Judge Chikopa’s stay is abuse of public resources – APNAC

The African Parliamentarian Network against Corruption (APNAC) has challenged government to state clearly what Malawian judge Lovemore Chikopa is still doing in the country when the tribunal he is supposed to head has not yet commenced sitting.
APNAC chairperson Cornelius Mweetwa says the continued stay of Judge Chikopa in Zambia is a serious abuse of public resources and that it sends a clear message that he will be compromised.

Speaking to QFM, Mr. Mweetwa notes that Judge Chikopa’s recent appearance at statehouse for the swearing in ceremony of the recently appointed MMD parliamentarians is a source of concern which government needs to explain.

Mr. Mweetwa says the foreign Judge’s stay in the country is prejudicial as it implies that he already knows that the outcome of the court proceedings will be in favor of the state.

In may this year, President Michael Sata appointed and swore in Malawi high court judge Lovemore Chikopa to chair a tribunal expected to investigate the alleged interference by the suspended judges in the case involving the development bank of Zambia and the post newspapers, JNC investment holdings and Mutembo Nchito.

The tribunal was however put on hold after two of the suspended judges filed an injunction against President Sata’s decision to suspend them and to set up a tribunal to probe them.

Zambia Federation of Employers Executive Director Harrington Chibanda today failed to show up at Lusaka Central Police where he was summoned for questioning over the minimum wage.

Mr. Chibanda said in an interview from Ndola that he could not make it to the police station today due to a family bereavement. He said he was on the Copperbelt arranging for the family to travel to Mwinilunga where the funeral was being held.

Mr. Chibanda was summoned to Lusaka Central Police after Labour Minister Fackson Shamenda reported him for inciting employers to disregard the new minimum wage. He however maintained that Mr. Shamenda’s complaint to the police is aimed at intimidating the Zambia Federation of Employers.

“I have asked my lawyers to communicate to the police that I will only be available on Tuesday next week, at the moment, we are in mourning as a family,” Mr. Chibanda said.

Meanwhile, Zambia Congress of Trade Unions Secretary Genral Roy Mwaba has appealed to Mr. Shamenda to drop the complaint against Mr. Chibanda. Mr. Mwaba said it does not help the spirit of social dialogue if some partners start involving the police in their issues.

“We believe that this is an issue which could be amicably sorted using the channels provided for in the Tripartite Labour Consultative Council. We appeal to the Minister to drop the charges,” Mr. Mwaba said.

Congolese singing sensation Fally Ipupa has revealed that he is a big fan of the Chipolopolo boys.

Fally said he was highly impressed with the manner in which the Zambia National Soccer team performed during the AFCON tournament.

He said Zambia has great footballers and singled out Kalusha Bwalya, Christopher Katonga and Rainford Kalaba as true football icons.

Fally said he could not rule out possibilities of recording a tribute song for the Chipolopolo following their AFCON triumph.

Fally who is in Zambia for a series of shows at the invitation of the Zambia Agriculture and Commercial Show Society was speaking at a news conference in Lusaka today.

“The Chipolopolo team is good, they have small players but very sharp, very fast players,” Fally said.

And Fally has promised his Zambians fans that he will unleash some tracks from his forthcoming album called Power which is set for release in December.

He said he is happy that he will be sharing the stage with some Zambian artists and singled out JK as one great Zambian artist.

DBZ Managing Director objects to an NGO joining the Post Newspaper and JCN Holdings K18 billion debt case

Development Bank of Zambia Managing Director Jacob Lushinga has objected to an application by a Non-Governmental Organisation known as the Zambian Voice to be joined in in the K18 billion debt case.

The Supreme Court last week granted the Zambian Voice an application as a joinder in the ongoing civil proceedings between JCN Holdings, Post Newspaper Limited, Mutembo Nchito and DBZ.

The Zambian Voice had applied as a joinder to the case in order to protect public interest.

It had stated that public interest should be protected in the matter especially that there were strong allegations that the Minister of Finance was protecting JCN Holdings, the Post Newspapers Limited and Mutembo Nchito from paying the debt.

But Mr. Lushinga, in an affidavit stated that the application by the Zambian Voice be rejected as being inappropriate and an abuse of the court process.

Mr. Lushinga charged that the basis for the joinder is misplaced as it seems to suggest that the application by the Minister to stay the proceedings was aimed at facilitating the appellants to avoid their obligations.

Mr. Lushinga stated that DBZ lawyers have advised him that the Minister of Finance in having acted as he did was acting within his rights as majority shareholder of DBZ.

He further objected to the decision by the Zambian Voice to comment on the termination of contract for Finance Permanent Secretary Dr. Abraham Mweenda.

“Dr. Mweenda’s contract is a personal and private matter and commenting on the setting up of a tribunal by the President in the manner the Zambian Voice as the matter is before this honourable court amount to contempt and should not be allowed before this court,” the affidavit read in part.

Mr. Lushinga also criticized the production of a letter from the Bank of Zambia which showed that the debt amount is infact K18 billion and not the K14 which was earlier mentioned.

“It is most unfortunate that the letter from BoZ was produced and I have been advised by my legal counsel that the letter cannot form the basis on which a party can seek joinder in these proceedings,” he said.

Mr. Lushinga said only the Bank of Zambia is the legally mandated institution to take action under the Banking and Financial Services Act as they deem appropriate.

He said the application should be dismissed as it aimed at embarrassing the respondents.

The Supreme Court has since set August 22 2012 as date for inter parte hearing.

A Chinsali school teacher allegedly murdered by bandits in January this year has been put to rest.

Lawrence Mulongwe, 36, senior teacher at Kapwepwe basic school in Munwakubili ward of Shiwang’andu constituency whose remains were recovered in the bush on Monday this week, was put to rest yesterday at Lubwa cemetery.

Addressing hundreds of mourners at the burial site, Chinsali District Commissioner, Evelyn Kangwa called on the police and other security agencies to join forces in reducing the escalating crime levels in the district.

Ms Kangwa also appealed to the police to ensure that all those connected to the brutal killing of the Kapwepwe teacher are brought to book and prosecuted in accordance with the law.

She warned that anybody who will try to frustrate the investigations into the death of Mulongwe will not be taken kindly by both authorities and the community.

Ms Kangwa also commended the police for working hard to find the killers of Mulongwe as well as his remains saying though only bones have been found, it is good that Mulongwe has finally been given a descent burial as a human being.

And Provincial Education Officer (PEO) Jobbicks Kalumba expressed sadness at the continued death of teachers in the district in similar circumstances.

Mr Kalumba said that in the recent past, about three Chinsali teachers have been found dead in unexplained circumstances and wondered how teachers could become enemies of society which they were serving so diligently.

Late Mulongwe was booked by unknown people to take them to Isoka on January 5 this year and never returned.

Muchinga province Acting Provincial Medical Officer Charles Chungu and another Medical Officer Kamina Kabongo examined the remains of Mulongwe in the presence of the police and his relatives at Chinsali district hospital mortuary before they were buried at Lubwa Cemetery.

However, results of the examination have not yet been released.

Mulongwe leaves behind a wife and four children.

Police are holding in custody three people in connection with the death of Mulongwe and they include Mathews Bwalya, a businessman of Chinsali popularly known as Chipendo, Diamond Sichela from New Kapiri Mposhi and Mike Mbewe who was arrested in Mbeya, Tanzania.

The fourth suspect is being held in Tanzania where he is facing similar charges of aggravated robbery and authorities in Zambia are making arrangements to have him extradited back to Zambia to stand trial.

In confirming the recovery of the remains of teacher Mulongwe, Muchinga Province Deputy Commissioner of Police Chilije Nyirenda said the suspects led the police in recovering the remains of Mulongwe which were found in the bush in Isoka district on Monday after a seven-month long search.

Relatives who also accompanied the police identified the clothes Mulongwe was wearing on the day he went missing.

His car believed to have been sold in the neibouring Malawi has not yet been recovered.

The shortage of petrol in Kasama has persisted resulting in some service stations to completely run out of the commodity, a situation causing traffic jams in few service stations having the commodity as motorists scramble for it.

A survey conducted by ZANIS today revealed that only PUMA filling Station has stocks of petrol on sale.

According to Service Station Supervisor Osward Mumba about 18, 800 litres of petrol is in stock from the 30, 000 litres received yesterday.

But Eugene service station has completely run out of petrol while Total filling station has 28, 000 litres of the commodity in stock although the product is not on sale due to the on-going maintenance works on the fuel tanks.

Meanwhile, a traffic jam characterized PUMA filling stations in Kasama yesterday when word went round that the service station had received petrol.

And some motorists talked to have appealed to government to find a lasting solution to the shortage of petrol in Kasama District.

One of the motorists Francis Chomba said the scarcity of petrol in the district has negatively affected business especially for transporters.

Kasama has in the past few weeks been hit by the critical shortage of petrol which has affected operations in the District.

The Pentecostal Assemblies of God (PAOG) has strengthened its resolve to upholding the death penalty in the draft constitution. Speaking at a press briefing today, PAOG Chief Bishop Harrison Sakala said this was in view of the increased brutal murders in the country.

He said life was sacred and it was unfortunate that in a Christian nation, people should be murdered in brutal ways.

He cited an example of the a NIPA student Ruth Mbandu who was murdered and had her facial skin peeled off while her eyes and ears were plucked out in what was suspected to be a ritual killing.

Bishop Sakala urged law enforcement agencies to ensure that all the culprits are brought to book.

He further called on the church to pray even more in times of such murders so that the ‘flaming darts of the devil’ are quenched.

He also urged the church to pray against road traffic accidents which have been on the increase in the country.

The bishop said the church strongly held that all human life is sacred and that was why it did not condone taking of life even through abortion.

Bishop Sakala said life begins immediately at conception and that it should be protected even before it is brought into the world.

He expressed disappointment that abortions are taking place in a Christian nation like Zambia.

He was reacting to reports that an international organization, Marie Stops, has been conducting illegal abortions in Muchinga and Northern provinces.

Mugabe expected in Zambia today

President of Zimbabwe Robert Mugabe is expected in Zambia today to officiate at the 86th Agricultural and Commercial show which opened its gates to the public at 08: 00 hours.

Mr. Mugabe is expected to be accompanied by his wife Grace.

According to the updates from the meeting of the Standing Committee of Permanent Secretaries on State Functions held last week at Cabinet office in Lusaka, Mr. Mugabe is scheduled to land at Kenneth Kaunda International Airport tomorrow at about 13:00 hours.

He is later scheduled to hold talks with President Michael Sata at State House which will be followed by a state banquet in the evening.

Mr. Mugabe is also scheduled to pay a courtesy call on Zambia’s first President Kenneth Kaunda at his office on Friday and later visit SARO Agro Industries within Lusaka.

On the same day, the Zimbabwean Head of State is expected to visit ZAMBEEF Huntley Farm in Chisamba, which is located less than 100 kilometres from the city.

Presidents Mugabe and Sata are on Saturday expected to be at the show grounds for the officials opening of the 86th Agricultural and Commercial show.

The two Presidents will earlier on the same day tour stands and pavilions.

As the two presidents will be touring, First lady Christine Kaseba-Sata will lead her Zimbabwean counterpart in touring selected stands before joining their husbands for the official opening in the afternoon.

The show society has since organised a luncheon at midday for the two Heads of State and the First Ladies at the Polo Grill which is just behind the show grounds.

Mr. Mugabe and his wife are expected to leave for Zimbabwe on Sunday morning.

High Court blocks Masumba expulsion

DEPUTY Minister of Local Government and Housing Steven Masumba has been granted a court order restraining the MMD from expelling him from the party.

Mr Masumba, who is MMD Mufumbwe member of Parliament, has been granted the injunction following his application on Monday.

The Deputy Minister sued MMD national secretary Richard Kachingwe and was seeking an injunction to stop the MMD from expelling him until the matter is determined by the court.

High Court Judge Chalwe Mchenga restrained the former ruling party from writing to the Speaker of the National Assembly to declare the Mufumbwe parliamentary seat vacant and to continue insisting that Mr Masumba is expelled.

This is contained in an ex parte order signed by Mr Justice Mchenga yesterday.

“It is ordered and directed that the defendant [Maj Kachingwe] and his agents or servants or otherwise, however, be restrained and an injunction is hereby granted restraining him from alienating the plaintiff [Mr Masumba] until after the hearing of this matter,” Mr Justice Mchenga said.

In a writ of summons filed on Monday, Mr Masumba wanted the High Court to grant him an injunction restraining the MMD, its agents or servants from any further action against him, until the determination of the matter.

He is further claiming an order that his alleged dismissal or expulsion from the party is null and void, costs and any other reliefs the court will deem fit.

Mr Masumba also wants the court to grant him an order that the expulsion of a member of Parliament by any political party from performing national functions, is ultra vires [beyond constitutional powers].

He said he was not called to any disciplinary committee to give his side of the story and determine the merits and demerits of his position and that he only learnt about the decision to expel him through the media.

Mr Masumba said the MMD’s decision is malicious and without due regard to the rules of natural justice and fairness.

And Mr Masumba, who visited the Daily Mail offices in Lusaka yesterday, said he is in Government serving the interests of Zambians.

Mr Masumba was expelled last month for what the MMD called “gross misconduct” and not because he accepted a job from the PF government.

The minister is one of the 10 MMD MPs serving as deputy ministers in the PF government.

Meanwhile, STEVEN MVULA reports that three traditional leaders in Mufumbwe have pledged to support the PF despite not voting for the party in last year’s general elections. The chiefs are Mushima, Chizela and Munyambala.

In a signed statement released yesterday, the chiefs said: “Despite the fact that we did not give you a seat in Parliament, we believe that all this is in the past. Now our President is Mr Sata and the PF is in government.”

The traditional leaders said they have been compelled to give unwavering support to the PF because it is the party in government and no meaningful development can happen without its involvement.
The chiefs said they want to be part of the team that will deliver development to Mufumbwe.

They also appealed to President Sata to move the capital of North-Western Province from Solwezi to Mufumbwe.

Mufumbwe, they said, is centrally located and it will help to spur development in the province.

Meanwhile, the MMD leadership in North-Western Province has expressed surprise that Mr Masumba has dragged the party to court for expelling him.

Acting provincial chairman David Kapwepwe said it is strange that Mr Masumba has U-turned on his earlier decision not to appeal against his expulsion.

Nevers Mumba ready to prove Emissary was sent from State House

MMD leader Nevers Mumba has said that he is ready to furnish President Michael Sata with information concerning the emissary that was allegedly sent to him from State house.

Dr. Mumba said that he is ready to meet President Sata to give him the details but that he is against the idea of exchanging words in the media on the matter.

The opposition leader has however maintained that an emissary from State House was sent to him when he returned from Canada where he served as Zambia’s High commissioner.

Dr. Mumba has explained to QFM News that the emissary claimed that President Sata wanted to resolve the allegations in which he had been accused of criminal conduct.

He said that this was after the investigations into allegations of criminal conduct leveled against him proved to be not true.

Dr. Mumba has noted that whatever he said about the emissary is true and that he would not in anyway fabricate a story saying he is a Christian who believes in telling the truth.

On tuesday, President Sata challenged Dr. Mumba to substantiate his claims that State House sent an emissary to discuss his alleged involvement in some criminal conduct whilst he served as Zambia’s High Commissioner to Canada.

MMD Mufumbwe Member of Parliament Takes His Expulsion to Court

Embattled MMD Mufumbwe Member of Parliament, Steven Masumba has challenged his expulsion from the party in the high court.

Mr. Masumba who is serving in the PF government as Local Government and housing deputy minister charges that the decision to expel him was done out of malice and without due regard to the rules of natural justice.

In his statement of claim filed in the Lusaka high court Mr. Masumba claims he was not heard at any disciplinary hearing to determine his merits or de merits of his position.

He is asking the court to order that his expulsion from the MMD is null and void.

Mr. Masumba has also filed in an exparte order for the court to grant him an injunction against the MMD until final determination of his law suit.

He says his acceptance of the position of deputy minister in the PF government is not against the MMD constitution.

Zambian lady handed 30 years in jail for attempting to smuggle drugs from India to South Africa

A special Narcotics Drugs Psychotropic Substances court in India has convicted a Zambian national and handed her down 30 years with hard labour for attempting to smuggle drugs from Mumbai to South Africa.

Naney Tembo, 28, was apprehended on December 22, 2008, by the detectives of the Mumbai Airport Intelligence Unit (AIU) on a tip off that she was carrying drugs when she was about to board a South Africa-bound flight.

The AIU officers recovered 77 tablets of heroin, weighing 840 gms, stashed in four socks hid by Tembo under her dress.

Tembo initially tried to misguide the interrogators saying that she was not aware that the consignment was a contraband and she did the “job” to support her family in Zambia. During the trial special public prosecutor Arun Gupte examined 13 witnesses.

Tembo was convicted on counts of attempting to smuggle drugs out of the country and contravention in relation to manufactured drugs and preparations under the provisions of the Narcotic Drugs and Psychotropic Substances (NDPS) Act.

The court also imposed a fine of Rs 2 lakhs on Tembo. She will have to undergo the sentence for 30 years with each term extending up to fifteen years.

Beston Denies He Has Rangers Revenge On His Mind

wer Dynamos coach Beston Chambeshi has refused to target revenge when the Faz Super Division defending champions face Nchanga Rangers in Kitwe this Saturday.

Rangers ended Power’s league unbeaten run on 2nd May after beating the Kitwe side 1-nil at Chingola’s Nchanga Stadium thanks to a 55th minute goal from striker Bonwell Mwape.

In an interview, Chambeshi said when the two teams meet at Arthur Davies Stadium in Saturday’s week 18 encounter, Power will not focus on revenge.

“No, we are not making any plans for revenge but we training hard for that game. We will just take that game seriously,” he said.

Chambeshi added:” I am happy the team is intact, we have no injuries and Mukuka Mulenga plus Joseph Sitali have recovered.”

He stated that Power’s third position on the league table is not putting the Kitwe side under pressure.

“We are not under pressure, all what we need is to focus on the remaining games. We need to take our games seriously so that we don’t drop any points.”

Blades Send Chabinga on Leave

Konkola Blades have suspended head coach Manfred Chabinga for one month.
Blades Chairperson Benard Mwanza confirmed on Wednesday.

The resolution to suspend Chabinga followed an executive committee meeting held on Tuesday to review the performance of the team so far in the season.

Mwanza said Chabinga’s fate will be known when his suspension ends.

” We have just suspended him. We had a meeting yesterday to look at our performance,” he said

Mwanza revealed that Enos Silwimba has since taken over as Blades caretaker coach.
The ex-Zambia international rose to the position of head coach earlier this year following the departure of Keagan Mumba who joined Zanaco.

Blades is 6th on the Faz Super Division table with 25 points in 18 matches and last Saturday lost 2-1 away at Roan United.

Earlier on Wednesday, sources at Blades told LT Sports that Chabinga had been fired together with his assistant Chewe Mulenga.
