Fred M’membe loses an injunction to restrain Investrust Bank from handing over assets held in securities

THE LUSAKA High Court has thrown out an application by Fred M’membe for an injunction to restrain Investrust Bank from handing over assets held in securities in connection to the debt owed by the Post Newspaper.

High Court Justice Winnie Mwenda said Mr M’membe had no locus standi to make any claim or speak on behalf of the Post Newspaper in liquidation when there was a provisional liquidator in the name of Lewis Mosho appointed to wind up the company.

Justice Mwenda said Mr M’membe had no legal standing to institute court proceedings against Investrust Bank Limited outside the authority of the liquidator as he claimed in his affidavit.

“It is my considered opinion that the claims do not disclose any reasonable cause(s) of action for the reason as a shareholder in the Post Newspaper Limited, the plaintiff has no locus standi to institute these proceedings on behalf of the company outside the name of the provisional liquidator, and therefore, cannot establish a clear right of relief in the action.

“I find that all the claims by the plaintiff do not disclose reasonable causes of action and that they are in effect vexatious and an abuse of court process,” she said.

She explained that the mere fact that Mr M’membe was a major shareholder in The Post Newspaper Limited did not give him the right to make any claims or interests on properties and assets in relation to the newspaper company as it was now in liquidation and under a provisional liquidator to wind up its operations.

The court has also slapped legal costs on Mr M’membe as a way of condemnation of his abuse of the court processes by litigant as guided by the Supreme Court Rules.

This was in a matter in which Mr M’membe sued Investrust Bank in connection with a consent order delivered in a related matter by High Court Justice Sunday Nkonde in which the bank applied to be joined as respondent to the winding up case of the Post Newspaper in
liquidation.

Mr M’membe wanted the court to declare that the action taken by Investrust in relation to the debt owed over a loan obtained by the Post was null and void, including attempts to assign such debt to the provisional liquidator.

The ruling means Investrust Bank must surrender properties held in debentures to the liquidator to facilitate for the winding up process before court.

Mr M’membe wanted the court to restrain the bank from surrendering the Post debt to the liquidator or his proxy or otherwise dealing with Mr Mosho in relation to the Post Newspaper Limited debt.

You know what, you are better off not stealing to avoid trouble.

      The idea of saying:
‘why am i being prosecuted as if I am the only thief’,
has not helped many people, and I don’t think M’membe will be helped by that philosophy.

You kill a person and then you say,
‘why am I jailed, am I the only killer?’

So, let M’membe not evade tax and then say,
‘I am not the only evader’

Look, in many countries especially the Western countries tax evasion is a criminal offence, and you both pay the dues and still go to jail for the crime.

M’membe should be grateful that the system is only talking about recovery of money and not criminal prosecution.

Not true. Zambia is a very good country. Do not lie. Mmembe miscalculated his luck. It is normal in business to miscalculate. He must just humble down and seek meeting the President, how to pay back. Am sure a way out would be found. After-all he employees most Zambians. He should stop scandalizing innocent people. Everyone looses in the end. To start thinking that when HH takes over Chagwa will be dealt with is wrong. We must not run a country out of vengeance. UPND is a very good political party but its wrong thinking that we shall takeover power and deal with Chagwa that may never happen. Its because of vengeance altitudes that scares away genuine membership from UPND. Mazoka never formed the party like that but as an alternative government.

Mmembe thought he could forever get away with insulting every leader he never agreed with whilst at the same time trying to pay tax at his own time. Now the court is saying he is abusing the court process by constantly running to it for relief when he is no longer in charge of The Post as it has been liquidated and ceased to be. Mmembe wants to posture as the owner of a company that is neither here nor there.

This is the price that you pay when you trade your values with politics. Instead of being the voice of the voiceless, he went to bed with PF, stopped paying taxes, gained undue advantage, invested the loot from the taxes that he should have paid tax and bought a fleet of trucks. There are two things in life that are certain, death and taxes, and you cannot escape one of them.He has destroyed a once vibrant company and emerging press that stood with the people. How can you expect the people to be with you when you decided to go to bed with the devil. This is pay back time and you will not run but pay to the last penny.

The only thing I hated with the Editor In Chief were mainly the insults directed towards the Head of State, that wasn’t good at all. I stronly disliked that but other than that, The Post was a good paper!

In fact we shall deal with Mmembe for threatening the King Shaka! Chagwa is another version of Shaka. Mmembe was left unchecked for a long time. If you are a whistle blower you must come with clean hands. Even Jesus Christ said the same thing. He had started very well but traded his morals with pieces of silver. D0 not think even HH was going to let Mmembe get away with it. Forget it. Life has it that you must know when to dance and exist. Even if HH wins in 2021 forget about Mmembe its over. I personally do not care whether its HH or Chagwa Lungu because both are Zambians. If HH can promise me that in fact Chagwa had left Mmembe free but he will collect all the taxes I would support him. Mmembe is another thief. Period

Remember what Chagwa said I will collect every penny Mmembe owes Zambians. Love Chagwa or hate him he is a true patriot. You can not owe taxes to the Zambian people and get away with it. Enough is enough. Yes if Chagwa looses power and he is found stealing the law shall visit him. But I can guarantee you nothing of that sort will ever happen. This is the first President who has dealt with the post hands down. That’s what a descendant of Shaka does. He sorts them out one by one. Shaka! Never leave an enemy behind. I voted for Chagwa because in him I saw Shaka………. He will still win in 2021. I love Chagwa. With his Bemba cousins he will win.

If M’membe wants he can consult HH regarding procedure for formulating a petition.

HH will tell him that, first you have to say Maureen Mwanawasa has found you ‘tax in a bin’.

When Maureen refuses to involve herself in that falsehood you can then revise you petition.

If all other witness whom you have listed as having seen how your tax was stolen refuse to involve themselves in falsehood, you can then embark on generating preliminaries.

If you lose on all preliminaries and your time is fully spent, don’t worry.

Just start telling your newspaper fanatics that the petition is alive, and that you have not been heard.

You, after watching the reaction of the father, you also go and damage the same man’s car.

The man gets angry and takes you to court and tells you he is not going to leave any stone unturned until you have paid for all the damage.

Then you stand and rebuke the man:

Even the BBC is a government institution my friend. In south Africa here SABC and metrol rails are owned by the government.
You cannot have a newspaper that always spreads hate speech about a President. Such does not happen in the UK or South Africa. Compete with government paper by highlighting failures of government not in three months headline is all about the head of state. Mmembe lost it. This is like the father and son I talked about over the damaged car. He cannot take his son to court, pay a lawyer, and then find money to give his pay himself. Why lose money to the lawyer when you will bail out your son and pay yourself.

The fellow was so chuffed at being a king maker and a demigod. He f#cked over presidents and MPs. He finished peoples reputations and left people totally and utterly beaten to powder.
Now the f#cker has the wrong shoe on the wrong foot. Damn, sh1t changes. Nothing last forever, huh?

Only a leach like goliath can think that this accounts clerk and wanna be scribe night school lawyer but not a practicing advocate brought free press. It is the Zambians who unmuzzled men such as him, it was great scribes like Jowie who wrote well edited news in the same standing as that one can only find in East Africa. But once this greedy man found power he then began to use the paper to settle scores and bring men to their knees….but he forgot the cardinal guide that he who brings an adulterous woman to be stoned must cast the first stone if he himself is innocent and has committed no sin.

unless edgar lungu and his friends plan to rule Zambia forever…they have dug a deep hole for themselves.
I doubt edgar will survive court battles that will follow him after he leaves office. Amos chanda will be somebodys wife in chimbokaila.

UPND gayz keep on day dreaming. You will never achieve what you intend to do because of your vengeance. God give chances to those that are sober minded. Who is a thief between your or sorry and the one you nickname a thief? Check your history. The upcoming elections in 2021, the mighty PF will carry the day and as for you, you will still be complaining of the shadows that never exist.

Lungu is digging himself a big hole, using our legal system to punish his opponents will only come back to haunt him. Dyonko might PF is failing the people now, the people who were celebrating last time are already crying now. They are being chased from the streets, committing and attempting suicide because if you elect a failure the joke is on you. Lungu is a failure and that is the truth, you cannot run away from the truth and pretty soon Zambians will have to come with grips with that. 2021 will be either death or change and I know change will prevail because Zambians like change, whether they like it or not change is inevitable in 2021 because now it is not even one year and everything seems to have gone sour by the time five years elapses people will be eating each other while Lungu…

      @ 49 China,

You have very little understanding of what a Zambian values.

A Zambian is not looking for a rich man but for a leader.

Do you know that the Kwacha went to its worst state in the 2015/2016 period?

And yet in 2016 people steal voted for a leader and not a rich man.

Look, Zambians have no problem voting for a rich man as long as he is a leader,. Not because he is a rich man.

Because of this some politicians have been failing for the past 6 elections.

Zambians are far smarter than some these people who have convinced themselves and a few of their friends that they are politicians.

Looking at the wisdom and smartness of Zambians, I am convinced that come 2021 Lungu will go through again.

Tip: the major problem with some politicians is that they thick all…

Tip: the major problem with some politicians is that they thick all that moves in the minds of Zambians is ‘economy’.

Well Zambians look at life in a much wider sense than most politicians.

All those that sympathize with M’membe, the only thing they can do now is to contribute some money try o help him pay his creditors.

Thinking about, and missing the post will not help. Post Newspaper is part of an informal syllabus for extra-curricular activities in community history.

Don’t misunderstand me, I am not saying school curriculum. The former Post Newspaper has not capacity to feature on formal school curriculum, but history curriculum for pass-time street stories.
