they were beating up the trio.

Police later started towing cars of Post employees away from Bwinjimfumu road who had gone back to their offices following a court order restraining ZRA from seizing Post property.

    • I APPEAL TO ALL MEDIA HOUSES TO STAND UP AND PROTEST AGAINST SUCH INHUMANE TREATMENT BY GOVERNMENT USING STATE APPARATUS. ALL JOURNALISTS SHOULD STAND UP TOGETHER AND SHOW SOLIDARITY WITH THE POST NEWSPAPER. IT IS WITH THE POST TODAY, TOMORROW IT WILL BE WITH ALL THE OTHER MEDIA HOUSES. WE NOW HAVE A DICTATOR PRESIDENT IN ZAMBIA. LUNGU IS INFRINGING IN OUR RIGHTS. LUNGU HAS NO RESPECT FOR THE ZAMBIAN PEOPLE, WHICH IS WHY HE DOES ANYTHING HE WANTS WITHOUT LISTENING TO THE VOICE OF THE MASSES. LUNGU IS A SERIOUS DANGER TO ZAMBIA’S DEMOCRACY, WHICH IS WHY WE SHOULD ALL PREPARE TO EFFECT CHANGE OF GOVERNMENT THIS AUGUST. LET US UNITE TO REMOVE THIS TYRANT BY VOTING FOR HH AND THE UPND TEAM. LET US LOOK FORWARD TO REAL DEVELOPMENT IN OUR COUNTRY BY VOTING FOR HH. LET US VOTE FOR HH WHO HAS…

    • Here is what my grandfather from Mushili said on Saturday 25th June at 19hrs in a phone conversation “moneni ba PF efyo baonaule calo. Ngamwa ba votela nafuti pa 11th August nimwebo mukaculilamo” Now granddad knows exactly the potential misery we face should PF win in this coming election. The warning has been sounded and come what may, know what needs to be done on August the 11th. All well-meaning Zambians are called to attempt to rid this country of the mess PF has put us in.

Secondly this woman has divorced him. Why is he maniputing and parading her in the think of the night.

Unless she went there for something…..

    • Who witnessed this BRUTAL BEATING at 01:00 am?
Police have the power to use ‘reasonable force’ in effecting an arrest, which may look ‘brutal’ to an effeminate person when there is resistance.

    • This Order is not making sense. I thought 11th July 2015 inapita kudela. I mean 11th July 2015 was last year. I think ZP got it right unlike the lawyers Nchito and the Judge of the RAT. Sharp officers kudos to you.

    • IT’S IRONICAL TO THINK THAT ONE CAN OPERATE HIS OR THEIR COMPANIES WITHOUT PAYING TAX. tHERE’S NO WAY ANYONE CAN EVADE TAX IN THE UK, AMERICA OR ANY OTHER COUNTRY IN EUROPE. YOU CAN BE JAILED OR BAILIFS TAKE ALL ONE’S BELONGINGS.

    • Order is defective. It says that Appellant pays to the Respondent by 11th July 2015, a date that has already gone a year ago.
Notwithstanding that the Post shall be allowed to operate while they are given time to pay in court all disputed amount.

    • This is pure police brutality. What kind of training do the police in Zambia receive? I’ve seen videos on YouTube of the police in Zambia brutally kicking and beating up suspects as they arrest them. Has anybody informed them that their job is to serve the people, and to arrest law breakers and not to beat them up? And that everyone is innocent until proven guilt in a court of law? If someone is not being belligerent, or rioting, there’s no need to use excessive force. Zambia is not a police state. Secondly, the ZRA issue seems to have gradually morphed into a political pawn than anything else. Some politicians seem to have pounced on it, using it as a political leverage. Just because the POST owes taxes doesn’t mean they can’t have access to their business premises, unless…

      0

      0
    • (Continued)…there’s a restraining order from the courts. It’s not the responsibility of ZRA to close businesses. That’s not their job. Thirdly, the temporary stay and restraining order against asset seizure that the court issued , should be enough for now for the POST officials to have access to their business premises. Ignoring the order clearly disregards the rule of law, and disrespects the judiciary. If there’s a law that allows suing the police or the city, the POST lawyer needs to initiate it. And the court too needs to hold someone in contempt of it’s order. We support ZRA, and we know it’s extremely important that everyone pay their fair share of taxes, including the POST company. But it doesn’t mean that other laws be disobeyed or broken in the process, in order to…

      0

      0
    • (Continued)…enforce the tax law. You’re expecting the POST to obey the law and pay the taxes they owe, and yet you’re blatantly disrespecting the rule of law by disobeying the court’s order. That’s a double standard.

      0

  2. WTF?????? Where’s the Rule of Law? This is an outrage. Have things come to this? The President needs to intervene as this is tarnishing Zambia’s image as a democracy and undermining investor confidence. Arrest the culprits without violence. These ZP chaps and their IG need to be educated on due process and can’t run the country like a police state. There are laws and its their obligation to enforce these without favour or brutality. I’m ashamed to read this article and genuinely sick to my stomach.

    • @2 ONEZAMBIA, IF TRULY YOU LIVE IN CANADA YOU KNOW FOR SURE THAT NO ONE CAN BE ALLOWED TO EVADE TAX. THE LAW IS VERY TOUGH ON TAX. WHAT HAS MEMBE BEEN DOING ALL THESE YEARS TO ACCUMULATE SUCH AN OUTRAGIOUS TAX AREAS? GUYS, DON’T JUST CONDEMN THE GOVT FROM YOUR POLITICAL ALLIANCE STAND-POINT. BE TRUTHFUL TO YOURSELVES. THESE ARE THE SAME PEOPLE WHO CONDEMN, USING THEIR OWN PAPERS, THE GOVT OF BEING BANKRUPTY. HOW DO THEY EXPECT THE GOVERNMENT TO HAVE MONEY IF COMPANIES AND PEOPLE ARE NOT PAYING TAX?

    • This just confirms that Chakolwa Chagwa does not want the Post to pay ZRA the taxes but rather to shut them down until after 12 August – if he wins. I hope this teaches Mmembe a lesson. He demeaned himself sticking up to his Michael and putting PF in power in 2011. RB never closed The Post although it still owed money even then. Now this is what you get for patronising riff-raff. PF are your personal lilomba that will consume you now.

    • Iwe One nation read the second page last sentence numbered 2. This order is defective and police were right to ignore it and put M’membe and cohorts in the chucks! What nonsense of the revenue tribunal has the powers to over rule the supreme court of Zambia firstly?
Secondly the date for the appellant to pay the respondent is indicated as 11 July 2015 hence defective.
It is useless to publish a defective document in the hope of enlisting some overzealous peoples’ sympathy!

  4. This proves beyond any doubt that the closure of the Post is not a tax collection issue but political. Even if the Post had paid all its taxes to ZRA it will still remain closed to ensure that Lungu’s election rigging manoeuvres remain undercover. Lungu is determined to retain power thru violence and rigging. Lungu knows he cannot win these elections without violence and rigging. By ignoring the court order ZRA and Lungu’s govt has shown clearly that it does not respect the rule of law and the Zambian Constitution. Zambians lets open our eyes and stop dictator Lungu in his tracks b4 Zambia is turned into a violent, lawless and failed state. On 11th August 2016 we have a duty to our Nation to vote out this thuggish and visionless President and PF. Viva HH,GBM &UPND.

  5. I have a question can the Revenue Appeals tribunal stay the matter already decided upon by the Supreme Court? In my view it can’t and I think The post should have first taken the matter to the Revenue Appeals Tribunal b4 they took it to the High Court and by them taking the matter to the High Court and the Supreme Court, the post finished the legal avenue and them going back is forum shopping and abuse of legal process. Furthermore deamining the supreme Court.

  7. Fred should have been locked up a long time ago. He always wants to make headlines for wrong reasons. He has the money. He can settle this case at any minute.

ZRA and the Courts have done everything to facilitate him to settle this bill for more than 10yrs.

Enough is enough. Even the diplomats who have followed this case know this.

When HH did NOT get coverage by The Post and he ( Mmembe) called HH a tribalist, HH was calling Mmembe a Tax cheat and Thief.

Now HH is calling Mmembe a Messiah that must be protected.

UNFORTUNATELY, the Big International Media Community is consumed with BREXIT.

  13. Annihilated this Is not a tax or legal issue. It is political survival for Lungu. ZRA and the Police have been directed by Lungu to keep the Post closed otherwise Lungu’s Election Rigging Moves will be exposed. Lungu has shown to the whole World that he does not listen to anybody and will do as he likes to remain President. Lungu is showing his true colours. Thru violence he became PF and State President. Lungu is determined to use violence again and rigging to remain President. This helps explain why Lungu has kept his Ministers in their posts illegally to help him rig these elections. This is a matter of life and death for Lungu. For the sake of Zambia and the future of our children Lungu must be stopped and shown the Exit Door at State House otherwise we are doomed as a Nation…

  14. I may not like M’membe, treating him as a less being as Zambia defeats the very purpose to be first a person ans secondly a Zambian! Application of law must be level! For example, if ECL in a year he is able to make double his assets, we must be availed with his taxes as well!

    0

    0
  15. People – let’s look closely at the structure and function of courts on the one hand, the constituted tribunals on the other as well as the merit of cases. The fact that the word ‘Supreme’ is used for a court of last resort does not mean ALL cases end their lifetimes there. This is now why Zambia itself is losing direction because its citizenry are not keen to work out simple lines of English in their own statutes. This is why even the President is maneuvering gingerly because he knows there are precipices on either side of his argument even to the distinguished excellencies he was addressing. Awe mwe!

  17. Well tried Mr Nchoti, very interesting but case cannot go anywhere. Court processes do not start from top to bottom and lower legal organs cannot overrule higher legal organs. If that was so and the lower organ erred at law who would apeal to who? Have you ever heard a court telling the defendant to pay what he feels he wants to pay, a proper revenue appeals court for that matter? How does a proper revenue appeals court “…order the appellant to handover trucks, trailers and other property to the tune of K53m….”? How can broken down and cannibalised trucks and trailers be worth K53m? What do tgey mean by other property if that does not include the bwinjimfumu offices and industriall area? Or does the so called tribunal intend to allow Post to operate only up to 11 July and thereafter…

    0

    0
  18. Can someone educate us please: It says the respondent hands over back the premises of the appellant on condition that they give trucks and properties to the tune of K53m. Before doing this why did he go to the office. Does it mean he didn’t read what this document was saying. I think our man must learn to be humble. The only way out f this Mr Mmembe should also conduct himself with humility. He has been preaching about a lot of virtues in his editorials. As much as we would not want government to suppress press freedom, we expect press people not to steal tax monies and also when found guilty, they show remorsefulness as expected from every citizen. Give ZRA trucks, properties and other items to make up K53m then you can gallantry enter your office. Simple!

    0

    0
    • No Mr Dominion! Fred Mmembe has a constititutional right to say what he wants, when he wants and how he wants! Constitutional protection is not predicated on someone ‘being humble’!

      0

    • So he does a handover without going to the office? Then what is ECL’s Ministers doing in offices if handover is possible from outside office?

  21. Kalok u are missing the point! Lungu is showing his true colours. He does not respect Court Orders, he not humble,he is violent and brutal, he will do what he wants to remain President. If Lungu rigged his way back into power even his supporters will feel it and cry. Lungu is a violent thug who became President by mistake. Unless we Zambians want dictatorship Zimbabwean and Ugandan style we have to vote Lungu on 11th August 2016. Lungu is now a threat to Zambia’s security left alone.

  22. Or does the so called tribunal intend to allow Post to operate only up to 11 July and thereafter can shut down again? Very suspicious move by Nchoti, What is it that Mmembe is being allowed to remove quietly or hide or tamper with, books of accounts? Why?

    0

    0
  23. ZRA just keep the Post shut until they pay. It is not the duty of courts or tribunals to open loopholes for thieves to escape. Also check the authenticity of all documents word by word and check signatures. This is a high stakes game and culprits are fighting matters of life and death. To me I can see that the Post’s offices or books may contain incriminating documents or references to the DBZ/ Zambian airways matter. This so called stay is designed to hide or remove . Nchoti and fellow defendants must have realised that incriminating document remained in the those offices.
Anyway police just keep the three under lock and key. Lock up the forgerer too.

  24. The people at the tribunal have a problem and they should be removed from their. When last did they do this for any company ZRA closed on. Is it right for someone to deduct PAYE from employees and not submit it since 2009. Even HH or Nawakwi or Sinkamba was the president I don’t think so they would allow any company do that. Why can’t Mmembe take a route of liquidating the debt as opposed to being confrontational. People are saying Lungu is not humble, what about Mmembe is he humble? Zambians lets look at this issue objectively, Is Mmembe right with what he has done and keep doing. Is Tax evasion not stealing?

    0

    0
    • Nobody has ever claimed that Mmembe is humble but PF has been singing that Chagwa is humble. What bothers me though is the seemingly inefficiencies demonstrated by our ZRA. What has taken them so long to recover money they are owed until it is election time? Is their interest to collect the money for the next government or what? They must be a bunch of incompetents. They need the whole choir behind them to do their job!!???

      0

      0
  25. There is no mess tgat the PD has brought to this country, only the Post, Mmembe, Nchotis, Zambian airways have brought mess and faeces to this country. Just imagine a DPP forcibly taking over the prosecuting of a friend Mmembe even when Judges have to declare interest? Do you see any morality or legality in such lawyers? And this is the same lawyer more or less same genes who is drafting this rubbish piece of paper. As for those who expectvriots over Mmembe, sorry you have orrted him. Nothing of the sort will happens. Genuine and majority Zambians will not sleep on Mmembe.

  26. What goes round comes back around, M’membe you have yourself to blame because you think you are above the law. I am seriously annoyed with HH who cheats people that he is an economist and yet he is now supporting someone who has been evading or withholding taxes for more than ten (10) years.
Am not an economist and will never be one because its a very basic subject, as it is underpinned on simple and straight forward dimensions: demand and supply.
Now what is TAX? Tax is money a consumer pays to Government based on some percentage on goods and services procured, and the selling entity, organisation or institution ONLY collects it on behalf of Government to be remitted in the the stipulated time period. If one doesnt remit this tax, its a serious offence because thats openly stealing…

  27. contd
If one doesnt remit this tax, its a serious offence because thats openly stealing from Government. It is used by Governments to fund Health, Schools, projects, pay civil servants etc…
Example of countries were tax laws are vicious and merciless is USA, UK, Germany, Japan and China. So l hope the f00ls in UPND will now understand this simple explanation.

  37. This exparte injunction is a document born in corruption. I don’t understand how an injunction can super-cede a supreme court order. Can someone explain how this works otherwise the blatant disregard of the law drives countries into disarray.

  38. The Revenue Incomes Tribunal is not above the Supreme Court . The courts have rules and regulations.
When you get a court order it is not your duty to execute that order but law enforcement agencies.
Mumembe might have got the judgment from his sympathizers but that does not give him authority to disobey the rules of the land.
Only UPND fools can support Mumembe’ s bad behavior
We as law abiding citizens are on the side of the law enforcement agencies

  39. You people, have you read this document properly? The document clearly states that ONLY UPON THE FULFILLMENT OF NUMBER 1 OF THE SAID DOCUMENT!! UNLESS THE POST RELEASES ASSETS EQUAL TO K53.8M…BUT HAVE THEY DONE THAT? Dont just argue ignorantly..

  40. Mmembe is so Cheap and a User. He is now using Muntita Mazoka ( daughter of founding father of UPND ) to annoy the Tonga Base.

Secondly this woman has divorced him. Why is he maniputing and parading her in the think of the night.

Unless she went there for something…..

  42. The law is the law. Those who know the law can use it to someone’s advantage that is why we have lawyers. If some of you don’t know how to use a lawyer, why blame those who can? Is it simple Zambian jealousy as usual! The level of rational thinking is quite baffling in this country.

    • Zambians as usual dances to see others harrassed. Is it out of Jealous or illiteracy. Mmembe though not liked by PF helped them to beat MMD and today PF does not want to give him any platform to resolve his grief. But at the end of it all justice must prevail.

  43. The Police officers at the Post offices acted unruly and illegally. Lungu and his govt should respect Court Orders in terms of Zambian Constitution. We are now dealing with a President who believes in the law of the jungle in a Constitutional Dermocracy. In Lungu we now have a violent and lawless President. If we don’t stop Lungu then Zambia will become another dictatorship and a failed state. Thank God in 38 days Zambians have another chance to get rid of dictator Lungu. Lets go and vote for HH and UPND in huge numbers and usher in a new govt. Yes We can!

  49. Membe, your daysfor ducking and diving are long gone. They went with the demise
of M Sata. Just pay what you owe. You are not a special or sacred cow. The tax appeals
tribunal that issued this fake order is not superior to the SUPREME COURT. THE SUPREME
COURT IS THE HIGHEST COURT IN ZAMBIA. That is why the police did not respect that
order. In any case, why issue a restraining order on an action that has already been carried
out? You and nchito are very dull lawyers

  57. The TaxAppeals Tribunal is equivalent to the High Court. So if you are not satisfied by the decision of the tribunal you appeal to supreme court.
The function of the tribunal is to preside over the decisions made by:
    1. The ZRA commissioner
    2. The Minister
But not the decision made by the supreme court. That registrar from the tribunal has questions to answer.

  60. I did say that The Post is not a simple kindergarten entity. Hate it or not, this event started by the unbridled raid and subsequent confiscation of assets is but a tip of an avalanche to unfold. We have seen this script before and we know where it will end in such a delicate campaign period at hand. Much support and prayers to our fellow Zambians at the Post. We await patiently for HH and his fellow team of fine Zambians to fix our broken country; this beating and violent culture has to cease after August. Much sympathy went to ba Sata when ba RB tear gassed the old man, sympathy results in votes. Much sympathy is pouring to the beaten up and defenseless friends and comrades!

    1. Fred Mmembe was accompanied by the wife and the other guy and found at the same time in the same prmises why should the wife excused?
    2. That place is under security officers ,how did they gain entry to the place (Corruption?)
    3. This Mmembe guy cannot outsmart the state taxes must be paid. For the bill to reach that amount means it has been accumulating from way back. ZRA is not a problem regardles of how huge the debt could be as long as you are able to settle in small amount they cannot harrass u in any way but becoz this Fred thout the impractible things in his ka head has led to this. If fred and the pot have been paying out somthing this tymn the amount should have been…

  66. There’s time for everything. This M’mbe guy was on top of the world championing anarchy and divisional reporting in his tabloids among Zambians. He should just come out of self- denial, deep sleep, and hallucination, pay ZRA ,accept that right now in Zambia we are all equal. Those days when he was untouchable are gone.I know he misses them.,but law is law and whatever goes up must come down. The man has done irreparable damages to dignified people,eg Dr FTJ Chiluba-people started to perceive him as criminal(RIP).So this is your turn to dance peletee.

(a) This is a defective order vis para.2 (b) The Registrar of the RAT does not have the powers that she has exercised she needed to call the Tribunal to sit to determine the matter she is ex-officio to the Tribunal (c) This application is irregular in that it is seeking to introduce a fresh prepayment order that fell apart once the Supreme Court Ruled as it did and (d) This is mischief on the part of Nchima he wants to restart appeal upon appeals in clear abuse of the process of the law? that’s why his brother the ex-dpp fired him, law must have its finality (e) Who goes to reopen his premises at 01.00 am suppose they had been shot? believing they were thieves….just go lie down

That is why our nation still remain under developed ,for people choose to steal and everyone supports them.

  70. The reign of terror by the dangerous president is getting out of hand and soon the vast majority of the population will be hit hard including those like Saulosi, Senior Citizen and Chief Bootlicker who sing praises to the regime. The president has openly and publicly told the nation that he gives his PF police orders to arrest opposition leaders as he wishes. We understand the man is a lawyer, if indeed he is people would have expected him to be the first to uphold the rule of law.
The people will never forget what is going on now and one day, no matter how long it will take to come someone will be made to answer and defend himself over the misrule that is being unleashed so brutally. Time will tell.

  71. How about arresting the people that beat up and undressed a woman on the video that’s circulating in Zambia. I’ve heard that in fact died of the beatings. What Zambia do we have. Why allow such a crime linger and deal with something that has injusticeness attached. Where are police.
