HH opposes Sata on constitution of a Medical Board

Opposition United Party for National Development (UPND) has opposed the suggestion by Patriotic Front leader Michael Sata that Cabinet should ask the Chief Justice to constitute a Medical Board to be flown into Paris to go and inquire into the condition of the President Mwanawasa.

UPND President Hakainde Hichilema described such calls as untimely and insensitive as the nation is at the moment pre-occupied with praying for the quick recovery of Dr. Mwanawasa.

Briefing the press in Lusaka today, Mr. Hichilema said a Board constituted under article 36 (1) of the constitution is not for patients who are still receiving treatment in hospital but those reasonably suspected to be incapable of ruling after receiving treatment beyond a reasonable time.

He said those who are in a hurry to invoke the provisions of article 36 of the constitution should hold their fire and wait for a reasonable period of time to allow the treatment to have its full course.

Mr. Hichilema pointed out that the nation will need to be satisfied that the treatment given to Dr. Mwanawasa has failed after which the relevant constitutional provisions can be rightly invoked.

He urged the Zambian people to be calm and commit Dr. Mwanawasa to prayers and also urged government through Cabinet to continue providing the necessary leadership in the absence of Dr. Mwanawasa who is hospitalized in France.

The UPND leader charged that Mr. Sata was evacuated to South Africa using tax prayers’ money and no-one championed calls to set a Medical Board to purportedly declare him unfit to run the PF party.

Meanwhile, Mr. Hichilema has said the food crisis Zambia is allegedly experiencing threatens household and national stability.

He blamed the food crisis on government’s bad policies in the agricultural sector.

Mr. Hichilema also said the Zambia Electricity Supply Corporation (ZESCO) and the Lusaka Water and Sewerage Company hiking of electricity and water tariffs is unacceptable.

  4. Quite well it is too early to come up with a board. Howewver, the nation deserves better updates from Paris. If LPM is still in Paris after Six months, how will people satisfy themselves that the treatment has failed or not. We need to know what is going on as LPM is our president and a public figure. Chief Justice please constitute a board and let them be on standby in case LPM remains in Hospital after 4 months. Both Sata and HH have valid points but we need a board on standby. This is how serious people work.

I think LPM cannot and should not be treated like anyother government employee.That is a special position.that is why we are all concerned.And don’t forget even if you have 90day full pay + 90 days half pay on medical as a govt employees your boss in you dept. has the right to relieve you of your duties when he sees it fit. LPM himself, if i remember well, retired sikatana in the same line.Who is LPM’s boss in this case?that is why we need to no for sure how his condition is.Let an independent medical team visit him.after all Zambian’s are likely to understand the “mutoto” he needs better than the french witches.

  8. What a joke. The president is lying in a French hospital in a coma. The nation has been kept in the dark as far as how grave his condition is. The VP has no legal authority to temporarily assume Presidential responsibility because of Mwanawasa’s greed, lack of forsight and wisdom. The country is essentially in autopilot and our esteemed opposition leader HH suggests that we continue fiddling our thumbs and toes. So how do we get to the point of “reasonably” suspecting Levi to be incapable of ruling if a medical board is not constituted. Are we to rely on the same gvt that told us that he was “jogging in the streets of London” the first time he had a stroke? Wake up people!

I must admit that I at times admire Sata’s straight talk, but as a politician aspiring to be a president i think he should sometimes guard against saying things that may lead to the electorate questioning his leadership credintials, especially at this point. He should remember people will not judge him the same way they may judge Teta, because of his status in Society.   10. RB yesturday told the Commonwealth meeting in LStone that the president is asking that we help Zim with the issues bla bla bla. Who was he referring to when he said The president??? How can someone in a coma, make a statement???? RB is a fool and he should just leave politics if he thinks this is the Kaunda era where people where not allowed to think. But as things stand the Zambian population does not even know the condition of the Head of State. How stable is a condition in ICU, ICU is not for stable conditions, if his condition is stable then it is critical, otherwise he is not supposed to be in ICU.   32. I think the problem we have here with the two is the fact that they may be interested parties both of them for plot one, so naturally, it will be dificult to draw a line or to convince anyone as regards to the motive of their statements.

    Personally, I have never trusted Sata’s motives, but the fact is what he said is what majority of Zambians would want to see happen now. I don’t know the politics behind this, but I want to agree with Sata on the constitution of a medical board for the sake of the nation being properly informed, I am not sure what the TORs will look like but I would imagine it would include giving feedbaco to the nation on the actual status of the President. 16 days of STABLE and SATISFACTORY on coma might not be the way to go for a President, its unfortunate people are talking of him as just another Government employee.

    Who is the acting president now? Is it Mpombo or RB? RB when asked about the wrangles in MMD simply said, “Let them sort it out, just like we sort out our problems in our own party (UNIP).” Gentlemen and ladies, the crisis is growing. We need national champions, NOW!

One thing I am 100% sure of though is that LPM doctors in paris have given government their opinion on LPM’s prognosis and this is what they need to tell the people and the CJ. And I believe based on this expert opinion, the CJ can then make up his mind wheter or not to constitute the said medical board. Under the current circumstances, I think it would be worthy to look into Sata’s suggestion pragmatically, for in reality, i looks like the way forward. Lets be realist.   38. While I apprecaite the need for continued prayers for the LPM, we should be preoccupied with how best the country should be run. LPM’s sickness should not bring the whole country to a stand still.(Halt). Let us distinguish between LPM as a President, and him as a citizen. Other countries (Israel and Palestine) have experienced this but their respective governments acted swifly so as not to disrupt the running of the affairs of the state. Today, we we read who Teta, foolishly or rightly proclaimed no one can fire him since the appointing authority is not in the country. We all know the limitations that RB faces, come on people. This is a very delicate situation and faulting Sata for asking what Zambians deserve is really like saying we deserve having a month without a President. If the family is quiet about the all thing, I am telling you things are not as they are supposed to be. How long should we wait before we get a substantive report about his condition?   44. i’ve always said the problem with African leadership is that it is soley dependent one the president.Presidency is a team effort and govt. is NOT just one man!! Zambia won many matches without Kalusha as captain…so can’t Zambia still progress without LPM?   46. I think It will be folly to think that despite the comments “lets pray from LPM,” some people are busy working behind the curtain or is it fighting on who will become the next president. Even RB is currently focusing his time on who will be the next president, what sata said is absolutely wrong and premature, however, what is even more distateful is the shroud of secrecy that Levy’s illness has been given. People should understand that we are not talking about Maureen leaving him, for sure that would be immoral if it happened. But we are asking for the presidency to continue functioning and not put in ICU in paris together with LPM its not his property. He was put there by the people to take custood of the office. We have the Attorney General (AG), Minister of Justice (MOJ) and Solicitor General (SG) all these chaps cant advise govt correctly? then whats their purpose in office f course not to mention that they are over duplicated jobs?

  51. The problem RB’s hands are tide. He is also afraid of the family and the way the MMD handles affairs. The man is literally at their mercy. The person who is supposed to really make things move is like Sata has said the the CJ. If the CJ is not willing to have Zambia move on, will continue gropping and waiting for the miracle. Coma is not like Malaria or mere Migraine. Some one can be in coma as long as the family wants. More so, I don’t believe Levy left a living will.   52. HH’s statement is very logical. The President is still undergoing treatment after which it will be determined whether he is fit to continue or not. Cabinet makes the recommendation to the Chief Justice to constitute a medical board to carry out an enquiry into the health of the President. The CJ then submits the findings to the National Assembly who will then put the motion to a vote. If the report says he is unfit and this is ratified by a two thirds majority, he ceases to hold office. The Vice President then assumes office for a three months period and then elections. The process requires time and must be approached with level heads not the uninformed positions most people are proposing.

It may seem like a radical idea but we should consider some form of african communism were we just have one party and all those interested in politics should be members of this party only.     When Zambia was facing an economic decline, since most if not all of the companies where owned by govt, they also had to be funded by govt. They are many mistakes KK made with his system of govt and the BIGGEST one was having monopolies. They where too many monopolies during KK’s time because KK never wanted competition in the fear that consumers might switch to the alternative. Also making Zambia a closed economy. Without trade, other industries cannot develop because for them to develop, they need to export and also face foreign competition so they can improve on there products but in KK’s system, they where limited to the Zambian market which meant limited market.

    Also if you have a bunch of monopolies which are run by govt, the probability of getting good leadership for those companies is extremely slim.

    When a bunch of monopolies owned by govt are making losses, govt is left with a few choices, either raise taxes so as to pay for the losses, transfer the money meant for other parts of the economy to the failing companies or borrow money which is what KK did. KK borrowed money in the hope that copper prices will rise but that never happened leaving Zambia with a bunch of failing companies and a huge debt.

  293. Chiluba was left with a few choices on his hand. He inherited a country which has huge debts and failing govt owned monopolies. What Chiluba had to do was sell the monopolies in the hope that competitors might show up, remove the fixed exchange rate policy, make Zambia an open economy and also Capitalise.

    Now this is where the problem comes from. Copper prices down and copper production diminishing and lets not forget the huge debt. Copper was the chief foreign exchange earner of the country (thanks to KK). Most of the foreign exchange earned through copper sales was used to pay off the debt. This meant local companies and govt had less foreign currency to buy inputs for the economy.

    Companies could no longer buy inputs because of the little foreign currency in the country and lets not forget govt couldn’t buy the necessary infrastructure needed in the economy. Chiluba was left with this choice, raise taxes and print more money. This resulted in inflation. With inflation on the rise, banks could no longer make profits and so they had to raise there interest rates. With high taxes and high interest rates, companies relocated and others closed. And to also add a dash of corruption, it was obvious the direction the country was heading. LPM (though i dont support him) is at least trying to cancel out the mess caused by KK’s economic policies.

In post #356 you have listed a few countries but again you can correct me if I’m wrong but from your list I think Cuba is the only country that has/was a full communist state. Zim and DRC have always had different political parties. After 1980 Zim had ZANU-PF under Mugabe and another party lead by J. Nkomo I believe. I don’t know much about pre- 1980 Zimbabwe. DRC had many parties too, Lumumba and others had their own parties. I think even Lumumba road must have been named after this DRC politician.

In China, govt does not own 60% of your business (which was KK’s system). There are many countries in which communism has failed. Just look at the difference between North and South Korea.     On agriculture i’ll agree with you, but as long as farmers are free to farm what they want (capitalism). They should not have there are twisted to farm what govt wants them to farm. And we cannot rely on copper forever. What will happen if copper prices fall again.

The chinese have a 3 tier system which is something like this: the chinese gov’t controls 50% of the companies i.e. state companies, 1/4 is owned by private chinese individuals and then the other 1/4 is what the have left for the foreign investors. So from my simple break down you can see that between the gov’t the the individual chinese investors, they control 3/4 of the econonmy and only a 1/4 is left to foreign investors. I believe this is what we need in Zambia not where by foreign investors control about 90% of our economy, the gov’t has 8% and local investors 2%. That is why Zambia can not develop like this.

  434. My friend #539 Chinsali…, let me inform you that I have never before voted for the UPND under all its leaders. However, I will inform you that it is not me who will make HH win the Presidency of Zambia but the Zambian people who will vote for him (HH).

    HH is as much a Zambian Citizen as yourself and so do not understand your assertions. It is not your vote alone which will cause a slow down in HH’s popularity but be mindiful that you as a single entity are not Zambia as a Nation. Re-check the statistics for the 2006 elections and prepare for a rude shock.
