Former Access financial services limited directors’ Faustin Kabwe and Aaron Chungu have asked the government to constitute a commission of enquiry to investigate and establish whether there has been collusion between the judiciary and the Task force in the prosecution of their case.

Mr. Chungu said they have come across a signed memorandum of understanding between certain donor countries and the Task force on corruption whose content on the advised counsel violates the constitution and undermines the administration of justice in the country.

Mr Chungu disclosed that the MOU has an attached restricted strategic plan of the task force , of which clause 2.5 says that the successful prosecution of the cases will depend to a large extent on the integrity and competence of the magistrates assigned to handle the cases.

He stressed that the clause alludes to a clear collusion between the Task force and the Judiciary noting that this has instilled fear in them, that their trial in the courts of Law and the results are predetermined.

They have since written to the Vice president George Kunda , Justice Minister and the Director General Anti-corruption commission ACC to investigate possible violations of the ACC Act in the interaction between the Task force and the Judiciary.

Mr. Chungu was speaking during a media briefing in Lusaka today.

  7. A lot of you that comment on here have very low appreciation of ebven those position you seem to expouse. It is not a bad thing to nopt comment when you can’t do it intelligently. A lot zambian are just like some of you, where when the state says it is so, then it is. We need people like chungu, who can challenge some of these things.

  12. Agreed with 23. Most of these cases were presented to court without proper investigations. Some of the cases were presented with missing information that would have exonerated some of the them. Ans some information it appears was presented to court out of pure vindictiveness

While its true there was, and there is still corruption in Zambia, the direction and the spirit in which the Task Force has hundled these cases is clearly punitive to the late president’s political opponents.   18. 29. I don’t doubt what you say, but when you accuse someone of being a thief, the evidence that is presented in court has to support that charge. For instance, I see Aaron Chungu and Faustin Kabwe being charged with theft, yet they were working in their capacity as director of a company. Was the veil of incorporation lifted. Did Access in its capacity complain of any theft. Did the govt provide an accounting of all inflows to the Zamtrop accounts rather just a focus on outflows. Those are the questions coming out in the courts. There may be a charge of abuse of office but I don’t think theft has been clearly asserted,

    When a company was allegedly used as a conduit to conduct criminal activities the veil of incorporation does not need to be lifted. This is especially true for its directors who can be charged jointly or severally for any crimes committed in their capacity.

Frankly i get very ticked off by our general zambian mentality where rumours are presented as facts, but this is not bad if we didn’t believe them as well. I feel scared when you feel that govt can strategise behind your back, even where the contistution does not provide for it and you are willing to accept it.     The case of Zambian Airways is different. Theirs is a situation where the company may have gone insolvent in the normal course of business. No one has accused them of committing any crimes (as far as I know). The directors of Zambian Airways could be accused of fraud if they presented a false picture of the company’s financial position (through fraudulent financial reporting).

    My point regarding Messrs Chungu and Kabwe is that one cannot commit a crime and hide behind the veil of incorporation.

I am in the UK, while I visit Zambia every so often, but I have developed some sort of obsession with these cases and so when I read some comments here, I tend feel dissapointed in that most comments here are devoid of a logic base.   34. 46. You are right that the veil of incorporation is lifted when the company was set up for fraudulent purposes. But wouldn’t you agree with me that this evidence would be in court by now. But it is not. frankly, i feel the cases are much ado about nothing.

    In the case of Zambian Airways, If you get a chance, read executive issue for July, September and January 2009. Does it make sense that Chileshe Kapwepwe was relieved of her Job when the National Aiport was asking for payment. The moment Mwanawasa dies and Magande is not successful, the airline goes bust. I don’t know what is happening but something sinister may be happening.

I do not disagree with your point above, but if I can find the links I will post them here. My questions is not whether this was a viable businesses or not, but it was being presented as such. Had Mwanawasa not died, it appears they would have gotten funding from ZSIC, NAPSA and ZCCM up to the tune of US$ 10 m. Already up US 5M from DBZ will be irrecoverable. I am just saying a bit of double standards here, Wasn’t this the very things that have put the Access Directors in trouble. There seem to be a lot of influence peddlings.

I concede that adequate evidence has not been forthcoming. the delay in finalising the cases has been a cause of concern for many Zambians and we run the risk of fighting a fight whose cost is greater than the benefits derived. However, the accused persons in the various cases have played no small part in delaying the progress of their cases.

    I have previously stated, on this forum, that I feel the real beneficiaries of the fight against corruption are the lawyers and officers seconded to the Task Force. One could actually argue that there exists a conflict of interest on the part of the people whose compensation is directly proportional the time spent fighting the cases.

  42. Access was set up to launder monies primarily from OP and Finance, follow the evidence in court carefully. Remember that Bank of Zambia was first to step in after suspicious activities. This led to further investigations and criminal charges.

    For example; Xavier would get huge overdrafts from ZANACO for “operations” and give them to his friends at Access who would use the money to loan companies including govt at much higher interests rates, eventually Chungu would pay back the money at the normal ZANACO overdraft rates (that’s why MD Musonda was convicted). At Finance Mpande and Stella Chibanda would do the same for millions

  43. of dollars under the pretext that they were hiding the money from the World Bank and IMF, access would use the same monies and make huge profits. Evidence produced also shows Mpande, Prof. Mweene (who has turned state witness) were corrupted with payments in cash, farms and tractors by Access to continue doing this.

    Please follow the trial before you are hoodwinked by these crooks!

  44. Thanks 62, the above charges however bad do not amount to theft. The bank of Zambia always inspected these companies and gave them a clean bill of health. Until the matrix publication born out of the fight between FTJ and the Post.

    My argument has been that I have seen potential evidence of wrong doing but not theft for reasons that I have presented before.

  45. 62 Mwealo, Aaron Chungu has not been charged with the matrix I stated above because the state knew it would be hard to prove. He has been charged with theft because the state has evidence that the shares he has/had in Access were bought using state fund, namely ZSIS.

    But there was no documentation supporting the response. The accounting records showed that the shares were paid for by ZSIS funds and that no accounting entries were passed.

    You don’t need to be an accountant to see that these transactions are related, for every debit to the balance sheet is a corresponding credit and vice versa. In this case, Chungu’s credit to his Access account was offset by an entry debiting the intelligence division and he has so far failed to explain this. He used this money to buy shares in Access = Theft!

  50. Mweola, I studied both law and finance, it’s one of the reasons the taskforce also has BOZ, ACC, ZP, OP, Justice and other officials. Some of these cases could not have been uncovered by ACC or DEC alone.

  51. #69, the Task Force is not illegal, read the charter. The task force is mandated to investigate only the cases under the Chiluba admin. It hands its cases to the AG who decides to go ahead or not with prosecution. The Task force does not prosecute cases and cannot in the Zambian legal system, the DPP appoints a prosecutor – in this case Nchito and crew to represent government. The only requirement is that the person is an officer of the court (sworn to the bar). By the way, there are a lot cases under privete prosecution in Zambia, it has always been there and continues.

  52. If convicted, they can go to the High Court and Supreme Court and argue on these points they have, right now they have to concentrate on their defense.

  53. 68 Except you forgot to mention that evidence has been presented in court that refutes the points you have put across against Aaron Chungu. The points you have are as presnted by the prosecution. The problem as recounted in the trial was that an account existed before the Zamin account was created using the same account code that had been closed. Before it was Zamin, it was debtors control account. The evidence showing this was not presented by the prosecution. The funny thing is without this bit of evidence one can say that there is theft. Introduce this evidence and the whole case cramble. Again in addition, no one can be accused of stealing before a full accounting ins & outs

The problem with most the cases is that there is a simple focus on outflowwithout due regard to the inflow financing that outflow. Take Aaron Chungu’s shares because a payment was made out of the Zamin account, there is a theft case created. The most comparing reason that the task force wanted to reopen cases in the case of Aaron Chungu and Faustin Kabwe appears to have been due to the crumbling of the existing cases.

  55. Dark Knight,75 the question you must ask your self is why the case to do with shares for Mr Chungu out of all charges that were flying about. The reason is simple. This case started at the time he was pursuing the case with Bank of Zambia. At this time the case does not make much sense and has crumbled in court. To ensure that he was not capable of suing the BOZ, in his capacity as Shareholder. Search for the BOZ Vs Aaron Chungu & Access Finance to understand this. The supreme uses an act that can only be used when evidence of theft has been established to overturn the high court ruling in favor of Access. It is a fun case, only that people’s lives are involved.

  76. 1 thing we ve to appreciate that ,the task force was created without following the laid down procedures.We sidelined the ACC, DEC etc and we went ahead to form another force.Much as we support the fight against corruption,we shudnt creat an illegal kangaroo court.Remember guys last week somebody said Singogo will never finish his jail,we doubted it.Zambian lowz are too low! >:)>:)>:)>:)
