Lusaka Magistrate David Simusamba has adjourned the alleged treason charge hearing slapped on UPND President Hakainde Hichilema and five others accused to Monday, 15th May, 2017.
Magistrate Simusamba says he will on Monday announce how and when the treason ruling will be announced.
This has been necessitated by a summon slapped on Intelligence officers Arthur Shonga and Mpanzi Mbita for contempt of court.
The said two intelligence officers allegedly defied a court order to release the properties they seized from Mr Hichilema and five others accused.
On Monday, Magistrate Greenwell Munalula will be also the passing of judgement on whether Mr Hichilema used insulting language on police officers.
Earlier today, the defence made an urgent application before the court saying records show that at the last sitting, the court ordered and directed that seized properties by the Police be given back to the accused.
The defence said to that effect a formal notification was made to the court and the court ordered that properties be given back as the Inspector General of Police and officers namely Arthur Shonga and Mr Mpanzi Mbita were told and acknowledged the receipt of the said order.
The defence however said officers refused to release the properties without any lawful reason or excuse.
They said orders of the court must be respected adding that the refusal by the said officers to release the seized properties amounts to intentional disrespect of an order of the court which he says is contempt of the court in terms of section 116, (1) of the penal code of the laws of Zambia.
Defence applied that the two officers Arthur Shonga, Mpanzi Mbita be summoned before the court to show cause as to why they should be cited for contempt of court or indeed committed to prison on account of the said actions.
Magistrate Simusamba has ruled that he has heard the deliberations and that he has summoned the said officers be brought to court on Monday.

HH looks too angry. It is not good to hang in there bottling up a lot of anger. He may come out a shell of his old self emotionally and mentally. He probably needs people that can offer counsel to him so that he remains himself. I still remember Edward Jack Shamwana coming out from his cell when we went to visit him at Mukobeko and the inevitable broad smile he still wore despite being incarcerated. He was such a mentally strong person. Zambians passed up the opportunity of writing about Shamwana’s prison experience so we could all have learnt something from him.

Police don’t need to get arrest warrants for Treason offenders. HH has been charged with treason and as such the police did not need to get an arrest warrant. Treason is equivalent to a declaration of war on your country, and the stated is not expected to get a warrant of arrest from the courts to stage a counter attack. So the way the police stormed HH was the extended way. It is a surprise action! Those in doubt should note that all the arrest in the treason cases before were conducted in the same manner. And HH is no exception.
Assuming HH will sue compensation of his jailing at $ 200,000 per night, this now accumulates to $7 million so far. Will Mutati manage to pay?

This Magistrate is under tremendous pressure from the powers that be to keep HH in jail even if the Treason Charge is frivolous. There is no connection between the contempt of Court for failure to release the stolen property. This is just a lame excuse to keep HH and others in Jail. This is a violation of Human Rights. The Whole World can now see how Vindictive the Man is. “To do justice is to love God and to love God is to do Justice”. Lungu is not a mad of God the way he is mistreating HH.
But its the defence lawyers who applied for that preliminary issue of contempt for the police officers and Lusaka Times have not even completed the response by the prosecution team which said that those who went to pick the seized vehicle and other items failed to prove ownership and hence the police refused to handover and hence the court’s adjournment…

If the courts will fail to charge hh for interfering with the presidential motorcade then they should know that from that day onwards police should stop clearing route for presidential motorcade. This is precedence they are creating. No person shall be charged for driving side by side with HEAD of state. Should hh goes unpublished I will do a race with presidential motorcade immediately. Christians are obedient to the law of the land. The government controls the courts of laws as every magistrate and judges on government payroll. The same magistrate when they rule against the state , the state must comply to show commitment of upholding the law. Disregard of the law or court order is inimical to proper Justice and the courts shall be rendered irrelevant. Who will desire to respect the law when the state disobey its laws. The state is not the law unto itself. Equality before the law is applicable to all litigants(government, every citizens of Zambia).
As HH is tried by the courts , Justice must be seen to be done on both sides. If HH is sentenced to death , let it be in affair manner not where the law is unfairly applied.

Get this in your thick heads: The President has no power to release HH (or you and me) mid-course through a court process. That would be gross interference of one arm of govt on another, executive on judicature. But, yes, the President can pardon a prisoner by power available to him through a harbeas.
Alternatively, you’re safer to call for the President’s arm before the commencement of the court process.
As things stand, the due legal process will have to run its full course. Not even USA or UK can do anything about it at this juncture. The doctrine of separation of powers was born from those democracies and inculcated in us.
Unfortunately HH is not a friend of any court in Zambia. From the time he was pronounced loser of elections, he has been using the insults he used against the police to insult all the judges in Zambia. I hope the judges are not avenging against the insults.

It is unfortunate that Hakainde Hichilema has caused more harm to Zambia’s economic well being than Lungu, even though UPND cadres keep thinking the Dununa reverse. From the economic growth standpoint the stance taken by the five time loser has done more harm than good to our political standing among world democracies. Economic reports by country monitors indicate political risks for Zambia, mainly arising from arrest of cadre-like behaving opposition leader. If HH had adequate leadership qualities he would have thought of the country first than putting his insatiable appetite for power first. The majority (50.4) of the electorate voted for the incumbent president. The thinking that political defiance and hooliganism will take him to state house is a cheap strategy that has not worked…

Am not a lawyer, but I have never heard in my life where someone has been committed to the high Court and the magistrates still rulling on the same matter.
From my layman point of view what I know when you are a suspect and arrested the police keeps exhibits until the matter is disposed off, but am seeing different ballgames here. Thousands of people have been committed to the high Court on capital offence and no magistrate has ordered or ruled for preliminary issues. Why don’t the magistrates do the same to other suspects? ??
