Human resource managers urged to enforce labour laws

Labour and Social Security Minister Fackson Shamenda has challenged Human resources practitioners in the country to play a pivotal role in ensuring that the amended labour laws are effectively enforced in their work places.

In a speech read on his behalf by Labour Deputy Minister Rayford Mbulu during the official opening of the Zambia Institute of Human Resource (ZIHRM) meeting held at Chrismar Hotel in Livingstone yesterday, Mr Shamenda said the human resources practitioners in the country should play an advisory role to their management to ensure that the country’s labour laws are adhered to.

Mr Shamenda observed that while government has successfully reviewed a number of statutory instruments related to labour such as the revision of the minimum wage as promised in its manifesto, the labour market in Zambia still faced a number of challenges such as poor working culture, poor conditions of service, non-compliance to labour laws among others.

The Labour minister said government expects all human resources’ practitioners in the country never to disregard labour laws but to appreciate and correctly interpret the labour laws and advise their employers accordingly.

“While the majority of employers in the country are now complying with the revised minimum wages, my ministry is disturbed by reports of some few employers who are not paying according to the statutory instruments,” said Mr Shamenda.

“ And this is where we expect the Human resources personnel to appreciate and interpret labour laws to employers to create interface between management and workers to facilitate social dialogue in order to promote harmonious industrial relations,” Mr Shamenda said.

The minister further urged the human resources personnel to assert themselves and point out wrong things at the places of work whether by their management or their workers.

“Let us not have rubber stamps human resources personnel who merely carry out instruction as directed even if such instructions are wrong and will disadvantage Zambia workers, but let us have human resource personnel who stand their ground and call a spade a spade even at the expense of losing employment,” said Mr Shamenda.

Mr Shamenda urged ZHRM to put in place mechanism to enforce the provision of the revised labour Act adding that for its part, government we will work closely with the institute to review the ZIRM
Act to strengthen the enforcement mechanism.

He also said the ZIHRM act no. 11 of 1997 was very critical in the development of the country and particularly in the improvement of productivity in all organizations in the country.

He said government would like to see that the productivity levels of Zambian workers are enhanced to match what was obtaining in other countries adding that ZHRM plays an important role in the training and development of human resources expected to meet the demands of business in the 21st Century.

“My government would like to see that the productivity level of Zambians are enhanced to match what is obtaining in other countries and as human resource personnel you must spearhead this objective through initiatives such as training and performance appraisals,” Mr Shamenda said.

He also said government banned non-Zambians from performing duties of human resources with the understanding that not only does the country have enough trained human resource personnel but also that human resource duties are better understood by Zambians who have an in-depth understanding of the local people and their cultural practices.

And ZHRM President Winner Kanyembo said the institute was facing a number of financial challenges to effectively carry out its operations such as conducting training workshops for human resources practitioners.

He explained that the institute had limited capacity to carry out inspections for compliance with the labour laws but added that the revision of the ZHRM act will help in enforcing compliance among
defaulters.

Mr Kanyembo also said ZHRM has embarked on a recruitment drive to ensure that all government human resources personnel were registered with institution as directed by the ministry of labour.

Mr Kanyembo further said the institute which currently has a total of 2,332 registered members will continue working with government to improve the labour market in the country.

Step mother jailed for pulling son’s manhood

A 33 year old woman has been sentenced to five years simple imprisonment after she pleaded guilty for one count of assault occasioning actual bodily harm contrary to the laws of Zambia.

Appearing before Magistrate Davy Simfukwe was Annie Chanda 33 of Molokai village in Senior chief Shimumbu in Luwingu district in the Northern province.

Facts before Magistrate Mr Simfukwe were that Annie on 28th April 2013 did injure a child aged 7 by pulling his manhood as a way to instil discipline for urinating on the reed mat.

Annie who is the step mother told the court that the child has been urinating on his reed mat every day despite having advised him to stop but failed and instead she decided to pull down his manhood so that the child stops the habit.

“I asked the juvenile why he had continued to urinate on the mat but he could not give satisfactory answer, I got hold on to his penis and twisted it with a view of stopping him from urinating,” she disclosed.

In mitigation Annie pleaded for lenience by saying she did that merely to discipline her step son from urinating.

And Magistrate Simfukwe said the convict being the first offender and having readily admitted the charge was entitled to lenience but the case committed has a minimum sentence of five years and not exceeding 10 years.

He explained that children are always vulnerable and they need to be protected at all times.

“One wonders how a person could think of pulling the manhood of defenceless child as the way of disciplining him,” he said.

Mr Simfukwe said the courts are duty bound to protect vulnerable children in society by imposing stiffer penalties to deter would be offenders like the convict.

He said although the convict was the first offender the case calls for a minimum sentence of five years imprisonment and not exceeding 10 years. “The only way I can express lenience is by sentencing the convict to the minimum sentence as provided for under the law,” he said.

Annie was sentenced to five years simple imprisonment for one count of assault occasioning actual bodily harm contrary to section 248 (a) of the penal code chapter 87 of the laws of Zambia.

Zambia contemplates banning tobacco adverts

Minister of Heath Joseph Kasonde has disclosed that Zambia was among many countries in the world that have embraced the World Health Organization (WHO) framework convention on tobacco control.

Dr. Kasonde said Zambia has since enacted and continue to enforce national and local smoke free measures to protect its people against exposure to conditions that were harmful to human health.

The Minister said he will submit the proposal to ban tobacco sponsorship, promotion and advertising in Zambia to cabinet.

He said this today during the commemoration of world no tobacco day celebrations in Lusaka.

He also revealed that the global statistic show that six million tobacco related deaths occur every year in the world.

Dr. Kasonde stated that out of this number, 600,000 are non smokers who are exposed to passive smoking.

He added that data from 151 countries show that about seven percent of adolescent girls smoke cigarettes as opposed to twelve percent of adolescent boys.

He also disclosed that in Zambia, 27 percent of men compared to three percent women smoked tobacco while the record also reveals that nine percent of boys in Zambia smoke compared to eight percent of girls respectively.

And World Health Organization (WHO) Representative Olusegun Babaniyi expressed sadness that tobacco related deaths have increased not only in Zambia but the rest of the world.

Dr. Babaniyi said in order to reduce tobacco related deaths, it was important that countries consider banning tobacco sponsorship, promotion and advertising.

He said although many countries were making significant strides in eradicating smoking and public smoking, there is more to be done in Zambia and other countries.

Siavonga MP calls for calm on old currency usage as deadline looms

Siavonga area Member of Parliament (MP) Kennedy Hamudulu has called for calm among the general public as the deadline for the usage of old currency approaches.

Mr Hamududu said that there is only 30 days remaining to transact in old notes and thereafter, there is still a provision for the general public to exchange their old currency from commercial banks up to the end of this year.

“Its only at the point of transacting that it will no longer be tenable but people still have time to go to the banks and exchange their old currency for the new notes up to the end of this year,” said Hamudulu.

The parliamentarian said people can exchange their old money through business transactions now as it is still a legal tender up to the end of this month (June).

Mr Hamudulu said this in an interview with ZANIS in Siavonga yesterday.

Mr Hamudulu however, called on the Bank of Zambia to intensify its sensitization programs in order to educate the public on the phasing out of the old currency in circulation.

Mr Hamudulu said that the Bank of Zambia should also take stock of the remaining old currency in circulation especially in rural areas.

“I think there might be some people in the remote areas who would want Bank of Zambia to extend the use of old currency up to December, I’m sure there is need to find out exactly how much money is still uncorrected from the rural communities,” suggested Hamudulu.

Meanwhile some traders and villagers in Siavonga district have called on the Bank of Zambia to introduce the mobile banks in the area to enable them discard their old notes for the rebased ones.

They said this will allow them to change their monies freely and avoid congestion at the only bank in the area, the Zambia National Commercial bank (ZANACO).

The villager’s also appealed to other people who have learned how to use the rebased money to help them and ensure that they don’t get cheated by unscrupulous people.

The Bank of Zambia has designated 30th June 2013 as the last day for the usage of the old currency as a medium of exchange at all points of sale.

BOZ adjusts policy rate upwards

The Bank of Zambia (BoZ) has adjusted its policy rate upwards by 25 basis points to 9.5 % for June 2013 following a meeting held by the Monetary Policy Committee this year.

A monetary policy rate is a tool used for controlling inflation, determining day-to-day liquidity operations and other market rates.

BoZ has in the last two (2) months maintained the policy rate at 9.25 percent.

In a statement issued to media in Lusaka yesterday, BoZ Head of Public Relations Kanguya Mayondi said the committee decided to increase the policy rate to 9.5 per cent for June as a response to inflation challenges.

Mr Mayondi disclosed that the Committee anticipates upward risks to inflation during the month of June 2013, mainly arising from recent increase in the pump price of fuel, coupled with the lagged effects of the recent exchange rate depreciation.

He said the committee, however, expects inflationary pressures to be moderated by the relative stable prices of food items.

Mr Mayondi said this resulted from a positive food balance as indicated in the recent crop forecast survey results.

He explained that the committee weighed the risks and was of the opinion that inflationary pressures during the policy-relevant period would be a threat to the achievement of end-year inflation target of 6.0%.

Mr Mayondi has since revealed that the next meeting of the Monetary Policy Committee to review the Bank of Zambia Policy Rate will be held at the end of June 2013.

Condoms runs out in Kabompo

The District AIDS Taskforce (DATF) in Kabompo district has run out of both male and female condoms for distribution to clients.

District AIDS Coordination Advisor Shoneka Shaloba confirmed the development in an interview with ZANIS in Kabompo today

Mr Shaloba said Kabompo district AIDS Taskforce has not received condom supplies from Medical Stores since November last year.

He said the district AIDS Taskforce has however been pressing orders for supplies of 27, 000 male condoms and 3,000 female condoms from Medical Stores but there has been no response since then.

And Kabompo District Commissioner Denis Kanyakula said he will sit with the AIDS Taskforce committee to source for condoms distribution during the traditional ceremonies in the districts scheduled for this weekend.

NGOCC Condemns Attack On CSOs By Patriotic Front Cadres, but Police blame the organizers of the event

The Non Governmental Organisations’ Coordinating Council (NGOCC) has condemned in the strongest terms the violent attacks by Patriotic Front cadres on Civil Society Organisations (CSOs) that gathered today at Matero’s Bible Gospel Church in Africa for a prayer meeting. The prayer meeting was held on the removal of subsidies because of the denial by the police for the CSOs to hold a peaceful demonstration.

In a statement released to the media and signed by the chairperson Beatrice Grillo, NGOCC said that they noted with great sadness and concern that this barbaric act comes barely two weeks after a similar attack on opposition party members who were going to address a meeting in Kanyama.

“As NGOCC, we believe that every citizen has a right to freedom of assembly and as such the CSOs were justified to have a meeting. The fact that the violence took place in a church which is considered as a holy place is very unfortunate. As a women’s movement, we are wondering where people can gather and speak freely on matters that affect their livelihood and well-being. Where is democracy in Zambia? We are therefore calling upon all peace loving Zambians to condemn this barbaric act. This violent act will instill fear in the esteemed citizenry to discuss matters of national interest, ” read the statement.

“As a women’s movement, we believe that violence can never be a solution to any perceived differences but there are other peaceful and constructive means of resolving differences. The Patriotic Front Government in general and its cadres in particular should exercise maximum tolerance of divergent views and opinions as opposed to violence and intimidation which is not a solution and will only hinder development at the expense of the innocent Zambians.”

In conclusion NGOCC urged the Patriotic Front Government to publicly denounce the cadres and condemn the violent acts.

“We further call upon the Inspector General of Police and her officers to ensure that justice prevails by arresting the people who were involved in this attack, ” ended the statement.

Today , PF of youths stormed the church, beating up journalists and the organisers who included leaders of various churches.

The violence erupted shortly after Bible Gospel Church in Africa (BIGOCA) overseer Peter Ndhlovu led the members of CSOs in praying for peace, love and unity to prevail in Zambia as well as extending prayers for President Michael Sata, his Cabinet and the citizenry at large.

The PF cadres stormed the building around 11.00 hours when CSOs representative and Anti-Voter Apathy Project (AVAP) executive director Richwell Mulwani was delivering his speech.

The cadres armed with planks, sjamboks and other weapons entered the church in Matero Township saying they would not allow people talking ill about the PF Government.

Among those either beaten or roughed up within and outside the church were camera persons from ZNBC and another believed to have come from the Office of the President (OP) as well Bishop Ndhlovu and former Church of God overseer John Mambo.

Others caught up in the fracas were Mr Mulwani, MMD vice-president (political) Michael Kaingu and Senanga United Party for National Development (UPND) Member of Parliament Likando Mufalali.

Operation Young Vote (OYV) executive director Guess Nyirenda, child rights activist Godfrey Simukonde and former PF member Sam Zulu were also not spared by the angry youths believed to have come in a Canter truck which they had parked meters away from the church.

The uncompromising youths were also not sparing suspicious looking individuals loitering within the church premises.

Besides injuring some of the congregants, the youths damaged equipment belonging to journalists and were seen banging on some parked vehicles.

And Lusaka province police Chief Joyce Kasosa has said that she was saddened that the meeting ended up the way it did and attributed that to failure by the organisers to inform the police that they were going to converge in Matero.

Ms Kasosa said she had written to the Black Friday organisers to settle for an indoor venue other than the outdoor location (Freedom Statute) they had earlier requested for as the former venues were easy to manage than the latter.

She said the organisers did not respond to her letter regarding their indoor venue, adding that she had only learnt that they were going to hold their meeting in Matero through the media.

Ms Kasosa said the police would have offered the necessary security had they been furnished with information on the venue of the meeting and the fracas prevented.

She said two people, whom she could not immediately mention, had formally made a complaint of assault at Matero Police and were issued with medical reports, an indication that investigations had been launched,but that no arrests were made as at 15.00 hours today.

Muchelenganga dropped after Nkana flop

Herve Renard has welded his axe after Zambia’s forgettable training game loss against Nkana.

Renard has ejected goalkeeper Rabson Muchelenganga after a modest display in the warm-up game that saw him concede two goals in a 2-1 defeat.

The Nchanga Rangers goalkeepers place has been taken up by Power Dynamos’ Joshua Titima who was suspended goalkeeper Kennedy Mweene’s deputy since the 2013 Africa Cup before falling out of favour after the Lesotho game in March.

Titima was in goals after Mweene’s 56th minute sendoff on March 24 in a 1-1 away draw to Lesotho.

The pressure is now at heated pace to find Mweene’s replacement for the June 8 return leg clash against Lesotho.

Green Buffaloes goalkeeper Davy Kaumbwa and Red arrows Daniel Munyao are the other goalkeeper in the race to be in goal for the Lesotho game.

Meanwhile, Munyao’s club mates midfielder Shadreck Malambo and defender Bronson Chama have also been dropped.

Konkola Blades coach Enos Silwimba says Sharp Razor must work extra hard to beat struggling Ndola Lime Hotspurs in Saturday’s FAZ Super Division Week 11 match at Konkola Stadium in Chililabombwe.

Silwimba predicted a tough match against Lime, who are placed second from the bottom of table with five points in 10 matches.

Blades have endured a three game winless streak.

“We have to collect three points; we have to work extra hard so that we can pick three points,” he said.

Silwimba added: “Lime are playing good football, they have improved so
it won’t be easy.”

And Lime coach Mathews Ndhlovu has rated the match against Blades as 50-50.

“It will be a 50-50 affair because we also want to be collecting points. We will do our best,” he said.

Lime warmed-up for Blades with a 3-1 win over FAZ Division One North leaders Kitwe United in a friendly at Garden Park Stadium in Kitwe on Thursday.

Nkana coach Masautso Mwale says the FAZ Super Division leaders are targeting a positive result as they take on Nkwazi away at Edwin Imboela Stadium in Lusaka on Saturday.

Kalampa, who are sitting on 23 points take on fourth placed Nkwazi in the Week 11 encounter hoping to recover from last weekend’s goalless draw against Kabwe Warriors in Kitwe.

Mwale said Kalampa must treat the game against Nkwazi seriously.

A group of people this morning stormed the BIGOCA Church in Lusaka’s Matero township and beat up worshipers who had gathered to participate in the ‘Black Friday’ Prayers over the removal of Fuel Subsidies.It is alleged that the group was armed with pangas, axes and hoe-handles.The alleged PF youths arrived in hired buses at BIGOCA and closed the doors and windows of the church building and started beating people indiscriminately.

Among the notables present were Movement for Multi-party Democracy (MMD) vice president in charge of political affairs Michael Kaingu, Bishop John Mambo, Emily Sikazwe and Andrew Ntewewe.Bishop Mambo, a stern critic of President Michael Sata and his policies, was among those who were beaten.Andrew Ntewere was also beaten.

Journalists who were caught up in the fracas were not spared as a Zambia News and Information Service cameraman was brutality beaten.

11 CSO’s had planned to hold a rally at the Freedom Statue but Police denied them a permit to do so,the conveners then opted for an indoor meeting which included the prayer meeting this morning.

PF should admit that Chikwanda’s budget has collapsed-Nawakwi

Opposition FDD leader Edith Nawakwi says Finance Minister Alexander Chikwanda must be bold and admit that his first PF national budget has burst.

Ms Nawakwi said Mr. Chikwanda must go back to Parliament and present a fresh mini budget and admit that his budget has collapsed mid-way through the financial year.

She said the removal of subsidies on fuel and food was a sinister move aimed at raising additional funds outside the national budget.

“What we have here is a situation where my elder brother at Finance has burst his budget and he has to look elsewhere for additional financing mostly to finance programme that were unbudgeted for such as new districts and bye elections,” Ms. Nawakwi said.

Mrs. Nawakwi observed that the removal of subsidies will send many Zambian families into poverty.

“People will not eat GDP, people want affordable food. You cannot postpone your hunger because somebody wants to build roads and bridges.”

She said no amount of positive publicity or propaganda on subsidy removal will change the public’s rejection of the move.

“They are sending Ministers and their Deputies to explain the alleged benefits of the subsidy removal. You know, what is good is good and what is bad is bad. You don’t need all those Ministers to go and tell the people what is good about this subsidy removal.”

The FDD leader also criticized comments by US Ambassador to Zambia Mark Storella who supported the removal of subsidies.

“I find it insincere for the American Ambassador to support this issue when the US is well known for subsidizing its agriculture with heavy subsidies. This move will affect the poor the most,”

Mrs. Nawakwi was speaking yesterday morning when she featured on a live Burning Issue radio programme on 5 FM Radio.
