PF cadres yesterday forced their way into the High Court foyer as some taunted and insulted police officers.

Some started chanting political slogans as Judge Gregory Phiri was hearing the party’s application to discharge the injunction in which the State is supporting the 27 Patriotic Front (PF) members of Parliament. The injunction is aimed at restraining PF from expelling its MPs for participating in the National Constitutional Conference (NCC).

Solicitor-General Dominic Sichinga said before Judge Phiri that the State’s position was that the injunction be sustained.

“The core public interest of the State is the integrity of the body known as NCC and integrity of NCC Act number 17 of 2007 by virtue of which the NCC was established.

“We submit that there is greater anxiety about prospects of a new constitution. It has taken many years for the country to have the NCC and enacting the NCC Act,” Mr Sichinga said.

He said the plaintiffs were MPs elected to enact laws and if their injunction were discharged, the constitution-making process would suffer setbacks, which in effect would not be atoned for in damages.

And the MPs’ lawyer Mutakela Lisimba said there was sufficient disclosure and a clear arguable claim that needed to be determined.

Mr Lisimba implored the court to rule in favour of the 18 MPs.

He said if the MPs were expelled from the party, they would suffer irreparable injury and their right to participate in party politics could not be atoned for in damages.

Mr Lisimba said for any democratic establishment, which the PF was, it should allow its members to agree or disagree.

Another plaintiffs’ lawyer Mwangala Zaloumis said the defendants caused delay in setting date for hearing the exparte injunction.

Ms Zaloumis said the defendants sought leave to appeal to the Supreme Court and the matter was adjourned sine die while waiting for the appeal to be heard.

“It is misleading to the court to say that the plaintiffs delayed the matter,” she said.

But defence lawyer Bonaventure Mutale maintained that the injunction should be discharged because there was no legal basis to continue sustaining it.

Mr Mutale said Mr Sichinga’s argument that discharging the injunction would negatively affect NCC proceedings was misconceived and misguided.

“The absence of 18 MPs is not likely to disrupt the NCC proceedings,” he said.

He asked the court to take judicial notice of media statements by PF Matero MP Faustina Sinyangwe in which she had been quoted as saying the party expelled her before the MPs sought the injunction.

He submitted that the restrictive injunction the MPs sought would not serve any purpose with regard to her.
“I submit that whatever ruling the court will deliver will and should not apply to Mrs Sinyangwe,” he said.

Another defence lawyer Mumba Kapumpa said it was not likely that the MPs would suffer irreparable damage if the injunction were discharged.

Judge Phiri set December 22, 2008, as the date for ruling.

MMD post 1991 had a calm period where we all said let us give them chance to work.   14. What is surprising is that PF seeks the law yet they seem not to be ready for the Law. What type of people are PF cadres? Anyway, this is not too unique occurence because even the Minibus drivers and conductors behave the same way even though they have not recieved any common training.     Who can fail to go and listen to a commedian who offers free performance?
    Sata is very entertaining when it comes to rallies. This why he pulled alot of people during his rallies in the justed ended election campaigns. Even in Mazabuka, Choma, livingstone, Mongu, etc he was pulling thousands upon thousands causing him to think he had support. But when it came to voting he was getting 600, 100, 52, votes and so on in these areas. So those MPs who left their business to listen to Sata were looking for nothing after their busy schedules but recreation and free entertainment which Sata provides.

    Do you know that even some MPs and officials from other parties such as UNIP, UPND, MMD etc would sneek in to attend Sata’s rallies for the sake of entertainment and relaxing after busy schedules. It is fanny that even the post which at one point people thought were analytical could not tell that people wanted simply to get free entertainment and recreation. this man, SATA is in a wrong career that is why he keeps losing elections. If he had found a job at Holywood in the USA during his early days of life, he would have been a world star by now.     I will tell you one thing; Facts remain facts whether or not they are acknowledged, whether or not they are appealing to our ears, whether or not we like them. It is like a man who has malaria; even when he says i dont have it it will be there, until he probably takes Coaterm or the like. He can go about condeming the lab tech for giving him results that show he is malaria++. So Sata needs to acknowledge that his rallies do not yield the desired result. Now, ask anyone as to whether Sata is entertaining or not, few will say he is not. Myself for example I dont miss his radio and TV interviews; I enjoy them so much, evem my kids know. Can you state some of the possible solutions Sata is offering now concerning the financial crisis which has led to copper prices gowing down, exchange rates going up and food prices going up. All I hear is let us demonstrate. If he was in state house would he solve these global factors by demos or by economic approach? Guys let us be serious, are we that easy to cheat?

  33. Zambia is a democracy. Therefore I can only end at advising people not to be cheated by SATA. In democracy we dont force but simply advise. If you want to be cheated, that is part of your freedoms and choices. All I will tell is that for me it is not possible to be cheated by SATA. You say SATA is identifying with the poor; well, he identified with them for 10 years what did they get in turn apart from killing industry and causing job losses? He see the poor, most of whom have little or no analysis and he amanipulates them by saysing he idenfies with them. He goes to Mongu and tells people he would honour the Barotse Agreement. I am happy the lozis were too good for him to manipulate.

    Most of Sata’s vote came from kaponyas. I am educated my friend and I did not vote for SATA. Sata scored votes in compounds where kaponyas are. That is your group I believe and if that is the education you are talking about, then being cheated will never end.
    I have just realised that are the people who praise Chiluba’s leadership. That is not surprising because even SATA your Boss thinks Chiluba’s leadership is the best Zambia can ever have. Because of that SATA spent sleepless nights trying to force a change of constitution to make Chiluba a ‘Muyaya’ type of a leader. Whatever the side, the fact is there is increased urban poverty and unfortunately more and more younger and energetic people are still flocking to the few cities we have in view of better opportunities as the rural areas remain stagnant with poor or no roads/bridges and other essential facilities not to mention inadequate agric activities/retains.Those unemployed masses or piece workers in towns would naturally be growing food for themselves and selling some to the town dwellers, so naturally unga manje nikudula mutengo since tabalima!The MMD govt seems has not made rural devp a priority only too much politiking.

    If blogging here comes from benefits from MMD, then ‘the spectator’ is one of the beneficiaries of MMD.
    Taking children to school should not come because someone has got benefits from MMD. I would be shocked if all the PF cadres are NOT taking their children to school. SATA himself has children in school, so Mr spectator go and tell SATA to confess to the nation that he is getting benefits from MMD. Man, just tell your fellow PF cadres to take their kids to school; it does not need to be from benefits from MMD, we call it hard work my friend. I have PF friend who can never think like that. They have better perception of issues.

At 70, Fine states that Kaponyas voted for Sata in town.This is simplistic and grossly misleadig.The implication of this statement is that educated people in town never voted for Sata and rushed to rural areas to give RB resounding victory in those areas.Further,it is a fact that relatively, the highest concentration of literate citizens is in urban areas and therefore,if Sata won in these areas then he is the more likely to have been voted for by many enlighted citizens opposed to RB.This is a simple law of probability.

    Sata winning in town does not imply he was voted by the educated, not at all.
    If you did not lack knowledge you would have been aware that 70% of town dwellers are uneducated.
    You would also have known that 98% of Sata’s rallies are attended by the uneducated.
    It is therefore shocking that anyone would ever think that winning in town means you have support of the elite.
    Anyway, by PF standards even grade 4s are educated. So the statistics of illiteracy are from different from those of Central Statistics Office (CSO).
