MISA welcomes govt move to table Access To Information Bill at Cabinet

Media Institute of Southern Africa (MISA) Zambia has welcomed governments announcement of its intentions to table the Access To Information (ATI) Bill before Cabinet as part of its implementation plan.

MISA Zambia chairperson, Nalumino Nalumino, told ZANIS in a press statement in Lusaka yesterday that for the past 11 years the process to enact the ATI Bill has been a back-and-forth process.

Mr Nalumino also noted that in 2012, government postponed several steps that would have resulted into the enactment of the bill.

He said MISA Zambia welcomes President Sata’s move to make the pronouncement, adding that this decision has been long awaited with abated breath for over 11 years.

Mr Nalumino stated that the Access to Information Bill has been on Zambians agenda since 2001 but that no meaningful movement has been recorded to bring the long walk to a logical conclusion.

Recently, Vice President Guy Scott, during the Public Service Day celebrations in Lusaka, announced government’s intentions to table the Access to Information bill in Cabinet.

The Access to Information Bill has for a long time been a hot issue in Zambia with media and civil society organizations pressing for the enactment of the bill as legislation.

THE Lusaka High Court has upheld the five year jail sentences slapped on former Finance Minister Katele Kalumba and three others saying their activities were tinted with corrupt practices.

Judge Evans Hamaundu sitting with High Court Judge-in-Charge Jane Kabuka said the subordinate court could not be faulted for slapping a custodial sentence against the four because they were guilty of the offences.

Katele, former directors of the defunct Access Financial Services Limited (AFSL) Faustin Kabwe and Aaron Chungu and former Finance Permanent Secretary Stella Chibanda had appealed against the five-year jail sentence on grounds that the lower court had erred both in law and facts when it found them guilty of the offences.

They were jointly charged with several abuse of office and corrupt related charges but facing different counts.

In a more than five hour majority judgment prepared together with Judge Nigel Mutuna, Mr Justice Hamaundu said suspending, reducing or acquitting the quartet as they had contended in their grounds of appeal would be sending a wrong message to would be offenders.

“The appeal conviction against the first appellant is dismissed, the appeal conviction against the fifth appellant is dismissed, the appeal conviction against the sixth appellant is dismissed and also the appeal conviction against the seventh appellant is also dismissed, “Mr Justice Hamaundu said.

He said the corruption prevalence in Zambia was on the increase and as such the reason for slapping a custodian sentence was to discourage would be offenders or to stop the accused persons from committing similar offences.

He said in a packed courtroom that the lower court could not be faulted in its findings because the punishment fitted the offences that the appellants had committed.

Mr Justice Hamaundu said that it would not be in public interest to issue the four with a suspended sentence because it would send a wrong signal to would be offenders.

He said the lower court was on firm ground when it convicted Katele, Chungu, Kabwe and Chibanda of the charges.

Judge Hamaundu has meanwhile granted Katele, Chungu, Kabwe and Chibanda permission to appeal against his decision to dismiss their appeal against their five years convictions.

Immediately after judgment was delivered, one of the defence lawyers Vincent Malambo informed the court that the four appellants were making an application to appeal to the Supreme Court against the judgment based on the provisions of section 14 (1) of the Supreme Act.

Mr Malambo said Katele, Chungu, Kabwe and Chibanda had no intentions to be engaging in the court walk about business but had strong issues that they want to be addressed by the highest court of the land.

But before Mr Malambo could go in detail divulging the issues, Mr Justice Hamaundu informed him that the court was not inclined to refusing the application to appeal to the Supreme Court against yesterday’s judgment.

Kitwe DC-Lets Clean-up City for Cosafa Cup

District Commisioner Elias Kamanga has called for sanity to prevail in Kitwe as the city hosts selected COSAFA Cup matches next month.

Kitwe will host majority of the COSAFA Cup matches including Zambia’s opener-a quarterfinal clash against Mozambique at Nkana Stadium on 14 July.

In an interview, Kamanga, the chairman of the COSAFA Cup organising committee in Kitwe, implored residents to keep the city clean ahead of the regional tournament that runs from July 6-20.

Arthur Davies Stadium is the other match venue in Kitwe.

“We must cherish this opportunity and position ourselves for these matches,” he said.

“I want to appeal to our people to exercise highest levels of cleanliness. To the business community lets clean our surroundings and buildings, motorists should park in designated areas,” Kamanga added.

Lusaka and Ndola are the other host cities.

Minister of Transports, Works, Supply and Communications, Yamfwa Mukanga, has said that the engagement and retirement of former Zambia Railways Limited Chief Excutive Officer Clive Chirwa was done in a transparent and mature manner.

In a Ministerial statement to Parliament this afternoon, Mr. Mukanga noted that Prof. Chirwa did not recognize the authority of the board in that he disobeyed most of the instructions given to him.

The Minister added that the board served him with several warning letters and reminded him of his duties under the contract.

He said the Ministry and the Board should guide the management on Government’s expectation of their roles in corporate governance but Mr Chirwa never took the advice.

Mr. Mukanga said that it was for this reason that government decided to take action against the former ZRL managing Director for his misconduct.

He said Government after investigations decided to retire Prof Chirwa in public interest. The minister also said results of investigations into the matter had been taken to the Director of Public Prosecutions for his action

And Mr. Mukanga has explained that his Ministry dissolved the ZRL board in order start afresh in terms of the leadership of company.

The Technical Committee drafting the republican constitution have refuted the comments attributed to Justice Minister Wynter Kabimba that they did not write to him about the one month extension.

Speaking at a media briefing today , the committee spokesperson Ernest Mwansa said that the committee duly responded to the request by the Minister and communicated to the Minister on June 12, 2013

“The Technical Committee wishes to clarify media statements attributed to the Minister of Justice, Wynter Kabimba, which seems to suggest that The Committee has neglected to submit a revised programme of work covering the proposed one month extension.

We want to put it on record that as a Committee, we duly responded to the request made by the Minister of Justice for us to condense the remaining activities in a programme of work which terminates on July,31, 2013,” Mr Mwansa said.

He said the Committee had tailored a revised programme of work following internal consultations and this had been communicated to Mr Kabimba as of June 12, 2013.

Yesterday government said that it had not yet received a letter from the technical committee on drafting the Constitution requesting for a one month extension.

“I have just been hearing about this one month request. I have not yet received this request myself.

“The government’s position is that it will only respond to this matter upon seeing this request and of course with full consultation from the Ministry of Finance,” Mr Kabimba said.

TREASURY BRIEF ON JANUARY TO MAY BUDGET PERFORMANCE

Lusaka, Tuesday, 25th June, 2013. The Government has raised KR10 billion in terms of tax, non-tax, and grant revenue for the period January to May 2013, while expenditure for the same period totaled KR12.8 billion.

Speaking on issuance of the latest treasury information brief, Secretary to the Treasury Fredson Yamba said the difference between revenue and expenditure was bridged by domestic borrowing through Government bonds and treasury bills, within the levels approved by Parliament for the 2013 budget.

“This outturn, against an approved budget of KR32.2 billion, represented an execution rate of 41.5 percent by end May 2013,” he said.

Of the releases made over the period, 42 percent went toward facilitating statutory and contractual obligations such as debt service and the payment of salaries and wages in order to facilitate service delivery. The balance of the releases, or 58.5 percent, enabled the provision of goods and services through the various Government departments. These included KR257 billion which went toward payments to retirees under the Public Service Pension Fund, KR1.6 billion for the construction and rehabilitation of road and rail infrastructure, KR365.8 billion for electricity distribution and KR106 billion for the facilitation of affordable credit to Small and Medium Enterprises (SME’s).

Mr. Yamba has said the performance of the 2013 budget has been impressive, dispelling rumours that it has degenerated into an over-run.

“From January to May 2013, Government only spent KR12.8 billion from the KR32.2 billion budget of which, first quarter [January to March] expenditure amounted to KR8.1 billion and in the last two months, an additional KR4.75 billion has been spent, how then can there be an over-run,” wondered Mr. Yamba.

He also stated that Government expected to raise KR2.55 billion from taxes and non-taxes in April 2013 but receipts amounted to K2.61 billion due to higher collections from Pay As You Earn (PAYE) and trade taxes. Revenues and grants collected in May amounted to KR2.1 billion and were above the projected target by KR131 million.

Mr. Yamba noted that the treasury faced timing challenges in terms of revenue inflows and expenditure demands towards the end of the first quarter and the beginning of the current quarter, particularly in facilitating the UNWTO activities and the funding requirements for the Farmer Input Support Programme.

The Government projected to spend K2.63 billion to facilitate various programmes and activities approved in the 2013 budget, but as at end April, a total of K2.8 billion was funded, representing 7.3 Percent above target. The higher than programmed releases in April were occasioned by expenditure pressures, particularly for oil procurement. Under constitutional and statutory expenditure, K847.2 million was spent on payment of salaries, wages and emoluments for constitutional office holders in April, 2013. K120.3 million was spent on domestic debt service related to Government bonds and Treasury Bills, while K100.9 million went towards external debt.

K1.75 billion was spent on operations and programmes in Ministries, Provinces and other Spending Agencies (MPSA’s) of which K51.4 million was allocated to pensions. Other notable expenditure in April included K164.20 million for road construction and maintenance, K48 million for the Constituency Development Fund (CDF), K18 million for compensation and awards, and K6 million for drafting of the Zambian Constitution. Incidentally, the K20 million budgeted in 2013 for drafting the constitution has been exhausted.

The Treasury also facilitated several unbudgeted for activities during the month of April 2013. These include K652.56 million to facilitate payments for fuel procurement, K85.44 million for the UNWTO capital projects and K26.3 million for seed suppliers arising from the re-planting exercise necessitated by the army worm attack in December 2012, and K6.24 million to cater for the shortfall for ZAWA.

The Secretary to the Treasury has said the domestic revenues in May 2013 collected were above the programmed figure of KR1.89 billion by KR149 million or 7.7 Percent.

“Of these collections, tax revenue amounted to KR1.96 billion while non-tax revenue was KR131.5 million respectively. Receipts from Cooperating Partners coming through the Treasury amounted to KR95 million,” he said.

Government projected a total of KR1.87 billion to be collected as tax revenue during the month of May, 2013 but the collections were above target by 4.8 Percent. This was mainly due to good performance under trade taxes, corporate income tax and excise duties. Total income collections came to KR709.4 million, slightly below target by about 0.2 Percent due to under collection on PAYE. Trade taxes where above target by 27 Percent and excise duties were above target by 13 Percent.
At KR131.5 million, non-tax revenue collections for the month of May were above the target of KR71.2 million by KR59.5 million or 84%. Only KR1.95 billion was released representing 19.9 Percent below the projected figure of KR2.43 billion. The lower than programmed expenditure was consistent with the revenue levels.

Under constitutional and statutory expenditure, a total of KR838.9 million was spent on payment of salaries and wages including other salary related emoluments for public service workers as well as emoluments for constitutional office holders. In terms of debt service payments, KR111.16 million was spent on domestic debt, that is, Government bonds and Treasury Bills. No releases were made towards external debt as there was no requirement to do so.

Releases for operation and development programmes coordinated by Ministries, Provinces and other Spending Agencies amounted to KR998.9 million. KR330.9 million was spent on transfers to Grant Aided Institutions such as the Zambia Revenue Authority, Road Agencies and Universities.

“In particular, it should be noted that approximately 60 percent of the funds in the 2013 budget have been allocated to public service delivery especially in the areas of health, water and sanitation and education; the facilitation of service delivery at local government level; enhancement of productivity in the agriculture, tourism and manufacturing sectors; and provision of essential infrastructure such as roads and energy in order support growth in the focus areas,” he said.

“I reiterate the Presidents guidance to continue focusing our budget execution on facilitating accelerated and sustained economic growth that translates into tangible realities for our people such as generation of sufficient and stable jobs, a redistribution of income and opportunities in favour of the poor, access to basic services and a general improvement in the standards of living,” said Mr. Yamba.

In implementing the budget, the Government has remained focused at ensuring that the overall objectives of the budget are maintained. This, it should be appreciated, is in the best interest of both the people, who are the key stakeholders, and the Government, whose existence is for the overall benefit of the people.

“For the month of June, a total of KR2.56 billion is expected to be collected in revenues and grants while expenditure is estimated at KR2.41 billion. Key expenditure items for the month will include releases towards UNWTO activities, Farmer Input Support Programme, Procurement of Strategic Food Reserves and the Pensions Fund,” disclosed the Secretary to the Treasury.

In terms of outlook, the Government projects to remain on course with the execution of the 2013 budget as collections have been projected to over perform by end of year. The projected higher collections, in addition, to the funds set aside under the contingency vote, are expected to cover, among other requirements, the higher wage adjustment for public service workers.

Mr. Yamba also pledged that in order to guarantee the execution of programmes and activities, the Treasury will implement the Presidents directive of ensuring that programme implementation reports are submitted by Ministries, Provinces and other Spending Agencies (MPSA’s) prior to receiving subsequent funding.

Complimentary to the foregoing, the Ministry will intensify the issuance of treasury information briefs in order to assist the public in monitoring and evaluating the implementation of the budget in a pragmatic manner.

Mailoni brothers killed

The three notorious Mailoni brothers have been killed.

The three serial killers have been responsible for a number of murders around the Luano Valley of Central Province and were on the run for a number of years.They were gunned down yesterday around 15 Hours by a team of Zambia Army Commados.

Central Province Police Chief Standwell Lungu confirmed that the three brothers were killed after an operation in the Luano valley.

“Yes I can confirm that the Mailoni brothers are no more. We have positively identified the bodies, they are in Kabwe General Mortuary. I’m just leaving the mortuary now as we are speaking, Commissioner Lungu said.

Kalume not excited ahead of Zesco reunion

Nkana captain Sydney Kalume says he has nothing to prove as the FAZ Super Division leaders face his old club Zesco United in the top of the table clash in Ndola this Saturday.

Kalume joined Nkana from Zesco last season.

The ex-Zanaco and Lusaka Dynamos midfielder said he has no grudge against second placed Zesco, who are two points behind his team.

Nkana have 29 points after a round of 12 matches.

“I am not going there to revenge. They (Zesco) know that I play good football,” Kalume said.

“I am going to play like I want to win not to be seen by people,” he stated.

Kalume added that Nkana will travel to Ndola with the aim of beating the Tenant Chembo-coached side

“We are not going to drop points as at now, we want to go to Zesco to beat them.”

A young boy learns that he has extraordinary powers and is not of this Earth. As a young man, he journeys to discover where he came from and what he was sent here to do. But the hero in him must emerge if he is to save the world from annihilation and become the symbol of hope for all mankind.

One of the main reasons that made me believe this would be a great movie even before watching it ,is the inclusion of Christopher Nolan as a producer of the movie . He is the man behind the mega smash Batman movie “Dark Knight”.

The plot of the movie may be simple and straight forward ,but that is what makes it work .Excellent story telling that gets you hooked from beginning to end . The action sequences are mind blowing .

“Man of Steel” not only does Superman justice, it’s a strong ground zero for an entire trilogy and most importantly a unique vision.

Police in Lusaka have pledged to observe professionalism in the investigations into the case of Bigamy involving the marriage of Lizzy Machina who is the officer commanding for Mazabuka Police to Mr Golden Phiri.

Police Deputy Public Relations Officer, Charity Munganga Chanda, said the fact that Mr Phiri is married to a senior police officer does not warrant special treatment and that the case will not die a natural death.

In a statement made available to ZANIS today, Ms. Mungnaga Chanda said the matter is receiving utmost attention and is being handled by experienced investigators who are looking at all angles critically as opposed to the impressions created in certain media circles.

She said the fate of the case will depend on the outcome of the investigations which are being carried out and further wished to correct the wrong impression that has been created in certain sections of the media.

She said the Zambia police instituted investigations into the case the day Emma Chima, who is the alleged legal wife of Mr Phiri, reported the case to Lusaka Central Victim Support Unit (VSU).

She stated that the offense which is being currently investigated is that of Bigamy contrary to Section 166 Chapter 7 of the Laws of Zambia.

Last week, the media carried a story in which Lizzy Machina who is the officer commanding for Mazabuka Police, was allegedly involved in a marriage scandal involving a Lusaka businessman, Golden Phiri, who is believed to be the legal husband of Emma Chima of Lusaka.

Government gives Choma council two weeks to get rid of of stray dogs

Government has given a two weeks ultimatum to the Choma Municipal Council to get rid of the huge population of stray dogs which have become a menace to the residents.

Choma District Commissioner Golden Nyambe says the local authority must work with the veterinary department and the Zambia Police Service in controlling the worrisome population of stray dogs that are posing a serious danger to the lives of the people in the area.

Mr Nyambe said he expects the council to implement this directive within two weeks.

He said residents in the district have lodged formal complaints to the council regarding the swelled number of stay dogs that were biting residents and exposing them to the danger of contracting rabies.

The District Commissioner said the council has not responded to the residents’ appeals thereby endangering their lives.

Mr Nyambe said it is for this reason that the council is now being directed to take immediate action to eliminate stray dogs in order to protect human life.

He said he expects government institutions to be proactive in handling matters that border on the lives of the people.

And speaking on behalf of the resident of Munzuma site and service, Teddy Musokwe said a number of people have suffered dog bites with some being hospitalized after fierce encounters with marauding dogs.

Mr Musokwe said residents are now living in fear of dog attacks and possible exposure to rabies because the council and other government institutions have not been proactive in dealing with the matter.

Opposition MMD leader Nevers Mumba has charged that the ruling PF is a blood thirsty party that thrives on spilt blood.

Dr Mumba said he has never seen a government that is so thirsty for blood like the PF in its two years of running government.

“This government only thrives when people die mysteriously. The PF government has allowed the senseless loss of lives across Zambia. The Commander in Chief, President Sata himself has allowed his troops to kill people at will and he has never issued any statement condemning such actions. He never went to Kampasa to mourn with the families of the deceased,” Dr Mumba said.

The MMD leader was speaking Tuesday morning when he featured on a special live radio programme on Q FM.

He urged Zambians to be more prayerful and the country approaches four more bye elections on July 25 2013.

“We need to ask God to protect our lives from these despicable attacks from the forces of darkness. We should not become sacrifices for this government. Each bye election we have in this country is preceded with people dying in mysterious circumstances. Only prayer can protect this nation and I call upon the Christian community to intensify their prayers during this period of bye elections.”

Dr Mumba called for dialogue between the state and its citizens in resolving contentious issues.

“On the Kampasa killings, the two lives lost were not supposed to be lost in the first place. Dialogue could have prevented all that killing. I remember when I was Vice President, I dealt with that issue and I encouraged dialogue between all the parties involved. You cannot just wake up one day and start shooting at people who have settled on that piece of land for over 30 years,” he said.

And Dr. Mumba said the well-oiled project to destalise the MMD has flopped.

“This government embarked on a huge project to kill the MMD. President Sata personally funded this project to the tune of K1 billion and he allocated K400 million to bogus NGOs that went round to community radio stations to disparage the MMD but that project has flopped.”

“As the MMD we are rebranding and we are getting rid of bad elements in the party and we will come out stronger than before.”

Acting Chief Justice Chibesakunda accepts Judge Musonda’s resignation

Acting Chief Justice Lombe Chibesakunda has accepted the resignation of Judge Philip Musonda raising questions whether the Judge is entitled to his life terminal benefits following his resignation.

Judge Musonda is among three judges being probed for alleged professional misconduct.

It is not clear whether or not the Tribunal would go ahead and hear the allegations against Dr Musonda despite his resignation.Unconfirmed reports indicate that President Michael Sata has also acknowledged Judge Musonda’s resignation.

Under the constitution, retired judges are entitled to 80 per cent terminal benefits of the incumbent Judges for life but does not provide for judges who resign their positions.

Attorney General Mumba Malila when asked on the way forward in view of the acting Chief Justice’s acceptance of the resignation referred all queries to the Tribunal secretary Chipili Magayane who refused to comment.

According to a letter to Dr Musonda dated June 19, 2013, Ms Justice Chibesakunda said she acknowledged receipt of letter dated June 18, 2013 concerning Judge Musonda’s resignation from office of judge of the Supreme Court.

She said the bench would ‘deeply’ miss Dr Musonda’s well-researched contribution and support.

“On behalf of the entire judiciary and on my own behalf, I wish you God’s blessings in your future endeavours,” Ms Justice Chibesakunda said.
Judge Musonda had written to President Sata and the acting Chief Justice informing them about his resignation as Supreme Court judge.

He later said his resignation had completely curtailed the Tribunal’s authority to proceed hearing his alleged professional misconduct.

But Tribunal chairperson, who is Malawian High Court Judge Lovemore Chikopa, set June 28, 2013 as the date for the official commencement of the hearing against Judge Musonda.

Mr Sata in May last year suspended Judge Musonda and two High Court judges Nigel Mutuna and Charles Kajimanga and set up a Tribunal to probe their alleged professional misconduct.
Judges Mutuna and Kajimanga have, in their latest legal battle, been granted leave to commence judicial review challenging the legality of the Tribunal.
