THE Forum for Leadership Search and the New Generation Party (NGP) have called on the Government to immediately drop Task Force on Corruption prosecutor, Mutembo Nchito, saying his stay at the Task Force will allegedly compromise investigations at the defunct Zambian Airways.

Forum for Leadership Search executive director, Edwin Lifwekelo and NGP president, Humphrey Siulapwa made the call at a joint Press briefing in Lusaka yesterday.

Mr Lifwekelo said Mr Nchito’s stay at the Task Force on Corruption would compromise investigations by the law-enforcement agencies at Zambian Airways where he was also a director.

“Our concern, members of the Press and the implication of this is that his role as Task Force prosecutor is under spotlight and being compromised.

“We are afraid that the probe that has been instituted will be undermined by Mutembo Nchito as long as he remains the Task Force prosecutor,” he said.

Mr Lifwekelo said Mr Nchito, as chief executive officer of Zambian Airways, was being accused of allegedly using Zambian Airways as a vehicle to defraud and steal public funds from banks and State institutions.

Mr Lifwekelo said Mr Nchito’s free interaction with law-enforcement agencies should be curtailed by removing him from the Task Force on Corruption.

“It is a fact that Mutembo Nchito is connected to top investigators in the country who are under his direct authority, and during this investigation, officials will be having difficulties to keep facts under the lid as key investigation findings are being leaked to The Post Newspapers,” he said.

The Zambia Police Service, the Drug Enforcement Commission (DEC) and the Anti-Corruption Commission (ACC) have instituted a probe into the financial irregularities surrounding the collapse of Zambian Airways.

Mr Lifwekelo said his organisation and others would today petition Vice-President and Justice Minister, George Kunda to have Mr Nchito removed from the Task Force as prosecutor.

He said the debt the airline had accrued should not be politicised and that President Rupiah Banda should not be accused of having a hand in the downfall of Zambian Airways, which started experiencing problems even when the late president, Levy Mwanawasa was alive.

And Mr Siulapwa said his party supported President Banda’s stance on the need for Zambian Airways to repay the money it owes various institutions, including the Government.

Mr Siulapwa said according to the information that the party had, Zambian Airways owed Zambia Revenue Authority (ZRA) US$2 million, National Pensions Schemes Authority (Napsa) $2.5 million, National Airports Corporations Limited (NACL) $2.5 million and Finance Bank $ 6.3 million.

He said other named creditors were owed $9.5 million, Intermarket Banking Corporation $1.5 million, Bravo Capital $1 million, Investrust Bank $1 million and the employees, bringing the total debt to $29 million.

He said if the directors of the company were found culpable, the law should take its course.

He said only legitimate organisations responsible for dealing with criminal matters should be allowed to handle and investigate the Zambian Airways saga. Mr Nchito could not be reached for a comment.

Mr Siulapwa also said his party was in support of the tribunal set up to investigate Communications and Transport Minister, Dora Siliya over the awarding of the contract to RP Capital to evaluate Zamtel assets.

      There is a conflict of interest. I have met Nchito he seems a down to earth man. But he is got to be relieved or it will compromise the confidence of the public.

      The man should have jumped before being pushed, as evident. I still have high confidence n his abilities though…

The noose is tightening around his neck now he wants to smear a very genuine and honest lawyer who has made tremendous contributions to this country’s fight against corruption. I know Mutembo personally and people need to know that he is beyond these shenanigans. He has never publicly commented on these issues because he is a man of integrity and he answers only to his God. Courage brother Nchito. Do not stumble. You have a Friend that sticks closer than a brother.

    • Chicago, please understand that the problem at hand is that ZA has engaged in unqusetionable conduct, so whether Siulapwa is dirty or not, ZA management has to explain where they took government money and how they were able to get it in the first place. the other issue is that under common company law a company and its shareholders are different entities, unless so expressed by the directors giving personal guarentees to get loans for the company like the case is now, so whether or not you have taken a bath, mutembo has to explain.

    • u are right. mutembo and fred have to explain. and i think investigations will be difficult to conduct with mutembo in the office as prosecutor.

    • whether or not you or i die, ZA will still owe US$29million, the sooner you understand this the better, we a zambians must learn to look at things objectively, it was not political for ZA to borrow money. why should it be polical when it comes to paying. no one hate the nchitos when they were borrowing, why should they be hated when they are asked to pay back, let us exercise maturity in our approach to issues that afect the entire country.

    • we should understand that if kafupi was corrupt, he will be judged likewise by the court, if nyama soya is corrupt, he will also be judged likewise, but for now serious allegations have been raised against the nchito’s, the same way that they have been urging others to be given chance to prove themselves, the nchito’s must not ask and expect anything less. everydog has its day, the only thing is that day seems to have come a bit early for ZA.

    • Dora Siliya, this whole corruption fight was a mess from inception. Corruption has been around since the time of moses but LPM convinced us that it came and ended with Chiluba. if LPM meant to fight corruption why did he restrict it to Chilubas term of office. iam not sayng the fight should stop but that it should include everyone before, during and after chilubas term. all those enganged in suspicious activities from RB to Maurine including Membe, Siliya and Nchito should be investigated and brought to book if found wanting.

By far such developments take so much from the confidence that the Zambians have bestowed on the officers prosecuting the cases on corruption. Pa first baku church, ba gladys nyirongo, very vocal on issues of corruption, even went to south africa leading a delegation to a gathering on corruption, but ukwisa dabwa fye ati yaluka she wasnt any different from those she was insulting and castigating.     • Nchito has been accused of usind ZA as a conduit to syphone money from banks. When the case goes to court will it be fare for Nchito to prosecute himslef. how will he be a defendant and a prosecutor at the same time? He must step down simple. As for Dora there is no case against her in court, a tribunal is not a trial? By the way can someone tell me the Law under Single sourcing, limited selection or open Bid that Dora has broken. By the way the tribunal has opened today and if you have any legally obtained evidence please take it there now so that you dont cry faul when the recommendations are done.

You are pro Siliya at the least… I would be happy to see both Nchito and Siliya suspended of their duties and here is why… You say there is no case against Siliya, they are alarm bells all around her, scientifically and in accounting terms. That raises enough suspicion to suspend and not expell her in order investigate the matter. How does Dora request RP Capital to value Zamtel without the boads concern?? Anyone in their right minds would question that and for that reason only is good enough to suspend her and investigate.     • It makes good business sense to investigate the matter and eventually have a case for her to answer in court. How else do you do it Engines.. It is the right procedure as she has been found wanting in all circles as a result of the breach.     • Agree with Nyangu, we do not suspend Dora though she is under investigation and in a position of influence. Then we ask the police to investigate the Ministry of Home Affairs (ie their bosses) for payments to MMD (the ulimate bosses – remeber who appoints the IG) We must apply justice fairly and not emotionally. By the way if the ZA case goes to court it is process through the police service of course he would not persecute himself but he can defend him self. Lets stick to the facts

    • Engines i think you are missing a point here our Dora didnt follow simple procedures(internal) which any honest person i ssuppose to. Transparency is cadinal especially if you are handling public money. As for Mutembo Nchito, we know he has work very well in prosecting these suspected cases of corruption.Engine cant you see that there is something fishy going on. Remember FTJ campained for RB in the last election. So RB is under pressure to pay FTJ back!!!!!!

If there is evidence that Dora abused her authority why dint the post or harrington go strait to the courts of law to obtain a sermon. they instead decided to go for a tribunal literally asking the court to look for evidence. to me this constitutes witch hunting because if you dont have evidence why ask the courts to look for it. if RB fires Dora then anybody against anyone in the ministry would simply ask for a tribunal so that that person is droped. remember the case of Mulyata, the man was lebeled a villain and droped frm his position. when the courts aqiuted him Membe never even published the verdict or even apologise to mulyata.

    • the biggest problem in this issue actually has not been RB or the Nchito’s, it has been the post trying to mislead and politicise a purely business arrangement, and they have managed to bring it down to personalities. in the ZA issue, the most culpable are the shareholders and directors, they should have gone to government to lobby for favorable loan repayment terms, as against the post declaring war on the same pipo that would have assisted them. as a thief, you do not break into a house, when the house owner shoots you, you complain that he is inhumane. country men and women, why the double standards.

    • Bobcat you are very right but you miss the underlying problem with zambians. Chilufya Sata and his people can not adjust to the fact that RB won the election and the next one is in 2011. They support Mmembe’s misleading articles because this gives them a chance to continue the fight against RB. For them the campaign has not ended. RB has not stoped any of the corruption trials at all. In fact the convincions have increased under RB. But they continue to accuse him of imaginery crimes because Mmembe says so.

  8. Justice is a vice without passion, the nchito brothers and the post are the toucn bearers to this corruption fight. This is very good and commendable. however, they do not have any imunity for any crime that they may commit including money laundering or graft. please Mr siulapya and lifwekelo go on with your petition we are behind you. those that live in glass hopuses must not throw stones, Corruption has been there since the times of Moses, it is therefore absurd to suggest that in zambia it came and ended with Chilubas term in office. Please Zambian lets fight corruption without restricting to those that served in Chilubas Govnt.

    • i totally agree with Engines, if i expose a crime or i make sure a criminal is locked up, it does not mean that i must commit a crime. the post has been insulting RB and Dora. they have not made mention exactly how much money ZA is owing and how they accrued this debt and how they intend to pay it back. this is not political, but rather the post trying to force the government not to collect what is due just because they have an interest in ZA. let us be fair to all parties, let us not be misled by an intrested party just because they have an interest to serve, fellow country men and women, let us be on guard.

    • The history of the Tribunal is that there is no need to resign over what may be fake allegations. If the Tribunal finds Dora with a case to answer she will be dropped as the case will go to trial. This is what has happened before when tribunals have been held.

Even in America they cant bail-out a company that is not listed on the stock market and has more liabilities that assets. its not wrong for mutembo to borrow but its wrong to fail to pay back the loan refuse to go into voluntery bancrapcy simple. All Nchito has to do is declare himself bancrapt then the loans will be cancelled but he will have to face the consequencies, that will be enough punishment to deter would be offenders.

    • Engines, i agree with you, ZA as a company has its’ own limited liability, when it fails to pay back, let it declare likewise. progressive country’s are bailing out national and semi national airlines not private airlines. BA is a private airline, that is why the british government has not offered to assist, as is the case for ryanair who want to be charging for using the loo. so if these 2 airlines want assistance, they should come up with a proper proposal as against getting money using aeroplanes they don’t even own. this is criminal behaviour pure and simple.

    • There is no basis for removing dora from office because there is no trial currently going on against her and the posibilities of a full trial are almost non.what is there is only a tribunal which very different from at a trial. this tribunal will depend on the evidence that you the citizens will volunterily submit to the tribunal from today. As for the Nchito’s there is an allegation soon going to court for money laundering and abtaining money by false pretences and Nchito can not be the accused and at the same time be the prosecutor of the same case against himself thats why he must immediately step down.

    • Something terribly wrong with you Engine. Be objective and face reality. No one is disputing the fact that ZA had borrowed the said money and in addition the accumulated so much debt. However, the financial forensic investigation being conducted is to determine as to whether monies were misappropriated to the directors benefits. Kindly note that some of their monthly outgoing as ZA was the payment of the aircraft lease of $77,000, coupled by the high fuel price bill it does not take a genious to see how the money could have been spent. Anyhow, lets wait and see what the investigators come up with. As for Mutembo resigning from Prosecutor, fat chance as FTJ is not going to slip away free

    • Anonymous the $77,000 you are talking about was surpose to come from daily revenues and not loans because this was a continuous payment with no end as it was a lease charge.The charge against Nchito is declaring collateral for the purpose of ZA loans knowing fully well that the declared collaterall is not property of ZA;Collecting money from ususpecting people as departure fees purpoting that the money is remmited to NAC when infact not;obtaining loans from banks purporting that the said money shall be invested in ZA when infact the said money was to be shared amoung shareholders;personally evalauting 2 planes to be used as collateral for loans knowing fully well that he is not an evaluator

  18. Chiluba is already appearing in court and defending his case. Some blogger has objectively commented that at the time of borrowing there were no politics involved. Why then should politics come in at the time of paying back. Just as chiluba should prove his innocence the same should apply to mutembo. Although iam not a symphasizer of Siulapwa and his party. I have a feeling he is talking sense this time around.

    • it is not rocket science that when one borrows, one must pay back, no matter how much you insult siulapwa, in case you have not been following, siulapwa has not been mentioned anywhere in the ZA scandal. what this means is that he is not involved period. there again we are trying to move ourselves from the issue at hand, and that issue is that ZA is owing, even if god forbid, all the involved parties die, the dedt will still have to be paid. let us not drag pipo’s names’ into the mud for no apparent reason, don’t do the crime if you can’t do the time.

    • Bobycat, it appears you are outlining the borrowing conducted at Chamboli market. In financial markets there is bankruptcy (I am sure you have heard of the term before). At times business does fail and you may not be able to pay off your debts from the assets you hold. As I understand it, ZA have no asset of their own to speak of that can offset the loan that they have. The lending was not based on financial viability but political so as to have an indigenous Airline afloat – in a way replacing Zambia Airwas as we knew it. LPM, BOZ Governor, Minster of Finance would have given these signals and thus lenders obliged.

    • Anonymous, my point has been that ZA as a limited company can borrow from any body or any institution as long as they borrow for the right reason and use the right collateral. when they realised that they were in ploblems, they should have gone back to their lenders to explain themselves, it was not for the post to begin insulting Dora, ZA should have explained themseleves period. now because of the post even the pipo or government that should have assisted will not do that but instead foreclose on the loans, yet we still want to blame Dora and RB.

    I know Nchito to be a man of impeccable honest and integrity.However,his biggest mistake was to go into partnership with M’membe.And the way things are,looks like nchito has fallen out of favour by the current corrupt leadership of RB where the likes of Dora are protected for her alleged misdeeds and others are blamed.Sad stuation.

  24. Most bloggers think the Case of Dora came earlier than the ZA copllapse and its all because of Membe misleading the very unimformed zambian public. The ZA issue started even before RB was adopted as president. The post attempted to blackmail him into submission by a massive campaign in the editorials, unfortunately the tactic dint work on a sleepy experienced diplomat. They then brought corruption issues dating back to the 80s in Munali, brought his relationships with Savimbi and his weaknesses with women but to no avail. for those that have followed theese things revelations about Dora are just last kicks of a dying Horse dont you wonder why harrington asked for a tribunal and not a trial.

In countries like the US you can go into Chap. 11 bankruptcy so that you straighten out your financials. In Zambia, you go bankrupt and the whole, entire President comes after you.     • Mama G, with all the good intentions, the nchito’s have some explaing to do, if they were in a foreign country and they enganged in this type of behaviour, they would surely be behind bars by now. the fact that they started a very good business does not give them immunity to commit crime. they have pulled a lot of pipo into this mess. DBZ has refused to comment on this issue because they know the implications. the post should have been professional enough not to take a purely business matter and report on it by giving only one side of the story. the other side is coming out, watch this space.

    • Which foreign country will jail the Ncito’s based on allegations of Money Laundering? If you mean to say, prosecutors would gather sufficient evidence to warant the charge being presented to the accused then yes. However, stop telling lies or misrepresenting facts. DBZ or indeed any other bank can not make any comment on private lending. It is like a Medical Doctor would not divulge any information to a third party.   43. the main issue with RP capital and Dora is that, zamtel is in debt to the tune of US$125million, whether or not Dora is fired the debt still has to be paid. failure to agree to accept legal asdvise does not constitute a crime. what the post should have dwelt upon was why zamtel has such a huge debt and why Dora ignored advice, it was not for the post to insinuate and conclude that Dora is corrupt for refusing to accept legal advise. the post should have tackled the reason behind the refusal not for them the pass on their opinion of Dora as the gospel truth.

  56. Two of the reasons why ZA went down was PILFERAGE by the financial chaps and secondly the company’s collapse of debt collection. I work for an international airline which owes ZA hundred thousands of dollars, but their system, STRANGELY, collapsed and lost all track of their debtors. To this day, they have failed to produce invoices in order for us to pay them. It is a shame that these chaps have tarnished Mutembo’s name. Thier misapropriation contributed to the demise of ZA. Very sad indeed.

    • Engine, when you use a house as collateral to obtain a loan from the bank, you have to show proof that you own that house that is being used as collateral. The burden of establishing proof has to be established by the lendor. If lendor is happy with the docs provided and does not do their own due dilligence, then that lendor is at great risk of losing their monies. Anyone that has taken little interest on ZA knows that they do not own a single aircraft outlight, in fact in the airline business very few Airlines own their aircrafts – they are always leased from Boeing and the likes. Get your facts right

In fact, Mr M. Nchito’s stay on the Task Force will compromise its work in the fight against corruption so it is only fair for him to resign and not wait to be dropped form there.

As of today nobody has submitted any evidence and Mr Harrington himself is requesting the tribunal to compel Miss siliya to submit her correspondence with RP capital so that he can use that as evidence. if anyone of you has evidence please take it to the tribunal to assist not only Mr harrington but also the people of Zambia.The post is unable to give any evidence they have because it was not legally obtained and is therefore not admissible. remember if you cant submit evidence then this case will be considered witchhunting

I am only worried about the MMD thugs who threatened to deal serious with Mr Harrington in form of violence in their claim that they wot spare anyone with opposing views against the GRZ of Mr President RB Banda. I hope President RB BANDA will take this opportunity to inform his MMD cadres to desist from such acts which are injurous to our young democracy and this is a form of anarchy and intimidation from the ruling party. This serves to inform President RB Banda and his Administration that the world is slowly coming to a global village form in which crimes against humanity can be instituted to anyone who does not discharge his duties well to avoid internal wars.

Jerry Rawlings once said that politics in africa is like riding a tiger-you dont know whether you are safe while on it or off it.This whole thing smacks and smells of a political hit job by RB -but that aside -what is amazing is how these seemingly inteligent guys thought they could make money from the airline industry.Reknowed airlines like Alitalia have colapsed and other have been forced to merge and these guys honestly thought they had a prayer.

  68. I think one thing we are missing here is, any company that does not pay ZRA and NAPSA is liable cos these are payments that are to be made immediately. This Mutembo whether he is not MMD or not, deducted money as ZA from employees but never gave it to the owners in this case Napsa and ZRA. he got tax from ticket sales but never paid NAC, so isnt that theft pls. am not a politician and I dont have to be to see that Mutembo needs to give answers as ZA. Post knows that Zamtel has been sinking over the years, much as Dora is not my favourite person we still need to look at things from the other side cos problem with Post is when they want to distroy you they will create or sensationalise

The Post and MMD are both 17yrs old. they have fought running battles before and they are still fighting. one interesting thing about there fights is that there seem to be no winner because the post is still operating and MMD is still in power. If you look at the nature of the fights in the last 17yrs, the official bone of contention has always been bad publications by the post and corruption on the MMD side. This time around it is the post being accused of gross corruption by way of using a legitimate company ZA as a conduit to syphone money from the state that MMD controls. gentlemen there is always an end even to the most wonderful song, this time around one of them is going under

  72. It is so funny to see people that are supporting Nchito are themselves not defending Chiluba. So far evidence that has come out from the trial seem to indicate that Chiluba did not steal but used gov’t institutions to receive money, which in it self may be subject to question. And the Access team were themselves running a private company which at least was solvent. And when you see the parallels in these cases. I would rather be in the Chiluba’s team.

    • iam dont like chiluba for what he did to this country but as far as his cases are concerned it will soon be a miscarriage of justice.Corruption existed even during the times of moses in the bible and it still exist even today.This is a fact unfortunately levy came and told us that corruption came and ended with chilubas term of office, he further established the task force to investigate chilubas term of office.if you read the auditor generals repoert of the 70s you will find as much misappropriation of funds as it was in the chiluba,LPM and RBs regime.if thats the case then why restrict the mandate of the task force to chiluba alone is that not witch hunting. lets fight corruption all round

    • Guys dont be cheated. If you have followed me recently I am now against fighting corruption in the name of fighting Chiluba. According to Zambians, corruption is chiluba and chiluba is corruption. Thats why corruption does not exist in Zambia unless the name of chiluba is mentioned. We have become sounding gongs because now the people committing corruption or found to have committed corruption are not from Chiluba’s team. So stop wasting the money to enrich the Task Force. there is no fight against corrupton in Zambia but the fight against Chiluba and his team.

  73. Greed and quick money has been the fall of many. It was greed that motivated ZA to obtain loans under false impressions. If only some people could learn to forgive. Even when people are genuiningly ready to forgive, they fail because the people under the spotlight have not extended forgiveness to others. This is GREED. ZA wants to be bailed out but they continue to insult the very same people who would help them out. Chiluba, Sakala, Bulaya and all the rest have never been given such an opportunity for forgiveness. People, no matter what you see outside, what matters is what comes from inside. If you cant forgive others, why should others forgive (bail you out) you?

  75. It is sad to to have thickheaded people blogging relentlessly. Very few bloggers look at issues objectively. But then, it is on record that most bloggers are inclined to dagga smoking and this explains a lot. I feel for the few sensible bloggers like Engines, Senior Citizen and the like. Unless you come to what I have come to understand, your effort will fall on deaf ears. Dagga makes people lose objectivity.

  76. I think some people should have chosen to drop out of the cases if they are religious. Religion teaches that all wrong. Where you take 5 years to dig up the truth, surely some must begin to weigh the balance. If somany billions have been recovered, can someone please tell us. All we see is that Billions are being spent by THE TASK FORCE. Where are our gains as a nation?

  77. It’s impossible to wipe out corruption, even harder to investigate corrupt officers if they are allowed to stay in office while enquiries are going on. This shows that the government is not serious about rooting out corruption or the government, itself, is rotten to the core.

  78. Two things come to light on this issue. The much needed resources lost on a selective drive on corruption has turned MMD govt into vulture within its ranks. The other is that the collapse of ZA has broght out the much feared eventuality of things falling apart before sending the pre condemned thief Chiluba to jail. The truth being, the same institutions that went to bed with the chiluba regime also bedded ZA in an effort to save their asses and have FTJ condemned. Now the die is cast and the institutions realise they played ball with the devil and are once more trying to save themselves. I wonder who they are bedding this time around…Dora?…Banda sons.?…disolved boards’ members?

  82. I believe that Mutembo is just as human as any other. He is also liable to offense or failure. The fact that one is a Lawyer here on earth does not make him pure or void of fault. It is just ethical and morally right for Mutembo to step down or be relieved of his position.
