PF Information Committee Member Sunday Chanda says LAZ President Linda Kasonde should not risk embarrassing LAZ by making statements without facts.

In a statement Mr Chanda said Ms Kasonde’s statement on Tuesday was shallow and devoid of legal grounding.

He urged Ms Kasonde to base her defense of the tax defaulting Post newspaper on facts.

Below is the full statement as issued by Mr Chanda.

LAZ PRESIDENT MS LINDA KASONDE MUST SLOW DOWN ON IGNORANCE SAYS SUNDAY CHANDA

Ms. Linda Kasonde, the new Law Association of Zambia (LAZ) president must slow down and make coherent and intelligent statements based on facts before she runs the risk of embarrassing the reputable LAZ and entire legal fraternity in Zambia.

We say so because her press event was nothing if not shallow and devoid of legal grounding today. She spoke like a pedestrian counsel and not a certified one which is shame.

There is absolutely nothing wrong with Ms Kasonde defending the tax defaulting Post newspaper but she must at least do it based on facts. Let there be honour even among thieves.

We would like correct the following misleading statements she uttered in her excited defence of The Post that owes poor Zambian tax payers more than 63 million Kwacha or 6.1 million US dollars:

• Firstly what she refers to as a court order from the so called Tribunal does not exist because the revenue Tribunal was repealed a long time ago, what exists is the Tax Appeals Tribunal

• Secondly there is no ruling that can be made to OVERULE the Supreme Court ruling so we wonder what Ms Kasonde means when she claims a legally binding court order was defied. This is what is called in legal terms, Gods Case.

• Thirdly, Fred M’membe (The Post) whom she is supporting is a tax offender who has taken money out of Zambians, poor Zambians that pay duty when importing cars for re sale, including his own employees. Zambians are the victims, he is an offender.

We can go on to point out more fallacies in Ms Kasonde’s overzealous statement, clearly she is very excited with her newly founded fame she does not want to stop and research before she shoots her mouth, however, we will spare her for the sake of the reputation of LAZ.

As we spare LAZ though, the gross embarrassment for Ms Kasonde’s un-researched excited utterances makes compels to ask, “where was she the day they taught law at law school?”

Conduct basic research Ms Kasonde, understand issues before you issue statements instead of embarrassing LAZ. *Mina amate!* (Swallow saliva).

We remind Zambians that Ms Kasonde is glossing all over real issues regarding how Mr M’membe, became a tax offender who must pay ordinary Zambians what he owes according to the Supreme Court. She is creating her own fictitious narrative due to excitement of her new election at the expense of LAZ reputation.

Also, the order Mr Membe presented to the police yesterday does not have the power to over-rule a Supreme Court order and it comes from a non-existent Tribunal.

We refuse and do not want Ms Kasonde to be mistaken for being ‘Legally Blonde’ so we will end here.

  1. Sunday is most ignorant if anything. This is a guy who the PF demoted from their media committee, The PF did not adopt for MP in Kanchibiya. Now we all know the mediocrity in PF, for one to be demoted and not even considered speaks volumes.     • Sunday, to say the least you are patronising Zambians. You are referring to Zambians as being poor, when you party is saying everything is fine and no need for anyone to fix the economy. There is everything wrong in bringing God’s name in you second point.

  2. It very sad to have a Law Association President who doesn’t know that the Tax Appeals Tribunal is not yet functional. That is why she is losing cases as the president of LAZ like that for ministers. I mentioned yesterday that it was too early to comment on the issue at 10hrs on the matter which happened the previous night at 01hrs.

  4. LAZ has a mandate to criticize government action, decision or its inaction or indecision. The government does not enjoy such a mandate. In defending government, it is necessary to protect small entities, such as a media house. Give chance to public interest litigation to prevail. There is no need for government officers to become defensive. By doing certain things, government exposes itself to ridicule in the eyes of the international community.

    • But I thought that could be done with facts! What if it turns out that the document Mmembe presented is forged, what will she say? Did she even examine the document herself? Yesterday she was against referandum going hand in hand with general elections and before long she turns round and justifies the move of holding it together with general elections! We are not saying she cannot criticise but she needs to take heart and examine all facts before jumping on band wagon!

      Who said that the document is forgery? Did Deputy Registrar make statement about her signature? On the other hand, if it is true that her signature has been forged, how come that ZP did grant “Police Bond” for serious felony, instead of taking accused in front of Magistrate?
      Somehow, things are not what Mr. Vuvuzela Chanda is trying to portray. There are to many why which he avoid to answer and cover-up.

Mr Chanda hope u are ok Man, are u a tax consultant and do u understand the taxation laws of Zambia, who should deal with this matter is it ZRA or State house? if its ZRA then M’membe would have been given what is known as a payment terms of an agreed installments. but wat should have been resolved by tax auditors has just slipped off in the hands of politicians now, let the CG ZRA and his staffs handle this matter and it will be done in a right way but if shallow minded people who does not even understand tax laws put their political and empty minds in it then it shall fail, Post has alot of employees who too are keeping up so many families are u even thinking of what will happen if post is to be closed? which is better he pays in installments or u close it down? bwana do not speak to…

    • ZRA has closed a lot of shops and small scale firms for ‘poor’ and voiceless people who defaulted on tax payments and they were not given the option of paying in installments. Maybe this case will change their method of operation but then it will be at the risk of encouraging people to default with the expectation that they will be treated leniently … it’s not as simple as it looks. If they give the Post leniency, i will also default tomorrow and other business people will do the same so that we could pay taxes at our terms and expand our business!

  11. So here goes what everyone was guessing to be correct; the persecution of the Post by the ZRA is Lungu’s ‘falling on you like a ton of bricks’, ‘alefwaya pakufwila., ‘I have small body but carry a big stick’.

    Why would Sunday Chanda bark unless his master Lungu orders him to do so. This whole thing is about Lungu and Chikwanda wanting to close the Post so that the loot these two chief criminals stole is not exposed.

    I say it again, Lungu is a thief. I am a lawyer and we have disbarred Lungu for professional misconduct. And as they say, uwakalema……. Now he has looted grand style the treasury.

Does anyone here know that Meembe has been charged with forgery. It is alleged that the document he wanted to present was not original. He comes for mention next so i also agree that the new LAZ president should have waited before making conclusions from inconclusive data. I dont agree about the being legally blond as well but i agree that she was over zealous to comment that early

  16. What law does Sunday Chanda know? Ms Kasonde is a professional trained lawyer with vast experience. With a Tax Court Order the trio did not tresspass their own property. The trio produced a Court Order allowing them to be at that property. Its not for ZRA and the Police to say the Court Order was forged. Let the Tax Court deal with the matter and after all that Court has already set 11th July 2016 to meet with ZRA and the Post to reconcile the tax figures. Sunday Chanda should leave lawyers to deal with legal matters instead of making a fool of himself by commenting on legal matters which he doesn’t understand. Forward with HH& UPND.

    (1) Forgery
    (2) Failure to remit taxes to ZRA.

    Where one earth and how does one appeal against the Supreme Court judgment?

      I did peruse “Ex-Parte Order” more than once, I did not find “Appeal Against Supreme Court Judgement” mentioned. Are you now imposing Vuvuzela Chanda biased interpretation?

    There two unrelated cases: One Criminal (Forgery of a court order) and the other is Civil against ZRA, which also can turn into criminal if ZRA had the time to pursue it.

So see clarification from them if what is reported is correct!!! Let the ZRA commissioner on come on the air and live to be asked questions and clear the mess!!! Then we will know who is at fault! For now let Post produce receipt to show that they paid!!!

    • One of the tenets of taxation is confidentiality. ZRA will never discuss tax issues of an entity in public. They will only deal with the affected entity on the matter and not reveal such information to the general public. NEVER!

      CRAP, read final report of “the Commission of Enquirer in to ZRA operations”.
      ZRA can be sued as it is Corporate entity. Read Act establishing ZRA.
      One of the steps of the judicial process called “disclosure” impose on ZRA to avail all relevant information to the opponent. It is up to the Court to decide if such information can be disclosed in public or in “chambers”.
      Never say “NEVER”. You may sound like Chanda, full of biased 5tupidity.

  25. The date on the Order is 15th July 2015. What a coincident? Can you spot anything wrong with this Order:? Besides the Post had entered into to Time to Pay in Installments but still defaulted. Let us be sincere in our comments. Further, once the Supreme Court of Zambia has decided a case, there is no more appeal. I beg to learn from you all learned Counsels.

  27. The Law Association of Zambia was destroyed during the reign of one lawyer! It was the time when every Jack in Zambia found time to go to “Law School!” They cannot distinguish between a High Court ruling from a Supreme Court’s. They are corrupt guys who pocket money through deceit.

    You see Mr. Chanda, changing name of the institution, does not imply that now TAT is in full compliance with the International judicial requirements to which Republic of Zambia has acceded and undertaken to comply. To the contrary, to day TAT (ex RAT) does not meet minimum International standards as to the impartiality, natural justice and rule of law.

  30. Pipo, you are missing something here. Post has not failed to remit the owing tax.what is pending is reconciliation of tax disagreement. That’s why the matter was supposed to go to the Tax appeal Tribunal before passing judgement by supreme court. Supreme court rushed in handling this. But now who is Chanda to determine the document. Is it the political party to determine this or official from ZRA or legal personnel. Who knows better about this court order to overrule the supreme between (Muchima Nchito, Kasonde) ànd this Pf information committe member? For the PF to indulge in such, simply means the party is the one backing-up.

I can only advise all of you bloggers including sunday to read and understand the supreme court ruling regarding the post issue and you will find that what they (supreme court) dealt with is totally different case from what ZRA demanded after the supreme court ruling ordering the post to pay. Further, for everyone’s benefit, please not that the supreme court does not deal with issues relating to facts of the case, they deal only with legal interpretation of the case at hand.   32. CONTINUED! So nothing wrong with post seeking reconciliation of debt with zra/tax tribunal as this is a factual issue that is within the mandate of the tribunal to deal. I can see Membe having the last lough.

  33. Sunday Chanda may be incompetent in some people’s minds, but what he is stating are facts which some bloggers who sounds illiterate are not urging with.
    1. Can a lower court challenge a Supreme Court Judgement.
    2. This Revenue and Tax Appeals Tribunal issues how legal are they.
    3. Does the Post owe 58 Billion Kwacha unrebased to ZRA.
    4. For how long have they avoided paying tax.
    The law fraternity is slowly drofting to Bilikiloni and Difikoti shows with this girl who seem to have attained her law degree from below as most of them do.
