Oasis Forum to maintain its distance from the NCC

The Oasis Forum says its decision to divorce itself from the National Constitution Conference (NCC) is strictly based on the fact that many contention issues in the NCC Act have remained unresolved.

Oasis Forum convener Father Joe Komakoma said at a press briefing in Lusaka today
that among the areas of concern is the composition of the NCC which is not
equitable.

Fr Komakoma  explained that this is so because out of a possible 502 members of the
National Constitution Conference, 279 are politicians, made up of 158 MPs, 48
representatives of political parties and 73  councilors. Only 15 percent of the
composition are from the civil society.

Fr Komakoma, who is also Zambia Episcopal Conference (ZEC) Secretary General,
further pointed out that the Act in its present state does not involve the
participation of the people at the level of adoption of the constitution.

He said the NCC Act, which establishes the NCC, clearly indicates a fundamental
departure from the people’s demands for a new constitution.

Fr Komakoma said the NCC is established not to adopt a new constitution but to alter
the current constitution.

“The Mungomba CRC had listened to the people and recommended repealing and replacing the current constitution which everyone including President  Mwanawasa considered as deeply flawed, oppressive and suffocating,” he said.

He said the NCC Act in Article 4 takes away from the people the chance to  be in
charge of the country’s constitutional destiny adding that the Act  provides for a
composition that now reflects a politician driven constitution over the constitution
making process.

Fr. Komakoma stressed that the popular mode of adoption, decided upon by the people,
should not be dominated by one particular category to ensure that the  draft
constitution to be decided upon will be a product of consensus.

He said agreeing to participate in the NCC would mean endorsing and  legitimizing a
process that has clearly departed from the poeple’s wishes to  repeal and replace
the current constitution.

And Fr. Komakoma explained that the Oasis Forum is not in alliance with second
republican president Dr. Frederick Chiluba.

He said contrary to media reports, during the Oasis Forum conference held on  13th
September this year, an invitation was sent to Dr. Chiluba and the first  republican
president Dr. Kenneth Kaunda in their capacities as former heads  of state and not
as individuals.

He said public meetings convened by the Forum have always been open and that
invitations are extended to all stakeholders regardless of political or religious
affiliations.

  1. The Oasis forum always distances itself from politicians and now don’t want to be part of the NCC because it full of politicians. Someone needs to tell Fr. Kamakoma that what they engage in is politics in itself are also politicians by default. The only difference is that they are not a registered political party.

  2. Finally I can hear some specific demand by civil society regarding this process, namely composition. Its interesting this from the Oasis forum. MPs are elected by the people so they are the most representative. If they are perceived by some people not to be, let civil society educate the masses and put pressure on their respective MPs to vote wisely on whatever the contentious issues might be in the constitution. And I imagine the 279 or 158 also include the opposition. I dont think that determining the composition that will satisfy everyone is an issue that can ever be resolved.

  3. I am not supprised. These guys distanced themselves from the Mung’omba CRC. Today they want to be seen to champion the constitution cause.
    They can go to hell.

    FORMER Forum for Democracy and Development (FDD) Mandevu Constituency member of parliament Patricia Nawa has charged that the Patriotic Front (PF) has failed to honour its pre-election campaign promises.

    In an interview, Nawa said there was nothing new that the current PF member of parliament Jean Kapata had initiated.

    “Most of the programmes that are being done are those that we left. When I am moving in the early hours what I see is that most of our women are waking up at one a.m. to draw water. During our time women had stopped waking up at one a.m. to draw water,” Nawa said. “PF was making promises of delivering within 90 days, they were promising to deliver free water before last year’s elections and since water falls under the council we thought that this would change but it’s not happening.”
    But Kapata said Nawa should just ‘shut her big mouth’ because as far as she was concerned, they were rivals.

It seems the Oasis Forum do not understand or accept the fact that MP’s are bonafide reps of the people.I would have thought the Forum would have taken on the job of lobbying the MP’s.The forum obviously feels they “represent” some section of society which is being sidelined from the NCC.Someone has to educate the forum on the technique of lobbying as they are merely a pressure group with no formal mandate from any section of society.Their behaviour continues to to baffle me as they are so confrontational even when they have genuine concerns that are best put forward by elected representatives.This is why they are labelled a political party in disguise….they behave as one !!

  9. We’re not aware of Oasis Forum’s Press briefing — LAZ

    THE Law Association of Zambia (LAZ) has disassociated itself from today’s Press briefing on the Constitution-making process by the Oasis Forum.
    LAZ president, Elijah Banda, said in an interview in Kitwe yesterday his organisation was not aware of the Oasis Forum’s Press briefing and as earlier indicated, LAZ was yet to come up with a firm position after consulting members.
    “We are not aware of the Oasis Forum Press briefing and even if we were aware, we would not be part of the briefing because we are yet to have our internal consultations,” Mr Banda said.
    Last week, Mr Banda said LAZ had stopped its members from attending the Oasis Forum stakeholders meeting because it wanted to prevent them from airing views that would contradict the association’s position on the National Constitution Conference (NCC).

  17. One needs to introspect before they point fingers and try to make decisions based on emotions. Fr kamokamo with his Oasis was part of the ZDIC and the people who drafted the NCC bill. He knew the content of the bill before it went to parliament for first, second and third readings. He never at any point pointed out the flows or his concerns regarding the NCC composition. The fact is, The president and the 158 MPs are the people we duly elected to represent us and preside over constitutional matters that is why the other name for MPs is legislators. They make laws. That is what we elected them for. The other bunch is the councilors (civic) leaders elected by the Zambian people to represent them regarding civic or local government issues. The people Oasis is alleging not to be represented are actually being represented by the MPs and councilors they actually elected to represent them. So what people is Kamokamo talking about? And since when did Oasis start representing us?….

  18. . LPM should forge ahead anarchy is not an option. Leadership calls for making tough decisions. You don’t expect 12 million people to agree on everything. We fundamentally agree that we need a new constitution. We also agree in principle on the adoption process. What we need now is strong leadership to steer the plan into the destiny. I support the close that says the president can dissolve the NCC, because we don’t need an endless process. We want results. The constitution also gives the president power to dissolve parliament. But we don’t see MPs boycotting parliament do we? The Oasis should appreciate the fact that in spite of being an illegal entity LPM has bent over backwards to accommodate their views. If this was KK era they would all be in jail today.

Who between them and GRZ is the constitutionally custodian of peace and safety of all Zambians. They have never signed any oath and owe nobody the duty of care.   27. NCC is going nowhere!! I support the position of O.F. We can’t let the C.M.P. be dominated by politicians because our Zambian politicians have no principles. Today the will say, we are in opposition, the next minute, after being corrupted; they will switch to the ruling party. A good example is one chimumbwa, he was there on PF ticket, and the next minute he had switched to MMD. When he was PF, the people of Chingola wanted to sue KCM for polluting Kafue River but Chimumbwa defended KCM and was against the will of the people of Chingola and Zambia in general. It turned out the reason this individual was defending KCM was because he is a registered supplier to KCM so he went out of his way to defend his ‘other’ pay masters. And he is not the only unprincipled politician we have, he is just one of many such corrupt people. So why should the people of Zambia let such criminals dominate the constitutional making process? Free thinking people must oppose NCC by all means!!

    Chinese couple beats anti copper sqaud officers in Kitwe

    Sept. 25 — Kitwe, September 25, ZANIS—–A Chinese Couple of Kitwe’s Buyantashi Township today assaulted some members of the Copperbelt Anti Copper Theft Squad in Kung Fu style after the couple was allegedly found with various finished copper products worth millions of Kwacha believed to have been stolen from Mopani Copper Mines, Copperbelt Energy Corporation (CEC) and Konkola Copper Mines (KCM) A check by the Zambia News and Information Services (ZANIS) at House Number 5876, Acacia Crescent in Buyantashi, found the emotionally charged couple pouring cold water on the Zambia National Broadcasting Corporation (ZNBC) News crew that had gone to cover the event.

One of the accused persons, a Ms Liang Yun, who was kicking the Police Officers as they tried to get entry into the house after obtaining a search warrant, also broke a camera belonging to Konkola Copper Mines after she tried to kick a KCM Employee who was taking pictures. Police sources found at the scene told ZANIS that they were acting on a tip off from members of the public. They said the couple, Mr Zhang Zhihua, and Liang Yun, who owns a Copper Supply and Processing Company, were found with Tonnes of copper cathodes, anodes, triangular bars, spillage, wires and angle bars believed to have been stolen from KCM, Mopani and CEC. Police said that the couple alleged that they bought the merchandise from some local individuals. And Kitwe Police Commanding Officer, Mhlakeni Zulu, who confirmed the development to ZANIS said he could not give further details on the matter as he was still waiting for a report from the squad on the issue.

  36. Levy reiterates that no Mugabe, no EU-Africa sumit

    Sept. 25 — From Emmerson Muchangwe New York, Sept 25, ZANIS-President Levy Mwanawasa has reiterated that the official position of the SADC region is that nobody will attend the Eurpean Union (EU) – Africa Sumit set for December in Portrugal if Presenedent Robert Mugabe of Zimbabwe is not anvited to that sumit. Mr. Mwanawasa, who is the current SADC chairman, said this yesterday when he was answering a question from a Zimbabwe journalists on the regional body’s official position on the summit. Mr. Mwanawasa said it would be difficult for any head of State in the SADC to attend the EU-Africa summit without Mr. Mugabe in attendance. He stressed that there was need for unity of purpose in the region in all areas of mutual interest. Earlier, Mr. Mwanawasa and his Zimbabwean counterpart had closed door discussions on the 47th floor of New York Palace Hotel where Mr. Mwanawasa is lodging.

  38. UNIP CB Provincial Chairman arrested

    Sept. 25 — Mufulira, Sept 25, ZANIS–Opposition United Natioal Independence Party (UNIP) Copperbelt Provincial Chairman, Oliver Kabange has been arrested by the immigration department over his nationality which is still being probed. Investigative wings say Mr. Kabango is not a Zambian but a Congolese national born in the Democratic Republic of Congo) DRC in 1963 and has been branded a prohibited immigrant. Mr. Kabango 44, a mining engineer at Konkola Copper Mines (KCM) is currently detained at Kamuchanga open air prison in Mufulira. The opposition Copperbelt Provincial Chairman contested last years September 2007, tripartite polls as a parliamentarian for the Mufulira Central seat under the joint alliance, the United Democratic Alliance (UDA).

  39. Sources handling the case say Mr. Kabango entered Zambia in 1993 and managed to acquire a Zambian passport and National Registration Card (NRC). The sources disclosed that Mr. Kabango claimed that he was a Zambian born at Kashiba District in Mwense in Luapula Province, but such chiefdom does not exist. The sources noted that Mr. Kabango’s arrest has nothing to do with his ties with the opposition party, UNIP. The sources said Mr. Kabango’s nationality has been under scrutiny for several years now and the immigration department has managed to extract and ellicit key details on this issue.
