Provision for NCC dissolution necessary – Mpombo

Government says a provision for the dissolution of the National Constitutional Conference (NCC) is a necessary sanction to ensure that delegates do their work within the confines of law.

Acting Chief Government spokesperson George Mpombo said it was proper that there is
a provision for dissolution of the NCC should its work degenerate into breach of
law.

Mr. Mpombo said the provision for the Republican President to dissolve an unruly NCC
is a necessary sanction to ensure that delegates conduct themselves property.

He said the provision is a security safeguard that would be used only when it
becomes absolutely necessary and unless the NCC chair is seen to be party to the
breach of the order.

He said it is at this stage that government would consult the chair and the
secretary before dissolution of the conference.

Mr. Mpombo said President Levy Mwanawasa meant acts likely to impede implementation
of the Act and governance that would constitute an offense.

” Those who express their right in a lawful manner need not fear because the
president has no intention of arresting nor threatening law abiding citizens for
stating their fears, concerns or wishes,” he said.

Mr. Mpombo told ZANIS in a press statement that government is concerned about
misinformation and ignorance being banded and exhibited by some political parties
and civil societies on the provisions of the NCC.

Mr. Mpombo, who is also Defence Minister, said people claiming that the NCC does not
provide a new constitution to replace the current one have not read the act.

He stated that Section 13 of the Act provided for the conference to consider and
deliberate the provisions of the report of the constitution and the draft
constitution.

The minister added that the Act provided that the entire draft shall be submitted to
a referendum if a decision to do so is made by the members.

He said it is surprising that the Patriotic Front (PF) party is calling for
proportional representation that equates political parties with church mother
bodies.

“The church mother bodies have been included on the NCC for the wisdom that the
participants can draw from them as non partisan people and not to represent their
church members,” he said.

He said a church mother body cannot claim mandate to speak for its flock on
contentious issues such as content of the constitution because its members belong to
different political parties that may represent them.

Unless it was the intention of the PF to leave out the church mother bodies that
were established less than ten years ago, Mr. Mpombo said there is no justification
to demand that only church bodies that had existed for ten years ago should qualify
 to send representatives.

Mr. Mpombo added that it is an insult on the intelligence of church leaders to
suggest that a church mother body that was established less than ten years ago will
be an appendage of the government.

He has since advised PF party to read National Assembly of Zambia Standing Orders
104 if it want certain parts of the NCC Act amended.

  1. MMD Govt is shameless in its corrupt practices. How can you put a provision to dissolve a body when you see fit. Only a stupid person can not read through the lines. This means that if the proceedings of the commision does not favour “them,” LPM can wake up one morning and dissolve the whole thing. THIS IS RIDICULOUS!!!

    What if LPM just voted for himself by rigging the last two elections 2001 & 2006 to get and stay in power? There is need for people to complain and act against poor and corrupt leadership!

    You appear to be talking in your sleep. Do you know that the President is sworn to be the custodian of the Zambian Constitution .Since independence the constitution has always guaranteed that the President can dissolve parliament which is more important since it’s members are elected by a cross section of people.He can also dissolve cabinet. This is done to ensure that the country is not made ungovernable through anarchy by members of any institution. What is so special about NCC

  13. Putting ethical issues aside, its hard to disagree with James Watson. Some traits of human behaviour, including aversion to progressive thinking, can become genetic over centuries.

    Why is total GDP of Sub-Saharan Africa, including RSA(700 million+), only about that of New Jersey (9 million) or Pennsylvania(13 mn), not to mention California.
    Prof Watson’s point was this, why is Africa still lagging far behind when other nations have shown how you can attain prosperity already?

In any walk of life there is a referee. If you a father you very well that they are certain things shouldnt tolarent in your house. The president has to be vested with the power of dissolving the NCC if its seen to be wasting time and task payermonies. You can imagine if this conference would take 4 years with 500…

  15. ctd. delegates each getting 500 000 kwacha for sitting allowance this is per sitting K250 000 000.00. These money can be used to in other sectors like buying health equipment, education, roads, expanding power, housing etc. So it makes sense to to have a judge who oversees the on going of the NCC- this can not be anyother than the president he is the head of state.

  17. Easy, Prof Watson’s comments were offensive. However Africa cannot continue to blame the west for its failures. Its your copper why are they controlling it? You spent K250 billion on CRC and are now looking at another 300-500 billion to enact it, so the constitution process will take set you back a trillion kwacha. Then the donors(who you blame) will fund your roads, education and malaria treatment. Only in Africa is such economic insanity so hard to see? Prof Hansungile is right

  18. #21 Francis u make alot of sense and this is what I ve been saying for along time but some pipo addicted to negativism have always protested that whatever it takes we have to spend whatever money we can on a ducument that is so centered on who has the power to exploit the pipo and not what will improve the lives.Don’t get me wrong constitution is very important document if we could just come together and focus on what unit us than what divid us we can build trust and pass it with less cost
