There has been no demand by DEC for information relating to PF’s source of campaign funds-Attorney General

Attorney General Kabesha Mulilo has said that there has been no demand by the Drug Enforcement Commission (DEC) for information relating to PF’s source of campaign funds for the 2021 August general elections,

Mr Mulilo in a defence filed in the Lusaka High Court explained that former PF Secretary General Mr Davis Mwila and ex media director Mr Antonio Mwanza were questioned over their alleged involvement in money laundering activities.

He said that Mr Mwanza had personally volunteered to go to DEC offices although at the end of the interrogation, he told the media that he was questioned about PF’s source of campaign funding.

He has thus urged the Lusaka High Court not to entertain the lawsuit by Mr Mwila and the party protesting investigations by security wings as it is a ploy to circumvent criminal investigation and possible prosecution through civil proceeding.

This is a matter in which Mr Mwila in his then capacity as SG sued Government on September 28, 2021, in the Lusaka High Court claiming that their members are being threatened by DEC with prosecution if they do not disclose the source of campaign funds for the August 12 general elections.

Mr Mwila demanded that Government pays damages for intimidation and harassment of the PF members.

The party is also seeking damages for misrepresentation and defamation of character following allegations by DEC that the PF’s source of fund was linked to money laundering.

But Mr Mulilo in his defence stated that both Mr Mwila and Mr Mwanza were not summoned in their positional party capacity but in their personal capacity.

He added that no pressure has been exerted on the junior PF members to disclose the source of funding for campaign activities.

“The defendant shall say at trial that Antonio Mwanza volunteered to go to the Commission offices in the presence of the media, and he informed the media that the commission was questioning him about the source of campaign funds used in the general elections, when in fact he was being questioned regarding alleged Money laundering,” Mr Mulilo stated.

“The Commission did not summon Mr Mwila in his capacity as SG of PF but in his personal capacity. The defendant shall also deny that Mr Teddy Mambepa was not called in for interrogation but merely for inquiry into the allegations of money laundering,” he stated.

Mr Mulilo stated that DEC is mandated under the Prohibition and Prevention of money laundering Act no. 14 of 2001 to probe into money laundering and related issues and may legally summon any person with relevant information on such a matter and PF members are not an exception.

“The plaintiff is merely attempting to derail on-going criminal investigations in which some PF members are implicated. That this matter is frivolous, vexatious and an abuse of court Process,” he contended.

    When the total bill for the use of GRZ transport and tax payers money for lungus campaigns is calculated, even their offices will be grabbed………….

    Even their backers can’t substantiate their wealth…………..its all stolen monies from Zambians.

  3. I am asking myself, what good has PF contributed in past 5months, as the strongest opposition party? Is the junky that we are getting from PF, truly reflect the famous REBRANDING? As an observer, what I have witnessed is the continued PF CHIPANTE PANTE syndrom, now getting even worse ! Totally no leadership! Nakachinda, Lubinda, Mundubile, Mwamba, CK, Lusambo…Each one pulling in their own different directions. One thing they have in common though, is misleading Zambians, complaining about petty things, wasting time rowding police stations seeking sympathy. Just from the top of my head, here are a few cases(out of many) to support my observation:

  4. So, these rogues were being summoned in their personal capacity on cases of money laundering and decided to implicate their dead PF party!
    Time of revelation has arrived and because of ‘ndendeule’, wrong answers being tendered will implicate the entire PF. No surprise quoting PF SG then said “If we do not work hard to win this election 2021, we will all of us go to jail”. Prophecy fulfilment.

    I am asking myself, what good has PF contributed in past 5months, as the strongest opposition party? Is the junky that we are getting from PF, truly reflect the famous REBRANDING?     Observation 1] Mr Davis Mwila questioned over theSource of Campaign money
    ==> The TRUTH: According to AG, Mr Davis Mwila was questioned over his alleged involvement in money laundering activities. But you recall how the PF Senior leadership, was wasting time, puportedly giving their support to Davies apparently, BECAUSE the police was questioning him about campaign money, including , the vehicles used. It turns out, this was WRONG Narrative by PF to mislead.

    Observation 2] Zambia Police Summon Opposition leaders for holding Indoor meeting without permit
    ==> The TRUTH: The reality was that SEAN Tembo was summoned by Police for an article he posted on FB
    But you recall how PF Senior leaders were at the Police Station SHAMEFULLY attacking UPND for not repealing POA. And on LT, there was a hot debate regarding POA and DOP. Again, WRONG Narrative by PF. Infact Mwamba, after Null & Void of POAby a judge, PF changed it BUT maintained the same reading that judge had nullified. But they are quick to get HH to repeal “yesterday”. Why rush now?

    Observation 3] ZESCO Unbundling proposal
    ==> DEBUCKED: PF Shamefully attacked UPND, calling out that this bundling proposal amounts to privitazation of ZESCO. Again, giving WRONG Narrative. Once an article came out that acually, Given Lubinda was involved in alleged ZESCO Asset stripping, PF suddenly STOPPED bit.ching about ZESCO.

    ==> DEBUCKED: It was reviewed that , actually, Emmanuel Mwamba, facilitated the engagements with the government and the SA investor. PF including Mwamba were feeding us with misleading information and accusing UPND government, for planning to BUILD expensive roads than were in PF era. Again, this was WRONG Narrative by PF.

    That is the Strategy of the so-called re-branded PF !!! Completely USELESS !! They are spending taxpayers’ money (those MPs) and also PF membership money if at all OR even sponsors money, wasting time giving their so-called solidarity or support by MISLEADING Zambian people that they are fighting for the right cause…ALAS ! the truth is somewhere else !! I wonder how these dies-hard PF can condone this behavior, is this the best they can get from their LEADERS? If YES, then PF is in for a big shock, the UBWATO is overturned fore-ever !! They are being sued for not honoring contract – Solly talebwelelapo !!!
