The opposition UPND is this week expected file a petition in the Constitutional Court against the re-election of President Edgar Lungu who scrapped through Thursday’s tightly fought election.

And the party is also demanding that somebody takes over the Office of the President in an acting capacity once the petition is filed in accordance with the amended constitution.

UPND Legal Adviser Jack Mwiimbu told Journalists in Lusaka shortly after President Lungu was declared winner that the opposition party will file the petition papers anytime this week.

Mr Mwiimbu also revealed that the Court has also granted leave to commence judicial proceedings against the handling of the election.

“I wish to disclose here that last night we had commenced judicial review process, the court has already given us leave to commence legal process, this matter will be held Wednesday morning, concurrently we are commencing the petition against the results of the presidency,” Mwiimbu said.

He said the constitutional provisions have to take root because the party has overwhelming evidence that the election was stolen from Hakainde Hichilema.

“When there is a petition, somebody else has to act as President until the petition is decided. We are not going to allow impunity in this country,” he said.

“This country is for all of us. This is a very sad day for this country. We so ashamed that we can have an Electoral Commission that colludes with a particular party, that is not what we wanted. That is not what we wanted when we put those people in power. We never thought that such travesty of the law can take place here.”

He added, “The Electoral Commission Chairman even had the audacity to say that the Electoral Process Act was the one which was also used in the 2011 elections. How can a law which was passed this year be passed in retrospect? It just shows that there is something wrong in the understanding of the laws of this country by people whom we assume to be knowledgeable. We cannot allow travesty of the law in this country.”

Mr Mwiimbu continued, “We are aware of what they want to do, we have no doubt in our minds. We are resolved, we are going to take up this matter legally and we will not be constrained by anybody. We know that actually there will be victimisation, some of our supporter’s homes have been attacked. In Chibombo, 10 Kilometres away from here, a school to one of our members has been completely destroyed. His houses have been destroyed, just because he belongs to an opposition party.”

“This not what we fought for, this is not what we wanted as a country, we are not in any way failing to protect our interest, we will protect democracy and we will ensure that the process commences very soon.”

    • You can count on the learned judges at ConCourt to guide you into concession that there is a winner and loser in elections. This time around, Zambian bought the ideas of ECL against your 10 bullet points scripted on an A4 paper as national development plan. Be warned, there is no loyalty in Zambian politics, you be shredding your money alone with many members coming to ECL house knowing there are many mansions.

    • If Lungu and PF won the election in a free and fair manner, they have nothing to worry about.

If the opposition were given room to.campaign, public media was fair, police unbiased and the ground level, then Lungu can sip some blue label and pop champagne.

But if not, the law courts do rude stuff. Like nullifying elections.

    • Today, I witnessed anarchy at its best in the name of celebrations. This is what I saw: Malnourished, dirty, bare feet, children and mothers dressed in tattered clothes running towards state house. Along the streets of Lusaka were the now permanent make shift stalls, loads and loads of rubbish. I also witnessed 2 men falling off moving vehicles. At Matero robots, our car was blocked by a mob wearing PF regalia. They forced my wife and I to raise the fist to let us pass. Today’s vote if not reversed is all about: high inflation, high interest rates and higher prices of essential commodities. The external debt will double while the IMF will come in with their SAP. Brace for harder times.

    • UPND already politically wired, they want to be legally wired and blame everyone in the country ( the Police, the Government, the Church, the ECZ, the Courts but themselves. Look at the goon in the photo; bitterness diffuses from inside out. Shear madness, they can’t manage the feeling of loss and healing will take ages. Envy and jealous rule their conscious. Shame!

    • Who cares. You told us this even before we voted that if PF wins you shall not accept the results. Even the judges you will be seeing know this. You are just fulfilling what you said.
What is sad is your voting pattern. We know what you do and we just let you go ahead since we know that will take you nowhere.

Do you suppose that we do not see those canters Ferring people to polling stations and the beers that follow. Your own rigging style has failed you for the second time.
You call voters morons and expect them to vote for you. What did GBM, SCOTT, SAMPA AND MULENGA bring to your party? It just makes the loss look much bigger and enjoyable by PF members.

    • For those of you telling these guys to just accept the results and move on, have you considered the fact that they’re just exercising their constitutional right to petition the election results? Do you even know what the constitution says about the issue? If they say they have evidence to show the election was not free and fair, let them present their evidence to the court. It’s their constitutional right and you cannot interfere with, or take that away from them—unless you don’t believe in the rule of law. So think twice before calling them names and telling them to “just accept and move on.” That’s undemocratic.

    • Please make sure you take this matter up, Lungu is a good man but he lost so let democracy prevail in Zambia such cheating is not good for our children and future Zambian leadership. Its a shame to see what PF have done. all blame goes to ECZ, they are not a true independent board but compromised with the ruling party.

    • With the Mugabe rigging formula, copied by Lungus’ men, democracy is dead in Zambia.

Zimbabwe has diamonds to sell on the black market and earn some dollar, what about Zambia?

Zambia has a worst country in the region during KK and is now going to be worst country to live in even worse than Zimbabwe jus mark my words. What I have said has always come to pass.

Intellectuals now is the time to make a move to other countries in which your work can provide for your family and enable you to educate your children.

Leave Zambia to true patriots who even they are hungry and dying of disease will still support Lungu ‘s mediocrity.

Entropy has engulfed the whole of Africa.

    • @Senior Citizen

Asserting a right is always to be encouraged especially if you have cogent evidence. Like video clips of attack by opponents, denial and or cancellation of rally permits, destruction of property by opponents, stuffing of ballot boxes, mis match of votes to register, weird presidential results restricted to a particular region etc.

In law you assert, then you have to prove on balance of probabilities. So if the ammonium is there, why not? After all Lungu ran a clean non violent campaign without help from illegal ministers….lol

    • @ Senior Citizen

I fully agree with you on this point. May I just add that the basis of my agreeing with you is due to lack of integrity of the ‘learned bench’ of the court in questions. They are a bunch of sellouts. Who doesn’t know that Mungeni is a pure breed PF cadre? What integrity do you expect from there?
The case will only be an academic exercise. Waste of time. What they have done in stealing the vote is worse than this small issue to them.

I have no doubt that you are esteemed fellow learned colleagues upto the task of sustaining an intelligent none opinionated debate. Kindly take off intentional biase substantially based on rumor milling works. We can drive this debate in so doing help each other on this overt source of public opinion. Time for campaign season straight jacket politics is over. Let’s debunk some issues based on substance. Note, I support their right to seek judicial recourse over street anarchy.

Thank you my brother. He who seeks equity must come with clean hands. Please drop your subjective commenting before you subject others to the same.

  11. That’s the problem with a lot of Zambians – and that is why you have Lungu as President. Simply wanting to exist in mediocrity. The UPND has a right to take a matter to court where it deems fit and justifiable. Why should people be so dismissive of those who want to ensure process and the respect of law are followed? You speak of democracy and shout from the top of mountains about respecting the Constitution. Yet, because you want to protect what you have benefited from Lungu, you choose to deride others and turn a blind eye to glaring injustices – essentially pushing the country to further primitive politics and a dire future for our children. Grow up and be objective!

    • You are one of the most midcore group in UPND. HH is your everything. He has failed so many times but yet you still hero worship him. You refused to be part of the new constitution and yet now you are the first to rush to ConCourt. Badala please please be serious when we are discussing national matters. If you had participated effectively may be some of the weaknesses in the constitution could have been avoided.

      0

      0
    • You are absolutely spot on…people should realize that the constitution is there for a reason its not a decoration -it is part and parcel of being in a multi-party democracy. This is why I say Zambians are docile people in Kenyan you honestly those ministers would have stayed even 24 hours after Parliament had dissolved, they would have had protested in front of Parliament with pigs and manure…if it was not for LAZ they would have walked away laughing.

      0

    • Emmanuel Mwamba is another example of our docility as a people here is a civil servant who has sent the last 6 weeks traveling to and from RSA campaigning PF at the taxpayers expense and time..yet no one has challenged him. If Lazy Bum appoints the Great Galu the same cycle of mediocrity and corruption will continue.

  12. The law is the law. Article 100(8) of the Constitution provides for petition in the Constitutional Court.

It’s your right as UPND to exercise. Go ahead and test the veracity of Lungu victory.

  21. These UPND fanatics must demonstrate a sense of dignity. A Germany friend of mine, who was part of the European Union delegation, and has a very good knowledge of Zambia, having spent more than half of his life here, expressed shock at the skewed voting patterns from Southern province. This is not something to be proud of.

    0

Dundumwezi gave ECL 200 whilst Chitulika gave HH 93.

    • SOUTHERNERS WILL LIVE TO REGRET ABOUT THEIR SKEWED VOTING STYLE WHICH HAS NOW CONTEGIOUSLY BEEN TRANSMITTED TO EVEN THE BEMBAS WHO HAVE NEVER VOTED ALONG TRIBAL LINES. BEMBAS VOTE BASED ON THE PERSON’S BENCHMARKS. NOW THAT THIS TREND HAS FINALLY BEEN DRUMMED INTO BEMBAS’ HEADS, IT WILL BE VERY DIFFICULT TO UNDRUM IT. AND IF THIS SHOULD GO ON FOR SAY 100 YEARS IT MEANS TONGAS MAY NEVER SMELL NATIONAL LEADERSSHIP BEFORE A MINIMUM OF 100 YEARS. ALL THE TRIBES- BA KACHOKWE NABA NGONI WILL RULE BEFORE OUR BELOVED BROTHERS AND SISTERS SMELL POWER. EVEN IF FINALLY THEY SMELL IT, THEY WILL NOT RECOGNISE IT’S POWER. THEY WILL THINK IT IS COW DUNG.

      0

      0
    • Analyse before you talk. Look at the figures. So if your dull German friend gives a poor analysis you believe. That is why PF rushed for Euro Bond which has now bonded us to poverty for the next 20 years.

      0

  22. Who did not see HH petition these results? HH has been preparing for this before even the votes where cast. If it wasn’t for the papers for voting being printed in Dubai, it was the G12 forms. But this case will pause a challenge to the Connstutional Court. UPND are demanding that the President steps down and that someone else acts. Who is that someone? If they were thinking it will be cartel Matibini, the one who was speaker in the last sitting of parliament, that unfortunately cannot work. Matibini is not speaker. His team went with the previous parliament. A new speaker? This one has not been chosen yet. So who is that someone else?

  25. Many people here are just posting like headless pythons.

    1) Where in the constitution does it say a candidate must win by 50.3%?
    2) Where in the constitution does it say a candidate must win by 1,860,000 votes? We no longer win using totals but using %, in this case 50+1. This is what Chulu was supposed to explain before declaring.
    3) 50+1 must be a percentage of the valid votes cast not a percentage of the total votes for Lungu and HH.
    4) Lungu has started a long legal battle which may see him not rule this country.

    0

    0
    • You UPND the problem you have is that you didn’t read the constitution when we were enacting it now you are confused. Artcle 47 of the constitution will help you understand. Its 50% plus 1 vote. or more than 50%.

Now you are rushing to ConCourt and yet you were against the new constitution. You are just a bunch of confused lot believing so much in your free mason leader as a result you don’t even read simple things.

Can you please get your lives back?

NOW, IS IT NOT THE SAME ORGANISATIONS THAT CAME TO MONITOR THE ELECTIONS AND PRONOUNCED ZAMBIAN ELECTIONS, “FREE, FAIR AND TRANSPARENT”? THAT SAID FROM THEM, HOW COME THEY ARE REFUTING THEIR FREE, FAIR AND TRANSPARENT PRONNOUNCEMENTS. THE COURTS WILL USE THESE ORGANISATIONS PRONNOUNCEMENTS TO MAKE A NO-TIME-WASTING JUDGEMENT. ALTERNATIVELY, ECL AND ECZ CAN REFER TO THESE RESPECTABLE INTERNATIONAL BODIES’ PRONNOUNCEMENTS.

  28. Ba UPND even in unlikely even that the elections are nullified what I gauarantee you is that you will not be allowed to get all those foolish votes you were getting in EP, MP, NP, LP unless you change your Dundumwezi mindset. Remember many of our people in these provinces didn’t believe when we used to tell them that your votes are based on tribe and not works or deeds.

So game on bring it on. Besides we also have evidence of you campaigning during the voting time. So who was breaking the electoral law?

  29. Just may be if UPND did not welcome all those whose common interest was their hatred for Lungu, the Zambian people might have been sympathetic. I mean those who “DEFECATED NOT DEFECTED” to UPND from PF and MMD. The likes of Muzungu wopusa Scott, GBH, KIlometre Sampa, Jonah Nevers Mumba who is still in the Whales belly for abandoning Gods mission, incompetent Mulenga Sata and horde of non performing MMD MPs. These people did not did not add value to UPND and did not bring any meaningful numbers. All they spoke about was their hatred for Lungu and continuously, insulting and mocking his back ground and belittling the development projects which the masses have witnessed and benefitted from in Zambia. This might have annoyed the voters who were hanging on the fence and changed their vote…

You guys are not clever that is why i wonder if you have political advisers – the best move for you is to leave it as it is and people will start respecting you. I can assure you GBM is not agreeably to go ahead with a petition because he knows politics. Did you ever see the master himself Sata petition an election………mulechenjela and make smart moves and dont be emotional when making decision. Lwenu politics teyabana iyo

  32. The numbers game with ECZ is hard to win because they really do a good job. This would even be tough now that all the major PVTs including that run by the Church group has confirmed that their respective numbers tally with those of ECZ. UPND needs to consult widely on this before rushing to court. It may be better to save some left over campaign moneys for party reorganisation given that God & the people of Zambia have already chosen President Lungu with a significant margin. God Bless Zambia

    • The law is the law of the land. Even if some people didn’t support it, once it was adopted, that is the law to use. Which law do you want UPND to use? Just like the President, even if about half the population didn’t vote for him, when he is sworn in, he is President for all Zambians.

  34. No doubt the results were definitely manipulated… They are not very clever too as it took them almost 5 days to find a way to stack up numbers. You can see how they tried to come up with that percentage results. By the way, doesn’t the Constitution say 50% + 1? Is it plus 1 vote or plus 1%?

The ConCourt results are almost predictable in this low budget movie script.

  42. I am ashamed to be Zambian right now, not for the election results but for the sort of nonsensical writing I am seeing here. Some elderly people think like children. What is wrong with a person wishing to go and get redress from the courts of the land? We have a group here that is civil and peaceful and that is why they chose to have their grievances channeled in the manner duly constituted for that purpose. We have had instances where otherwise legal groups have turned to insurgency to foster their political agenda and in many such cases its the civilians that receive the blunt of the conflict, case in point is Angola. As Zambians we take for granted the peace that we enjoy, we never realize how close we come to civil strife. Laws are passed for a purpose, laws enable us to live in an…

I wonder what is wrong with us. What is it that you gain by insulting your fellow compatriot just because he supports another party or comes from a different part of the country??????

It would be morally comprehensively rejected.

This is exactly what Joshua means just because someone isn’t PF then the are tonga and voted for HH. Such small mindedness. You should just be for PF then people will think your in the right and anything else will mean your in the wrong.. Give us a break and try to grow up. Some of you are adults but your reasoning is as that of a child…Am not tonga and am not for UPND but am tired of block heads thinking the know it all because of party affiliation.

  51. We said in the past eight years that this type of voting is bad especially when it spreads to the other provinces of our country, you ignored, now look at what you have made our country into?
H.H has brought a very bad type of politics of which if left unchecked, it’s a source of confusion. Sometimes you have to be civil as aspiring leaders and learn from the ordinary citizen of this country.

An election is not won in court but its won by voting, democracy is about the majority whether they are wrong or right they win. No one or three judges have power to appoint a president.

Mr Mwiimbu, why were you not the one raising issues during the annoucement of the results?Martha Mushipe was too emotional and we needed you our sober minded lawyer. We missed this part i think….no wonder they stopped answering questions and just announced the results.Or you could have told her to calm down.I hope we have overwhelming proof of the claims, otherwise it will be merely academic.ECL has his people on the concourt,so what are the odds of them overturning the vote?even the alleged miscalculation by ECZ,they will easily rectify by cooking up figures or simply saying they erred on some of the results. So looks like we’re up against a mountain. But it never hurts to try i guess!!

  56. HH is in a problem, a lot of people want to share his wealthy, through the court of law. eat with him by taking PF to court. HH must be very careful, who to give him the correct advice
Or do they just want to eat with him and drain his income. they are just interested to drain him,
I m sorry for MY FELLOW Zambian especially HH. He has spent a lot of money and the lawyers are not even merciful with him, they want to drain more and more.

  58. Yes HH is very wise man spending his own richness for campaigns than Lungu who is using gorvenment funds in short stealing from the people of zambia who are already facing economic problems. Whats wrong with you people can you not open your eyes and see what is happening. I cry for zambia and am ashamed to be a zambian at this moment. Bear in mind that Lungu will never ever share with you this money he is stealing from the country. You are just becoming poor and poor, things in zambia are not ok write now. Accept to change leadership when it is needed. Write now its time to change leadership. Who ever chosen if he does not put interest in the peoples problems remove and put another one. That is democracy. Do not accept zimbabwe system. Not one party state!! NO never again.

    0

    0
  62. Let the courts decide please! Hopefully, you will accept when all evidence is concluded. The fact is that you ganged up on tribal lines and the rest of the country realised what you were up and obviously they outnumbered you. Where do you think such a case would go? Can someone make your people understand that this is what you did. If you fail to say the truth to your people, you will never win an election in Zambia. Zambia is one of the most urbanised countries in Africa and will not accept to be duped into jungle groupings anymore, you are going against our history and taking us back to what our forefathers fought for. Unacceptable behaviour and the consequences are grave. Do not lie to your people. Why do you think Lusaka voted against yout 10 points?

  63. If you must win, win genuinely, not by stealing votes you brood of dishonest people, God will see you. if you will swear in lungu you will be bringing a curse on yourselves because he is not clean. Let the law take its course without fear or favour. Do not block justice

  66. 50% + 1 Calculation.
    Constitution (Amendment)No 2 of 2016 ,47(1)
Add votes for all candidates and get 100%, In this case 3,695,710 is the total of valid votes cast representing 100%. Then 50% of 3,695,710 is 1,847,855 of the valid votes cast
EL scored 1,860,877 which is 50.35% with a difference of 13,022 votes. Therefore any extra vote above 50% qualifies EL attain 50% + 1 target

  67. Very sad reading. I have just been looking at the votes on ECZ web site. If the other provinces went to vote at 76% plus using the same neganega or is it dudunumwezi style then no one will talk about winning. Every one should worry about what is going on. One wonders with the hate speaches and insults and tribalism going on where we are going. I believe the whole civil service and foreign posts will be Tonga. The bembas and others will be taught a lesson. Why .Am a very proud Bemba and will remain so as I was born one. I was never taught in my childhood to hate anyone hence the mix in my family of Lozis,Tongas, ngonis etc as my grandchildren am proud. When I employ people I have never asked them their tribe .

ECL has never lost elections in Zambia as a Presidential candidate. Let HH be replaced by Jack Mwimbu/Mazoka Junior because this Party belongs to Tongas and NOT GBM/C.BANDA OR M MWANAWASA.
