Man Jailed For Slapping a Man Who Touched His Wife’s Breasts

The Nchelenge Magistrate Court has sentenced a 28-year-old man to six months imprisonment with hard labour for slapping another man who touched his wife’s breasts.

Before Resident Magistrate Luckson Mbewe was Pardon Mpundu, who readily pleaded guilty to the offense of assault occasioning actual bodily harm (AOBH), contrary to section 248 of the penal code chapter 87 of the laws of Zambia.

Brief facts in the matter were that on 1st May, 2025 in Nchelenge district, Mpundu assaulted Richard Limbikani thereby causing him actual bodily harm.

State prosecutor, Kennedy Chimbali, narrated before court that on the material day, the duo was at a named bar when they picked a quarrel over Mpundu’s wife.

Mpundu told the court that he was forced to slap Limbikani because he touched his wife’s breasts.

“Your honour, the victim in this matter was touching my wife’s breast, no wonder I fought him,” Mpundu told the court.

In mitigation, Mpundu pleaded with the court for leniency adding that nobody will take care of his wife, who is currently pregnant, if he was given a custodial sentence.

  1. Why wasn’t the slapped guy also jailed for marriage interference? The latter is in the law books!

    • Failed to understand the case at hand and even the reporting is very unprofessional. It doesn’t give a statement on what the judge said and why they came to that ruling. Why wasn’t the man who touched the wife charged? As reporters you have power to create a precedent of people believing it is ok to do something wrong and when you are assaulted the one who assaulted you will be the person who will be charged. This must be corrected, please report the way the court of Law has ruled and not over sensationalize the case. Was the woman in an affair with the man that was touching her? Those are questions that must be answered.

  2. This is absurd to say the least! The man, like all married men, was protecting his family. I can not believe this!!!

    • If the facts of the case are correct,this sentence must be appealed.It is irrational and too harsh.It is like the magistrate would like to feel the breasts, also.

    • What the pregnant woman was doing in a pub with the husband is none of your business.The important issue here is that she was touched.

    • Zambia doesnt have laws against pregnant women entering bars. It is an ethical issue so stick to the guy touching her breast-period!

    • The isn’t a normal Judgment. Judge must have graduated from the famous Matero University. Next thing is to sue this relative to the judge who touched the woman’s “things” for sexual harassment.

    because that Limbikaya will certainly not going to see the light of the year by 2026 because of that jailing of that Guy.
    Those sangomaz will practice heavy incantations on the remaining guy. the honorable justice should have just fine mpundu and also mpundu’s wife should have filed in a lawsuit against Limbikaya.

  5. Please can the legal aid department come to the rescue of this innocent husband and appeal the sentence or case altogether?
    Justice must not only be done but must be seen to be done
    This is a miscarriage of justice by the judge and judge is just promoting adultery in marriages

  6. This magistrate must be locked up! We know that two wrongs don’t make a right, but neither do three wrongs. I won’t allow any man to touch my wife’s breast. And you might say it is wrong to beat up this sex offender but locking me up is very very ,very wrong. Abash shimafumu Luckson Mbewe!!
