
MMD parliamentary chief whip Vernon Mwaanga has said that the impeachment plan by the opposition is baseless because they have failed to tabulate the breaches they allege President Rupiah Banda has committed.
Patriotic Front (PF) chairperson for local government and housing, Wynter Kabimba has written to the Speaker of the National Assembly, stating that he has been instructed in his capacity as a lawyer to give a notice of motion for impeachment of the president.
Speaking in an interview in Lusaka yesterday, Mr Mwaanga said if the PF and United Party for National Development (UPND) were serious about impeaching Mr Banda, they could have tabulated all the alleged constitutional breaches.
He said to the surprise of the MMD, the said letter was only on one page and without substantiating the claims against the president.
“They should also know that Mr Wynter Kabimba has no standing to write about the impeachment because he is not an MP. According to Article 37 of the Constitution, impeachment proceedings can only be started by an MP and Mr Kabimba is not an MP,” Mr Mwaanga said.
He said according to the Constitution, the impeachment proceedings could be started when the letter handed over to the Speaker had been signed by one third of the MPs but that had not been done.
He said that the impeachment of a head of state could only be commenced if the office holder had violated the Constitution and in this case the opposition parties had failed to state what violation had been committed.
And Chief Government spokesperson Ronnie Shikapwasha said that the Government was ready to defend itself as President Banda said on Tuesday.
Lieutenant-General Shikapwasha said the opposition were merely playing to the gallery and advised them to desist from entertaining the public through cheap politics.
MMD national chairman Michael Mabenga said the opposition has failed to offer justifiable reasons for their calls to impeach President Banda.
In a letter dated July 21, 2009 to the speaker, Mr Kabimba of WM Kabimba & C
ompany said his law firm had been instructed to advise its clients the various breaches of the articles of the Republican Constitution by President Banda for presentation of the motion for impeachment.
“These breaches cover the period from August 2008 when Mr Banda was acting as president of the Republic of Zambia following the demise of president Levy Mwanawasa in Paris, France todate,” reads the letter in part.
In his letter copied to PF leader Michael Sata, his UPND counterpart Hakainde Hichilema and what he termed MMD client members, Mr Kabimba stated that he was acting for the PF, UPND and ruling MMD MPs.
“We shall forward the motion to your office for presentation by our clients within 14 days from the date hereof,” reads the letter to the speaker.
UPND spokesperson Charles Kakoma in a separate interview said members of the pact were still looking for evidence of the alleged violation of the Constitution by the president
Mr Kakoma said the grounds included the alleged violation of the Constitution, m
ismanagement of the country’s affairs and gross misconduct, among the said charges.

The issue here is not name calling and getting all heated up. The big question Zambians need to be debating is has the constitution been breached?, if so what are the legal alternatives. Does the constitution allow for impeachment or what are the options. If the constitution allows for impeachment then it has to be implemented, for those who are panicking you need to ask yourself why does our constitution have a clause on impeachment if all the conditions have been fulfilled, that should also answer those that are concerned about instability. Why does the Zambian constitution and every other country’s constitution have a clause on impeachment if it will bring about instability. In my view, the PACT is showing signs of panicking. If really they had evidence, they would not be wasting time.
On the issue of the MP’s voting against the impeachment , if indeed the constitution had been breached then they should also be dropped by their constituencies for failing to protect and honor the constitution of the land. If the constitution was not breached then the HH Sata Pact needs to concentrate on voter registration, restructuring of ECZ, civic empowerment in rural areas and a complete overhaul of the Justice System in Zambia that is where the problems are right now.if indeed the constitution has been breached and the constitution allows for impeachment it’s now upto Zambians to petition and hold their MP’s accountable to protecting the constitution. Looking at his picture today the man looks unwell and frail and I ask myself, what is he up to still clinging to dirty MMD politics in that condition? I’m afraid Mwaanga is dead right on this one. Impeachment of presidents is a rare event in history. Even in the US, out of 50 presidents in over 100 years, only 2 presidents were impeached by the U.S. House of Representatives, but acquitted by the Senate: Andrew Johnson and Bill Clinton . Richard Nixon resigned after Watergate before he could be impeached.

African Presidents are always committing some offense even when they open their mouths. I would not rush to say mwaanga is right without reading or waiting for impeachment articles. I don’t think the PF/UPND lawyers don’t know what they saying. Already Sakala/Chitengi issue is one impeachable case. President sleeping on the wheel. We should learn from other developed countries and use some ideas of how they got to have efficient political systems which delivers. Such ideas can help us come up with a local system, imbedded in our constitution. eg The Japanese system facilitates impeaching a leader based on performance, even the performance of the economy. Breaching the constitution should not be the only reason. Wrong appointments of corrucpt people into responsibilitties should be impeachable. If we imagine that Banda is removed from office, then what? Another election? Does PF/UPND have time to come up with ideas as to how to move Zambia forward? I think most PF MPs do not know what is at stake. All they are thinking is that once the impeachment goes thru, it is only RB to go yet even they as MPs will have to be subjected to elections. Now there are 18 MPs in PF who have a weak support base and within UPND and PF there could be those who may have fallen out of their electrorates favour. Those would not wnat to risk their positions hence wont vote for this thing. But as usual with PF MPs it is ubumbutuma at play. I doubt if Hon. Mumbi Phiri knows what this is all about if last time she was coerced into voting for increased salaries without understanding why. You can just see it by the way they are using a lawyer instead of MPs themselves presenting the impeachment case.

My advice to the UPND-PF PACT is that, please consider withdrawing the 14 day notice and let the High Court and LAZ sort out the illegal or legal Chief Justice problem first. This is because it would be sad to have new elections and then President with an illegal Chief Justice to swear him/her in to defend the Constitution. Also, the PACT will have more time to frame the impeachment motion nicely so that the 53 MP signatures can be easily mobilised.
In the meantime, non-rebel PF must reconcile with its rebels.

What the hell is on Mwaanga’s head in the pic? Ok, a friend has just clarified with me that the white stuff on Mwaanga’s head is a latst bluetooth from China. It has recently been designed for the aged. The manufacturers were informed that the clip on the ear from the bluetooth was giving a disconfort due to prolonged use. He is not retiring because he is financially dependent on his job for his day to day livelihood (and medical expenses , which cannot be cheap) Shocking? Not really. The Impeachment clause and all other articles were wilfully, purposely and specifically included in the constitution to protect the nation from the emergence of tyranny and truancy in the President.
If and where the Opposition parties have a solid case for impeachment of the current President, so be it. It is conctitutional. It is no recipe for confusion or conflict, but a legitimate way to remove a errant office holder.

Lastly the POST indicates that Dr Clive Chirwa said “Prof Chirwa said ministerial positions were being given to people who could not read, write or even carry out comprehensive debates in Parliament and to the outside world” and so what is his position on the qualification of MP and President of Zambia in terms of literacy as the Constitution stipulates, if I may ask?
If Dr Clive Chirwa is to join the UPND-PF PACT, what would be his position on PF political party self-appointed leader MC Sata who is alleged to have only reached Sub B (Grade 2) or Standard 4 (Grade 6)?
