LAZ to hear Mutembo Nchito’s alleged professional misconduct in his absentia

The Law Association of Zambia (LAZ) says it will proceed with its scheduled July 16 hearing on a matter Director of Public Prosecutions (DPP) Mutembo Nchito is facing allegations of professional misconduct.

LAZ president James Banda says the matter will be heard by the association’s Legal Practitioners’ Committee whether Mr. Nchito appears before the committee or not as the case is still active.

Mr. Nchito has already written to LAZ explaining that he is above such committees and as such can’t appear before them for disciplinary charges.

Mr. Banda has however affirmed that the Legal Practitioners’ Committee is not stopped from hearing such cases as the DPP is facing, if Mr. Nchito does not exercise any other options as provided for under the LAZ regulations.

The second summoning of the DPP is a follow up on a complaint to LAZ by Movement for Multiparty Democracy (MMD) Solwezi Central Member of Parliament Lucky Mulusa who complained to the association that Mr. Nchito allegedly lied to the parliamentary select committee when he was being screened for his current job by the parliamentary select committee.

The latest summons dated 30th May 2013 also indicate that LAZ has changed venue from Lusaka to Ndola City Council Chamber where he is expected to appear before a five man committee.

Chief government spokesperson Kennedy Sakeni says the Patriotic Front (PF) government has not received any report suggesting that the African Union has found a prima facie case against Zambian government over the Barotseland Agreement of 1964.

Earlier the PF government had indicated that it will engage dialogue with the Barotse Royal Establishment to find a solution to the 1964 land agreement which the Barotse Royal Establishment feels has not been upheld from the time that it was signed between the two parties.

Mr. Sakeni however notes that his government still engages dialogue with all traditional establishments in all ten provinces of the country.

Mr. Sakeni has also told Qfm that the PF is also in the process of decentralizing government functions in all ten provinces through local authorities in collaboration traditional establishments.

Vice President Guy Scott says government has not scrapped off the subsidy under the Farmer Input Support Program (FISP).
Dr Scott said the Patriotic Front (PF) government only wants to work on the system to make it better in order for small scale farmers whom the program was meant for to be benefiting from it.

The Vice President further advised Zambians not to listen to people complaining about government’s agriculture policies adding that such people are the ones against the PF government’s development agenda.

He said this when he addresses a rally to drum up support for Lameck Mangani a PF candidate in the Chipata Central Parliamentary by-election slated for July 25, at Chipata Basic School ground in Chipata district in Eastern province.

Meanwhile Dr Scott who is also PF party Vice President has asked electorates in Chipata Central to give Mr Mangani a 100 % vote during the by-election.

He also advised the electorates not to vote on tribal lines but vote for a PF candidate as he has the ability to deliver.

Dr Scott said that the PF government wants a member of parliament who will be able to give good representation in order to help government implement projects in the area.

The Vice President advised his PF party members to avoid confrontations amongst themselves and with members of the opposition as they campaign.

And Home Affairs Minister Edgar Lungu called on electorates to cast their vote wisely during the by-election by voting for Mr Mangani.

Meanwhile Mr Mangani said he would like to see Chipata Central develop further once voted for as area Member of Parliament.

Speaking earlier Eastern province Minister, Malozo Sichone disclosed that government will next year embark on the construction of Chipata District Hospital.

Mr Sichone said all the plans for the construction of the district hospital in 2014 have already been put in place.

Dr Scott also addressed rallies at Mchini and Nyakutwa grounds respectively.

He was accompanied by Defence Minister Geoffrey Mwamba, Home Affairs Minister Edgar Lungu, Foreign Affairs Minister Effron Lungu, Lusaka Province Minister Benson Kapaya and other senior government and party officials.

The Chipata Central Parliamentary seat fail vacant after the High court nullified the elections of MMDs Reuben Mutolo.

Four political parties are taking part in the Chipata Central Parliamentary by-elections and these include PF, UNIP, MMD, NAREP and an independent candidate.

Moses Phiri relishes Cosafa Cup callup

Zanaco striker Moses Phiri says he will utilize his inclusion in Zambia team for the COSAFA Cup as a springboard to earn a place in the senior Chipolopolo squad.

Phiri is part of the 20-member home based squad that entered camp in Lusaka on Thursday to prepare for the ongoing COSAFA Cup.

He hailed his national team call-up as morale booster.

“I just have to work hard so that I can earn a place in the senior national team.” Phiri said.

“The call-up for me is a booster,” he added.

Phiri further said he expected his call-up.

“I have been expecting it because I have been working hard.”

Meanwhile, Zambia shifts camp to Kitwe on 10 July, four days before their opener against Mozambique – a quarterfinal clash at Nkana Stadium.

People’s Party (PP) President Mike Mulongoti says acting chief Justice Lombe Chibesakunda should step down to keep her good reputation and integrity.

Mr. Mulongoti said that Justice Chibesakunda is a qualified person who does not need to worry about her future if she leaves her position today.

Mr. Mulongoti said that he has no doubt that Justice Chibesakunda will listen to the many people who have continued to speak negatively about her holding on to her current position.

The people’s party president has since appealed to the chief justice to reconsider her position and move a step further in her life by doing other things.

Mr. Mulongoti said that Justice Chibesakunda comes from a humble beginning and she should not dent her image by holding on to the position which she no longer qualifies for.

And National Restoration Party (NAREP) president Elias Chipimo has urged acting chief justice Lombe Chibesakunda to leave room for someone eligible to take over her position.

Mr. Chipimo said that there was no basis in law which allows somebody who has passed retirement age of a judge to be considered for a permanent position of chief justice.

Mr.Chipimo stressed that calls for her to retire have nothing to do with questioning her integrity or competence.

Mr.Chipimo added that for the sake of preserving her integrity which is important to everyone, she should not allow the process to continue.

He noted that someone eligible, capable and qualified by age should take over adding that the move will be fair for the Zambian people who are familiar with the law.

The NAREP leader said that it was unfortunate that on a straight forward matter the PF administration is again choosing to follow instinct and emotion rather than reasoning.

They will do well to consult widely and refer to the parliamentary select committee meeting for acting chief justice to resign he said.

He further added that government should blame itself for the consequences of not listening to the people.

Zambia not a dumping ground for substandard goods – Mukanga

Communication, Transport, Works and Supply Minister Yamfwa Mukanga has implored all manufactures and supplies of goods and services not to use Zambia as a dumping site of bad and substandard products.

Mr Mukanga said the Zambian community is expectant of top quality and innovative products that will better the lives of all road users.

Speaking when he officiated last night at the official launch of the wonder tyre safety product Self Sealing Tyre Technology (SSTT) in Lusaka by G and H Corporation Limited, Mr Mukanga said Zambians desires to have a private sector that will enhance economic development programmes in the country.

The Minister said the Patriotic Front government wants to see a situation where the local private sector takes up the initiative to partner with other companies from more developed countries in facilitating the transfer of technology and ensure that they create availability of modern products on the market.

He urged others companies to consider investing in Zambia adding that Zambia is strategically and geographically positioned in the region with membership from SADC and COMESA.

Mr Mukanga expressed hope that the newly introduced self sealing tyres will help Zambia reduce the number of road accidents which have increased in the recent past.

He however cautioned that despite the product being introduced on the market, the public should not do away with road safety but ensure that their vehicles are well maintained to avoid loss of life and property.

He further added that despite government constructing and rehabilitating more roads it will make no difference if road users do not uphold road safety precautions.

And Road Transport and Safety Agency Chief Executive Officer, Zindaba Soko attributed many road accidents that Zambia has witnessed in the recent past to poor vehicle maintenance and non adherence to road safety.

Mr Soko said people should make use of the newly introduced tyres by G and H but should not do away with road safety precautions and maintenance.

He further asked G and H Corporation Limited to consider partnering with Public Service Transport operators and test their products with them as they have the major road users.

He said the company should also consider coming up with other programs of vehicle maintenance and road safety to help Zambia reduce drastically on the number of road accidents being recorded on the Zambian roads.

G and H Corporation Limited had thanked the PF government for the favourable business policies that have helped build both small and medium enterprises in the country.

Chiefs unhappy with rising number of citizens being displaced from their farmlands by Investors

Traditional leaders have expressed concern over a high number of citizens who are displaced from their farmlands by developers who come to invest in the chiefdoms which are in the mining areas.

The chiefs complained of the large pieces of land which is being lost to developers who are not concerned about the livelihood of the local communities who are displaced from their farmlands as a result of the mining activities without compensation.

Speaking in an interview with ZANIS in Kabwe yesterday, at the just ended two days Chiefs’ Indaba organized by the Council of Churches in Zambia (CCZ), Chief Sinazongwe of the Tonga speaking people in Southern province emphasized on the government protection of the local people from being displaced by investors.

The traditional leader described as sad the situation where large pieces of land was being converted from farmland to mining areas without any benefit to the local communities who get displaced in the process.

CCZ, Chiefs and some investors from the six chiefdoms of Southern, Luapula and North-Western provinces were deliberating on the Statutory no. 55 of 2013 which aims at enhancing transparency and accountability in the natural resource management in the CCZ operation areas.

Chief Sinazongwe said most investors lack respect for traditional leaders when they come into the chiefdom, adding that the same investors are usually not monitored by government authorities to ensure adherence to the regulations of the land.

Their royal highnesses appealed to the government to work in consultation with the local traditional leaders in the issuance of licenses to the investors before they could be allowed to carry out activities in their chiefdoms.

And in a collective agreement read out by CCZ Communications officer Grace Zulu, the Indaba participants recommended a number of issues to the government among them, the enactment of the law on compensation which should be re-aligned with international lands standards and for
government to strengthen the law on environmental protection.

Other recommendations were the enactment of the law to protect people who are displaced in the process of paving way for investors and that government should ensure that there is harmonization in the laws on mining, agriculture and land.

They further recommended that government should come up with a law that will compel investors to pay up to about 25% of their profits to the royal establishment in the areas of operations, and that it should ensure that Statutory Instrument no. 55 of 2013 is strictly adhered to by all investors.

The indaba discussed among other issues the role of traditional leaders in the promotion of transparency and accountability in the management of natural resources, especially in the mining and forestry categories.

Among the six chiefs in attendance were Chiefs Musele, Mumena, Matebo, Chimese, Sinazongwe, and Simaamba all from CCZ areas of operation in Western, Luapula, and Southern provinces.

Others were the representatives from Lumwana South mine, First Quartum, Kalombeka Mines and Maamba.

ZCTA’s measure commended

A political activist Stanford Lizu has praised the Zambia Information Communication and Technology Authority (ZICTA) for instituting criminal proceedings against the three mobile phone service providers in the country.

Mr Lizu who is also a consultant, said the decision taken by ZICTA is long overdue as the three mobile providers have been offering sub standard services to their subscribers for a long time now.

He told ZANIS in an interview in Lusaka yesterday that Zambians expect good services from these service providers.

Mr Lizu however, said ZICTA should have first of all investigated why the three mobile providers have been offering substandard services to their subscribers as opposed to taking a legal redress.

He also stated that it is sad that ZICTA has become a complainant in a case of these three mobile providers instead of being the regulator, adding that the subscribers themselves would have been the ones suing the mobile providers.

Mr Lizu said the action by ZICTA indicates beyond doubt that the service providers have failed lamentably to perform a better job for the Zambian people.

He hinted that it could be that the three mobile providers acquired obsolete and substandard machines in the nation, hence the reason why their services are pathetic.

The political analyst also noted that government should not condone at all cost investors offering inferior services to the Zambian people.

Mr Lizu who cited South-Africa and Nigeria as among other nations where network is good, said communication is paramount in any prosperous nation.

ZICTA has instituted criminal proceedings against the three mobile phone service providers namely Airtel, MTN Zambia and ZAMTEL for failure to meet minimum standards of quality of service.

ZICTA also has resolved to take remedial measures relating to enforcement of quality of service in order to protect public interest in pursuant of the information and Communication Technologies Act No. 15 of 2009.

Meanwhile, Mr Lizu has called on government through the Ministry of Justice to give the Technical Committee drafting the republican constitution another one month in order for them to complete its works.

Mr Lizu told ZANIS that although he does not understand the reason why the Technical Committee drafting an important document failed to wind work within the stipulated time, the team should be given another month so that they do not make an accuse of limited time for giving the Zambian people a substandard piece of document adding that no additional funds should be given to them at this particular time.

He appealed to Justice Minister Winter Kabimba to reconsider his decision as being advocated by the church and other non-governmental organizations on giving the Technical Committee another month to completely finish its job.

Mwale-Nkana is back where it belongs

Nkana coach Masauso Mwale says Kalampa belong at the top of the FAZ Super Division table.

Mwale’s Nkana returned to the top of the table after thumping arch-rivals Power Dynamos 2-0 in the big Kitwe derby on Wednesday jut three days after losing 3-1 to Zesco United who temporary warmed up the top slot.

He reiterated that Nkana were not under pressure to stay at the top of the league table.

“It’s good we are back at the top, that’s where we belong,” Mwale said.

He added: “There is no pressure, we know what we are looking for and we do not concern ourselves with what others are doing whether we are neck to neck.”

Nkana goes into the three-week break to pave way for the COSAFA Cup Zambia 2013 leading the table on 32 points in 14 matches.

Israel Mwanza is FQM FC coach

Israel Mwanza has been appointed head coach of promoted FAZ Division One North side FQM Mining Football Club.

Mwanza confirmed his appointment on Friday.

The ex-Zambia and Nchanga Rangers defender said he has been at FQM for close to three weeks.

“I am now in Solwezi coaching FQM Mining, I have been there for almost three weeks,” Mwanza revealed.

He bounces back into coaching after leaving Mighty Mufulira Wanderers last April.

Mwanza’s immediate task is to help the Solwezi outfit stay in Division One North.

FQM Mining lies 14th on the 18-team Division One North table with 14 points after a round of 14 matches.

Mwanza started coaching at his childhood club Nchanga as youth team coach and later served as an assistant trainer before joining Wanderers earlier in 2012.

Increased illicit sex in villages located along the Chingola-Solwezi road worries Taskforce

Solwezi District Aids Taskforce (SDATF) says it is concerned with the increase in illicit sexual activities that are happening in villages located along the Chingola-Solwezi road.

SDATF Chairperson David Manda said villages around St. Dorothy and Kabisapi have become sleep over stations for local and international truck drivers.

He noted that the situation is alarming because girls as young 11 years old and young women are actively exposing themselves to risky sexual behaviours.

Mr Manda said this in an interview with ZANIS during the commemoration of the Voluntary Counselling and Testing (VCT) day held today at ST. Dorothy community.

Mr Manda said this is a challenge that the District AIDS Taskforce is facing in realizing HIV and AIDS prevention interventions in the district.

He also said the affected areas are under serviced in terms of VCT services as there are only Corridors of Hope that are conducting periodic mobile services.

And District Commissioner Crispin Likando in a speech read for him by the District Administrative Officer, Chipawa Chipawa said Solwezi district is rapidly being ravaged by the effects of HIV and AIDS following the population increase caused by the opening of the mines.

Mr Likando urged traditional and political leaders to encourage the people to go for VCT and obtain their results so that they can help to control the spread of the HIV virus.

The national VCT day was commemorated on June 30, under the theme “Reaching everyone, everywhere with Voluntary Counselling and Testing Services”

Times of Zambia to stage a sit-in protest on Monday due to three months non-payment of salaries

A sit-in protest slated for Monday 8th, July, 2013 is looming at the Times of Zambia to pressure government to help the state owned public media settle the three months non- payment of salaries.

The unionised workers at Times of Zambia have not been paid their monthly salaries for three months from April to June 2013.

The decision to stage a sit-in-protest follows a meeting held in Ndola where management and unionised members resolved to take the action next week.

The members unanimously resolved to take a go-slow with the view to seek government intervention in their plight adding that some of the workers have since been evicted from their houses due to non-payment of house rentals and also non-payment of utility bills such as water, electricity and even school fees for their school going children.

This is contained in a press statement signed by Zambia Union of Journalists (ZUJ) made available to ZANIS in Lusaka today.

The statement further states that the members resolved that the situation has continued to drag on for some time now and they feel withdrawing their labour would be the best answer to addressing the problem.

“Chapel executive committee officials explained the outcome of the meeting but the unionised members felt that things were not improving at Times of Zambia despite assurances from government and management.

“We unionised workers at the company have unanimously resolved to stage a sit-in protest on July 8th, 2013 to pressure government to address the situation because we have gone without being paid our monthly salaries for three months now,” the statement reads in part.

The unionised members however, have pledged to stand by the Union leadership as the only way to ensure that the firm is prevented from total collapse.

Namibia stun Mauritius in Cosafa Cup opener

Namibia kicked off the 2013 Cosafa Cup on a winning note after beating Mauritius 2-1 at Nkoloma Stadium in Lusaka.

The 1997 tournament runners-up up could have come away with a runaway score-line had they not been wasteful in front of goal.

Despite stamping their authority in the first half, Namibia were seriously guilty of bad finishing.

The goals meanwhile came from Striker Petrus Shitembi who scored the opening goal in the 19th minute with a stunning free kick while Pinehas Jakob fired in an unstoppable volley in the 44th minute.

Mauritius were a much improved side after the break and gave Namibia some scary moments but just lacked that final touch to make it a serious contest.

Mauritius striker Louis Laval hit the post in the 60th minute but made no mistake nine minutes before the end of the game after crashing in a superb free kick.

Namibia are top on three points, ahead of Monday’s final group A match against Seychelles who they must beat to secure their semifinal place.

Meanwhile the spotlight on match day two will be at Arthur Davies Stadium in Kitwe where Swaziland take on Botswana at 17:00 in the opening game in Group B.

Women want Dora Siliya back in Parliament

The Women’s movement has advised MMD Spokesperson Dora Siliya to recontest the Petauke Central seat.

Ms. Siliya recently lost her Petauke Central seat after the Supreme Court nullified her 2011 election victory saying it was marred with widespread electoral malpractices.

NGOCC Executive Director Engwase Mwale said in an interview in Lusaka that Ms. Siliya should consider re-contesting the seat in order to promote women’s participation in politics.

Mrs Mwale said Ms. Siliya is one of the strongest female political figures hence the need to retain her in the political landscape.

“For us Ms Siliya has demonstrated over the years that she is powerful female character in our politics and she has adequately represented the women in Parliament and we would like her to try again, ultimately the people of Petauke will have to decide but we would like to have her in Parliament again,” Ms. Mwale said.

She bemoaned the low levels of women’s participation in Parliament adding that losing Ms. Siliya in Parliament further weakens the female voice in politics.
