Government has noted with concern that some sections of the society have embarked on cheap propaganda of circulating falsehoods regarding the nomination of presidential candidates.
Speaking during a press briefing in Lusaka yesterday, Minister of Justice Given Lubinda said there is information circulating which is quoting the repealed presidential form of Act number 2 of 1991 as amended by Act number 23 of 1996.
Mr Lubinda stated that the Act among other things provides that a presidential candidate must declare that he or she has not been elected twice as president.
He however corrected that the provision was outlawed by Act No 12 of 206 under statutory instrument number 92 of 2006.
The Minister noted that the statutory number 96 of 2006 was revoked by the electoral process regulations of 2016 which under general form 4 provides for an affidavit of declaration for presidential candidates and his running mate.
“The form does not in any way contain a requirement for a presidential candidate to declare that he or she was twice elected as president. The form requires a presidential candidate to declare their nationality, nominations, academic paper, and attach other relevant proof of citizenship,” he charged.
Mr Lubinda explained that the form further provides that the presidential candidate must declare that he or she qualifies for nominations and the disqualification of Article 100 (2) does not apply to that candidate.
He advised the perpetrators who are circulating wrong information to stop as it is not necessary as they are simply misinforming people with outdated information.
He further urged citizens to discredit the outdated document circulating to avoid being misinformed.

We have seasoned constitutional lawyers who have already applied their legal rights to block Edgar Lungu.
It means the president can’t be sworn in twice for the office. Whether he served two full five year terms or not but as long as he has been elected twice and sworn in twice by the chief justice that constitutes to have served two terms. He can’t be sworn in the third time that what constitutes to third term.
Given Lubinda must not mislead Edgar Lungu. The constitution is very clear.
Bill 10 failed because of the likes of Given Lubinda and Tutwa Ngulube plus Mundubile types.

Anyway would we expect a Minister appointed by Lungu to tell us that the President doesn’t qualify for the next elections? Actually if he said so that’s when it would be news to report about. Right now what he is doing is what is expected of any bootlicker so its not news ba LT. This is like telling us that President Lungu has woken up from bed today. Its not news.
It’s good that Bill 10 failed because you wanted to remove the clause that allows citizens to petition the nomination of any candidate. So instead of continuing this debate let’s leave till a day after nominations. Besides, it’s only a few bootlickers that are parroting the eligibility hymn within the PF. We have information that a good number don’t want him. COVID-19 has now relaxed so the PF must go to the convention where we know he’s going to be humiliated. If he’s man enough let him allow the convention to proceed, let him stop shivering.
Let the games begin. The people circulating must go to court. Only after insulting the entire constitutional court, kaya your chances there.
PF needs kicking out, but the best way is at the ballot. Only the opposition is greedy & everybody wants to live on govt money now. Opposition should have become serious & form one block, not the many scattered scattered. It will leave lots of room for rigging. Signs of panic and distress, since when did a Justice Minister assume the powers of a Court. The court will tell us when the time comes on who is eligible and who is not. Just relax, you seem so stressed after bill 10, your boss was right for the first time, lets move on.
In a country where normalcy is upheld, the entire Government should have resigned on account of Bill 10 failure! That’s what normal/sane people do!

Forget arguing about what is written on the nomination form… what is important is what is written in the Constitution, period! I really hope Zambian judges redeeme themselves and side with the people like their counterparts in Kenya and neighbouring Malawi did recently.

The headline is misleading. According to the body of the text, there is nowhere Given (and Taken back) Lubinda has said that President Lungu is eligible to run in 2021. If he did say so, then include the quote in the text LT.

Hon Lubinda is trying to mislead the president, but the president cannot be mislead by Lubinda because the president is a lawyer by profession. If the president buy in what Lubinda or Constitutional Court is saying it is his fault. Does the lawyer need interpretation of two terms or being elected twice? One who has completed Grade 12, if reads carefully in the constitution concerning who qualifies to contest in a presidential election, one would understand. You do not need a doctor of thesis explanation to understand the qualifications of a president.
