Kapoko, four others get 18 years in jail for corruption

The Lusaka Magistrates Court has sentenced Henry Kapoko, former Ministry of Health Chief Human Resources Officer and four others to 18 years imprisonment with hard labour each for corruption, money laundering and theft of over K6million.

The sentence includes five years each for theft, 5 years for money laundering and a further nine for theft by public servant.

In a ruling that lasted for two days, Principal Resident Magistrate Exnobert Zulu convicted Kapoko aged 45, three accountants namely , Zukas Kaoma, 47, Evaristo Musaba, 56, Vincent Luhana, and an Internal Auditor Jasper Phiri, 46.

However, the Principal Resident Magistrate has acquitted other persons that were jointly charged namely Roy Maswenyeho, Luke Makeche, Chrispine Sichone, Nobert Pellets, and Essau Banda on account that no offence had been proved against them.

Kapoko and nine other officials from the Ministry of Health were jointly charged by the Anti-Corruption Commission on 67 counts following investigations conducted by the Anti-Corruption, Zambia Police, and Drug Enforcement and were found with a case to answer on 66 counts by the magistrates court.

Principal Resident Magistrate Zulu in his ruling ordered that all convicts properties and accounts in which stolen money was deposited be forfeited to the State. He also entered a statutory judgement in favour of the Attorney General to recover over K6.8m from the convicts.

The said properties include 24 motor vehicles including BMW, Mercedes Benz, Nissan Truck. Others are 3 houses, 2 Lodges, 1 Filling station, 5 Banks Accounts.

He ruled that for the money to move in the fashion it did, there was collusion among the five convicts, and therefore the five were also ordered to pay costs incurred by the State during the whole court process.

The Principal Resident Magistrate found that there were hyper activities in terms of the money Kapoko was depositing into his business and personal bank accounts.

He said that Kapoko continued to endorse dubious payments from the Ministry of Health to a named consultancy agency, even after he had been transferred to the then Ministry of Local Government and Housing.

This was evidenced in the cheques and payment vouchers that were found in his house by the investigative wings.

He said that it was peculiar that Kapoko was making huge bank deposits at the same time he was acquiring high value motor vehicles and properties.

In this nine year trial, the investigative wings conducted an investigation following the unearthing of a scam involving corruption, theft, and money laundering at said Ministry.

This is contained in a statement to ZANIS by the ACC Public Relations Manager Timothy Moono, this evening.

    • Great job. Kudos to the judges. This is how you control corruption. Stiff penalties for corrupt people. Anything less than this is a joke. The ACC needs to be made more independent so they can be free to go after the big fish. Lungu and his gang should be next. There should be zero tolerance for corruption in Zambia. Again thank you judges. Great job. We’re proud of you.

  1. He’ll be 63 after serving his full term but don’t get excited. This is Zambia. He will receive presidential pardon before he does half of his term!

  2. European donor countries were waiting for Zambia to account for the theft of money donated to help the health sector. Remember that European citizens pay their hard earned money to help you. Make sure you account for every ngwee (cent) and keep prosecuting the thieves.

      Very true what you say. But this is a story for another debate, I will say it anyway!

      Africa is the richest continent on Earth. Africa is Europe’s milk, they get money from our continent on the cheap cause WE cannot get together to economically protect ourselves by selling them our natural resources at an arms length.

      Word of advice… Never give Europeans/whites credence when it comes to Africa’s economy… just google and see the mess they make for the little money they give you back as aid.

  3. The best sentence ever. That is why when a person breaks a law do not listen to Common Health. Let the Law take its course. If that thug does what he did in Mongu Hagain, please lock him at Kamfinsa or Mukobeko.

  4. Henry KAPOKO has been sentenced several times and this is just one of the announcements, he helped us alot in PF to bankrol the party we cant allow him rotting prison go for 6 months and we shall do a ka kanene or chimba the 3rd

  5. Donors contributor around $43bn per year as aid, whilst Africa receive more than $54bn from Africans in diaspora. But its good these guys have been jailed by the europeans. It was their money. So standards have been set. Whether local funds or foreign a barometer is now in place.

    My main worry is the Zambian Pope of Corruption Jonathan Pombe Mutaware will use his Presidential powers to pardon this fellow Mbava like he did Muteteka, Mpombo, & that Fat Crook who buried illegal proceeds (cash) at his Lusaka West farm.
    Jona Pombe loves Corruption so much, he always releases these economic saboteurs, coz he knows his day in Himbokaila will come, so he’s setting a precedent, hoping he’ll also be pardoned in future for his many corrupt acts including Eswatinigate.

  9. Just imagine 18 years. This is the time it takes for one born to grow ,start school and complete grade 12. This Kapoko had a “brilliant” idea which didn’t sit well with the law. Like they say, you reap what you sow.

  11. I am demanding criminal prosecutions for the 12 Zambian Lawyers who pillaged me in abuse of the court process, for racketeering and money laundering acts. They enjoyed discounts they are. It qualified to, when I,my he UN Diplomat who worked for such money has been made to bleed by their acts. Banditry in Zambia is very shameful and those that attacked me, worked in collusion with members of the judiciary. They shamefully look at me each time they see him, Court Mwrshals and the lawyers clerks all started fatter ing after stealing from me. It is not right. If Kapoko was convicted by an I gernationL criminal tribunal. We hit more than 30 years conviction in jail for such cold criminals. How do you steal other people’s money without remorse and guilty.   12. We demand life sentences for the lawyers and members of the judiciary who pillaged me. Shameful stealing in Zamnia irks and sucks.

    They enticed themselves with my UN benefits and stole like *****s. Well I am. It giving anyone impunity. After stealing, they attempted to kill me and even hired assassins to poison me. They then got a relative Judge to illegally remove my suit in which I sued them. From the cause list. We need her impeached, JCC must look into it, and no one must be spared of corruption. I didn’t work fir the UN guRd ties who have not skills to get on board the UN. I demand justice, not impunity. Impunity will get instant justice. Scamsters. Don’t mind the jargon in my article above.   13. It’s misleading because the maximum period they can stay in prison is 5 yrs. It’ll be interesting to see the whole judgment and see why he made those remarks about Simon Miti, otherwise some parts may be struck off on appeal. Miti was a witness so how did the court find that he should have been an accomplice? This is what causes professionals shun govt jobs. Chibamba Kanyama was scandalized at ZNBC but look at him now
