UPND President Hakainde Hichilema and his Vice Geoffrey Bwalya Mwamba were this afternoon released on bail by the Luanshya Magistrate Court.

This was after the duo pleaded not guilty to different counts.

In count one and two, Mr. Hichilema and Mr. Mwamba are charged individually with seditious practices contrary to section 57 sub section 1 chapter 47 of the laws of Zambia.

In count three the duo is jointly charged with unlawful assembly contrary to section 75 as read with section 74 of the penal code and regulation of the Public Order Act.

Particulars are that accused number one, Mr. Hichilema, 54, of house number 14/38 Sable Road in Kabulonga, on September 26, in Mpongwe district of the Copperbelt province, did conspire with others unknown to bring into hatred, incite violence, resistance and disobedience to the administration of the elected Government of Zambia by uttering words namely, ” nga taba mufumishe Matambo, epo ulubuli lwalatampila”.

In count two Mr. Mwamba, 57, of house number 10 Roan Road in Kabulonga, is charged with seditious practices.

It is alleged that on September 26, in Mpongwe, Mr. Mwamba, who is accused number two, did conspire with others unknown to bring into hatred, incite violence, resistance and disobedience to the administration of the elected Government of Zambia by uttering words namely, “ifwe pano ngaba UPND tufwile twakana iyi Government yakwa Lungu; ngabamyeba ati kuli ama meeting yaba Lungu mulekana, pantu president wesu ni HH”.

In count three, the duo is jointly charged with unlawful assembly contrary to the laws of Zambia.

It is alleged that on September, 26, in Mpongwe, being in a public place, jointly and whilst acting together with others unknown did convene, assembled unlawfully with intent to carry out some common purpose without notifying the regulating officer.

And making the bail application, the UPND legal team stated that the duo should be granted bail as they are prominent politicians heading the most vibrant opposition party and that the alleged committed offences are bailable and that the accused are of fixed abode.

And Ndola Magistrate Judge John Mboozi stated that the state has no objection to the application because the alleged committed offences are misdemeanours and bailable.

Magistrate Mboozi granted the two accused 25,000 Kwacha cash bail for each.The matter has since adjourned to 19th October, 2016.

The two opposition leaders appeared in high spirits during court proceedings.

And Mr Hichilema has vowed that justice or no justice, the UPND is resolved to even demonstrate that PF and Mr Edgar Lungu will not succeed in turning Zambia into a one party state.

  1. There are no winners in this whole HH and GBM arrest saga. The real losers are the ordinary people of Zambia. At the time when we want to mend our economy such headlines aren’t good for the country’s reputation. Those in the ruling party should not dance to the opposition game. Arresting the opposition leaders actually gives them a platform to remain relevant in the country’s political discourse. But it’s our economy that gets bruised at the end of the day. Yes, someone will say, HH and GBM should have act responsibly, THEY WON’T and WILL NEVER. The onus is on the govt to read the duo’s game play. In any case, this arrest will NOT lead to a conviction, it will not make them broke and crucially, it’s not a deterrent. They are out on bail, but you will see them holding “illegal”…

    • No one is above the law. Let the police continue catching anyone who commits crime. I think it is also a good source of revenue for the courts. Imagine just on one day 50pin was collected. The question is what is happening to those stone throwers who were arrested for thinking that they can rescue HH and GBM. It is most probably some of them are still there and some don’t even have food. It is a lesson to my fellow youths and women not to follow blindly.

    • There is nothing in the allegation sounding illegal telling your adult members not to attend meetings of your opponent can not be un offence, a normal govnt wont bother,that Katanga police has had issues with democracy from the time of her appointment,she is responsible for 90% mistreatment of the UPND,we remember her LSK, L/stone,now CB abuse of upnd members.Everydog has its day.If malema was in Zambia Katanga and her police would have been staying in his home to prevent him from going to the loo.What value have our female officers brought to the police apart from demanding uncompromising bribes at road blokes.

    • Victor, there is a difference between democracy and following the law. Democracy is that process of choosing leaders and this done through an electoral system with defined rules. People contest for those positions and the one with the majority votes (either by simple majority or other defined criteria like 50%+1) takes up the position. Now in this situation the winner will always have some people who didn’t vote for him but once declared winner he is leader for ALL. Telling people to disregard an elected leader is against the law. HH and GBM have no evidence to show that their votes were stolen (how many, where and how). They failed to show this in court and now they are influencing you to think in an evil manner. Don’t follow politicians blindly. Ask your friends in Luanshya – arrested…

    • Arrested together but when the two paid their bail, they drove of to Lusaka, leaving their supports / sympathizers languishing in the cells. How many lies have you heard from politicians? Many times people have said when you vote for me I will build a school, bridge, repair the road etc. How many have fulfilled. 1964 people were promised an egg a day and they voted, 1991 people were promised a better standard of living and roads with no potholes, 2011 people were promised more money in the pockets, 2016 I’ll fix it. It is the same story. None of them has any concern for you. Find what you can do for yourself.

They were just waffling and that is why their petition was thrown out. Unlawful assembly is an offence that is why they even agreed to pay for bail. They had polling agents in the polling stations whose job was to collect the results and add them after their addition, what was their total?

    • I don’t know if you have the same definition of democracy. it means a government were leaders are chosen in the election and the one with the MAJORITY becomes leader. The one with Minority votes is the loser. Zambia uses a secret ballot system. So if you voted for HH and HH did not win it does not mean that everyone voted for HH or that you vote was stolen. Majority of the people in 6 provinces voted for Lungu and Majority of the people in 4 provinces voted for HH, that is why PF has the Majority in parliament. Democracy is accepting an election result unless you can prove otherwise.

  30. its amazing how the wheel of fate turns. the privatization of luanshya mine has two ugly faces. the first face was that of its sale, handled by late penza. during this period, the privatizing team lead by the then minister of finance sold the mine to a company called RAMCOZ and we know what happened in that deal. the second face involves the liquidation of RAMCOZ by grant thornton and hh as an auditor in this firm. at the conclusion of the liquidation process, ZANACO were still owed $80,000,000 by RAMCOZ, CEC were owed over $30,000,000. these two matters were subject of a high court case in kitwe. the miners were also not paid their benefits. the liquidator, hh, paid himself and his firm, leaving the Zambian interest unsecured. today, he is back in the same town as an accused.
