Lusaka High Court reject Kambwili and Nkombo’s application to join the Impeachment case

THE Lusaka High Court has rejected Chishimba Kambwili and UPND Mazabuka Central MP Garry Nkombo’s application to join a case where two private citizens have sued the Attorney General over the Speaker’s decision to table the impeachment motion of President Edgar Lungu.

When the matter came up for ruling yesterday, High Court judge Banda Bobo refused to join the duo on grounds that they, despite being the movers of the motion, do not have sufficient interest to warrant them being joined.

Judge Bobo said the two were forum shopping by seeking to be joined to a judicial review on impeachment on matters that were already before the Constitutional Court.

Mover of the motion; UPND Parliamentary whip, Nkombo and Roan MP Kambwili being the seconder, had asked to join the case on grounds that any decision which would be arrived at would affect them.

But the applicants, Mr Robert Chabinga and Mr Henry Mulenga urged the court to reject Mr Kambwili and Mr Nkombo’s application.

They argued that Mr Kambwili and Mr Nkombo had not demonstrated their interest in the matter, adding that their application for joinder was anchored on a wrong provision of the law.

The applicants said for a party to be joined, they must demonstrate that they were entitled to or share interest in the subject matter of the suit or are likely to be affected by the results.

They argued that the fact that the motion movers may be affected by the decision of the court does not give them sufficient interest or authority that entitles them to be joined to the proceedings.

The applicants said the Attorney General was already party to the proceedings because he was the custodian of matters that were of public interest.

The applicants challenged the two parliamentarians to state whether they are opposing, supporting or wish to join as friends of the court.

  1. Judge BANDA BOBO. The name outs you, sir. How can you call people as Movers of the case for impeachment and at the same time say they don’t have “sufficient interest” to warrant them being joined. Really? The law in Zambia has not gone to dogs. It is really in the hands/paws of dogs.

  4. The losers! It is a shame to see some people who call themselves “politicians” in our country! What a waste!

    • Actually, we are more concerned about you and how your cadre mentality affects your thinking and your support for criminals like Lungu. A PF cadre in the US is really a stretch. Even being in the US alone without going school, we expect you to have learned something through life experiences and how people run affairs here. Could be some tribal support, but still more you are really classical.

Do you have the values of those companies? About hardworking, was that a comparative question between HH and the real Criminal Chagwa Lungu? Was that a honesty question? Really?

I look @ Kambwili’s face & so I wonder why he is so ugly and have such an ugly neck when others like Vincent Mwale have nice bodies. Why was God unfair to this creature called CK???

  8. But Kambwili is very bitter mwe! More than HH. …at least HH is not a PF MP. The guy should just relinquish the position so that he recontests under the party where he’s president. Don’t waste our time.

So, they know that the outcome will not be in their favour. This is typical of failure of mind or what l call cognitive rigidity. Why rush to do things when you have not done your work? Apparently, this is the same thing with government. They brush prosecute, two days later, ati nolle. Tiye nabo. Banda very good. Rubbish!!! Ma, ma give us a signal.
