Defiant PF MPs drag Sata to court

The 27 opposition Patriotic Front (PF) Members of Parliament threatened with expulsion by their president Michael Sata for registering to participate in National Constitutional Conference (NCC) have asked the Lusaka High court to grant them a permanent injunction to restrain their leader from expelling them.

The Members of Parliament are also asking the court to, in the meantime, grant them an interim injunction, pending trial of the matter, to restrain Mr. Sata, his agents or servants from going ahead with the intended action to expel them.

Kasama Central MP, Saviour Chishimba and his Shiwang’andu constituency counterpart, Celestino Chibamba, filed the affidavit in support of the summons for the interim injunction on behalf of the other 25 MPs in the Lusaka High Court yesterday.

The duo filed an application for an injunction against Mr. Sata in his capacity as party president and Mr. Edward Mumbi in his capacity as Secretary General of the PF.

The 27 MPs are contending that they should not be expelled because they were elected members and had an unalienable duty to participate in the deliberations of the NCC.

They said in their affidavit that their party president, Mr. Sata, had consented to the concept of the NCC and allowed all his MPs, including the 27, to participate in the discussions of the conference bill in parliament.

They said therefore that the sudden change of mind by their president would hinder them from using their democratic rights as MPs to be part of the NCC for reasons only known to himself.

“We have come to this court to ask for a permanent injunction to restrain the defendant either by himself, his servants or agents from implementing what he has threatened to do, to seek damages for the inconveniences caused in threatening to do so,” they said.

The MPs further said an interim injunction should be granted to them to avoid being subjected to what they termed undue hardships which could not be compensated for by an award of damages.

  2. Stop boys! I think Chisataumwine has kicked his bowls because the court can not rule in favor of the MPs. This is playing around with the integrity of the nation. SATA you cannot win sympath like that. The money should not be the issue anymore because he himself testified during the run up to 2001 elections giving MMD to buy 150 vehicles for campaign. We have not forgotten this. He want to exzonaret himself from evil.

  3. The high court can not grant a permanent injuction. What law school did their layer attend? An injuction is a legal instrument granted in the interim to suspend all proceeding while the court evaluates the case. What is interesting here is that Hon Sata has not expelled the MPs so there is legally no case or damage for the high court to consider. Mr Sata has to first expell the MPs and then sue him. Remember the FTJ third term MPs ? well there is law protecting MPs from party insurbordination…

All Hon Sata is saying is that if we cannot equitably represent our people then we will not be part of NCC. The NCC will only serve one objective in its current state. Sure if PF is not care it will be left of this national duty by the time they be in power some would have been old men and no one will vote for them. There is phrase which says: If you cant beat them fight from inside. It could have been ideal for the PF to fight from within like UPND. This would have made impact the same way you debate in parliament.

  10. The question of NCC has nothing to do with how democratic Sata is. Its about insurbodination. When a political party takes a stand , all members should obey.PF Central commettee comprises mostly MPs. Why did they elect not to participate in the NCC? If they have a change of heart first call a meeting with your members of the central commettee and vote to participate in the NCC. First deal with the party b4 you register or you are just causing confusion.

  16. ‘Expel anti-NCC PF MPs instead’

    PATRIOTIC Front (PF) members of Parliament who have refused to attend the National Constitution Conference (NCC) should be expelled from Parliament, MMD information and publicity chairman, Benny Tetamashimba, has said.

    Mr Tetamashimba said in a statement issued in Lusaka yesterday that the MPs that had refused to attend the NCC had broken the law and should therefore be expelled.

  17. He said the MMD was disappointed with PF’s insistence to expel law-abiding MPs just to make them lose their parliamentary seats.

    He said lawyers should advise Mr Sata to expel MPs who breached the Constitution and not those who followed the law and the duties that they were elected for.Mr Tetamashimba said the NCC recommendations would not be subject of a Cabinet white paper but would go straight to Parliament as a Bill and would be passed through all the necessary stages.

As much as the MMD is in a solid representation at Manda hill and independently vote without reprisal on nationalistic bills, the Machungwa/ Chishimba group already in majority of PF MPs should study and consider endorsing the “age limit clause” for Presidency. Our senior citizens at that age should be accorded a last role of advisory than a challenging job of Presidency.

  38. There is no value in labelling Sata dictator. As a party PF resolved long before not to attend the NCC coz Zambia already has had numerous contitutional submissions (Mwanakatwe, Mvunga & Mung’omba) from which a good constitution can be derived from. Remember LPM wants to use every avenue to weaken the opposition. PF should have consorted amongst themselves about how to get LMP’s money and still maintain its stance on on the matter. That was going to be a win-win situation for all.

  47. I hope you have found my summary for the week on the embattled Sata resourceful. Face it, Sata has been politically undermined and his recovery has gone to the moon. The dissidents represent 51% of PF MPs. It will cost Sata more than money to repair himself politically. Meanwhile MMD is realigning itself operation wise. Billions, logistics and human capital will be aplenty, all readied for the 2011 battle lines way ahead of time. Political efficacy through strategic planning adds the momentum.

  51. The Pf has the right to deal with those MP’s in any way it sees as fit. The MPs have betrayed the voters and the party. MMD is getting less and less popular. In 2001 they got 90% in Nchanga. In September 2006 they got 23%, in November 07 they got 20%. PF is getting stronger. So those who stood on PF, if expelled today will never regaing thier seats.

Mr.Chilufya Sata, only thought of “punishing” those PF MPs on NCC, but never said he will never listen to them.     Over the last few yers Chiluba has been trying unsuccesfully to gain a foothold on the political scene through sponsorship of parties under Dan Pule and Chitalu Sampa.What an opportunity that Sata picked as his MP the Chiluba loyalists such as Dr Xaviar Chismba, Dr Peter Machunga, Celestina Chibamba and Rev Sampa Bredt.It is these same MP who are leading the rebellion.
