Government has acknowledged the depreciation of the kwacha and is working out modalities to strengthen it in order to compete well against other major foreign currencies.

Finance Deputy Minster Miles Sampa said that the Kwacha is expected to standout fairly and stronger considering an increase in the exportation of oil which is mostly the commodity on high demand by the developed world.

Mr Sampa noted that Zambia had a positive trade surplus from KR112.8 million in November last year to over KR135 million in December 2012.

In an interview with ZANIS in Lusaka today, Mr Sampa expressed confidence that it is imminent that the introduced Rebased Kwacha will stabilise for a much longer period.

The Finance Deputy Minister who attributed the instability of the kwacha against other foreign currencies explained that most commercial banks have been holding on to the Dollar thereby putting more pressure on the kwacha.

Mr Sampa urged Commercial banks across the country to work towards addressing the weakening of the Zambian Kwacha saying if this is not sorted out it will cause hostility for business transactions for persons in the entrepreneurial sector.

He said that financial lending entities should realise they have a part to play in the currency market exchange rate by making sure the exchange rate is made much ideal for the local currency.

Various financial players in the economy have expressed concern with the recent depreciation of the Zambian kwacha and asked government to intervene.

Samfya farmers protest over mode of distribution of inputs

Over 20 farmer Cooperative representatives from selected farming blocks in Samfya district have urged government to find a lasting solution to delayed input distribution.

Speaking when they stormed ZANIS offices in Samfya yesterday, the irate farmers said most of their crop under the 2012/2013 farming season have failed to grow well due to delayed inputs under the Farmers Input Support Program (FISP) and alleged inconsistent distribution mechanism used.

Patrick Kaoma a Camp Agriculture Committee Chairperson for the 18 Cooperative farming groups and clubs of Bangweulu Central Farming Block , flanked by George Mwape a trustee of 16 cooperative groups and clubs in Mano Block said a lot of farmers in their entities had experienced a delay of Urea and some D Compound fertilizer which was coming in trickles.

Another farmer representative, Boniface Chilufya, Vice Chairperson of Mwenshilungu farm Block said the situation was worsened by long distances farmers were forced to cover in order to access to the inputs.

Mr Chilufya said the fertilizer inflows’ pace was disheartening and proving to be an extremely costly venture on the part of a peasant farmer as they indefinitely had to wait or gamble to come to the boma in a bid not to be left out of the share of packs they had already paid for.

And when the group visited the office of the District Commissioner, demanding to know what authorities were doing over the matter, District Administrative Officer James Mulenga assured the farmers that government was mapping a way forward to bring to an end the issue of delayed input distribution to farmers.

The fuming farmers bemoaned what they termed as favouritism of some farming cooperatives or grouping they alleged to have been given preference at the expense of other groups.

The angry farmers alleged that some cooperatives have accessed all the input requirements in what they termed as a questionable distribution formula at the district level.

Speaking in the company of an Agriculture officer, Mr Mulenga reiterated governments commitment towards coming up with an enhanced and timely FISP distribution mechanism.

Mr Mulenga said his office was fully updated that so far 6,419 bags out of about 12,000 bags of fertilizer targeting the over 6000 farmers in the district has been disbursed and efforts were underway to reach the deficit in due course.

He said the figure represented a 98 percent distribution mark for top dressing (Urea) and basal dressing (D compound) fertilizer combined while Urea alone was at 49 percent in terms of what had been received and distributed currently.

THE Kitwe business district was yesterday hit by a power outage from 04:00 hours until after 09:00 hours affecting business activities.

The outage paralysed business operations in major shops and some businesses which remained closed for more than two hours.

ZESCO Public Relations Manager Yammie Zimba said the power outage might have been caused by an internal problem from power supply unit.

“We were not aware of what had happened but from the investigations it seems there was an internal fault which caused the problem,” said Ms Zimba.

Ms Zimba said the technicians were already making progress to ensure the situation returned to normal.

Shoprite remained closed until after 09:00 hours with some people anxiously waiting at the entrance to buy various items.

Bayport Financial Services Corporate Affairs Manager Wane Msiska said in an interview that the financial firm was inconvenienced by the power disruption but the generator was quickly turned on to continue offering services to clients.

Spur Chicken customer attendant, Jacqueline Oldy said the business was affected as customers could not be served on time.

“It is regrettable that we had no power. It was important that ZESCO should have informed us well in advance and how can we start operating after 9 am,” said Ms Oldy.

An official from ADJS Network, who declined to be named said, the power outage inconvenienced the businesses in the district and regretted that no notice was issued by ZESCO on the power outage.

A.C.C summons Former President Rupiah Banda over corruption allegations

FORMER Republican President Rupiah Banda has been summoned to appear before the Government Joint Investigations Team over allegations of corruption and other criminal activities.

Mr Banda, who was defeated in the September 20, 2011 general elections, becomes the latest high-profile figure to be summoned before investigative wings after several of his former Cabinet ministers availed themselves for questioning.

His son, Andrew is already on trial over corruption charges in road contracts signed between the Road Development Agency and Fratelli Locci Construction Company, an Italian firm.

His other son Henry, who is based in South Africa, is being sought by law enforcement agencies for corruption related matters but has refused to avail himself.

According to a summon dated February 4, 2013 signed by Anti-Corruption Commission (ACC) director-general Rosewin Wandi, the former President is expected to appear at the Drug Enforcement Commission (DEC) head office in Lusaka on Thursday this week in the morning.

“The Government Joint Investigations Team has been carrying out investigations into allegations of corruption and other criminal activities in which you have been named,” Ms Wandi said in the summon addressed to Mr Banda.

Ms Wandi noted that the investigations team was aware that Mr Banda enjoyed immunity as former President but that it was in his best interest to defend himself against allegations levelled against him.

“We are mindful that you currently enjoy immunity from prosecution on offences allegedly committed, while you served as Republican President.

“However, it might serve your interests to avail yourself the opportunity to provide answers to the allegations made against you without losing your immunity,” she said.

The ACC chief advised Mr Banda that in an event he decides not to avail himself, the law enforcement agencies will pursue other legal avenues.

Government has said that it is highly irresponsible for Dante Saunders to call for the impeachment of President Michael Sata over the appointment of the Chief Justice, as reported in today’s Daily Nation newspaper.

Chief Government Spokesperson Kennedy Sakeni in a statement released to the media said that the call is shallow, unresearched and unfounded as there is no such an appointment that the President has made in the office of the Chief Justice.

Mr Sakeni said that constitutional appointments by the President, including that of the Chief Justice, are subject to rigorous scrutiny by relevant oversight institutions, including parliament.

Mr Sakeni stated that the call for impeachment, therefore, does not arise as there are adequate safeguards in the appointment of constitutional office holders.

Mr Sakeni reminded Mr. Saunders that Parliament comprises men and women of high integrity as representatives of the people who perform their duties diligently as has been demonstrated in the past.

Mr Sakeni said that it was, therefore, mischievous for Mr. Saunders to insinuate that Parliament has been endorsing illegalities in the appointment of constitutional office holders by the Executive.

He has advised Mr. Saunders to desist from dwelling on speculations and displaying his ignorance on issues he least understands.

Mr Sakeni added that Government takes great exception to Mr. Saunders’ allegation that Government wants to use the Judiciary, the Police, Drug Enforcement Commission, Anti-Corruption Commission and other wings of Government to fix its perceived political opponents.

Mr said that this was a fallacy which government wishes to dismisses with the contempt it deserves.

He further said that the PF Government had demonstrated its unwavering commitment to the rule of law and separation of powers among the three arms of Government.

Mr Sakeni stated that the Government does not influence the operations of the Judiciary because they believe in a professional and independent Judiciary as seen in the fact that all suspects in the on-going corruption and Abuse of Authority cases are enjoying their full rights as provided for in the country’s legal and justice system.

Zambian trainer Fordson Kabole says he has settled well in DR Congo where he is coaching Don Bosco.

Kabole said neither Congolese langauges nor culture have been a challenge to him.

The veteran coach joined Bosco early in 2012 after being fired by Power Dynamos and guided his new side to winning promotion to the national league.

“It has not been difficulty because football is only one language,” Kabole said.”They speak Swahili, French and English,” he added.

Promoted Bosco will compete in the 2013 CAF Confederation Cup by virtue of winning one of the Congolese National Cups in 2012.

“In the Confederation Cup we are inexperienced but we will try. I will do my best,” Kabole stated.

The Olympic Youth Development Centre (OYDC) Director Clement Chileshe says his institute will engage expatriate athletic coaches to be assisting local trainers to train young athletes at the centre in various sport disciplines is on-going.

OYDC Director Clement Chileshe said that OYDC has since drawn a budget line for the same programme to help continue spearheading the programme.

He told ZANIS sports in an interview in Lusaka today that OYDC would soon announce the estimated total cost budget.Mr.Chileshe said that OYDC was working with other partners concerning the same adding that people should be patient with the centre.

He pointed out that OYDC wants to ensure local trainers gain the required skills of training young athletes at the centre and that his organization believes that there are a lot of young people with potential and great talent that needs to be exposed.

Chileshe further noted that OYDC has since observed that the country lacked highly trained trainers who can offer all the necessary skills training to the young people.

He stressed that his organization is this year targeting to help improve sport in the country by all means possible and to motivate different athletes strategically in selected sport disciplines.

The opposition United Party for National Development (UPND) has commenced legal action against Justice Winter Kabimba over his allegations that the opposition party is behind the killing of Western Province Minister Obvious Mwaliteta’s houseboy, Johan Lyakoka.

Justice Minister Winter Kabimba is quoted in today’s edition of the post newspapers alleging that the UPND is behind the killing of Johan, but Southern province police commissioner Charity Katanga has disclosed that results of a postmortem carried out show that Johan was killed in a road traffic accident.

UPND Livingstone by-election campaign manager Garry Nkombo says the UPND will pursue Mr. Kabimba through the legal channels on the matter.

Mr. Nkombo told a media briefing in Lusaka this morning that his party is also writing to the Electoral Commission of Zambia (ECZ) on the breach of the electoral code conduct by Mr. Kabimba and Mr. Mwaliteta, as PF campaign manager for Livingstone, for issuing inflammatory remarks contrary to the conduct.

He has also appealed to President Michael Sata to discipline Mr. Kabimba stating that he is not only a threat to himself, but to the party and the country as a whole.

The body of Lyakoka, aged 19, was found lying in the early hours of Saturday on the tarmac along the Livingstone-Lusaka road opposite Crossroad Lodge a few meters away from where the deceased and his colleagues were sleeping.

After the postmortem yesterday, the body of Mr Lyakoka was taken to Sioma District in Western Province for burial.

PF Member Lawrence Nyambe claimed that the United Party for National Development (UPND) had gone too far with its ‘mapatizya formula’ in that an innocent life had been lost but UPND campaign manager for the Livingstone by-election Gary Nkombo refuted the murder allegations.In an interview outside Batoka Hospital mortunary yesterday, Mr Nyambe said everything points to the fact that Mr Lyakoka was not killed by ordinary criminals but by political opponents using the UPND’s ‘mapatizya formula’.

“The best way to mourn this young man is that we are going to make sure that we win the February 28 Livingstone by-election,” he said. The deceased did not have a shirt and shoes on when his body was picked by the police.

Ratification of Madame Justice Chibesakunda as new Chief Justice violates constitution

Statement on the planned request by President Sata to the National assembly for ratification of Madame Justice Chibesakunda as new Chief Justice

It has come to our attention as NAREP that President Sata is planning to or has already submitted the name of Madame Justice Lombe Chibesakunda to the National Assembly for ratification as Chief Justice. Before he takes any further action, it is important that he is aware of the implications of such a move under the current Constitution.

First of all, I should point out that Justice Chibesakunda is like a mother to me and is a dear family friend. I raise my concerns about this development, therefore, as a matter of principle in relation to the action intended to be taken by the executive wing of Government. I am in no way questioning the quality, competence and capabilities of one of Zambia’s renowned judicial minds. I am not even sure Justice Chibesakunda is aware that that the President wants to submit her name to parliament for ratification.

However, the National Assembly has no jurisdiction to determine the candidature of a person that has already passed the retirement age for High Court or Supreme Court Judges as set out in the Constitution. If Justice Chibesakunda was born in 1944 as indicated in her resume, that would make her nearly 69 years of age. Any consideration by the National Assembly of her candidature would therefore contravene Article 98(1) of the current Constitution which stipulates that “a judge of the Supreme Court …shall vacate that office on attaining the age of sixty-five years”.

Looking at the various provisions in the Constitution on the appointment of Supreme Court Judges, it is possible that what the President has in mind with his intended action is Article 93. This states that the Chief Justice and Deputy Chief Justice shall, subject to ratification by the National Assembly, be appointed by the President. However, this would only relate to a person that has not yet reached retirement age. The Constitution also provides that if the office of the Chief Justice is vacant then until a person has been appointed to that office, the President may appoint the Deputy Chief Justice or a Judge of the Supreme Court to perform such functions. This is in fact what the President has already done by appointing Judge Chibesakunda to act in that position. Should he attempt to go beyond this and ask for ratification of her appointment as Chief Justice by the National Assembly, he will be going out of bounds.

A person that has served as a judge of the High Court or the Supreme Court and attained retirement age can only continue to serve in such capacity if the President (and not the National Assembly) permits that person to do so and in such a case, the extension can only be for a maximum period of 7 years. There is therefore nothing stopping the President from extending the service of Justice Chibesakunda as an ordinary Supreme Court Justice up to a maximum 7 year period but submitting her name to the National Assembly for approval as full time Chief Justice would violate the Constitution.

It is of course arguable that a person could continue to serve in an acting Chief Justice capacity for 7 years but this would clearly be an abuse of the law. It seems clear under Article 93(2) that appointing an acting Chief Justice is intended to be temporary and only until a new person is appointed. Notwithstanding the obvious qualities of Justice Chibesakunda, the reason why it is not desirable to continue to engage a person to act as Chief Justice after they have reached retirement age (even for a short period) is that this is likely to have the effect of undermining the independence of the judiciary in the eyes of ordinary Zambians. When judges are appointed and they have not reached retirement age, they enjoy what is called security of tenure – meaning they can only be removed if they have committed some form of misconduct and even then, they have to first be subjected to a tribunal hearing before they can be removed from office. Once they reach retirement age, they are put on contracts, meaning their contracts can be terminated at any time. Engaging a person in a sensitive position as Chief Justice on contract goes against the spirit of judicial independence which is vital in a democracy, especially one facing many challenges related to the erosion of freedom of expression. Such a situation should therefore be discouraged.

There are 4 things that can be done to prevent the President from seeking to breach the Constitution should he insist on submitting the name of Justice Chibesakunda to the National Assembly for ratification:

  1. An approach can be made to Justice Chibesakunda directly in order to highlight the obvious constitutional problem that this will create in the hope that she will advise the President to withdraw his plans or for her to withdraw her name from consideration.
  2. The National Assembly can be lobbied to debate and consider the application when it comes in and to obtain a ruling from the speaker as to the constitutionality of such an action (the Speaker could in fact be approached separately even before the matter is placed before the National Assembly – as both a lawyer and former Judge he should be able to advise the relevant Presidential team as to the legality of the intended action).
  3. Court action could be taken by interested parties to obtain a ruling as to the constitutionality of such action.
  4. An appeal could be made directly (or indirectly) to the President explaining the constitutional irregularity in the hope that should he wish to continue with the appointment, it would have to be based on the powers he already has in the Constitution to extend the service of the current Acting Chief Justice as a Supreme Court Judge and not as Chief Justice.

The Auditor General’s report has revealed that the Ministry of Energy and Water Development, now the Ministry of Mines, Energy, and Water Development has operated without a strategic plan since the expiry of the last one in 2007.

The latest Auditor General’s report stated that the Ministry of Energy, which is the parent ministry for strategic institutions such as Zesco, Indeni Petroleum Refinery and TAZAMA Pipeline had been operating without a strategic plan.

“There was no evidence that the ministry prepared annual operational plans whose implementation was evaluated and monitored.

“In this respect, the implementation of activities at provincial level was not monitored by the ministry headquarters and progress reports on the activities implemented were not prepared,” the report said.

Other irregularities involved the manner in which the Ministry of Home Affairs entered into a deal with the Mufulira Municipal Council for the procurement of 14 houses for the Zambia Police Service at a cost of KR323, 729 (K323 million).The report indicated that a physical inspection of the 14 houses located in Kansuswa residential area showed that they had cracked walls.The Auditor General observed that although the valuation report was prepared, no structural assessment was availed to ascertain the status of the houses at the time of purchase.

The report also revealed that the Zambia Army, without following proper procedure, paid out KR208 million to various landlords for repairs of houses rented by Army personnel.According to lease agreements signed between the Zambia Army and its landlords, the Army, through its maintenance section, was responsible for undertaking repairs to damaged rented houses.

In cases where the maintenance section was unable to carry out the repair works, the section was required to make an assessment of the repairs required and based on this, the Army would pay the landlord to carry out the works.

“However, without assessments from the maintenance section, the Army paid amounts totalling K208, 330, 130 to various landlords for the repairs on the houses.

“In the absence of the assessment reports, it was not possible to ascertain the basis on which the payments were made,” the report said.The Army also purchased a house in Mansa at a cost of KR350,000 (K350 million), without carrying out a valuation of the property.The Auditor General questioned how the Army arrived at the house value without a valuation.

A Taxi driver in Chililabombwe has been shot dead in yet another grisly murder of a public service vehicle driver.The assailants went away with his Toyota Corolla as fear gripped other operators in the border town and surrounding areas.

Maybin Bwalya, 32, of Plot Number 3738 Kakoso Township, was killed in cold blood and dumped a few metres from his house in the early hours of yesterday.
He last spoke to his wife around 22:00 on Saturday as he went about his business in his green Toyota Corolla taxi that he used to operate at night.
Police sources said Mr Bwalya, who was an employee of Railcon operated the taxi during the night.

He was shot in the left side of the chest and his body was discovered in the morning. Police struggled to keep people who wanted to have a glimpse of the body at bay.

Lusaka, Kabwe and Kapiri Mposhi are other towns in the country where taxi drivers have been targets of shocking murders suspected to be ritual.

Mathews Chipili, 20, was murdered in bizarre circumstances, as his killers gouged out his eye, and pulled out his tongue and throat before dumping the body in Lusaka’s Roma Township.

Joseph Simfukwe, 28, was another victim, who was beheaded and had his private parts removed in a suspected ritual murder. His body was found buried in Namwala in Southern Province.

Gift Tembo is another taxi driver murdered in Kabwe in a brutal fashion as he was found with deep knife-cuts on his body. Mr Tembo, 28, was killed and his body dumped near Makombe Farm in Kabwe on the Great North Road, on December 29, last year.

In another development, two human rights consultants have allegedly killed a 40-year-old Lusaka man who was seeking to iron out marital differences with his wife at their offices.

Shadreck Shawuma of Old Kanyama Township was on separation from his wife and on the material date, he went to visit his wife who reported him to a justice and human rights office for the couple to address their marital differences.

Police spokesperson, Elizabeth Kanjela said in Lusaka yesterday that two people had since been apprehended in connection with murder, while two other suspects were still at large.The two suspects had been identified as Cosmas Kangondo, 40, of House Number 47/04 and Morgan Kakumba of House Number 49/66, both in Kanyama Township.

Meanwhile, a 15-year-old boy of Lusaka and a 10-year-old boy of Luapula died after they drowned in separate incidences.

In Lusaka, the 15-year-old boy went swimming at the infamous Blue Water Dam in Chawama in the company of his friends and drowned in the process.

The body had not been retrieved by Press time yesterday.

In the Luapula incident, the 10-year-old drowned in Lake Mweru near the fisheries offices as he was also swimming in the company of others when he met his fate.

We as Lafarge employees including unionised workers who suffered most in the hands of the deported director would like to use this opportunity and thank the Zambian Govenment for deporting our former director Mr Fola Esan.This man had no human heart.He never respected us and nor our laws, worse off the Government and its leadership.

He has sown seeds of division among us employees.He brought a lot of exploitative rules that oppressed his workers to a point were no one could talk or complain. He became untouchable. This Government had its own reason for deporting him and so did we as employees. Almost everyone is happy except for a small group of selfish managers that he used to perform his evil acts.

Hitler is gone and we are happy and working peacefully. The Home affairs and Labor ministries should have come to find out from employees whether we are happy or not following the deportation of our most hated former MD.

Once again we say thank you to the Ministry of Home affairs and please we beg you not to allow this man to come back. They have wasted our pension scheme, this causes our retirees to come back begging for contract employment a few weeks after retirement. We humbly request our Govmnt to intervene and investigate what happens to our pension.We urge our sleeping Labor ministry to wake up and stand for the good of the Zambian workers. I am among those employees who are retiring in the next two years and hope they don’t pay us half our pension benefits.

Prof Chirwa’s underground rail line plans in Lusaka technically possible-EIZ president

Zambia Railways Chief Executive Officer, Professor Clive Chirwa’s plans to construct an underground rail line for passenger trains in Lusaka to decongest traffic in the City has received support from the Engineering Institute of Zambia (EIZ) President saying that it was technically possible to create an underground rail line in Lusaka as suggested.

Institute President Bernard Chiwala told ZNBC that Zambia has the knowledge, experience and expertise in creating and managing underground tunnels especially on the Copperbelt.

The EIZ president said that Engineers from the Copperbelt can be engaged to help create a tunnel in Lusaka where rail line can pass.

Last week Prof Chirwa unveiled designs to revamp the railway sector and turn it into a 21st century railway system that was modern and profitable.

Professor Chirwa said 90 percent of the railway stations in the country were beyond repair and there was therefore need to sink the railway station underground particularly in Lusaka adding that this would go a long way in improving the outlook of the sector.

He said this at a public discussion hosted by the Engineering Institution of Zambia (EIZ) where he presented new architectural designs and a computer generated simulation on the new look railway system.

Explaining the simulations of the model, Prof. Chirwa said ZRL would establish electric powered trains to run on the rail track that will be rehabilitated.

He said having electric trains would be cheaper than using coal to move the machines.

He explained that the company was already considering three ways of doing it.

Prof. Chirwa said the first way would be to have a solar panel while the second one is to generate power from Lusemfwa and the third option was partnership with ZESCO whom he said had pledged to support the reconstruction.

He further highlighted nine modules to categorise development of the second 921 kilometre railway line that will be built from Chingola to Livingstone at a cost of US$120 million.

The modules have about 100 kilometres each and they include Mayoba 105km, Choma 112km, Monze 101km, Naluama 101km, Chisamba 109km, Luanshima 103km, Kafulafuta 104 km, Mabote 94 km, and Chingola 92 km.

He stated that ZRL’s core business model would be to build partnerships with businesses that are centered on five divisions namely.

The divisions are freight, passenger, inter-mine, engineering design and infrastructure commercial.

Prof. Chirwa said these five areas will give ZRL a platform to become not only the country’s major employer with over 10, 000 jobs and also make it one of the biggest contributors to the national economy.

Burkina Faso coach Paul Put said eliminating Zambia and holding Nigeria has hardened them for their semifinal clash against Ghana.

Burkina Faso booked their debut semifinal place after beating Togo 1-0 in the 105th minute of extra time at Mbombela Stadium in Nelspruit on Sunday.

They face four-time champions Ghana at the same venue which is now officially Burkina Faso’s home ground until the last match is played there on Wednesday February 6.

“We know Ghana is a very big team but we have played Nigeria, we have played Zambia in football anything is possible. You never know,” Paul said in a post-match interview at Mbombela on Sunday after beating Togo 1-0 in their quarterfinal match.

Burkina Faso drew 0-0 with Zambia in their final Group C match to see the latter eliminated after finishing on three points.

Meanwhile, Group C’s interest at the Africa Cup remains with both Nigeria and Burkina Faso still in the competition.

Nigeria, who drew 1-1 with Burkina Faso in their opening Group C game on January 21, eliminated Cote d’Ivoire 2-1 in their big quarterfinal clash earlier on in the day up in Rustenburg.

Evans Kangwa Closing in On Spanish Deal

Nkana striker Evans Kangwa is reported to be on the verge of joining Spanish second division side Recreativo da Huelva.

Club chairman John Chiwele has confirmed.

Kangwa arrived in Spain on Friday in readiness to undergo medical tests and an assessment.
Medicals and a brief assessment will determine the conclusion of negotiations between Nkana and Huelva.

Kangwa was supposed to attend trials at English championship side Watford early in January but the plan flopped for unknown reasons.
