Concourt orders that the main petition be heard today up to midnight.

The Constitutional Court has ruled that the main election petition challenging the re-election of Edgar Lungu be heard today up to midnight.

And Concourt has dismissed UPND’s application to refer for interpretation to the High Court the issue of the 14 days for lack of merit.

The UPND was denied the application to refer the 14 days interpretation to the High Court because the High Court is subordinate to the Concourt.

But UPND lawyers have responded that they raised the issues of inflation of the votes because Edgar Lungu challenged them to provide evidence in his answer to the main petition.

Meanwhile, the UPND has applied that ZNBC avails them all 19 Hours news bulletins from May 5 to August 11 because they need to refer to them in their evidence.
The matter has stood down for 5 minutes to enable PF lawyers to respond to the new applications.

Further, the court insists there is not much time because the trial has to be concluded by 23:59 Hours.

And the Law Association of Zambia came in to address the Concourt with a proposition to join the case but the Concourt refused because they did not file the applications formally.

The petitioners have also come up with a fresh application to have the full bench decide on whether the Concourt can allow the UPND to make amendments to the petition before trial proceeds.

The petitioners also want to inspect and make copies of all ECZ election materials in various places.

The Concourt will have to make a ruling of these applications before trial can proceed.

Also, making amendments to the petition on the very last is a no-no, simple. Wanting to photocopy ECZ materials and wading through ZNBC news on the very last day? Funny. The petitioners thought the 14 days was discounting weekends (even weakends), birthdays, eclipse days, sunny days, … Crazy if you ask me!

      Yes they ruled against him regarding the ministers to blindfold the opposition into buying the bait. The matter regarding illegal ministers will soon be tabled before the same judges and they will simply reverse the ruling and offer apologies to Lungu and PF ministers.

      Why make a ruling in the kiddle of the night? I smell a rat here but Lungu should be reminded that if tries to arrest any opposition leaders immidiately after the court ruling, Zambia will go up in flames just like that. Even PF police and PF soldiers will not manage to save him.

    • Going forward UPND should seek independent international monitors involvement in collecting the results papers and take them to ECZ for tabulation so that no one can dispute the results.

      Our democracy can be resuscitated if we engage independent UN monitors to actually be stationed at every polling station and physically record the announcing of the results and collect the results papers for tabultaion at ECZ.

      Without this strategy folks we should forget the democratic gains we achieved after removing UNIP and KK.

      Lungu is now going to be a full blown dictator. Those who think are close to him should be weary of him because they will be his first targets to avoid blackmail.

      It has emerged that one of the pieces of evidence presented in the ConCourt by UPND on electoral fraud in Lundazi came from an SOCIAL MEDIA publication.

      The Constitutional Court Judge could not take kindly to this. She was very tough on the UPND lawyers as she directed them:

      “When you come here (Court), you must bring facts and not speculations. Ask your polling agents or assistants for evidence, not frivolous bloggers. This is a court, not a place for bedtime stories. We work on evidence.”

    • How UPND has been technically beaten in the presidential petition.The con court made sure it made it difficult for UPND lawyers present their evidence by doing two things.1.Failing to make Edgar Lungu hand over power.they are mute on this issue.Any normal person can stand as witness in court against the president.so most witness have grown cold feet.2.Delayed the process to frustrate the UPND lawyers and give 6hrs to present evidence.This is the same system ECZ used by delaying the results and deny UPND to do a PVT through non availability of the Gen 12 forms.ECZ then called all the results of 100 costituences in one day and quickly declared ECL as winner after the Job was done by Kaizer Zulu.In all these maneuvers God is watching and will pay them handsomely.     • People complained about small shortcomings of ECZ, such as shortage or missing of G12 forms, neglecting the overall excellent work done by ECZ regarding the entire round of elections.

      But what do we see from them? They could not manage to submit properly even a mere petition, after claiming they had overwhelming evidence.

      They kept correcting mistakes until all the 14 days were exhausted; releasing several versions; Ver.1, Ver.2, Ver3, etc. of the same petition hoping that through guess work things might work out.

      Now judge for yourself who did better between ECZ’s handling of elections and UPND’s handling of their own petition.

    • What do we see, they themselves violet the Act even more by jumping the Minister and going straight to court, when they know they cannot take IBA to court but the minister’s ruling if not satisfied.

The British system of government allows the party with the majority of seats in parliament to form government and appoints a Prime Minister among the MPs of the party forming government. India which is also a former colony has adopted this system except that the Queen is replaced by a non-executive president. The PF would have already formed government under this scenario. Our system is bad because it is possible for a president of a party to win with a minority of seats in parliament who would then have problems in passing laws in parliament just like Obama has problems and instead tries to govern by executive orders.   1. This is a typical case of Judges for Hire. Article 103(2) states that ; the constitutional court shall hear an election petition relating to the President elect within fourteen days of the filing of the petition.
    Clearly the word hear is not the same as determine. To hear means to ;
    attend to, listen to , take notice of, perceive .
    To determine on the other hand means to settle, establish , resolve, conclude, decide , define, finalise.
    I submit that the judges handling this matter are corrupt to the core0.

    • The law is not definite like science which have formula to prove a point but it is abstract meaning that it is theoretical so it is subject to different interpretations depending on the angle you are looking at. So the fact that the word hear is used does not necessarily mean that they can not decide because the law is abstract.

    • Ambanwa, any profession has its own language. In the military ‘take-out’ means shot-and-kill, whereas in finance it would typically mean subtraction. ‘Hear’ in law and in the context of the petition in question, might as well mean hear and dispose. It is not expected that the ConCourt would take their sweet time after the 14 days to make a ruling (they could do so, if they so wish), BUT they are aware the nation is waiting upon them – so a quick fire should not surprise anything. Check out the case of Kenya petition of 2013 whereby the Supreme Court delivered an ‘oral’ verdict at the close of the petition hearing days and delivered the detailed written judgement 2 weeks later.

    • Ambanwa. I also argued in those lines. However, a friend of mine married to a lawyer just laughed at me. Lawyers interpreted the law in a different way than non lawyers. If you are not lawyer Ambanwa I would suggest we all keep quite and wait for the court to tell us what is the way forward. Law is not 1+1=2

      If they can hear the matter in 14 days, they can decide on it within the same period. Or do you want them to go away for some days just to decide the case? Of what benefit is that, and to whom?

    • No they are very sane and logical. They are supposed to hear the case WITHIN 14 days after lodging in the petition. HH/GBM submitted the petition on 19 August 2016 so when do you start counting, from today the fourteenth day after lodging the petition? Common buddy, the petitioners should not have wasted time on preliminary issues. Remember out of the 22 witnesses statements, the petitioners just need one to succeed.

If they had applied for it two weeks ago, they would have got it then and been prepared for the case today. They would have furnished the respondents with a copy of it because that is what the law requires. Even if the judges had said the case ends September 8, applying for that evidence today would still have been late because of the points I have raised.Hopefully, this is simple enough for you (@Cactus) to comprehend.

      If you are informed today that you are required by court order to release recorded tapes by midnight tonight, you will have no time to edit those tapes but release them by midnight. I’m sure even the judges don’t understand that coz of the reason provided for the refusal-High Court is a lower court. These guys made a lot of noise at the beginning. In the real world any smart person would have planned for the worst case scenario i.e assume it was 14 calendar days so as to avoid getting caught out. And also, simple logic tell you that you are not gonna be able to get so much ZNBC news footage & be able to package it for the court within the short time they have been allocated today. What are these people playing at and where are they really from? Oh, wait a minute, maybe they know their goose is cooked but just want to be seen to be arguing one way or the other….

To attempt to have the High Court interpret the 14 day petition hearing window is a no-no (any law student knows that). To amend the petition at the very last day is like making a substitution on the 90th minute when you are already 4 goes down – simply funny. The petitioners OUGHT to have been spot-on with the case and NOT ask the court to waste time on non-issues such as ECZ materials (you need to note here that the petitioners have no evidence against ECZ in the meantime. To ask the ConCourt to seize ECZ materials was simply absurd – its like Cops impounding your car for no reason at all -believe it or not, any sane court would NOT allow it).

    • Judges are appointed by the president ONLY IF RATIFIED by parliament. Ratification is such a big catch here and simply means parliament has such a major say.

    The hard fought for democracy has been defeated by PF. A true meaning of their campaign song of Going backwards. Indeed all the achievements of Levy and MCS have been reversed by PF under Lungu. Zambia is worse now than at a time of Magande and HIPC.

  67. UPND is a regional party. It is very difficult to win presidency from 3 provinces out of 10. In fact Zambia should include an electoral college vote so that leaders from regional and small parties like UPND can never rule Zambia. Tell me what is so orincipled about HH cheating people that he will give free education to university immediately he steps into state house. Tell me what us orincioled about HH lying to people that he will bring back Anglo American to restore people’s jobs. If you do then we can have a meaningful discourse.

    HH told people at a rally in Chililabombwe that they attend his rallies in huge numbers but when it comes to voting they deny him the vote. Tell me what HH has done to change things.

  69. So the Concourt itself has failed together with HH lawyers? Shame. I will soon be launching a complaint to the Judicial Service Commission to probe the incompetence and misconduct of Concourt judges. Just compiling my evidence now.
