FJT’s troubles deepen

chilu.jpgTHE London High Court of justice chancery division will tomorrow pass another judgment in the case in which the Attorney General of Zambia is challenging the misappropriation of public funds by Second Republican president, Frederick Chiluba, and 19 others.
Dr Chiluba, former ministry of Finance permanent secretary, Stella Chibanda, former Zambia Consolidated Copper Mines (ZCCM) chairman, Francis Kaunda and Access Financial Services directors, Aaron Chungu and Faustin Kabwe were found liable to conspiracy to defraud the Government of Zambia and the court ordered them to pay 85 per cent of what was alleged to have been misappropriated.
Others were former Zambia Security Intelligence Services (ZSIS) director, Xavier Chungu, Congolese businessman, Raphael Soriano, former Zambian ambassador to the United States of America, Attan Shansonga and London-based lawyers, Meer Care and Desai.
Dr Chiluba, Mr Kabwe, Mr Chungu and Ms Chibanda have since applied to set aside the London judgment in the Lusaka High Court after the Attorney General applied that it be registered.
According to a letter dated June 22 this year by DLA Piper, who are the lawyers representing the Attorney General in London and addressed to Mr Kabwe and copied to Dr Chiluba, Ms Chibanda, Mr Chungu and Mr Kaunda, the court would deliver judgment regarding recoveries, interest and costs in the matter at 11:00 hours Zambian time.
“We write to inform you that judgment regarding recoveries, interest and costs in the above matter will be handed down on Friday, June 29, 2007 at 10 am in the United Kingdom (11 am in Zambia). As with trial, you will be able to participate via video link in the Zambian High Court.
“The handing down of the judgment will be conducted in public pursuant to the directions of Justice Peter Smith.
“We also enclose again a copy of our letter to the court regarding Dr Chiluba’s request for access to the transcripts of the trial, and the courts response,” reads the letter.
In the scheduled hearing of the registration of the judgment, Lusaka High Court Judge Japhet Banda yesterday adjourned the matter to July 9 for hearing.
Mr Justice Banda adjourned the matter after chief State advocate, Dominic Sichinga, applied to do so.
In his application, Mr Sichinga submitted that the State was desirous to consolidate its position in the matter so that submissions to be made to the court would be helpful in arriving at a fair and just conclusion for the parties involved.
He told the court that the adjournment was not intended to prejudice the respondents’ case as the matter was of public interest and that the State had heard the anxieties of the respondents through their affidavits.
Lawyers representing the respondents did not object to the application for an adjournment .
Meanwhile, the Attorney General, Mumba Malila, has asked the court to dismiss Dr Chiluba’s application to set aside the registration of the London High Court judgment.
In his affidavit in opposition to the application, Mr Malila claimed that most allegations made by Dr Chiluba not to register the London judgment were baseless and irrelevant to issues in court, as they had accepted that the English Court and Court of Appeals had jurisdiction to hear and determine the claims made against them by the Attorney General.
Mr Malila indicated that the position adopted by Dr Chiluba and others in their summons to court were inconsistent with their earlier position, and complained that they had failed to disclose full and accurate account of the London High Court proceedings to Mr Justice Banda.
He maintained that most issues raised by Dr Chiluba could not be relied upon as grounds to set aside the registration of the London High Court judgment and dismissed, as irrelevant, allegations that the proceedings were political and not legal and that the outcome of the judgment was pre-determined.
Mr Malila further stated that Dr Chiluba did not explain the basis upon which he said the London High Court judgment was not a judgment to which the Foreign Judgments Act of Zambia applied and that its registration was a contravention of the Act.

  4. #1, I think this has to do with giving effect to the ultimatum in the original judgment. FTJ and others were directed to restitute 85% of what they stole. They didn’t oblige, so Smith will be courting them 2moro for the consequences of not doing that. Not sure though about the implication on the judgment, granted that the trio are challenging it following its registration in Zambian courts.

  5. Pundit1# The london judgement is valid and it has been passed because it involves british nationals. One can say what they want the whitemans court will not reserve the judgement. The deliberations in Zambian court are just formalities. Our judiciary was not to quick and now you see how embarrassing it. Moreover we Zambia is donor funded so we are stuck my brother. I hope our judges have learnt a lesson that sitting on a case for so long is not good unless they want to be dismissed from their jobs. Look in Paksitan the chief justice is on a blick of being imprisoned because of not enforcing the laws himself. I hope our judiciary workers are back to for work because we need then they also need the money to feed their children.   6. The problems is this case has exceed public interest it has dimension of worldwide interest. The EU, USA, G8 name them all they are talking of good governance so expect that such case disposed as expected from the masses. In this case 85% paying back.

They have opted go with sata in the political gallows without a conscious. Chiluba is in big trouble and Frank Saviuor Chungu in sight has to utilised his prisoner’s dilemma wisely to mitigate his quagmire. Any gambling with the resolved Mwanawasa Boma of patriots will summarily finish him.The poor Chungu should use his skills to prove resourceful to avoid his worst senario end at the hands of his comrades.
    There are no two ways about this. Chiluba was legally misled by Sangwa and Simeza who have played cool on his way to calvary. Charles Taylor just fired his misleasing attorney which Chiluba missed big time. He has had a chance for a dignified compromise which has been missed. Mwanawasa is a seasoned attorney at law who knows criminals’ mindset. He also has the intruments of powers to use the existing law.

  17. I hope it won’t end on chiluba and the 19 others only. A lot of zambians benefited from Chiluba’s legacy. Plots were allocated illegaly. Council and government houses were sold for a song. Some senior civil servants acquired wealth much beyond what they used to earn. All these issues should investigated in depth so that all the beneficiaries of plundered citizens’ resources face the wrath of the law.

    What we expect FTJ to do is to simply say he admitts he was wrong and seek forgiveness.

    That way it will be easier for him. Zambians do forgive if you admitt your guilt. What most of us are frustrated about is his blutant denial of his wrong doings when everyone and everything points to the fact that he did steal.

This is where we’ll build modern universities, schools, hospitals, recreation parks. I have a problem with capitalism. I feel we cannot develop our nation in capitalism. It’s all about who has money. It’s the capitalist of course. So we have to be looking at these guys to come and invest. what about us?

Mwanawasa wants to finish Chiluba but he does not realise that as soon as he leaves office the same people will go after him. The difference between Chiluba and Mwanawasa is that Mwanawasa does a better job of stealing than Chiluba did, he does a good job of it.     A spokesman for Blair, 54, who stepped down on Wednesday and will take up a role as Middle East peace envoy, would neither confirm nor deny the reports.

    A police spokesman said they were not prepared to discuss the matter.

    Since March last year, detectives have been investigating whether political parties nominated people for state honours that come with seats in the House of Lords, in return for cash.

    He has been questioned twice before as a witness, the first serving prime minister to be quizzed in a criminal investigation.

    Prosecutors are considering whether charges should be brought against any individuals involved in the probe, which cast a shadow over the final months of Blair’s premiership.

    Detectives also investigated whether members of Blair’s inner circle sought to conceal evidence from police.

    Two close Blair aides are among three people who remain on police bail and both are under suspicion of taking part in a cover-up. All those questioned in the probe deny any wrongdoing.

    As he left office, it was announced that Blair would represent the Quartet of international powers — the United States, United Nations, European Union and Russia — in efforts to negotiate peace in the Middle East.

    In my view, judge Smith cannot determine for Zambia what is security operations or not. He cannot ascertain that expenditures made by the intelligence were not legitimate. To show how this money was spent is to dwell on internal operations of the intelligence. The Zamtrop account has done and been used for a lot of good for this country.

    That account has hidden nothing, any money spent by Chiluba from their was money that came from other sources and not government money. And the accounts can prove it at the bank, the auditors, Coopers as I have said and the Bank of Zambia itself, they all agreed that there was a surplus. Now if you have a surplus of 9 million and assuming you have misused other people’s money amounting to three million.

    Is it not only reasonable, natural and wise that somebody is not running an overdraft account…if he has nine million how does he steal three million? If you are telling me that there was a dificit of three million and then Chiluba took out nine million ooh.. he is liable. I know I can’t remember the subject maybe its algebra where you can deduct a bigger figure from a small one and there is a minus answer. But in this case if you have nine million and take away three surely I leave that matter to our lawyers to work on.

    But all the three audits that were carried out proved there was money in that account. And to suggest it was that account therefore, ni ng’ombe shakwa musanga it was all government money its not fair, its unattainable. Let me say that combart operations are meant to be secret and are guarded operations. There are many people who the state pays or reward financially or materially but whose details should remain anonymous. It will be irresponsible for me to disclose names and details of intelligence operations during 1995 to 2002.

  65. KK owes Barclays K 104 million
    FORMER President, Kenneth Kaunda, owes Barclays Bank K 104 million that he obtained as a loan.

    Barclays Bank Compliance manager James Kalambata submitted yesterday that neither Dr Kaunda nor the United National Independence Party (UNIP) had money in the bank.

    This is in a case in which lawyers from law firms, among them Central Chambers, Andrea Masiye and Company, Dove Chambers, Lukona Chambers and Mvunga and Associates, are owed legal fees amounting to US$ 645,526.26 by Dr Kaunda and UNIP.

    Mr Kalambata submitted that as at May 2007, Dr Kaunda owed the bank K104, 644,700.

    In an affidavit in opposition to the application for Garnishee order absolute, Mr Kalambata said the order ought not to have been made absolute to the bank.

    He however said following the order, he made a search for any account held by Dr Kaunda and UNIP.

    Mr Kalambata said he only came across a prestige plus account in the name of the former President.

    He said the account was holding a debt balance of a loan that was advanced by the bank to Dr Kaunda.

    “There is no money now held which can be applied to the judgement creditors (lawyers) in satisfaction of the said judgement debt as ordered by the Garnishee Order Nisi,”Mr Kalambata said.

    He also said the order was defective as it did not state the account numbers with Barclays Bank that the lawyer sought to attach.

    Mr Kalambata further said the order was defective in that it attempted to order that all the debts of Dr Kaunda and UNIP be attached to answer the judgement without considering whether the two defendants owed Barclays Bank.

    “It is prayed that the order against the second Garnishee should on the aforesaid grounds be set aside for irregularities or in the alternative should not be made absolute,” Mr Kalambata said.

    The companies include Zambia National Commercial Bank, Standard Chartered Bank, Stanbic Bank, Indo-Zambia Bank and Investments Bank.

    Others are Zambia National Holdings Limited, United Quarries Limited and Dora Tamane School.

    But Dr Kaunda has maintained that the lawyers volunteered to defend him and UNIP.

    According to an affidavit in support of summons for account inquiry, Dr Kaunda said the question of legal fees for the lawyers was a subject of discussion at a number of central committee meetings of the party since 1996.

    Dr Kaunda said a report by the then UNIP secretary general Sebastian Zulu made at the 31st Ordinary Council meeting of the party held in Kabwe in September 1996, stated that about 18 lawyers volunteered to defend him and the party.

    He said Ms Mwangala Zaloumis, one of the plaintiffs, confirmed that a group of lawyers representing him were offering free legal services and that they were acting for him on pro-bono basis (free).

    Dr Kaunda said it was an understanding between the defendants and the plaintiffs that although the services were offered pro-bono, there was need for him and UNIP to assist the lawyers with travel, accommodation, documentation and incidental expenses.

    The legal fees accrued when the lawyers represented Dr Kaunda in cases that included the misprision of treason, which attracted a fee of US$171,726.25, citizenship case with a fee of US$150,000, and the Black Mamba case at a feet of US$90,475.

    Other cases in which they represented Dr Kaunda are the Kabwe assassination attempt and the illegal assembly that attracted a fee of US$45,825 and the 1996 presidential petition case.
