Alleged owner of 48 houses has back from his self-imposed exile to claim the houses

The alleged owner of the infamous 48 houses has reappeared from his self-imposed exile. Charles Loyana, a former Accountant at the Ministry of Finance has returned to the country. Loyana, who is a nephew to the Minister of Finance, Situmbeko Musokotwane, says he wants his property and his job at the Ministry back.

Loyana had fled to Tanzania fearing for his arrest and his life. Loyana is among the three people who have sued the Anti-Corruption Commission (ACC) over the 48 houses in Lusaka’s Chalala area.
He recently submitted to the Court that he as Charles Loyana, a senior accountant at the Ministry of Finance, remains qualified to own property in Zambia using funding from any legal sources of his choice.

In this matter, Uziel Bashire, Zuberi Bigawa (both Tanzianians) and Loyana have sued ACC in the Lusaka High Court, seeking declaration that Loyana had and has the requisite power and authority by law in Zambia to purchase, possess and own property in his name for his own benefit or for the benefit of any other person.

They also want the court to order that Bashire, a Tanzanian but currently residing in Norway, has an interest in the properties bought by Loyana and was to be the ultimate beneficial owner of the properties bought, and such Loyana as purchaser of the properties should be granted possession of the said properties.

But in its defence, ACC argued that Loyana did not challenge the forfeiture proceedings that were instituted by the commission despite being served with the notice of intention to have the said properties forfeited to the State.

ACC added that Loyana in a statement to it dated May 16, 2018, told the commission that he owned only two properties, that is, one in Chilenje and the other in Chalala.
Meanwhile, ACC submitted that there was no record of either Bashire or Bigawa (both Tanzianians) being granted an investment permit to enable them to invest in Zambia.
However, in their reply to ACC’s defence, the three argued that there was no law in Zambia that proscribed a foreigner from funding a local person who qualifies to own property to purchase property or to fund any such investment to require them first to have an investment permit.

They argued that thus, ACC’s understanding of the requirements of an investment licence to justify its illegal seizure of the properties was out of context and remains unjustified at law.
The three further argued that neither does there exist any law in Zambia that proscribes a foreign national from having an interest in any investment or property owned by qualified persons under the law in Zambia.

They stated that what the law prevents was owning the property in the foreigner’s name if that foreigner does not meet or does not qualify to own land in his/her name as required by law.
“Further, a transaction regarding sale and purchase of property between private parties as was the case herein was and remains a private contract between the parties to the transaction and the defendant (ACC) was never a party to the transaction.

The third plaintiff (Loyana) remains qualified to own property in Zambia using funding from any legal sources of his choice and cannot be deprived of the said properties in the circumstances of this matter,” the three plaintiffs stated.

They maintained that ACC did not comply with the law in the process of seizing the said properties and would duly prove that at trial

  1. What is the mention of Musokwane in all this fake story? And so what if he is related to the Minister – Did he play a part in it ? How many relatives does corrupt Lungu have are they all corrupt ? Dulloooooo………..

  2. His uncle has been at the ministry of finance for a long time. Is he the one who employed him? Did he got promoted because of his uncle?
    Now that his uncle is back as minister of finance, Loyana wants to be back at the ministry. African and Zambian tipical where nepotism is more deadly than cancer. I have little hope if this goverment will surely fight and unite the country from divisions based on ethenic groupings. This because i know it has embaded in many governace institutions. There are certain goverment departments and ministries where if the directors and ps are there, only his or her tribesmen and related people dominate. They will even lable other tribes has thieves, tribalists, dull etc and i dentfy themselves honest, inteligent and kind.

  6. Charles Luyana ran away from Zambia to Tanzania because he feared for his life. Now that the regime has changed he has reappeared to claim his properties.

  8. They have concocted a story. Where has this guy been all this time only to appear now? How can a civil servant manage to build 48 houses mwebantu when it takes some of us years to build a single house?

  9. This just shows how ACC lacks a killer blow. When someone is suspected or found to be in possession of proceeds of crime all such should be confiscated, tried and arrested. This halfhearted approach is time wasting and troublesome. Why is he back now?

  10. He keeps going and coming back – PF must have been a very incompetent Government. Honestly this chap should have a lot of documents to support his claim – starting from:
    – Application for land if first owner.
    – minutes to the letter of offer
    – Letter of offer
    – Consent to change of property if bought from someone
    – letter of sale
    – Property transfer Tax certificate from ZRA
    – Title deed…
    – Building permit….etc etc

  11. I will be very upset if he gets back his properties and the job, it’s a myth, So why did he run away if he obtian those properties in a lawful way. I smell a dead rat here!!!!!

It surprising that GARY and JACK who were so vocal about the 48 houses did not that the owner is a close relative to their close and inner circle member of UPND. For sure Musokotwane knew about the houses. Did he hide this from his friends and his god. ? Can you trust these guys ……NOOOOOOO. Next you will find that lots of them own plots in forest 27…….Mark my words.

  17. This is deception on the part of the opposition, they used all sorts of tricks to win the elections now this will haunt them for a very long time. They accused wrong people to gain political mileage. We are waiting for them to redeem themselves, axcuses are not acceptable. We need results, the blame game will not help anyone.

  20. Even me from here in the UK, I can do a better job than ACC surely who built the properties and who was on the title deed…how much were they sold for? This is a simple but smart move by these chaps bringing in foreigners as you can not track down the finances or history…can you imagine if it was a Mr. Mulenga from say Twin Palm Rd .. you would know everything about him.

  28. When the PF said these houses belonged to Mr Musokotwane’s nephew, people refused and said it was for Tasila and Edgar was blamed for it. ECL was called all sorts of names for these houses. One UPND supporter has them as part of his pseudo name. Lyana has not cooked up a story. He is the owner. If truly he was funded by those Tanzanian guys as a channel of investing in the real estate in Zambia he should be given back his houses full stop. If an American gives me money to invest in Zambia how does that become corruption? Money has trails, all Loyana needs to prove is the money transfers from Norway or Tanzania to his account. End of case. Mule tekanya, imwe everything is corruption.

  29. What Zambians don’t understand is that the FIC does not report stolen money but makes a report of financial transactions that needs clarifications. It’s only a subsequent report making up those who fail to explain their financial transactions that people can start suspecting corruption. FIC report is raw financial data which requires further processing. Now you find even PHD holders shouting corruption from a report which just says Mr A transferred funds to Mr B but looking at his income we don’t believe he has capacity to do so. Can ACC or DEC establish one where he got the money from and why he transferred that money to Mr B. Before that is done someone calls Mr A corrupt. Africans we are our own enemies. Things that happens in western countries us we call them corruption just…

The biggest corruption in Zambia is carried out by ordinary civil servants who cut across political parties through procurement processes, trips, conferences attendance allowances, fuel and transport reimbursements. They use these moneys to build houses, buy cars and live luxurious lives. Just get 20 houses of civil servants from Chalala and ask the owners to show proof of bank loans or inheritance of wealth for them to build such expensive houses, over 95% will fail to do so but if you ran a report of allowances given to them in the past 5 years, you will find that to be the source of funds they used to build and buy cars.

  31. Please stop the ugly comments over the 48 houses, haven’t you heard that the truth always comes out. Remember God sees and knows everything. There is no hiding place with God, He will avail us the whole truth, Zambia needs redemption from whatever corrupt practices we found ourselves in. So stop sinning through the ugly comments in the name of politics and unnecessary hatred. Trust God to expose everthing, the really shall be known. Advice, please fear God, otherwise God may also expose you for that secret under your sleeve.
