UPND to petition Edgar Lungu’s victory, demands that President Lungu steps down

The opposition UPND is this week expected file a petition in the Constitutional Court against the re-election of President Edgar Lungu who scrapped through Thursday’s tightly fought election.

And the party is also demanding that somebody takes over the Office of the President in an acting capacity once the petition is filed in accordance with the amended constitution.

UPND Legal Adviser Jack Mwiimbu told Journalists in Lusaka shortly after President Lungu was declared winner that the opposition party will file the petition papers anytime this week.

Mr Mwiimbu also revealed that the Court has also granted leave to commence judicial proceedings against the handling of the election.

“I wish to disclose here that last night we had commenced judicial review process, the court has already given us leave to commence legal process, this matter will be held Wednesday morning, concurrently we are commencing the petition against the results of the presidency,” Mwiimbu said.

He said the constitutional provisions have to take root because the party has overwhelming evidence that the election was stolen from Hakainde Hichilema.

“When there is a petition, somebody else has to act as President until the petition is decided. We are not going to allow impunity in this country,” he said.

“This country is for all of us. This is a very sad day for this country. We so ashamed that we can have an Electoral Commission that colludes with a particular party, that is not what we wanted. That is not what we wanted when we put those people in power. We never thought that such travesty of the law can take place here.”

He added, “The Electoral Commission Chairman even had the audacity to say that the Electoral Process Act was the one which was also used in the 2011 elections. How can a law which was passed this year be passed in retrospect? It just shows that there is something wrong in the understanding of the laws of this country by people whom we assume to be knowledgeable. We cannot allow travesty of the law in this country.”

Mr Mwiimbu continued, “We are aware of what they want to do, we have no doubt in our minds. We are resolved, we are going to take up this matter legally and we will not be constrained by anybody. We know that actually there will be victimisation, some of our supporter’s homes have been attacked. In Chibombo, 10 Kilometres away from here, a school to one of our members has been completely destroyed. His houses have been destroyed, just because he belongs to an opposition party.”

“This not what we fought for, this is not what we wanted as a country, we are not in any way failing to protect our interest, we will protect democracy and we will ensure that the process commences very soon.”

    • Today, I witnessed anarchy at its best in the name of celebrations. This is what I saw: Malnourished, dirty, bare feet, children and mothers dressed in tattered clothes running towards state house. Along the streets of Lusaka were the now permanent make shift stalls, loads and loads of rubbish. I also witnessed 2 men falling off moving vehicles. At Matero robots, our car was blocked by a mob wearing PF regalia. They forced my wife and I to raise the fist to let us pass. Today’s vote if not reversed is all about: high inflation, high interest rates and higher prices of essential commodities. The external debt will double while the IMF will come in with their SAP. Brace for harder times.

    • For those of you telling these guys to just accept the results and move on, have you considered the fact that they’re just exercising their constitutional right to petition the election results? Do you even know what the constitution says about the issue? If they say they have evidence to show the election was not free and fair, let them present their evidence to the court. It’s their constitutional right and you cannot interfere with, or take that away from them—unless you don’t believe in the rule of law. So think twice before calling them names and telling them to “just accept and move on.” That’s undemocratic.

      Asserting a right is always to be encouraged especially if you have cogent evidence. Like video clips of attack by opponents, denial and or cancellation of rally permits, destruction of property by opponents, stuffing of ballot boxes, mis match of votes to register, weird presidential results restricted to a particular region etc.

      In law you assert, then you have to prove on balance of probabilities. So if the ammonium is there, why not? After all Lungu ran a clean non violent campaign without help from illegal ministers….lol

The UPND has a right to take a matter to court where it deems fit and justifiable. Why should people be so dismissive of those who want to ensure process and the respect of law are followed? A Germany friend of mine, who was part of the European Union delegation, and has a very good knowledge of Zambia, having spent more than half of his life here, expressed shock at the skewed voting patterns from Southern province. But this case will pause a challenge to the Connstutional Court. UPND are demanding that the President steps down and that someone else acts. Who is that someone? If they were thinking it will be cartel Matibini, the one who was speaker in the last sitting of parliament, that unfortunately cannot work. Matibini is not speaker. His team went with the previous parliament. A new speaker? This one has not been chosen yet. So who is that someone else?

    1) Where in the constitution does it say a candidate must win by 50.3%?
    2) Where in the constitution does it say a candidate must win by 1,860,000 votes? We no longer win using totals but using %, in this case 50+1. This is what Chulu was supposed to explain before declaring.
    3) 50+1 must be a percentage of the valid votes cast not a percentage of the total votes for Lungu and HH.
    4) Lungu has started a long legal battle which may see him not rule this country.

    • You UPND the problem you have is that you didn’t read the constitution when we were enacting it now you are confused. Artcle 47 of the constitution will help you understand. Its 50% plus 1 vote. or more than 50%.

  30. The numbers game with ECZ is hard to win because they really do a good job. This would even be tough now that all the major PVTs including that run by the Church group has confirmed that their respective numbers tally with those of ECZ. UPND needs to consult widely on this before rushing to court. It may be better to save some left over campaign moneys for party reorganisation given that God & the people of Zambia have already chosen President Lungu with a significant margin. God Bless Zambia

    • The law is the law of the land. Even if some people didn’t support it, once it was adopted, that is the law to use. Which law do you want UPND to use? Just like the President, even if about half the population didn’t vote for him, when he is sworn in, he is President for all Zambians.

  32. No doubt the results were definitely manipulated… They are not very clever too as it took them almost 5 days to find a way to stack up numbers. You can see how they tried to come up with that percentage results. By the way, doesn’t the Constitution say 50% + 1? Is it plus 1 vote or plus 1%?

  38. I am ashamed to be Zambian right now, not for the election results but for the sort of nonsensical writing I am seeing here. Some elderly people think like children. What is wrong with a person wishing to go and get redress from the courts of the land? We have a group here that is civil and peaceful and that is why they chose to have their grievances channeled in the manner duly constituted for that purpose.   47. We said in the past eight years that this type of voting is bad especially when it spreads to the other provinces of our country, you ignored, now look at what you have made our country into?
    H.H has brought a very bad type of politics of which if left unchecked, it’s a source of confusion. Sometimes you have to be civil as aspiring leaders and learn from the ordinary citizen of this country.

    An election is not won in court but its won by voting, democracy is about the majority whether they are wrong or right they win. No one or three judges have power to appoint a president.

Mr Mwiimbu,why were you not the one raising issues during the annoucement of the results?Martha Mushipe was too emotional and we needed you our sober minded lawyer.We missed this part i think….no wonder they stopped answering questions and just announced the results.Or you could have told her to calm down.I hope we have overwhelming proof of the claims,otherwise it will be merely academic.ECL has his people on the concourt,so what are the odds of them overturning the vote?even the alleged miscalculation by ECZ,they will easily rectify by cooking up figures or simply saying they erred on some of the results.So looks like we’re up against a mountain.But it never hurts to try i guess!!

    Add votes for all candidates and get 100%, In this case 3,695,710 is the total of valid votes cast representing 100%. Then 50% of 3,695,710 is 1,847,855 of the valid votes cast
    EL scored 1,860,877 which is 50.35% with a difference of 13,022 votes. Therefore any extra vote above 50% qualifies EL attain 50% + 1 target
