The Lusaka High Court has adjourned the case in which former Deputy Minister in the Chiluba administration, Newton Ng’uni is challenging the presidential power transfer from Justice and Defence Edgar Lungu to acting President Guy Scott.
High Court Judge Justice Gertrude Chawatama heard the matter today in chambers and has since adjourned it to 28th November 2014 for continued inter-parte hearing.
Attorney General Musa Mwenye told journalists that the court has issued directives to both parties to advise their clients not to make any statements that are prejudicial to the case.
Mr. Mwenye said the matter was now in court adding that no one was allowed to comment on it as doing so is sub judice.
He said no adverse order has been made against the Vice President, who is currently acting President, which leaves him to continue acting as Head of State.
This is in a case in which former Education Deputy Minister Mr. Ng’uni is challenging the presidential power transfer to Dr Scott from Justice Minister, who is also PF Secretary General Edgar Lungu following the death of President Michael Sata.
The judicial inquiry comes after Mr. Ng’uni petitioned the High Court saying the constitution was violated after Justice Minister Edgar Lungu, who was appointed Acting President by the late President Sata before he went abroad to seek medical treatment, ceded authority to Dr. Scott.
Mr. Nguni alleged that Dr. Scott and Cabinet had forced Mr. Lungu to relinquish power after he was allegedly threated that if this did not happen, Mr. Lungu and other cabinet ministers would be charged with treason.
Mr. Lungu, in his affidavits in support of the motion submitte that the Attorney General warned him that police were on stand-by to arrest him and other cabinet ministers opposed to his opinion.
Mr. Lungu submitted further that the Attorney General instilled fear in him and other cabinet ministers forcing him to surrender the instruments of power to Dr. Scott.
Lusaka lawyer Anthony Kasolo is representing Dr. Scott while the Attorney General Musa Mwenye is representing the state.
Chipolopolo on Saturday seek to maintain second place in Group F of the 2015 Africa Cup qualifiers when they face Mozambique at Zimpeto Stadium away in Maputo.
Zambia and Mozambique are tied on five points after four rounds of matches.

The Patriotic Front (PF) has set November 17, 2014, as the date for the party Central Committee to discuss and agree on the adoption process of the PF candidate for the forthcoming Presidential by-election.
PF Secretary General, Edgar Lungu, said the road map to be arrived on selecting the presidential candidate will then be communicated to all the PF party organs.
Mr Lungu, who is also Justice Minister and Defence Minister, stated that it was only the Central Committee which has power to spell out the avenue to be used by aspiring Presidential candidates.
He stressed that the PF is a democratic institution, adding that all members wishing to contest for Presidency will be availed an opportunity to do so.
Mr Lungu highlighted that the party constitution allows the Central Committee to, among other things, initiate and approve changes in the regulations and rules of the party.
He said until the Central Committee makes its decisions no official should be cheated into travelling anywhere to attend to anything concerning the party.
Mr Lungu said this during a press briefing held at Blue Nile Inn in Lusaka today.
And Mr Lungu has conveyed gratitude to the rank and file members of the party for the solemn and dignified manner in which late President Michael Sata was mourned.
He urged the PF general membership to remain focused and steadfast as the party advances President Sata’s vision both for the party and the nation.
Newly appointed Information and Broadcasting Services permanent secretary Chanda Kasolo has urged the media to uphold responsibility in reporting events leading up to the imminent Presidential by-election.
Mr Kasolo who took over office from Bert Mushala last Thursday, said the media should be responsible as they report on events during the political transition period.
He said it was critical that the media upheld responsibility to promote peace and reconciliation in the political arena.
“The media should be responsible and reflect on the kind of information is passed on to the nation during this transition period so that people are not falsely alarmed,” he said.
Mr Kasolo said the media had the role of helping Government uphold good governance prior to and after the Presidential by-election.
Meanwhile, Mr Kasolo yesterday circulated a notice to all political parties directing them to nominate one member who will serve as a point of contact for the media.
Mr Kasolo said the ruling and opposition political parties should each have one person as media contact to avoid distortion of information.
“Information from political parties should be channeled to the nation in an orderly manner and there is a circular from my office informing the political parties about this arrangement,” he said.
Mr Kasolo has taken over from Mr Mushala who has been moved to Cabinet Office as permanent secretary in charge of special duties.
Secretary to the Cabinet Roland Msiska announced the changes last Thursday.
The Drug Enforcement Commission (DEC) has arrested a 44-year-old banker of Lusaka for money laundering activities involving over K700,000.
Alex Mulenga Kasepa has been arrested for theft by public servant, forgery, altering false documents, obtaining money by false pretences, destroying materials and money laundering contrary to the laws of Zambia.
Particulars of the offense are that Mr Kasepa, on dates unknown but between January 1, 2012 and September, 2014 whilst acting together with other persons unknown, in his capacity as a clerk, did steal a total sum of K745,000 belonging to four bank customers by forging cheques and cash withdrawal slips and consequently altering them to the bank tellers and purporting to be cashing for the owners of the accounts when infant not.
Mr Kasepa further obtained a cheque book belonging to one of the account holders without lawful authority from the owner of the account or the bank and kept it to himself thereby permanently depriving the account holders of their money.
He will appear in court soon.
This is contained in a statement released to the media by DEC Public Relations Officer, Theresa Katongo.

The opposition United Party for National Development (UPND) has unanimously endorsed party President, Hakainde Hichilema, as a sole candidate for the forth-coming Presidential election to be held early next year.
UPND Vice president Canicous Banda disclosed the development at press briefing held at party secretariat in Lusaka today.
Dr Banda said the endorsement was arrived at yesterday by the highest organ of the party, the National Management Committee (NMC), attended by all UPND Members of Parliament (MPs) and other senior party officials.
Dr Banda, who was flanked by other senior party officials, said Mr Hichilema is a meritorious candidate to contest the Presidency.
“Our party, which met yesterday, has endorsed our leader Mr Hakainde Hichilema. He is a meritorious leader to contest the forth-coming Presidential poll. The NMC of our party unanimously endorsed Mr Hichilema because he is the only one to carry on where late president Michael Sata left,” Dr Banda said.
At the same press briefing, former Lusaka Province Minister, Sony Mulenga’s son, Gabriel, and former UNIP Isoka MP, Wilson Siame, defected to the UPND.
The duo said the UPND has good policies to steer the development of Zambia and that Mr Hichilema is an outstanding leader with quality leadership style.
Meanwhile, Dr Banda has urged party members to be peaceful during the 90 days transition period when Zambian goes to the poll slated for January, 2015.
The UPND Vice president condemned the infighting in the ruling Patriotic Front, saying it was denting the good image of the country.
And UPND National Chairperson, Mutale Nalumango, urged the Zambian people to vote for Mr Hichuilema.
Mrs Nalumango claimed that Mr Hichilema is a tested leader and this is the best opportunity for the Zambian people to rally behind him.
She echoed the UPND Vice president that the infighting in the ruling party is a confirmation of bad governance and leadership of the PF.
She called on the Zambian people to scrutinize all those vying for presidency.
But PF Deputy Secretary General, Bridget Atanga, in a separate interview, dismissed the infighting in the ruling party.
Mrs Atanga categorically said there is no infighting in PF and advised the opposition UPND to concentrate on its own internal affairs.

Matero Member of Parliament Miles Sampa has officially said that he will contest the PF presidency at the party’s general conference.
Mr Sampa stated that he has been motivated to stand because he believes time has come for fresh leadership.
Addressing a media conference at Lusaka’s Pamodzi Hotel, Mr Sampa who is also Commerce Deputy Minister said he wants to become PF President to carry on late President Michael Sata’s vision for the party and the nation.
He said that he has accepted to run for the presidency after an overwhelming number of requests from ordinary PF members.
“Now this is a Jubilee year and things are seemingly taking shape. Our late President answered the Lord’s call in this year when the old generation is biblically meant to pass the leadership mantle to the younger generation. In the Bible, Leviticus…states that ‘ask yee for the verse’. I am a youth and answering this biblical call as well,” he said.
Mr Sampa said people who judge others by their age should know that at 44 years, he has done a lot of developmental projects in Matero that have benefitted both the youth and much older citizens.
“Age is not a factor in producing results to uplift the livings standards of our people. After all, I stand to be corrected but I gather our founding father Dr Kenneth Kaunda was only 40 years when he became resident of Zambia and President Obama was only 43 years when he became the most powerful man on Earth,” he said.
He added, “As we go on this campaign journey, I undertake to evoke a clean campaign based on issues and not personal attack on other opponents. I will undertake to embrace, respect and work with whomever the PF delegates will settle for at the convention.”
The Matero MP has also challenged those claiming to have been anointed by late President Michael Sata to stop demeaning the name of the late President.
“The President always encouraged people to seek the mandate of the people through an election and he was one to favour or impose anyone on party members. That’s why the assertion by some that they were anointed is a shame and embarrassing to the late President’s name. He is not there to confirm or defend himself and therefore people should not put words in his mouth or mind.”
He added, “I saw the Minister of Information Dr Katema going on TV barely an hour after burying the President falsely claiming that someone had been anointed. When the President was alive, the Information Minister was too scared to even go live on TV. He was absent on the screen during the funeral when he should have been comforting mourners and the nation at large. He however found it prudent to do so a few minutes after the burial. What a shame. I urge all those abusing the name of the President through anointment pronouncements to stop.”

Transport, Works Supply and Communications, Minister Yamfwa Mukanga, this morning told Parliament that Guy Scott is still acting Republican President.
ZANIS reports that Mr Mukanga, who is also Leader of Government Business in Parliament, said rumours that Dr. Scott has been expelled are misleading.
Mr Mukanga said those spreading such rumours are not patriotic Zambians and urged them to be level-headed when dealing with such issues.
He said the office of the President is a respectable and dignified institution which must be respected by all well-meaning Zambians.
Mr Mukanga was responding to a concern from United Party for National Development (UPND) Monze Member of Parliament, Jack Mwimbu, who told the house that expelling Dr Scott was not a good move.
Mr Mwimbu said the happening in the Patriotic Front (PF) government are endangering the security and peace of the nation.
He said the PF government has created a constitutional crisis because the members have taken peace that is prevailing in the country for granted.
Mr Mwimbu said State House must always be protected despite who is occupying it because it is a public office.
He has urged the PF to uphold peace and exercise patience until a preferred candidate for Presidency is chosen amicably.

The events of the past two weeks in Zambian politics make it impossible to resist commenting on. Before the end of January 2015, Zambia must yet again go to another Presidential Bye Election and naturally as a conscious citizen, I’m just as interested as the next person to know who will take up the leadership mantle and propel our believed country to greater heights.
There are many contenders but of particular academic interest is the United Party for National Development UPND’s Hikainde Hichilema because in the ‘pecking order’, many believed that it should be automatic that he should be Zambia’s sixth President but to the contrary. While people should have been automatically pointing to him as the next President, many people that I have interacted with have their misgivings; there is just something about him that doesn’t seem plausible.
This should not come as a surprise because of a systematic propaganda campaign that HH has been subjected to in the last five years that has branded him as a ‘bitter man, merchant of death, selfish man and an under-five politician’. This has been very clever and it has worked. Secondly the UPND also has a somewhat bizarre PR approach that actually helps to enhance their opponent’s accusations.
Leading to the 2006 and 2008 elections I wrote a series of articles that were meant to be an eye opener to various Presidential contenders giving a snapshot check of an ordinary voter’s perceptions. In the next three months, I will add a youthful view to the happenings on the political landscape of the nation with the hope of giving an objective and fresh perspective as the drama unfolds.
Starting with Hikainde Hichilema, below are two fold submissions that can help change his image in their eyes of the urban voter;
Message
I know, as do many people that the UPND stands for better economic management, good health and a sound education system (Obviously). That’s nothing new or special because just about every other political party including the PF stand for the same. So nothing new there and nothing to write home about.
There has been a critical failure by the UPND to propagate their message because their stance on several issues such as Mineral Taxes, Street Vending, taxes, Foreign Policy is interwoven in a detailed and long manifesto, which voters have no time read. No one knows for sure that HH stands for, his message too complicated for the common man.
Even the PF had the same problem until they took the advice to break it down to ‘Lower taxes, better jobs and more money in your pocket’, see? That’s a simple message that everyone is able to catch. More importantly the message is able to resonate with the common man i.e. taxi driver, bus driver, marketer and street vender.
As a Politician, HH needs to be abreast with the heartbeat on the street, know what people want and tell them what they need to hear – its politics.
Therefore my submission to HH’s camp is that they change their message to ‘Vote HH for nshima on the table’ along with a ridiculous promise to bring down the price of meali meal to K20.00 within 30 days of taking office, BOOM!!!
As the adage goes, a ‘hungry person is an angry person’, and to be frank, at the end of the day, every family/household should at least to able to put nshima on the table and the rest will sort itself.
‘Nshima on the table’ becomes the axis of HH’s messaging that answers all the other problems. When your stomach is full, it keeps the doctor away, you will work harder, less corruption, less crime and violence, kids will focus in schools and we will have happy faces – people don’t ask for so much really.
Now you can see how this message coupled with selling his youthful traits ‘Pali Umwachie/Mwanike/Munyamata’ and use of ‘Donchi Kubeba’ in reverse psychology (I don’t think its not patented) would change the tides.
‘Zambia Forward’ to where? Its not working!
Political Constituency
It’s a game of numbers, the PF won the last lections because they increased their numbers in provinces such as Western province, Eastern province and parts of North Western province. This was the game changer because they knew that they always had Lusaka and Copperbelt where MMD always lost to the opposition and of course they had the traditional Luapula and Northern provinces so no worries there.
In my humble view, Eastern (Where RB lost votes when Mpezeni endorsed PF) and Western Province (Where ridiculous promises were made culminating in an unprecedented PF votes from Loziland) were the ‘swing states’. They decided the shift in power because their where no collateral changes in the voting pattern in Luapula, Northern, Lusaka and Copperbelt.
HH now has to work and focus on gaining back all of Mazoka’s votes in Sourthern Province (Find a way of diffusing the Mukombwe factor), Western Province (Evade or minimize the anticipated voter apathy), North Western, Central Province and EASTERN PROVINCE.
To achieve this, HH will have to reshape his shadow cabinet, for starters, Dr. C. Banda, a good man, but a serious political liability who doesn’t bring any numbers to the table. Being a town mouse, he has no grounding and is not seen as a legitimate representative in the eastern province later on one that can swing some votes UPND’s way.
Seeing as a pact with MMD is far fetched, HH will need to surround himself with torchbearers from all the provinces so that they can help him swing things his way or look like he has national appeal. Power is a game of perceptions. If he can get Father Frank Bwalya, Enock Kavindele, Sakwiba Sikota, Peter Magande, Daniel Munkombwe Dora Siliya and get an endorsement from Maureen Mwanawasa, we could be onto something. (Good luck!)
Finally on this chapter, GET RID of or hide from cameras; UNIP era William Banda, he aligns you to old political gimmicks and as such a PR liability.
Cosmetic Changes to the Brand
The following are quick fix cosmetic measures that will make HH a little more appealing;
1. Rebrand, Stop using RED
Red is danger, fire and blood. Change it to something more PR friendly, an appealing color. The color is too harsh and doesn’t help with his image. In fact the red color in the UPND brand enhances all the misconceptions about HH.
2. Put him in a suit
I don’t recall the last we saw HH in a suit, but he quickly needs to get back in one. He has to be seen as presidential and as a statesman and not as a renegade lone political figure without a necktie (Going against the norm)
3. Change of hair cut
A change in hair cut will also go a long way in giving the impression that there is now something different about the man. People need to perceive him as a ‘mature politician’, a new man!
Should HH choose not to wallow in over confidence and listen to other views besides those from people around him and also focus on getting his electoral constituency back, then perhaps he can take advantage of the imminent in-fighting in the PF and become Zambia’s sixth (Or is it seventh) President!
Movement for Multi-Party Democracy (MMD) has said that it will meet on Saturday to chart the way forward on the forthcoming by-election. Commenting on remarks by a faction within the MMD calling itself National Taskforce for the Reconstruction of the MMD and led by Chiwele Maimisa that Nevers Mumba is not an automatic candidate, National Secretary Muhabi Lungu dismissed the allegation as baseless.
Mr Lungu said Mr Maimisa is not in the party structure and it is, therefore, wrong for him to issue statements.
“I have told you 100 times that MMD is an organised institution and I shall not entertain self-appointed chairmen like Maimisa or Bowman Lusambo,” Mr Lungu said.
He, however, said the national executive committee (NEC) will convene a meeting on Saturday to decide the way forward.
Mr Maimisa said that it is not automatic that the party’s president Nevers Mumba will be its presidential candidate in the forthcoming by-election slated for January next year, adding that the MMD is a democratic party and chooses its leaders through a democratic process.
“Dr Nevers Mumba should not deceive himself and think that he is automatically our presidential candidate.
“If we don’t have money our constitution empowers the national executive committee to pick one,” Mr Maimisa said.
Mr Maimisa said Dr Mumba should leave the MMD and organise himself.
VETERAN politician Vernon Mwaanga has urged political parties to put personal ambitions aside and carefully read the mood of the people and put Zambia first as they select their respective candidates.
In a statement issued on Wednesday, Mr Mwaanga urged the parties participating in the elections to conduct peaceful and issue-based campaigns.
“It is my hope and prayer that campaigns and the elections that will follow will be clean, issue-based and peaceful.
“I appeal to all those who will be participating in these elections at whatever level to desist from violence and bear in mind at all times, that Zambia is bigger and greater than anyone of us,” Mr Mwaanga said.
He thanked Zambians for mourning late president Sata in peace, respect and dignity.
Mr Mwaanga said the manner in which the Zambian people mourned President Sata has defined Zambia as a great country.
“I thank the Zambian people from all walks of life and political affiliations, for having mourned President Sata in peace, respect and dignity.
“That is what defines Zambia as a great country. Great nations and people rise above national tragedies. Now we must return to the requirements of our constitutional democracy, to elect a new President within 90 days from October 28, 2014,” Mr Mwaanga said.

“According to him there has been a violation, the constitution has been assaulted. What is happening, the status quo is not supposed to be the status quo,” said Mr. Mubanga.
Mr. Ng’uni alleged that Dr Scott and the cabinet had forced Mr. Lungu to relinquish power “threatening that if that did not happen, Mr. Lungu and other cabinet ministers would be charged with treason”.
“The cabinet meeting that purportedly resolved that the instruments of power be transferred to Dr Scott had no authority to discuss such transfer of power as there was no vacuum of power because the instruments of power were already being held by Mr Lungu,” said Ng’uni in the petition to the High Court.

This is the matter in which a judicial review application has been filed against the decision of cabinet to transfer power from Mr. Lungu to Dr. Scott.
The court order follows a petition by Mr. Ng’uni who has sued Dr. Guy Scott as first respondent, Attorney-General Musa Mwenye and Mr. Lungu as second and third respondents respectively.

Rapheal Nakacinda-Communications Director- Office of the President-MMD
Opposition Movement for Multiparty Director of Communications Raphael Nakacinda has called on people advocating for Rupiah Banda’s come back to remember that “there is posterity after today.”
Reacting to assertions by party Deputy National Secretary Chembe Nyangu that it is not automatic that party President Nevers Mumba is the candidate for the forth coming Presidential elections, Mr. Nakacinda said it was immoral for people to try and use a political argument in solving a (party) constitutional issue just for the sake of immediate personal gratification.
He said the question of Dr. Mumba’s candidature does not arise because there is a constitution in the party which gives him the mandate to represent the MMD as he was not appointed but elected to lead the party.
He observed that there would be confusion if the party had a president and every time there was an election then look for someone else to stand on its ticket.
“In matters of this nature, there is need to read consult and understand the provisions of the party constitution before they opens their mouth.
“Those who are advancing an agenda that there is choosing of a candidate are trying to use a political channel to try and solve a legal issue.
Like we have advised in the past he” continued, those championing RB’s comeback should be aware that there is posterity after to day, there is a future after today. Let’s not abrogate our own constitution conveniently for temporal gratification.”
He further explained that there is no provision in the party constitution that say that party elects some one to stand on its ticket when there is a president.
“There is no provision in the constitution that says when there is a siting president you go through another process to select a person to stand on the party.
“From 1990 Chiluba was elected, that why in MMD we don’t appoint presidents we elect them at a convention that is the provision of the constitution and it says there shell be an election of a president who shell also be the leader of the party,” Mr. Nakacinda explained.
He added: ” it doesn’t suggest in anyway that after the election of the party president then at some point you pick somebody else to become the candidate that is confusion even the writers of the constitution would have been deliberately causing confusion if that was the case.”
Mr. Nakacinda also wondered how a person would go through the ordeal of being elected at a convention, go round the country campaigning only for a few individuals to come and say will have to go through another process to determine who stands on the party ticket.
Mr. Nyangu is quoted in the media saying the party NEC will have to decide a candidate to represent the party in the coming elections.

State railway firm Zambia Railways has disclosed that the two luxury trains it recently acquired from South Africa will be named the Golden Jubilee Michael Chilufya Sata Express Trains.
Zambia Railways Chief Executive Officer Muyenga Atanga told a media briefing that the state of the art passenger coaches from Transnet Engineering of South Africa will be commissioned this Saturday at 10 Hours.
“Taking into account the two major developments that we have just gone through as a nation, i.e the celebration of 50 years of our independence and the untimely death of our President, the late Mr Michael Chilufya Sata under whose dynamic leadership the Zambia Railways was repossessed from the Concessionaire, we found it appropriate to name the new train as the Golden Jubilee Michael Chilufya Sata Express Train,” Prof Atanga said.
He promised that the new trains will bring added value to the Zambian people as the coaches are modern and luxurious.
And Prof Atanga has disclosed that the entire US$ 120 million allocated from the Eurobond has been exhausted completely.
“That money, the popular Eurobond is gone. Completely finished, we have exhausted that money. We used K 41 million? from the same Eurobond to acquire the two trains,” he said.
