THE Legal and Justice Sector Reforms Commission yesterday heard that the five-year ban on Zambia Institute of Advanced Legal Education (ZIALE) students who fail three examinations should be abolished.

George Silonda submitted that the law banning students after attempting three examinations should not be entertained because it was segregative and shattered future dreams for would-be lawyers.

Mr Silonda said ZIALE students already had a qualification from the University of Zambia (UNZA) and that in an event that they failed ZIALE examinations for three times, it did not mean that they were dull but it was clear that the move was meant to avoid saturating the market.

He also proposed that ZIALE should come up with specialised courses because it currently has too many courses, making lawyers not to concentrate and ending up failing because the school has too much work.

“ZIALE should have specified people as lecturers, examiners and people to specifically mark. As it is, it is compromising because the same people are lecturing, setting examinations and marking the same exams,” Mr Silonda said.

The petitioner also submitted that ZIALE should allow more tuition centres to be opened while it remained an examination centre.

DIVISIONS between the United Party for National Development (UPND) and fellow opposition MMD have continued to manifest with the former calling the latter an ‘obsolete party’ headed for extinction.

Copperbelt UPND chairperson Elisha Matambo said MMD leaders should accept the harsh reality that the former ruling party was finished.

Mr Matambo was reacting on MMD leader Nevers Mumba’s attacks on the UPND that it is a region party because of alleged failure by the top leadership to attend the Mutomboko and other ceremonies in Luapula province.

But Mr Matambo described that statement by Dr Mumba as being based on hurt because of continued defection of MMD members to the UPND.

“Dr Mumba is issuing such statements because he is very hurt that 90 per cent of their members have crossed over to the UPND,” Mr Matambo said.

He said contrary to Dr Mumba’s claim that UPND was a regional party, they membership including members of parliament (MPs) and councillors nearly in all provinces namely Central, Western, North-Western, Copperbelt.

“So no one can buy that story by Dr Mumba that UPND is a regional party. We have MPs and councillors in all parts across the country and so those claim by Dr Mumba is sour grapes,” he said.

Mr Matambo advised Dr Mumba to work extra hard in growing the MMD by attracting members as opposed to launching baseless attacks on the UPND.

“He is talking that UPND didn’t attend the Mutomboko Ceremony last weekend when in actual fact we had representation from there and we even presented our gift to the Mwata,” Mr Matambo said.

Visiting Spanish football Coach has described Zambia’s football as slow and passive.

Speaking during a briefing in Lusaka last evening, Isaac Hernandez, of Barcelona Football club said Zambia just like other African countries has slow and passive football.

Hernandez was however quick to mention that Zambian and African football in general will improve with time as he urged them to implore new tactics and develop a culture of training players from their childhood.

He is hopeful that their coming to Zambia, Zimbabwe and Tanzania will contribute in improving the soccer standards.

And his colleague Daniel Alsina said their coming to Africa will enable them share new technics with youths and local coaches.

The sponsor of the African tour, Castle Lager and Zambia Breweries represented by David Minja and Luke Njovu pledged continued support for football in Zambia and hope to see high standards of soccer after the 48 hour coaching clinics by the two FCB Coaches.

Meanwhile, the Football Association of Zambia (FAZ) said it is committed to improving soccer standards especially from the grass root level.

Government keen on seeing more undergo circumcision

Community Development Minister Emerine Kabanshi says government is keen to see many men undergo circumcision to lessen the increasing rate of HIV/AIDS.

Speaking in Lusaka during a Media breakfast, Ms. Kabanshi through her deputy Dorothy Kazunga said the country will be destined for a good healthy citizenry.

And Voluntary Medical Male Circumcision National Coordinator Dr. Albert Kaonga revealed that 17, 000 people are targeted to be circumcised in August 2014.

Dr. Kaonga also called for the private sector to join and support the noble cause.

He aded that over 800, 000 infants have undergone male circuncision since 2007

Movement for Multiparty Democracy MMD Chairperson for Arts and Culture Elizabeth Chitika Mulobeka says the removal of basic education in the country’s school curriculum is disadvantaging the girl child in the country.

Ms. Mulobeka said the MMD brought basic schools to encourage girls attain basic education which was closer to villages before moving to secondary schools which are far and wide apart.

Ms. Mulobeka who is also former Kawambwa Member of Parliament said places such as Luapula province secondary schools are few hence abolishing basic schools without a contingent plan of how to handle the increasing number of pupils going to grade 8 is nothing short of a blunder which needs to be ratified by reinstating primary schools with basic schools statuses.

She noted that girls are not belt like boys who can endure walking long distances and that girls are made to do house errands which boys excluded hence making them walk long distances when they are still little (in grade 8) is another burden which can be avoided by ensuring that basic schools are reinstated.

Meanwhile Chief Puta of Chiengi District has praised the US government for the continued support his chiefdom is receiving in campaign against early marriages in the area.

His Royal Highness said the support the US government through the USAID is rendering has helped many under age girls return to school after being married off by their families.

The Chief said his Chiefdom has been battling early marriages for long time and that the support has helped his community sustain the program.

He emphasized the importance of educating a girl saying the nation will only develop if there is full participation of women at all levels and that; that can only be achieved if more girls were educated.

Muziyo roars into Glasgow Games medal spot

Ben Muziyo boxed his way into the medals bracket in style at the Commonwealth Games in Glasgow on Wednesday night.

The 21-year-old Middleweight boxer qualified to the semifinals in dramatic fashion with a first round technical knockout stoppage over Cedric Olivier of Mauritius.

Zambia’s last man standing in the ring stopped his opponent in the 58th second to record his second successive knockout result of the Games.

The 2010 African Youth Games champion will face Englishman Anthony Fowler on Friday night at 22h15 for a place in the finals.

“At least we have something to smile about,” Zambia national boxing team coach Kennedy Kanyanta said after the fight.

“We are looking forward to meeting the Englishman and see if we can change the medal colour.”

Kanyanta is a Commonwealth Games medal winner himself after picking Flyweight Gold at the 2002 event down in Manchester.

And Muziyo’s feat on Wednesday means Zambia is guaranteed its second medal at the Games.

Both losing semifinalists get Bronze while the winners battle for Silver and Gold.

Zambia’s only medal so far in Glasgow has come in Judo where Boas Munyonga won a Bronze medal in the 81Kg category.

Zambia Sugar workers reject foreign Manager

Some employees at Zambia Sugar PLC in Mazabuka have warned that they will stage a peaceful demonstration should management go ahead with plans to employ a South African national as Factory Manager.

The employees who vowed to demonstrate against the move said Zambia is not short of qualified personnel to take up such a role.

ZANIS in Mazabuka reports that the workers are opposed to plans by the company management to employ a South African national as Factory Manager.

The employees who declined to be named for fear of victimization said they were aware of plans by Zambia Sugar which is a subsidiary of Illovo Sugar Limited of South Africa to replace suspended manager James Mukukwa with a South African national.

The employees revealed that the mood among employees is very low following information filtering through that management at Illovo limited in South Africa have recommended that they send someone to take over the duties of Factory Manager.

They wondered the motive behind employing a foreign national when the country has a lot of skilled and qualified human resource that can effectively oversee the operations of the factory.

“We thought the employment of a first Zambian Managing Director (Aubrey Chibumba) had marked the end of employing foreign nationals into key positions but plans to bring in someone from South Africa is quite disturbing,” lamented an employee.

The employees said there is need for government to quickly intervene and halt such plans if job opportunities are to be created among its citizens majority of whom they said have no decent jobs.

Recently, Management at Zambia Sugar suspended the Factory Manager James Mukukwa indefinitely in the ongoing exercise aimed at ridding the company of suspected corrupt employees.

Sources close to Mr Mukukwa revealed that he had decided to tender in his resignation following his suspension because management as neither charged him with any offence nor reported him to the police.
Four other dismissed employees are currently in court facing corruption charges.

Sources further revealed that both the Anti – Corruption and the forensic experts from Illovo in South Africa have separately intensified their investigations into some practices of corruption involving both senior and junior officials at Zambia Sugar PLC.

The investigations are mainly targeted at employees occupying influential positions in the Sugar company and are linked to fraudulent transactions where they allegedly force contractors to pay them kickbacks in order to be awarded contracts.

Two businessmen plead guilty of selling expired products in Katete district

Two Katete business men have pleaded guilty to offering for selling products without manufacturing and expiry dates contrary to section 6 of the Food and Drugs Act.

This is contrary to the Act’s regulations number 489 (4) (m) of the statutory instrument number 90 of 2001 of the food and drugs Act chapter 303 of the laws of Zambia.

It is alleged that Siraz Esmal aged 48, while trading as Kesons Enterprises on June 27, this year did offer for sale products namely 7150 millilitres cases of glycerine and 95 by 100 millilitres of glycerine without as expiry or manufacturing dates on them as requires by the law.

In another count Esmail is charged with an offence of offering for sale expired products contrary to section 3 (b) and 6 of the Food and Drugs Act chapter 31 (2) of the Food and Drugs Act cap 303 of the laws of Zambia.

It is believed that the businessman while trading as Kesons Enterprises on June 27 this year did sale or store products namely 2×100 grams of lifebuoy soap tablets which had expired in contravention with the laws of Zambia.

However in the third Count he pleaded not guilty to obstructing or impeding or preventing or attempting to prevent the execution by an authorized officer of his duties contrary to section 24 (4) of the food and drugs Act cap 303 of the laws of Zambia as read with section 31 (2).

Particulars of the offence are that on June 27 this year, Kessons enterprise did obstruct or impede or prevent or attempt to prevent Tresford Mwansa an authorized officer from executing his duties in contravention with the law.

And Beza Phiri of Blue Moon Investment pleaded guilty to offering for sale products with no manufacturing and expiry dates contrary to section 6 of the Food and Drugs Act as read with regulations number 489 (4) (m) of the statutory instrument number 90 of 2001 of the food and drugs Act chapter 303 of the laws of Zambia.

It is alleged that Mr. Phiri while trading under Blue Moon Investment in Katete on July 23, 2014 did offer for sale namely 2× 100 millilitres of Clere body lotion without expiry or manufacturing date on them contrary to the laws of Zambia.

Further it is believed that on the same date Mr. Phiri did offer for sale expired products contrary to section 3 (b) and 6 of the Food and Drugs Act chapter 31 (2) of the Food and Drugs Act cap 303 of the laws of Zambia.

Particulars of the offence are that Phiri while trading as Blue Moon Investments did sell or store products namely fourty five by two liters of Yummy drinks, five by five hundred grams of Blue Band Butter and one by two hundred and fifty grams of baked beans.

Other goods included one by three hundred and seventy five grams of steers salad dresser, six by four hundred and fifty milligrams of down lotion, two by three hundred fifty grams of tomato paste, one by one liters of fruit cocktail drink and one by five hundred millilitres of true lemon juice which had expired in contravention with the laws of Zambia.

Meanwhile Esau Mwale of Mphewa Pharmacy has pleaded not guilty to offering for sale products with no manufacturing and expiry dates contrary to section 6 of the Food and Drugs Act as read with regulations number 489 (4) (m) of the statutory instrument number 90 of 2001 of the food and drugs Act chapter 303 of the laws of Zambia.

It is alleged that on July 23, 2014 Mwale while trading as Mphewa Pharmacy did offer for sale products namely 10×250 grams f supper family powder without expiry or manufacturing date on them as required by the law.

Magistrate Mary Musongole has August 12 as date for the reading of facts in respect of Phiri and Esmail respectively while trial is for Mphewa Pharmacy is set to begin on August 18.

However the duo despite accepting the charge told court that had ordered the respective goods in the manner they were found in by inspectors from the manufacturers alleging that they were not aware of the errors.

Police abuse complaints dominate Reform Commission sittings in Lusaka

Complaints against police mal-practices and human rights abuse have characterized the ongoing Legal and Justice Sector Reform Commission ( LJSRC ) sittings in various Lusaka townships.

In all the four locations where the Commission has so far held its sittings, complaints against police conduct, abuse of authority, corruption and ignorance of the law by police are common during the sessions, respectively.

Police officers and judicial officers especially judges and prosecutors have in most instances been reported to be the most corrupt in the justice system.

On the other had the Drug Enforcement Commission, Anti-Corruption Commission (ACC) and the Zambia Prison Service officers have been accused of being perpetrators of human rights abuse and mistreating suspects.

The Commission has so far conducted sittings at Lusaka’s Civic Centre, Chawama, Garden and Chilenje townships aimed at collecting views of the general public on how it wants the legal and justice sector to be reformed.

In all the townships, members of the public have complained of police corruption, intimidation and arrests of ‘ innocent’ people on flimsy charges without proper investigations which lead to courts failing to prosecute such cases for lack of evidence.

The conduct of officers in law enforcement agencies and the courts have attracted calls by the public to introduce cameras in these institutions to monitor their operations so that they do not abuse their authorities and officers when dealing with the accused.

Mr. Tomson Tembo, a retired Police Officer who was trained in 1975 has observed that corruption and ignorance in the application of the law by police of nowadays has reached alarming levels in Zambia.

Mr. Tembo stated that police officers deliberately misapply laws and violate people’s human rights without being questioned by anyone.

He has recommended to the commission that government should consider revising the training Programme for police officers especially in the area of criminal investigations saying the police currently rush to arrest suspects without conclusively investigating the matter for the cases to be tried in courts.

He revealed that even the police bond has been abused by police officers who use it as a fundraising venture as they request people who have been charged and ready to proceed to go to court to report back to the police once they are released on bond which he said should
not be the case.

He also noted that failure by police to investigate homicide cases has led to councils burying huge numbers of unclaimed bodies who could be claimed by relatives if the police had trained investigators.

The commission which is conducting public sittings in Lusaka district is remaining with Kabwata and Matero before it moves to Luangwa district in Lusaka Province.

Zambian Voice adamant about meeting Sata

The Zambian Voice has remained adamant on seeking an appointment to meet President Michael Sata at State House despite his recent appearances on television and still pictures.

Executive Director Chilufya Tayali says the idea is not to prove that President Sata is well and working as the government puts it, but that his organization wants to set a precedent that all public offices can be accessible to the general public.

Mr. Tayali says his organization wants to send a message to Zambians that State House is like any other public office that should be accessed by members of the public.

He has told Qfm news in an interview that his organization will extend such visits to other public offices such as government Ministries especially when there is a concern that specifically concerns a particular public office.

Mr Tayali says his organization wants to have a good and cordial discussion with the Head of State and does not want to give an impression that it intends to meet the President for an acrimonious confrontation.

Youths who failed to pay back loans will be arrested-Kambwili

Youth and Sport Minister Chishimba Kambwili says members of the seventeen youth groups in Eastern province that have failed to pay back loans amounting to K331, 000 from the Youth Development Fund will be arrested.

Mr. Kambwili has told Qfm in an interview that similar action will be taken against any youth group in the country that fails to pay back the loans.

He says government will use the 17 youth groups as an example in order to send a warning to other defaulting youth groups.

Mr Kambwili adds that government will put stiff measures in place to ensure that only youth groups that qualify access the funds to avoid cases of default.

He further states that he has directed officers in his ministry to compile a list of those that have not paid back the loans country wide so that necessary action can be taken against them.

Mr. Kambwili says youths accessing funds under the youth development fund should realize that there are other youths willing and waiting to access the funds and government will not tolerate any misuse of the funds by those who access the funds.

He notes that failure to pay back is a major setback to the country’s economic growth, stating that youths who access the funds are expected to contribute to job creation, reduction in high levels of poverty as well as contributing to the economic growth of the country.

And Mr Kambwili has implored the people of Kaoma district to reject politics of tribalism.

Drumming up support for PF candidate, Rodgers Lingweshi yesterday at Kazabami Village in Mangango Constituency, Mr Kambwili appealed to the electorates of Mangango to embrace one another.

Mr Kambwili, who is also Youth and Sport Minister, castigated the opposition UPND leadership for describing the ruling party candidate, Mr Lingweshi, as a ‘poor man’ because it is poor people that ushered in and voted for the PF Government into power in 2011.

The minster warned the voters to be careful because some leaders may be rich through practicing Satanism.

Mr Kambwili urged the people of Mangango Constituency to support the PF government if they are to see meaningful development.

Meanwhile, PF campaign member, Bonnie Tembo, in a telephone interview advised the UPND candidate, Godwin Putu, against talking ill of President Michael Sata.

Mr Tembo appealed to Mangango electorates to invest their votes in PF and not to worst their ballots on voting for the opposition candidates who are of ‘no-match’ Mr Lingweshi.

The people of Mangango will cast their ballot box on August, 19, 2014.

Vice President Guy Scott has said that Republican President Michael Chilufya Sata is well and enjoying good Health.

Dr. Scott was reacting to concerns raised by Senior Chief Amukena the second of the Lozi speaking people of Kaoma District in Western Province following continued speculations that the Head of State is unwell.

Dr. Scott said people should not pay attention to what he termed as fabricated stories from malicious people.

He told Chief Amukena that government has so many priorities aimed at developing the Nation.

Dr Scott said that while the PF government has only been in government for two and half years, it has made tremendous strides as evident from the many developmental projects being worked on across the Country.

He further stated that the PF government wants to ensure that it talks Less, but instead concentrate on taking development as closer as possible to the people.

Speaking earlier,Senior Chief Amukena the second commended government for the two major developmental projects in the district which have benefited the Royal establishment.

He cited the completion of the communication tower by the Information and Communication Technology Authority (ZICTA) for having made tremendous improvement to Communication system in the area, which has enabled people to access internet and all mobile phone networks.

Meanwhile, Chief Mwene-Mutondo of the Nkoya speaking people in Kaoma District said that despite having a few challenges in his Chiefdom, his Royal Establishment will continue to support the Patriotic Front government.

He said his desire is to see the PF win the Mangango parliamentary by-election.

And PF Mangango Parliamentary candidate Rodgers Lyambai Lingoshe has appealed to the people of Kaoma to help him win the seat so that all the challenges they are facing can be addressed.

Mr. Lingoshe was speaking this afternoon at Mutondo Primary School in when the Vice President addressed a rally to drum up support for him ahead of the Mangango by-election slated for 19th August, 2014.

ZAF fires Arrows chairman

The Zambia Air Force (ZAF) has fired Red Arrows chairman Kathavia Banda.

ZAF Public Relations Director Mwaka Simasiku said in a statement on Wednesday that Banda has been replaced with Nolasco Chilando.

Struggling Arrows have lost their last seven FAZ Super League matches in a row.

“ZAF wish to inform the general public that Col Nolasco Chilando has been appointed as Chairman of the Red Arrows Football Club to replace Lt Col Kathavia Banda,” Simusaki stated.

Arrows are 12th on the Super League table with 17 points after 17 matches played and in their last match they lost 3-1 to Kabwe Warriors at home.

After this loss, some Arrows supporters protested against Banda and called for his removal from the club.

“Command is grateful to Lt Col Banda for his immense contribution to the running of the club during his tenure of office and congratulates the new Chairman on his appointment.”

Simasiku added:”ZAF also wish to thank all Arrows supporters for their unwavering support to the club.”

Glasgow Wrap: Zambia banking on Muziyo

Boxer Ben Muziyo holds Zambia’s dwindling medal hopes today when he returns the ring for a third time at the Commonwealth Games in Glasgow.

This follows Saviour Kombe failure to qualify the 400 meters mens finals after losing in Tuesdays semifinal heats in Glasgow.

Kombe finished seventh in the third semifinal heat as Zambia’s medal hopes continued to fade at the ongoing Commonwealth Games that end on August 3.

The scenario was the same on the courts where Chongo Mulenga and Ngosa Chonga were eliminated from the Badminton doubles on Tuesday.

Chongo was also eliminated from the mens singles on Wednesday while Mulenga tumbled from the same event on Tuesday.

And so Middleweight Muziyo who is Zambia lone boxer out of five still standing enters the ring at 22h15 to fight Cedric Olivier of Mauritius in a quarterfinal bout.

Meanwhile, Zambia’s final hope for medals will come in the 400X 4 meters mens relay when the heats start on August 1.

Zambia has one just one medal from eight events entered.

The only medal so far has come in Judo where Boas Munyonga won a Bronze medal in the 81Kg category.

SuperSport praises Zambia League

SuperSport says the FAZ Super League is improving.

Company Marketing Manager for Southern Africa Marlon Kananda said in the last three years SuperSport has noted an improvement in the administration of the league.

Kananda said the growth of the Zambian league has led to clubs attracting sponsors.

“In the last 3 years we’ve seen a lot of improvements in the administration of the MTN Zambian Super League, the league is growing and all the different stakeholders are on hand to play their part, the fans, the players, the administrators and the sponsors are all there to make our beautiful game live up to its expectation.”

Kananda, however, noted that the Super League was facing challenges such as infrastructure saying some stadia in the local league do not meet broadcasting standards.

“We have had our own challenges and it includes infrastructure, most stadiums are not meeting our broadcasting standards and we need to see an improvement in this area, this will enable us cover as many teams
at the teams home grounds,” he said.

Kananda added:”Our target for this year is to broadcast a minimum of 50 local games and also cover the Barclays Cup.”
